Regulation (EU) 2024/1392 of the European Parliament and the Council (1) renewed the temporary trade-liberalisation measures supplementing trade concessions applicable to Ukrainian products. At the same time, Article 4(7) of Regulation (EU) 2024/1392 introduced a new automatic safeguard measure for eggs, poultry, sugar, oats, maize, groats and honey (‘the products concerned’), which provides for the reintroduction of the tariff-rate quota suspended by Article 1(1), point (b), of that Regulation if the cumulative import volumes of a product since 1 January 2024 reach the respective arithmetic mean of import volumes of that product recorded in the period from 1 July to 31 December 2021, in 2022 and in 2023.

The publicly available information (2) on the cumulative import volumes of the products concerned is compiled as follows: for imports recorded between 1 January 2024 until 6 June 2024, the import volumes are compiled on the basis of import volumes recorded in Eurostat and later in Surveillance 3 as they become available. For imports of the products concerned as from 7 June 2024, Commission Implementing Regulation (EU) 2024/1671 of 6 June 2024  (3) establishes a system of order numbers to track the volumes imports of the products concerned. The record of import volumes between 1 January 2024 and 6 June 2024 may be subject to corrections as a result of additional reporting on import volumes by Member States.

For example, the Commission recently received updated information from a Member State regarding the import volume of sugar between 1 January 2024 until 6 June 2024. Accordingly, the cumulative import volume of sugar in 2024 reached the relevant arithmetic mean calculated in the Annex to Implementing Regulation (EU) 2024/1671. Such corrections result in an adjustment of the volume represented in the ‘balance’ row of the publicly available information. Similar adjustments may occur in the future for the other products concerned.
