Language of the case: French

Parties

Applicant: Council section of the European Civil Service Federation (FFPE, Council section) (Brussels, Belgium) (represented by: A. Champetier and S. Rodrigues, lawyers)

Defendant: Council of the European Union (represented by: M. Bauer and I. Demoulin, acting as Agents)

Re:

By its action, the applicant seeks, first, on the basis of Article 263 TFEU, the annulment of the note of the Council of the European Union of 3 April 2023 on the outcome of the second verification procedure concerning it, in so far as that note suspends the rights conferred on it as a representative trade union or professional organisation and, second, on the basis of Article 268 TFEU, compensation for the non-material damage allegedly suffered by virtue of that fact.

Operative part of the judgment

The Court:

1.

Dismisses the action;

2.

Orders the Council section of European Civil Service Federation (FFPE, Council section) to pay the costs, including those relating to the proceedings for interim measures.
