[pic] | KOMISIJA EVROPSKIH SKUPNOSTI | Bruselj, 27.9.2005 KOM(2005) 462 končno SPOROČILO KOMISIJE SVETU IN EVROPSKEMU PARLAMENTU Rezultati preverjanja zakonodajnih predlogov, ki čakajo na obravnavo zakonodajalca SPOROČILO KOMISIJE SVETU IN EVROPSKEMU PARLAMENTU Rezultati preverjanja zakonodajnih predlogov, ki čakajo na obravnavo zakonodajalca Komisija je v Sporočilu z dne 16. marca 2005 „Bolje oblikovani predpisi za rast in delovna mesta v Evropski uniji“[1]napovedala, da se je odločila postopoma spremeniti način, s katerim skuša zagotoviti, da kakovost pravnih aktov v Evropi spodbuja cilje partnerstva za rast in nova delovna mesta. Regulativno okolje Evropske unije mora biti na najvišji možni ravni, če želi povečati evropsko konkurenčnost. Za dosego tega cilja je treba poenostaviti in po potrebi posodobiti pravni red Skupnosti, tj. skupek obstoječih pravnih aktov, za katere je predvidena vrsta ukrepov, vključno z začetkom nove faze Poenostavitvenega programa v oktobru 2005. Komisija je tudi odločila, da je v oblikovanje politike treba vključiti boljše pravne predpise in da morajo novi zakonodajni predlogi, ki jih predloži Komisija, spodbujati boljšo pravno ureditev in prispevati h konkurenčnosti. To uresničuje predvsem zahteva, da se za nove zakonodajne pobude zdaj opravi presoja vpliva, kot je napovedano v zakonodajnem in delovnem programu Komisije za leto 2005, za katerega je Komisija pred kratkim sprejela obširne in natančne smernice[2]. Kar zadeva predloge, ki jih je Komisija predložila v preteklosti in ki čakajo na obravnavo, je Komisija v marčevskem Sporočilu navedla, „da bo preverila predloge, ki čakajo na obravnavo v Svetu/Parlamentu, glede na splošno pomembnost, vpliv na konkurenčnost in ostale vplive“. Cilji, postopek in rezultati tega preverjanja, ki je prvi svoje vrste, so predstavljeni v tem sporočilu. 1. Cilji preverjanja predlogov, ki čakajo na obravnavo Cilj preverjanja je bil omogočiti Komisiji, da zagotovi, da so vsi zakonodajni predlogi, ki čakajo na obravnavo, v celoti skladni s političnimi prednostnimi nalogami Komisije, in da pregleda, ali spremenjene okoliščine upravičujejo ponovni pregled prvotnega pristopa v nadaljevanju. Kjer je bil potreben ponovni pregled, je to preverjanje določilo tudi ustrezne ukrepe, ki jih je treba izvesti, kot so sprememba, nadomestitev ali umik predlogov, ki čakajo na obravnavo, ter izboljšanje presoje njihovega vpliva. Pregled je bil namenjen natančnemu preverjanju predlogov, ki čakajo na obravnavo, glede treh postavk: Prvič, Komisija je predloge, ki čakajo na obravnavo, proučila glede na njihovo usklajenost z lizbonskimi cilji EU in zlasti glede spodbujanja konkurenčnosti. Merila za ocenjevanje predlogov v tem pogledu so določena v „preskusu konkurenčnosti“, ki je del nedavno spremenjenih smernic za izvajanje presoj vpliva[3]. Drugič, Komisija je preverila, ali je pri predlogih, ki čakajo na obravnavo, v določenem časovnem obdobju zakonodajnega postopka premalo bistvenega napredka. V teh primerih so bili proučeni tudi razlogi za počasen napredek in možnosti, ki bi to stanje izboljšale. Tretjič, Komisija je proučila predloge, ki čakajo na obravnavo, da bi ugotovila, ali izpolnjujejo trenutne izboljšane regulativne zahteve, zlasti glede na ustrezne presoje vpliva. To merilo zadeva zlasti tiste predloge, ki jih je Komisija predložila v času, ko presoje vpliva še niso bile formalno zahtevane. 