Re:

By her action under Article 270 TFEU, the applicant seeks, first, the annulment (i) of the decision of the Secretary-General of the European Parliament of 4 October 2023 not to confirm her in her duties as Head of the [confidential] Unit of the Parliament’s Directorate-General for [confidential], (ii) of the decision of the Secretary-General of the Parliament of 23 October 2023 approving her transfer to the [confidential] Unit of the same Directorate-General and (iii), in so far as necessary, of the decision of 17 April 2024 rejecting her complaint and, secondly, compensation for the non-material damage that she claims to have suffered as a result of those decisions.

Operative part of the judgment

The Court:

1.

Annuls the decision of the Secretary-General of the European Parliament of 4 October 2023 not to confirm EP in her duties as Head of the [confidential] Unit in the Parliament’s Directorate-General for [confidential] and the decision of the Secretary-General of the Parliament of 23 October 2023 approving her transfer to the [confidential] Unit in the same Directorate-General, as supplemented by the decision of 17 April 2024 rejecting the complaint;

2.

Dismisses the action as to the remainder;

3.

Orders EP and the Parliament each to bear their own costs.
