Form of order sought

The applicant claims that the Court should:

find that the action is admissible and well-founded in its entirety;

annul Council Decision 2013/255/CFSP, (1) as amended by Council Decision (CFSP) 2025/1095 concerning restrictive measures in view of the situation in Syria, (2) in so far as Mr Hashem Akkad’s name has been included on the list set out in Annex I to Council Decision 2013/255/CFSP;

annul Council Regulation (EU) No 36/2012, (3) implemented by way of Council Implementing Regulation (EU) 2025/1094 concerning restrictive measures in view of the situation in Syria, (4) in so far as Mr Hashem Akkad’s name has been included on the list set out in Annex II to Council Regulation (EU) No 36/2012 of 18 January 2012 concerning restrictive measures in view of the situation in Syria;

order the Council to pay all of the applicant’s costs, expenses, fees and other expenditure linked with his defence in the present proceedings.

Pleas in law and main arguments

In support of the action, the applicant relies on seven pleas in law.

First plea in law, alleging material infringement of the rights of the defence and of the right to a fair trial;

Second plea in law, alleging failure to fulfil the obligation to state reasons;

Third plea in law, alleging infringement of the right to effective judicial protection;

Fourth plea in law, alleging an error of assessment on the part of the Council of the European Union;

Fifth plea in law, alleging infringement of the right to property, failure to observe the principle of proportionality, and infringement of the freedom to conduct a business;

Sixth plea in law, alleging infringement of the right to a normal life;

Seventh plea in law, alleging a serious infringement of the right to the protection of reputation.
