Re:

By its action based on Article 263 TFEU, the applicant seeks the annulment of Commission Decision C(2021) 7675 final of 29 October 2021 to adopt interim measures (Case M.10493 – Illumina/Grail) pursuant to Article 8(5)(a) of Council Regulation (EC) No 139/2004 of 20 January 2004 on the control of concentrations between undertakings (OJ 2004 L 24, p. 1).

Operative part of the order

1.

There is no longer any need to adjudicate on the action.

2.

The European Commission shall bear its own costs and shall pay those incurred by Grail LLC.
