Is Article 2(3) of Directive (EU) 2019/1024 (1) of the European Parliament and of the Council of 20 June 2019 on open data and the re-use of public sector information to be interpreted as meaning that the term public undertaking includes an undertaking in which several public sector bodies may jointly exercise a dominant influence by virtue of their ownership, their financial participation therein, or the rules which govern it? |

If the first question is answered in the affirmative, is a dominant influence, as defined in the above-mentioned article of Directive 2019/1024, to be assumed, even where several public sector bodies jointly hold the majority of an undertaking’s subscribed capital, control the majority of the votes attaching to shares issued by the undertaking, or can appoint more than half of the undertaking’s administrative, management or supervisory body, or is it necessary to examine whether those public sector bodies actually act in concert and have common interests? |
