Must Articles 10(1) and (2), 11(1) and (2)(a) to (e), 11a(1)(a) and 11(3) of Directive 2008/98/EC of the European Parliament and of the Council of 19 November 2008 on waste and repealing certain Directives (1), as amended by Directive (EU) 2018/851 of the European Parliament and of the Council of 30 May 2018 amending Directive 2008/98/EC on waste (2), and in the context of recital 51 of Directive 2018/851 of 30 May 2018, be interpreted as precluding national legislation which fails to impose an obligation – on entities collecting municipal waste from property owners – to submit reports ahead of the deadlines for meeting the targets (early warning reports, for example, quarterly or half-yearly), and incorporates only follow-up reports, in respect of the previous calendar year, on the preparing for re-use and recycling rate for waste attained, which makes it more difficult for public authorities immediately to implement appropriate preventive legal measures, including supervisory measures, to ensure that the minimum requirements are met and the objectives of the directives are attained?
