COMMISSION IMPLEMENTING DECISION (EU) 2025/108

of 22 January 2025

amending Implementing Decision (EU) 2024/2666 as regards the data recognised as accurate for the purposes of measuring greenhouse gas emissions associated with the cultivation of agricultural raw material in Germany on organic soils

THE EUROPEAN COMMISSION,

Having regard to the Treaty on the Functioning of the European Union,

Having regard to Directive (EU) 2018/2001 of the European Parliament and of the Council of 11 December 2018 on the promotion of the use of energy from renewable sources (1), and in particular Article 31(4) thereof,

Whereas:

By Implementing Decision (EU) 2024/2666 (2), the Commission recognised that the report submitted to it by Germany contained accurate data for the purposes of measuring the greenhouse gas emissions associated with the cultivation of wheat, rye, maize, barley, triticale, sugar beet, rapeseed, field grass and grassland cuttings typically produced in NUTS 2 regions in Germany on mineral soils.

The Commission also assessed the greenhouse gas emissions associated with the cultivation of those crops produced in Germany on organic soils and found them accurate. The related emissions values were erroneously omitted from the Annex to Implementing Decision (EU) 2024/2666 and should be included in that Annex. Therefore, Implementing Decision (EU) 2024/2666 should be amended accordingly.

This Decision should apply as from the date of application of Implementing Decision (EU) 2024/2666. This is to ensure that the calculations for organic soils are already valid as of 4 November 2024 and that a coherent approach is taken for the same crops grown on two different types of soils.

The measures provided for in this Decision are in accordance with the opinion of the Committee on the Sustainability of Biofuels, Bioliquids and Biomass Fuels.

HAS ADOPTED THIS DECISION:

Article 1

The Annex to Implementing Decision (EU) 2024/2666 is amended as set out in the Annex to this Decision.

Article 2

This Decision shall enter into force on the twentieth day following that of its publication in the Official Journal of the European Union.

This Decision shall apply as of 4 November 2024.