2. Postopek preverjanja Ob začetku preverjanja aprila 2005 je bilo skupaj 489[4] predlogov, ki čakajo na obravnavo. Obseg preverjanja, ki je bil opredeljen v marčevskem Sporočilu, je bil omejen izključno na predloge, ki čakajo na obravnavo in so bili vloženi pred 1. januarjem 2004. To je zajemalo 183 predlogov. Ti so bili predmet skrbne presoje, ki je pripeljala do ugotovitve, da približno 100 predlogov dejansko prispeva nove zakonodajne pobude. Ti so bili v nadaljevanju ocenjeni glede na njihove možne škodljive vplive na konkurenčnost in širše gospodarske vplive. Preostali predlogi imajo po vsej verjetnosti omejen vpliv na konkurenčnost ali pa ga sploh nimajo. To zadeva zlasti predloge, ki izhajajo iz mednarodnih obveznosti ali prispevajo k prilagoditvam pravnega reda Skupnosti o znanstvenem in tehničnem napredku. Nekateri od teh predlogov neposredno prispevajo k „boljšemu pravnemu redu“, ker ga kodificirajo ali poenostavljajo. 3. Rezultati preverjanja Po natančni analizi vseh predlogov, ki čakajo na obravnavo, je Komisija predvidela dve širši vrsti ukrepov: (1) Umik predlogov. Komisija namerava umakniti skupaj 68 predlogov. Ti predlogi se štejejo za neskladne z lizbonskimi cilji ali načeli bolje oblikovanih predpisov, v zakonodajnem postopku ne napredujejo učinkovito ali so vsebinsko neustrezni[5] (npr. cilji so že bili ali bodo doseženi z drugimi ukrepi). Nekateri od teh predlogov bodo lahko ponovno proučeni v okviru nadaljnjih analiz. V nekaterih primerih namerava Komisija ponovno proučiti potrebo po zakonodajnem posegu glede na rezultate celovite presoje vpliva. (2) Za predloge, ki bodo ostali v zakonodajnem postopku, bodo opravljene ekonomske analize, ki bodo predložene zakonodajnemu organu v presojo[6]. To zadeva pet predlogov, za katere je Komisija prepričana, da so še vedno pomembni in za katere bo dodatna predložitev analiz o njihovem vplivu zakonodajnemu organu najverjetneje omogočila lažje odločanje. Kot rezultat preverjanja Komisije bo skupaj 73 predlogov, ki čakajo na obravnavo, predmet ene od oblik posega. To zajema predloge, ki ne izpolnjujejo ciljev konkurenčnosti v celoti, predloge, katerih nadaljnje ekonomske analize je treba predložiti zakonodajalcu v presojo, kot tudi predloge, ki v zakonodajnem postopku ne napredujejo zadostno ali so zastareli. Komisija je umaknila skupaj 31 %[7] vseh predlogov, ki čakajo na obravnavo in so bili vloženi pred 1. januarjem 2004. Vsi posegi, vključno s predlogi, ki so bili izbrani za nadaljnje ekonomske analize, ustrezajo 33 %[8] navedenih predlogov, ki čakajo na obravnavo. Poleg tega so bili rezultati preverjanja pri vsaj dveh predlogih takšni, da ne spadajo neposredno v eno izmed zgornjih kategorij. Pri preverjanju predloga Direktive Sveta o minimalnih zahtevah za varnost in zdravje v zvezi z izpostavljenostjo delavcev fizikalnim dejavnikom (optično sevanje), 1992/0449/COD, je Komisija ugotovila, da je treba izbrisati vidike, povezane z izpostavljenostjo delavcev naravnemu optičnemu sevanju, kar je predlagal tudi Evropski parlament. V zvezi s predlogom o začasnih delavcih (2002/0072/COD) si Komisija pridržuje pravico, da predlog ponovno prouči v okviru prihodnjih razprav o drugih predlogih. Priloga k tem sporočilu povzema stanje in vsebuje podrobnosti o zadevnih predlogih. Sklepna ugotovitev Preverjanje predlogov, ki čakajo na obravnavo, je prvo celovito preverjanje, ki ga je opravila Komisija. To priča o zavezanosti Evropske komisije Partnerstvu za rast in delovna mesta ter zagotavljanju izvajanja načel za bolje oblikovane predpise. Dejavnosti, povezane s preverjanjem, tj. načrtovani posegi v predloge, ki čakajo na obravnavo, kot je določeno v Prilogi, so zasnovane z namenom, da s spodbujanjem konkurenčnosti pozitivno vplivajo na uresničevanje lizbonskih ciljev, razvoj boljšega zakonodajnega okolja in izločanje predlogov, ki verjetno ne bodo obravnavani ali so zastareli.Predlogi, ki čakajo na obravnavo, bodo v nekaterih primerih umaknjeni ob celovitem pregledu politik ali zaradi ponovne proučitve glede na nove elemente politik in celovito presojo vpliva. V skladu z obveznostmi Okvirnega sporazuma o odnosih med Evropskim parlamentom in Komisijo (člen 32) Komisija pred umikom predlogov o tem obvesti Parlament in Svet.
