COMMISSION IMPLEMENTING DECISION (EU) 2022/2191

of 8 November 2022

on the harmonised standards for radio equipment drafted in support of Directive 2014/53/EU of the European Parliament and of the Council

(Text with EEA relevance)

THE EUROPEAN COMMISSION,

Having regard to the Treaty on the Functioning of the European Union,

Having regard to Regulation (EU) No 1025/2012 of the European Parliament and of the Council of 25 October 2012 on European standardisation, amending Council Directives 89/686/EEC and 93/15/EEC and Directives 94/9/EC, 94/25/EC, 95/16/EC, 97/23/EC, 98/34/EC, 2004/22/EC, 2007/23/EC, 2009/23/EC and 2009/105/EC of the European Parliament and of the Council and repealing Council Decision 87/95/EEC and Decision No 1673/2006/EC of the European Parliament and of the Council (1), and in particular Article 10(6) thereof,

Whereas:

In accordance with Article 16 of Directive 2014/53/EU of the European Parliament and of the Council (2), radio equipment which is in conformity with harmonised standards or parts thereof, the references of which have been published in the Official Journal of the European Union, is to be presumed to be in conformity with the essential requirements set out in Article 3 of that Directive, covered by those standards or parts thereof.

By Implementing Decision C(2015) 5376 (3), the Commission made a request to the European Committee for Electrotechnical Standardisation (Cenelec) and the European Telecommunications Standards Institute (ETSI) for the drafting and the revision of harmonised standards for radio equipment in support of Directive 2014/53/EU (‘the request’).

On the basis of the request, ETSI drafted harmonised standards EN 303 347-2 V2.1.1, EN 301 489-12 V3.2.1, EN 301 489-20 V2.2.1, EN 301 489-52 V1.2.1, EN 303 347-1 V2.1.1, EN 303 347-3 V2.1.1, EN 303 363-1 V1.1.1, EN 303 213-5-2 V1.1.1 and EN 300 674-2-1 V3.1.1.

On the basis of the request, ETSI revised harmonised standards EN 300 422-1 V2.1.2, EN 300 422-2 V2.1.1, EN 300 422-3 V2.1.1 and EN 301 908-10 V4.2.2, the references of which are published in the C series of the Official Journal of the European Union by Commission Communication 2018/C326/04 (4). This resulted in the adoption of harmonised standards EN 300 422-1 V2.2.1 and EN 301 908-10 V4.3.1. ETSI also revised harmonised standards EN 301 025 V2.2.1, EN 303 345-2 V1.1.1, EN 303 345-5 V1.1.1 and EN 301 908-13 V13.1.1, the references of which are published in the L series of the Official Journal of the European Union by Commission Implementing Decision (EU) 2020/167 (5). This resulted in the adoption of harmonised standards EN 301 025 V2.3.1, EN 303 345-2 V1.2.1, EN 303 345-5 V1.2.1 and EN 301 908-13 V13.2.1.

The Commission, together with ETSI, has assessed whether those harmonised standards comply with the request.

Harmonised standards EN 300 422-1 V2.2.1, EN 301 025 V2.3.1, EN 301 908-10 V4.3.1, EN 303 347-1 V2.1.1, EN 303 347-2 V2.1.1, EN 303 347-3 V2.1.1, EN 303 363-1 V1.1.1, EN 300 674-2-1 V3.1.1 and EN 303 213-5-2 V1.1.1 satisfy the essential requirements which they aim to cover and which are set out in Directive 2014/53/EU. It is therefore appropriate to publish the references of those standards in the Official Journal of the European Union.

Harmonised standards EN 301 489-12 V3.2.1, EN 301 489-20 V2.2.1, and EN 301 489-52 V1.2.1 include tolerances for the set-up. This element exceeds the purpose of a harmonised standard in support of the Union legislation, due to the fact that it regulates concrete aspects of the testing equipment instead of focusing on the results. The references of those harmonised standards should therefore be published in the Official Journal of the European Union with restriction.

Harmonised standard EN 301 908-13 V13.2.1 includes, in its clause 4.2.2, tolerances for the measurement of the maximum power. A limited tolerance for such measurement can, under certain circumstances, be accepted, as specified in Commission Decision 2010/267/EU (6). That Decision limits the tolerance to +2 dB, which is lower than the values laid out in clause 4.2.2 of that harmonised standard. Greater values of tolerances can lead to the production of harmful interferences. The reference of that harmonised standard should therefore be published in the Official Journal of the European Union with restriction.

Harmonised standards EN 303 345-2 V1.2.1, and EN 303 345-5 V1.2.1 allow the manufacturer to determine that certain tests are not necessary, as regards the unwanted emissions in the spurious domain. Due to this discretion, it cannot be ensured that the values laid down in harmonised standards EN 303 345-2 V1.2.1, EN 303 345-3 V1.1.1, EN 303 345-4 V1.1.1 and EN 303 345-5 V1.2.1 are achieved. The references of those harmonised standards should therefore be published in the Official Journal of the European Union with restriction.

