DECISION OF THE EEA JOINT COMMITTEE No 169/2023
of 13 June 2023
amending Annex XX (Environment) to the EEA Agreement [2023/2566]
THE EEA JOINT COMMITTEE,
Having regard to the Agreement on the European Economic Area (“the EEA Agreement”), and in particular Article 98 thereof,
Whereas:

(1) |
Commission Delegated Directive (EU) 2023/544 of 16 December 2022 amending Directive 2000/53/EC of the European Parliament and of the Council as regards the exemptions for the use of lead in aluminium alloys for machining purposes, in copper alloys and in certain batteries (1) is to be incorporated into the EEA Agreement. |

(2) |
Commission Implementing Decision (EU) 2022/2462 of 14 December 2022 amending Commission Implementing Decision (EU) 2016/2323 establishing the European List of ship recycling facilities pursuant to Regulation (EU) No 1257/2013 of the European Parliament and of the Council (2) is to be incorporated into the EEA Agreement. |

Annex XX to the EEA Agreement should therefore be amended accordingly, |
HAS ADOPTED THIS DECISION:
Article 1
Annex XX to the EEA Agreement shall be amended as follows:

The following indent is added in point 32e (Directive 2000/53/EC of the European Parliament and of the Council):

The following indent is added in point 32fhd (Commission Implementing Decision (EU) 2016/2323):

Article 2
The texts of Delegated Directive (EU) 2023/544 and Implementing Decision (EU) 2022/2462 in the Icelandic and Norwegian languages, to be published in the EEA Supplement to the Official Journal of the European Union, shall be authentic.
Article 3
This Decision shall enter into force on 14 June 2023, provided that all the notifications under Article 103(1) of the EEA Agreement have been made (*1).
Article 4
This Decision shall be published in the EEA Section of, and in the EEA Supplement to, the Official Journal of the European Union.
