COMMISSION IMPLEMENTING DECISION (EU) 2023/2461
of 7 November 2023
amending Implementing Decision (EU) 2019/451 on the harmonised standards for construction products drafted in support of Regulation (EU) No 305/2011 of the European Parliament and of the Council

THE EUROPEAN COMMISSION,
Having regard to the Treaty on the Functioning of the European Union,
Having regard to Regulation (EU) No 305/2011 of the European Parliament and of the Council of 9 March 2011 laying down harmonised conditions for the marketing of construction products and repealing Council Directive 89/106/EEC (1), and in particular Article 17(5) thereof,
Whereas:

In accordance with Regulation (EU) No 305/2011 manufacturers are to use the methods and the criteria provided in harmonised standards, the references of which have been published in the Official Journal of the European Union, for assessing the performance of construction products covered by those standards in relation to their essential characteristics. |

By Commission Implementing Decision C(2021) 5359 (2), the Commission made a request to the European Committee for Standardization (CEN) for the drafting and revision of harmonised standards in support of Regulation (EU) No 305/2011 for space heating appliances. |

On the basis of the request set out in Implementing Decision C(2021) 5359, CEN revised harmonised standards EN 13240:2001, EN 13240:2001/A2:2004, EN 13240:2001/AC:2006 and EN 13240:2001/A2:2004/AC:2007 – Room heaters fired by solid fuel – Requirements and test methods; EN 13229:2001, EN 13229:2001/A1:2003, EN 13229:2001/A2:2004, EN 13229:2001/AC:2006 and EN 13229:2001/A2:2004/AC:2007 – Inset appliances including open fires fired by solid fuels – Requirements and test methods; EN 12815:2001, EN 12815:2001/A1:2004, EN 12815:2001/AC:2006 and EN 12815:2001/A1:2004/AC:2007 – Residential cookers fired by solid fuel – Requirements and test method; EN 12809:2001, EN 12809:2001/A1:2004, EN 12809:2001/A1:2004/AC:2007 and EN 12809:2001/AC:2006 – Residential Independent boilers burning solid fuel – Nominal heat output up to 50 kW and EN 14785:2006 – Residential space heating appliances fired by wood pellets – Requirements and test methods. The references of those standards are published in the C series of the Official Journal of the European Union (3) . |

The revision of those standards resulted in the adoption of revised harmonised standards EN 16510-2-1:2022 – Residential solid fuel burning appliances – Part 2-1: Roomheaters, EN 16510-2-2:2022 – Residential solid fuel burning appliances – Part 2-2: Inset appliances including open fires, EN 16510-2-3:2022 – Residential solid fuel burning appliances – Part 2-3: Cookers, EN 16510-2-4:2022 – Residential solid fuel burning appliances – Part 2-4: Independent boiler – Nominal heat output up to 50 kW and EN 16510-2-6:2022 – Residential solid fuel burning appliances – Part 2-6: Mechanically by wood pellets fed roomheaters, inset appliances and cookers. |

The revised standards contain measurement methods for NOx, hydrocarbon and particulate matter emissions for solid fuel burning appliances, specifications for classification of solid fuel burning appliances and system boundaries for room sealed appliances, the applicable energy efficiency and energy class labelling and seasonal space heating efficiency and essential characteristics related to environmental sustainability. The revised standards allow manufacturers to declare emissions, energy efficiency and environmental sustainability and therefore contribute to the removal of technical barriers to trade. |

The Commission, together with CEN, has assessed whether the harmonised standards revised by CEN comply with the request set out in Implementing Decision C(2021) 5359 and Regulation (EU) No 305/2011. |

The harmonised standards revised by CEN are in conformity with Implementing Decision C(2021) 5359 and Regulation (EU) No 305/2011. It is therefore appropriate to publish the references of those standards in the Official Journal of the European Union. |

Annex I to Commission Implementing Decision (EU) 2019/451 (4) lists the references of harmonised standards drafted in support of Regulation (EU) No 305/2011. In order to ensure that references of those standards are listed in one act, the references of the harmonised standards EN 16510-2-1:2022, EN 16510-2-2:2022, EN 16510-2-3:2022, EN 16510-2-4:2022 and EN 16510-2-6:2022 should be included in that Annex. |

In accordance with Article 17(5) of Regulation (EU) No 305/2011, a coexistence period is to be indicated for each harmonised standard that supersedes another harmonised standard. |

Implementing Decision (EU) 2019/451 should therefore be amended accordingly. |

In order to allow the manufacturers to use the revised harmonised standard as soon as possible, this Decision should enter into force on the day of its publication in the Official Journal of the European Union, |
HAS ADOPTED THIS DECISION:
Article 1
Annex I to Implementing Decision (EU) 2019/451 is amended in accordance with the Annex to this Decision.
Article 2
This Decision shall enter into force on the day of its publication in the Official Journal of the European Union.
