WHAT IS THE AIM OF THE REGULATION AND THE DECISION?

  • The regulation gives effect to Decision 2011/72/CFSP.
  • The regulation sets out the financial sanctions directed against certain persons, entities and bodies in view of the situation in Tunisia.

KEY POINTS

  • The decision and regulation impose restrictive measures that freeze the assets of individuals, companies, bodies or entities, along with their associates, identified by the Council as being responsible for the misappropriation of Tunisian state funds.
  • The regulation applies:
    • within the EU territory, including its airspace;
    • on board any aircraft or vessel under an Member State’s jurisdiction;
    • to any EU national inside or outside the EU territory;
    • to any company, entity or body which is incorporated or constituted under the law of an EU Member State;
    • to any country, entity or body in respect of any business done wholly or partly within the EU.
  • Specific exemptions to these measures are set out in the regulation.
  • No funds or economic resources will be made available, directly or indirectly, to those named.
  • The annex to the decision and Annex 1 of the regulation list the individuals whose funds and economic resources will be frozen.
  • The annexes set out the grounds for including those listed.
  • The annexes are reviewed at regular intervals, at least every 12 months.

A number of third countries (non-EU countries) have agreed to ensure that their national policies conform to the decision.
