The appellant claims that the court should:

set aside in part the judgment of the General Court;

itself give final judgment on the matters at issue in his appeal;

order the Council to pay the costs.

Grounds of appeal and main arguments

The appeal concerns the interpretation and application of the grounds for refusal set out in the third and fourth indents of Article 4(1)(a) of the Transparency Regulation. (1)

The appellant contends that the General Court interpreted those grounds for refusal too broadly when it decided that they also applied to passages (with observations and individual positions of Member States) which are not necessarily reflected in, or compatible with, the final position adopted by the Council. Furthermore, the appellant submits that the statement of reasons provided cannot substantiate that refusal.

The General Court should, therefore, have ruled that the obligation to grant partial access applies also to passages which (contain observations and individual positions of the Member States concerned which) are not necessarily compatible with, or reflected in, the final position adopted by the Council.
