Form of order sought

The applicant claims that the Court should:

Annul Article 1, paragraph (15) and (16) of Council Decision (CFSP) 2025/1495 of 18 July 2025 amending Decision 2014/512/CFSP concerning restrictive measures in view of Russia’s actions destabilising the situation in Ukraine;

Annul Article 1, paragraph (18), (19) and (20) of Council Regulation (EU) 2025/1494 of 18 July 2025 amending Regulation (EU) No 833/2014 concerning restrictive measures in view of Russia’s actions destabilising the situation in Ukraine, insofar as they concern the applicant;

Order the Council to bear the cost of the present proceedings.

Pleas in law and main arguments

In support of the action, the applicant relies on eight pleas in law.

1.

First plea in law, alleging breach of the European union’s international obligations; breach of Article V(2)(d) of the Convention on the Recognition and Enforcement of Foreign Arbitral Awards (New York, 1958); breach of Article 54 ICSID Convention, Regulations and Rules; breach of the principle of pacta sunt servanda under Article 26 of the Vienna Convention on the law of treaties.

Second plea in law, alleging breach of Article 4(3) TEU; breach of the principle of sincere cooperation; breach of the obligation to fulfil international commitments.

Third plea in law, alleging misapplication of Article 215 TFEU; wrong choice of legal basis under the treaties of the European Union.

Fourth plea in law, alleging breach of Articles 2, 3 and 40 Treaty on the European Union and breach of the principle of legal certainty and legitimate expectation for contradiction with Regulation (EU) 1219/2012.

5.

Fifth plea in law, alleging breach of the European Union general principle of legitimate expectations; breach of the principle of legal certainty.

6.

Sixth plea in law, alleging breach of the agreement on partnership and cooperation establishing a partnership between the European communities and their member states, of one part, and the Russian federation, on the other part.

7.

Seventh plea in law, alleging violation of the principles of non-discrimination; breach of Articles 20 and 21 of the Charter of Fundamental Rights; breach of Article 14 of the European Convention on Human Rights; breach of the principle of proportionality.

8.

Eighth plea in law, alleging breach of the right to be heard and breach of the right to effective judicial protection – Articles 41(a), 47 and 48 of the Charter of Fundamental Rights; Articles 6 and 13 European Convention of Human Rights; breach of the right to property – Article 17 of Charter, Article 1 Protocol n.1 European Convention of Human Rights.
