repealing Implementing Decision (EU) 2025/362 postponing the expiry date of the approval of cypermethrin for use in biocidal products of product-type 8 in accordance with Regulation (EU) No 528/2012 of the European Parliament and of the Council

THE EUROPEAN COMMISSION,
Having regard to the Treaty on the Functioning of the European Union,
Having regard to Regulation (EU) No 528/2012 of the European Parliament and of the Council of 22 May 2012 concerning the making available on the market and use of biocidal products (1), and in particular Article 14(5) thereof,
After consulting the Standing Committee on Biocidal Products,
Whereas:

Cypermethrin was approved as an active substance for use in biocidal products of product-type 8 by Commission Implementing Regulation (EU) No 945/2013 (2) subject to the conditions set out in the Annex to that Regulation. |

The approval of cypermethrin for use in biocidal products of product-type 8 (‘the approval’) was to expire on 31 May 2025. On 24 November 2023, an application was submitted in accordance with Article 13(1) of Regulation (EU) No 528/2012 for the renewal of the approval. |

Pursuant to Commission Implementing Decision (EU) 2025/362 (3) the expiry date of the approval was postponed to 30 November 2027, to allow sufficient time for the examination of the application. |

However, on 21 May 2025, the applicant who submitted the application informed the Commission that it withdrew its application for the renewal of approval. Consequently, as it has not been established that cypermethrin still meets the conditions laid down in Article 4(1) of Regulation (EU) No 528/2012, Commission Implementing Decision (EU) 2026/1112 (4) did not renew the approval. Therefore, it is appropriate to repeal Implementing Decision (EU) 2025/362 postponing the expiry date of the approval of cypermethrin for use in biocidal products of product-type 8, |
HAS ADOPTED THIS DECISION:
Article 1
Implementing Decision (EU) 2025/362 is repealed.
Article 2
This Decision shall enter into force on the twentieth day following that of its publication in the Official Journal of the European Union.
