DECISION OF THE EEA JOINT COMMITTEE

No 102/2015

of 30 April 2015

amending Annex X (Services in general) and Protocol 31 (on cooperation in specific fields outside the four freedoms) to the EEA Agreement [2016/1285]

THE EEA JOINT COMMITTEE,

Having regard to the Agreement on the European Economic Area (‘the EEA Agreement’), and in particular Articles 86 and 98 thereof,

Whereas:

(1)

Regulation (EU) No 1024/2012 of the European Parliament and of the Council of 25 October 2012 on administrative cooperation through the Internal Market Information System and repealing Commission Decision 2008/49/EC (1) is to be incorporated into the EEA Agreement.

(2)

Regulation (EU) No 1024/2012 repeals Commission Decision 2008/49/EC (2), which is included into the EEA Agreement and consequently the reference to Decision 2008/49/EC should be deleted from the EEA Agreement.

(3)

Annex X and Protocol 31 to the EEA Agreement should therefore be amended accordingly,

HAS ADOPTED THIS DECISION:

Article 1

The following is inserted after point 2d (Commission Implementing Decision 2014/287/EU) of Annex X to the EEA Agreement:

‘3.

 32012 R 1024: Regulation (EU) No 1024/2012 of the European Parliament and of the Council of 25 October 2012 on administrative cooperation through the Internal Market Information System and repealing Commission Decision 2008/49/EC (OJ L 316, 14.11.2012, p. 1).

The provisions of the Regulation shall, for the purposes of this Agreement, be read with the following adaptations:

(a)

The words “Article 26(2) of the Treaty on the Functioning of the European Union (TFEU)” and “Article 26(2) TFEU” shall read “Article 1(2)(a) to (d) of the EEA Agreement”.

(b)

The words “Union acts” shall read “Union acts incorporated into the EEA Agreement”.’

Article 2

The text of the second indent (Commission Decision 2008/49/EC) of Article 17(6)(b) of Protocol 31 to the EEA Agreement is deleted.

Article 3

The text of Regulation (EU) No 1024/2012 in the Icelandic and Norwegian languages, to be published in the EEA Supplement to the Official Journal of the European Union, shall be authentic.

Article 4

This Decision shall enter into force on 1 May 2015, provided that all the notifications under Article 103(1) of the EEA Agreement have been made (*1).

Article 5

This Decision shall be published in the EEA Section of, and in the EEA Supplement to, the Official Journal of the European Union.
