In accordance with Article 13 of Regulation (EU) 2016/426 of the European Parliament and of the Council (2), appliances and fittings which are in conformity with harmonised standards or parts thereof, the references of which have been published in the Official Journal of the European Union, are to be presumed to be in conformity with the essential requirements covered by those standards or parts thereof set out in that Regulation.

By Commission Implementing Decision C(2023) 4789 (3), the Commission made a request to the European Committee for Standardization (CEN) and to the European Committee for Electrotechnical Standardization (CENELEC) for the revision of existing harmonised standards drafted on the basis of standardisation mandate M/BC/CEN/06-89 of 29 April 1990 to ensure that they continue to reflect the generally acknowledged state of the art in order to meet the essential health and safety requirements set out in Annex I to Regulation (EU) 2016/426.

On the basis of the request set out in Implementing Decision C(2023) 4789, CEN revised several existing harmonised standards. As a result CEN adopted the following revised harmonised standards in support of Regulation (EU) 2016/426: EN 30-2-1:2024 on domestic cooking appliances burning gas for rational use of energy, EN 88-2:2022+A1:2024 and EN 88-3:2022+A1:2024 for safety and control devices for gas burners and gas burning appliances, EN 125:2022+A1:2024 on thermoelectric flame supervision devices for gas burning appliances, EN 15502-2-2:2024 on gas-fired central heating boilers for type B1 appliances, and EN 16304:2022+A1:2024 on automatic vent valves for gas burners and gas burning appliances.

The Commission, together with CEN, has assessed whether EN 30-2-1:2024, EN 88-2:2022+A1:2024, EN 88-3:2022+A1:2024, EN 125:2022+A1:2024, EN 15502-2-2:2024 and EN 16304:2022+A1:2024 comply with the request set out in Implementing Decision C(2023) 4789.

The following harmonised standards satisfy the essential requirements which they aim to cover and which are set out in Regulation (EU) 2016/426: EN 30-2-1:2024, EN 88-2:2022+A1:2024, EN 88-3:2022+A1:2024, EN 125:2022+A1:2024, EN 15502-2-2:2024 and EN 16304:2022+A1:2024. It is therefore appropriate to publish the references of those harmonised standards in the Official Journal of the European Union.

In addition, CEN issued a correction to the harmonised standard EN 15502-2-1:2022+A1:2023 on a specific standard for gas-fired central heating boilers for type C appliances and type B2, B3 and B5 appliances of a nominal heat input not exceeding 1 000 kW, the reference of which is published in the Official Journal of the European Union by Commission Implementing Decision (EU) 2024/2944 (4). This resulted in harmonised standard EN 15502-2-1:2022+A1:2023 as corrected by EN 15502-2-1:2022+A1:2023/AC:2024. The correction EN 15502-2-1:2022+A1:2023/AC:2024 is indispensable for the correct application of EN 15502-2-1:2022+A1:2023 as a harmonised standard. It is therefore appropriate to publish the reference of EN 15502-2-1:2022+A1:2023 as corrected by EN 15502-2-1:2022+A1:2023/AC:2024 in the Official Journal of the European Union.

The Annex to Implementing Decision (EU) 2024/2944 provides the references of harmonised standards conferring a presumption of conformity with Regulation (EU) 2016/426. In order to ensure that the references of harmonised standards drafted in support of Regulation (EU) 2016/426 are listed in one act, the references of those standards and of a correction to EN 15502-2-1:2022+A1:2023 should be included in that Annex.

Implementing Decision (EU) 2024/2944 should therefore be amended accordingly.

Compliance with a harmonised standard confers a presumption of conformity with the corresponding essential requirements set out in Union harmonisation legislation from the date of publication of the reference of such standard in the Official Journal of the European Union. This Decision should therefore enter into force on the day of its publication,
