amending Implementing Decision (EU) 2023/1586 as regards harmonised standards for lifts, firefighting and rescue service vehicles, application equipment for coating materials, cranes, hoists, aircraft ground support equipment, supply and circulation equipment for liquid coating materials, power operated doors and gates, garden equipment, food processing equipment and welding equipment

THE EUROPEAN COMMISSION,

Having regard to the Treaty on the Functioning of the European Union,

Having regard to Regulation (EU) No 1025/2012 of the European Parliament and of the Council of 25 October 2012 on European Standardisation, amending Council Directives 89/686/EEC and 93/15/EEC and Directives 94/9/EC, 94/25/EC, 95/16/EC, 97/23/EC, 98/34/ EC, 2004/22/EC, 2007/23/EC, 2009/23/EC and 2009/105/EC of the European Parliament and of the Council and repealing Council Decision 87/95/EEC and Decision No 1673/2006/EC of the European Parliament and of the Council (1), and in particular Article 10(6) thereof,

Having regard to Directive 2006/42/EC of the European Parliament and of the Council of 17 May 2006 on machinery, and amending Directive 95/16/EC (2), and in particular Article 7(3) thereof,

Whereas:

In accordance with Article 7 of Directive 2006/42/EC, machinery manufactured in conformity with harmonised standards, or parts thereof, the reference to which have been published in the Official Journal of the European Union, are to be presumed to comply with the essential health and safety requirements set out in Annex I to that Directive covered by those standards or parts thereof.

By letter M/396 of 19 December 2006, the Commission made a request to the European Committee for Standardization (CEN) and the European Committee for Electrotechnical Standardization (Cenelec) (‘the Request’) for the drafting, the revision and the completion of the work on harmonised standards in support of Directive 2006/42/EC to take account of changes introduced by that Directive in comparison with Directive 98/37/EC of the European Parliament and of the Council (3).

On the basis of the Request, CEN and Cenelec drafted the following new harmonised standards: EN 81-44:2024 with safety rules for the construction and installation of lifts in wind turbines, EN 17677:2024 with safety and hygiene requirements for food processing equipment, EN 17942:2024 with safety requirements for welding equipment, EN 50059:2025 with safety requirements for hand-held electrostatic coating material application equipment and EN 50176:2025 with safety requirements for automatic electrostatic liquid coating material application equipment.

On the basis of the Request, CEN revised the following harmonised standards, the references of which are published in the Official Journal of the European Union by Commission Implementing Decision (EU) 2023/1586 (4): EN 81-31:2010, EN 81-41:2010, EN 1846-2:2009+A1:2013, EN 1953:2013, EN 12077-2:1998+A1:2008, EN 12159:2012, EN 12312-4:2014, EN 12621:2006+A1:2010 and EN 12978:2003+A1:2009. This resulted in the adoption of the following revising harmonised standards: EN 81-31:2024, EN 81-41:2024, EN 1846-2:2024, EN 1953:2025, EN 12077-2:2024, EN 12159:2024, EN 12312-4:2024, EN 12621:2025 and EN 12978:2024.

Furthermore, on the basis of the Request, CEN amended the following harmonised standards, the references of which are published in the Official Journal of the European Union by Implementing Decision (EU) 2023/1586: EN 12312-5:2021 and EN 13684:2018. This resulted in the adoption of the consolidated harmonised standards EN 12312-5:2021+A1:2025 and EN 13684:2018+A1:2024.

The Commission, together with CEN and Cenelec, has assessed whether those harmonised standards comply with the Request.

The following harmonised standards satisfy the safety objectives which they aim to cover and which are set out in Directive 2006/42/EC: EN 81-31:2024, EN 81-41:2024, EN 81-44:2024, EN 1846-2:2024, EN 1953:2025, EN 12077-2:2024, EN 12159:2024, EN 12312-4:2024, EN 12312-5:2021+A1:2025, EN 12621:2025, EN 12978:2024, EN 13684:2018+A1:2024, EN 17677:2024, EN 17942:2024, EN 50059:2025 and EN 50176:2025. It is therefore appropriate to publish the references of those standards and amendments thereto in the Official Journal of the European Union.

Annex I to Implementing Decision (EU) 2023/1586 lists the references of harmonised standards conferring a presumption of conformity with Directive 2006/42/EC. In order to ensure that the references of harmonised standards drafted in support of Directive 2006/42/EC are listed in one act, the references of harmonised standards EN 81-31:2024, EN 81-41:2024, EN 81-44:2024, EN 1846-2:2024, EN 1953:2025, EN 12077-2:2024, EN 12159:2024, EN 12312-4:2024, EN 12312-5:2021+A1:2025, EN 12621:2025, EN 12978:2024, EN 13684:2018+A1:2024, EN 17677:2024, EN 17942:2024, EN 50059:2025 and EN 50176:2025 should be included in that Annex.

It is necessary to withdraw the references of harmonised standards EN 81-31:2010, EN 81-41:2010, EN 1846-2:2009+A1:2013, EN 1953:2013, EN 12077-2:1998+A1:2008, EN 12159:2012, EN 12312-4:2014, EN 12312-5:2021, EN 12621:2006+A1:2010, EN 12978:2003+A1:2009 and EN 13684:2018, given that they have been revised or amended, from the Official Journal of the European Union. It is therefore appropriate to delete those references from Annex I to Implementing Decision (EU) 2023/1586.

In order to give manufacturers sufficient time to adapt their machinery that is covered by harmonised standard EN 81-31:2010, EN 81-41:2010, EN 1846-2:2009+A1:2013, EN 1953:2013, EN 12077-2:1998+A1:2008, EN 12159:2012, EN 12312-4:2014, EN 12312-5:2021, EN 12621:2006+A1:2010, EN 12978:2003+A1:2009 or EN 13684:2018, it is necessary to defer the withdrawal of the references of those harmonised standards.

Implementing Decision (EU) 2023/1586 should therefore be amended accordingly.

Compliance with a harmonised standard confers a presumption of conformity with the corresponding essential requirements set out in Union harmonisation legislation from the date of publication of the reference of such standard in the Official Journal of the European Union. This Decision should therefore enter into force on the date of its publication,

HAS ADOPTED THIS DECISION:

Article 1

Annex I to Implementing Decision (EU) 2023/1586 is amended in accordance with the Annex to this Decision.

Article 2

This Decision shall enter into force on the day of its publication in the Official Journal of the European Union.

Point (1) of the Annex shall apply from 20 January 2027.
