Update of the list of residence permits referred to in Article 2(16) of Regulation (EU) 2016/399 of the European Parliament and of the Council on a Union Code on the rules governing the movement of persons across borders (Schengen Borders Code) (1)

The publication of the list of residence permits referred to in Article 2(16) of Regulation (EU) 2016/399 of the European Parliament and of the Council of 9 March 2016 on a Union Code on the rules governing the movement of persons across borders (Schengen Borders Code) (2) is based on information communicated by the Member States to the Commission in conformity with Article 39 of the Schengen Borders Code.

In addition to publication in the Official Journal, a regular update is available on the website of the Directorate-General for Migration and Home Affairs.

NB: The residence permits pursuant to Section 24 (1) of the Residence Act (Implementation of Council Directive 2001/55/EC of 20 July 2001) that are valid on February 1, 2024 or on February 1, 2025, including their conditions and ancillary provisions, have been extended generally by means of an Ordinance and continue to apply until March 4, 2026 without the issuance of a new card for the residence permit.

Aufenthaltserlaubnis für Angehörige eines Mitgliedstaates der EWG (paper document)

(residence permit for EC Member State nationals)

NB: Under section 15 of the Act on general freedom of movement for EU citizens, an ‘Aufenthaltserlaubnis-EU für Familienangehörige von Staatsangehörigen eines Mitgliedstaates der Europäischen Union oder eines EWR Staates, die nicht Staatsangehörige eines Mitgliedstaates der EU oder des EWR sind'’

NB: Residence permit for family members of EU citizens or EEA Member State nationals who are not themselves EU citizens or EEA Member State nationals issued before 28.8.2007 remains valid as a residence card.

NB: The aforementioned permit entitle the holder to enter without a visa only if issued in a passport or separately in conjunction with a passport, but not if issued as a sticker affixed to a substitute identity document (‘Ausweisersatz’) with exclusive validity in Germany.

NB: These permits are valid in lieu of a visa, for entry without a visa, only if issued in a passport or separately in conjunction with a passport, not if issued as an internal document in lieu of an identity card.

An ‘Aussetzung der Abschiebung (Duldung)’ (deferral of expulsion (exceptional leave to remain)) or an ‘Aufenthaltsgestattung für Asylbewerber’ (temporary residence permit for asylum seekers) are not valid for entry without a visa.

Fiktionsbescheinigung

(Provisional residence document)

Only if the third box on page 3 is ticked – the residence permit continues to be valid. Entry is allowed only in connection with an expired residence permit, visa, a valid passport pursuant to Article 10 of Directive 2004/38/EC, or a German permanent residence card pursuant to Article 20 of Directive 2004/38/EC.

If the first or second box is ticked, the ‘Fiktionsbescheinigung’ does not entail the right of entry without a visa.

Provision on the implementation of the Agreement on the withdrawal of the United Kingdom of Great Britain and Northern Ireland from the European Union and the European Atomic Energy Community

As provided for in the provisions concerning the withdrawal of the United Kingdom of Great Britain and Northern Ireland from the European Union, with effect from the end of the transition period under this Agreement, British nationals and their family members who hold rights in Germany under Part Two Title II Chapter 1 or under Article 24 (2), also in conjunction with Article 25 (2) of the Agreement, are allowed to enter even if they do not have an expired residence permit or a visa in addition to their passport also with a ‘Fiktionsbescheinigung’ (provisional residence document) in which the fourth box on page 3 is marked, indicating (In German) that ‘The holder has applied for documentation of a right of residence under the Freedom of Movement Act/EU or the EU-Switzerland Agreement, which is hereby provisionally certified’, even if they do not have an expired residence permit and a visa in addition to their passport. That indication in the document is written in German and reads: ‘Der Inhaber / die Inhaberin hat die Dokumentation eines Aufenthaltsrechts nach dem FreizügG/EU oder dem Abkommen EU-Schweiz beantragt, das hiermit vorläufig bescheinigt wird.’

The same box is marked if the holder already has applied for documentation of a right of residence under the Freedom of Movement Act/EU or the EU-Switzerland Agreement, but no document according to the uniform format defined by Council Regulation (EC) No 1030/2002 is ready for issuance. In this case, the right of residence is certified by the provisional residence document. In such cases, holders of a Fiktionsbescheinigung are allowed to enter if the fourth box on page 3 of the document is marked, indicating that ‘The holder has applied for documentation of a right of residence under the Freedom of Movement Act/EU or the EU-Switzerland Agreement, which is hereby provisionally certified’, even if they do not have an expired residence permit or a visa in addition to their passport.

NB: Since 1 August 2003 a new type of pass has been issued for members of diplomatic missions and for members of career type consular posts. Those types of passes established before 1 August 2003 are no longer valid.

SPAIN

Replacement of the list published in OJ C 140, 21.4.2021, p. 2

1.   Residence permits issued according to the uniform format:

Permiso de residencia expedido a nacionales de terceros países (Residence permit issued to third-country nationals)

Cards issued from 19 May 2020 in accordance with Regulation (EU) 2017/1954. Existing cards will be valid until their expiry date.

Residence permits issued to third-country nationals in accordance with the implementation of Council Directive 2001/55/EC of 20 July 2001 (persons affected by the conflict in Ukraine).

N.B.: All residence permits issued under Council Directive 2001/55/EC of 20 July 2001 (persons affected by the conflict in Ukraine) have been extended by Order INT/195/2025 and continue to be valid until 4 March 2026 without the need for a new residence permit card.

2.   All other documents issued to third-country nationals having equivalent value to a residence permit:

Tarjeta de extranjeros ‘régimen comunitario’ (EC scheme card for foreign nationals (issued to relatives of EU citizens)

Cards issued from 17 May 2010 to 2020 will be valid until their expiry date with a maximum validity of 10 years.

Cards issued from 17 May 2010 to 2020. Existing cards will be valid until their expiry date.

List of persons participating in a school trip within the European Union.

Holders of the following accreditation cards issued by the Ministry of Foreign Affairs, the European Union and Cooperation may enter without visas: (see Annex 20).