Harmonised standards EN 303 345-3 V1.1.1 and EN 303 345-4 V1.1.1, published under Implementing Decision (EU) 2020/167, include the same elements indicated in the previous recital. The references of those harmonised standards should therefore be published in the Official Journal of the European Union with restriction.

It is therefore necessary to withdraw the references of harmonised standards EN 300 422-1 V2.1.2, EN 300 422-2 V2.1.1, EN 300 422-3 V2.1.1, EN 301 908-10 V4.2.2, EN 301 025 V2.2.1, EN 303 345-2 V1.1.1, EN 303 345-5 V1.1.1 and EN 301 908-13 V13.1.1 from the Official Journal of the European Union.

Harmonised standards EN 303 413 V1.2.1, EN 303 372-1 V1.2.1 and EN 303 372-2 V1.2.1, the references of which are already published in the L series of the Official Journal of the European Union by Implementing Decision (EU) 2020/167, are the new versions of, respectively, harmonised standards EN 303 413 V1.1.1, EN 303 372-1 V1.1.1 and EN 303 372-2 V1.1.1, the references of which are published in the C series of the Official Journal of the European Union by Communication 2018/C326/04. It is therefore necessary to withdraw the references of harmonised standards EN 303 413 V1.1.1, EN 303 372-1 V1.1.1 and EN 303 372-2 V1.1.1 from the Official Journal of the European Union.

In order to allow manufacturers sufficient time to adapt their radio equipment that is covered by any of the harmonised standards EN 300 422-1 V2.1.2, EN 300 422-2 V2.1.1, EN 300 422-3 V2.1.1, EN 301 908-10 V4.2.2, EN 301 025 V2.2.1, EN 303 345-2 V1.1.1, EN 303 345-5 V1.1.1 and EN 301 908-13 V13.1.1, EN 303 413 V1.1.1, EN 303 372-1 V1.1.1 and EN 303 372-2 V1.1.1, it is necessary to defer the withdrawal of the references of those harmonised standards.

Harmonised standards EN 301 908-14 V13.1.1, EN 301 908-15 V11.1.2 and EN 301 908-18 V13.1.1 have been withdrawn from Annex I to Implementing Decision (EU) 2020/167, which lists the references of harmonised standards conferring a presumption of conformity with Directive 2014/53/EU. Though the references of those standards have been withdrawn from the L series of the Official Journal of the European Union, the transitional period for those references has been included in Annex III to Implementing Decision (EU) 2020/167. That Annex lists, however, the references of harmonised standards that are withdrawn from the C series of the Official Journal of the European Union. In order to ensure clarity and legal certainty, it is necessary to insert, in the L series of the Official Journal of the European Union, explicitly the date of withdrawal of the references to those harmonised standards.

In the interests of clarity and rationality, a complete list of references of harmonised standards drafted in support of Directive 2014/53/EU and satisfying the requirements they aim to cover should be published in a single act, including any limitations set out for any of those harmonised standards. The references of harmonised standards drafted in support of that Directive are currently published by Implementing Decision (EU) 2020/167 and Communication 2018/C326/04.

Implementing Decision (EU) 2020/167 has been substantially amended several times. In the interests of clarity and rationality, and since further amendment needs to be made to that Implementing Decision, that Implementing Decision should be replaced.

Many of the references of harmonised standards published by Communication 2018/C326/04 have been withdrawn by Commission Implementing Decision (EU) 2019/1202 (7). In the interests of clarity and rationality, Communication 2018/C326/04 should be repealed. In order to give manufacturers sufficient time to adapt their products to the revised versions of the standards concerned, Communication 2018/C326/04 should continue to apply until the dates of withdrawal of the references of harmonised standards concerned and published by that Communication.

Compliance with a harmonised standard confers a presumption of conformity with the corresponding essential requirements set out in Union harmonisation legislation from the date of publication of the reference of such standard in the Official Journal of the European Union. This Decision should therefore enter into force as a matter of urgency,

HAS ADOPTED THIS DECISION:

Article 1

The references to harmonised standards for radio equipment drafted in support of Directive 2014/53/EU, listed in Annex I to this Decision, are hereby published in the Official Journal of the European Union, subject to any limitations set out in that Annex for any of those harmonised standards.

The references of harmonised standards for radio equipment drafted in support of Directive 2014/53/EU, listed in Annex II to this Decision, are hereby published in the Official Journal of the European Union. Those references shall be deemed to have been published in the Official Journal of the European Union for the periods set out in that Annex.

Article 2

Implementing Decision (EU) 2020/167 is repealed.

Article 3

Communication 2018/C326/04 is repealed.

However, it shall continue to apply to the references of the harmonised standards listed in Annex III to this Decision until the dates of withdrawal of those references as set out in that Annex. Each of those references is withdrawn as of the date set out in that Annex for that reference.

Article 4

This Decision shall enter into force on the day following that of its publication in the Official Journal of the European Union.
