Which national legislation is applicable pursuant to Regulation (EC) No 883/2004 (1) and which is the competent Member State, the competent institution, which must grant unemployment benefits, in the light of the following: (1) the person concerned is a national of the Republic of Bulgaria, which is a Member State of the European Union; (2) he owns a home in the Republic of Bulgaria; (3) his family (his wife) and his centre of interests are in the Republic of Bulgaria; (4) he was employed by an employer established in the Italian Republic; (5) he worked as a seaman; (6) he carried out his employment activities on board of a vessel flying the Italian flag and within the territorial borders of the Italian Republic (within the borders of the European Union), and (7) it is not disputed that unemployment insurance was paid by his employer in the Italian Republic?

Do the first sentence of Article 11(4) of Regulation (EC) No 883/2004 and Article 65(1) of that regulation, read in conjunction with Article 11(3)(c) thereof or Article 11(3)(e) thereof, permit a practice of the institutions of the Member State refusing to grant unemployment benefits to a person on the ground that that person is not seeking employment in the Member State to which he or she has submitted an application for unemployment benefits and the insurance contributions which that person’s employer paid while he or she was employed were paid into the insurance funds of another Member State and not into those of the Member State from which unemployment benefits have been claimed?
