Questions referred

1.

Is Article 8(1)(a) of Regulation (EC) No 261/2004 (1) of the European Parliament and of the Council of 11 February 2004 establishing common rules on compensation and assistance to passengers in the event of denied boarding and of cancellation or long delay of flights, and repealing Regulation (EEC) No 295/91 (Flight Passenger Rights Regulation), read in conjunction with Article 7(3) thereof, to be interpreted as meaning that a passenger who has paid for a flight partly with frequent-flyer miles may request monetary reimbursement of the price of the flight ticket from the operating air carrier, which is not his or her contractual partner?

2.

If the answer to the above question is in the affirmative:

Is the price of the flight ticket to be reimbursed by the operating air carrier determined on the basis of the publicly available fare at which the passenger’s contractual partner offered the relevant cancelled flight or on the basis of the (average) value of the redeemed frequent-flyer miles?
