Prvo poročilo o napredku glede strategije za poenostavitev zakonodajnega okolja

Povzetek

Sedanji delovni dokument Komisije je neposredno nadaljevanje Sporočila COM(2005) 535 iz oktobra 2005: Izvajanje Lizbonskega programa Skupnosti: Strategija za poenostavitev zakonodajnega okolja. Dokument dopolnjuje tudi Sporočilo o strateškem pregledu boljše pravne ureditve v Evropski uniji.

Poenostavitev zakonodaje EU lahko pomembno prispeva k izboljšanju zakonodajnega okolja, dopolni in posodobi predpise in tudi zmanjša upravno breme ter ob upoštevanju tehnološkega razvoja, trgov in mednarodnega konteksta izboljša položaj evropskega gospodarstva. Zato je Komisija poenostavitev označila kot eno od ključnih političnih prednostnih nalog v načrtu za boljšo pravno ureditev.

V skladu s to usmeritvijo delovni dokument Komisije upošteva doseženi napredek pri izvajanju poenostavitve iz oktobra 2005, obravnava tekoče delo in predstavlja povsem nove pobude, ki bodo izboljšale tekoči program poenostavitve za obdobje 2006–2009. Eden od ključnih dosežkov poenostavitve je postopno vključevanje vseh področij zakonodaje ES. Delovni dokument Komisije predstavlja tudi sedanje stanje kodifikacije.

Obenem to prvo poročilo o napredku obravnava tudi dejavnike za uspeh pri doseganju ciljev poenostavitve, zlasti homogeni sklop metodologij, izboljšanje medinstitucionalnega sodelovanja z Evropskim parlamentom in Svetom za uresničevanje ciljev, večjo uporabo samoregulacije in koregulacije ter tudi poenostavitev na nacionalni ravni, s čimer se zagotovi, da se prednosti poenostavitve EU ne izničijo z novimi nacionalnimi predpisi ali tehničnimi ovirami.

UVOD

V skladu s političnimi prednostnimi nalogami politike za boljšo pravno ureditev, ki je bila oblikovana marca 2005, je Komisija oktobra 2005 sprejela novo strategijo za poenostavitev zakonodajnega okolja[1]. Širši cilj strategije je izboljšati kakovost in učinkovitost pravnega reda ter odpraviti nepotrebna bremena za izvajalce in tako prispevati k večji konkurenčnosti evropskega gospodarstva.

Evropski parlament[2] je pozdravil program Komisije za poenostavitev pravnega reda Skupnosti, medtem ko je Evropski svet[3] pozval Svet, naj z zakonodajnim sistemom omogoči prednostno obravnavanje predlogov. Sodelovanje s sozakonodajalci je pri reševanju predlogov za poenostavitev ključno.

Kot dopolnilo Strateškega pregleda boljše pravne ureditve v Evropski uniji[4] so v tem delovnem dokumentu Komisije od začetka strategije oktobra 2005 prvič predstavljeni dosežen napredek in potek uresničevanja ciljev strategije za poenostavitev. Zlasti:

- je predstavljeno sedanje stanje izvajanja strategije za poenostavitev in postopka kodifikacije s poudarkom na:

- zaključenih ukrepih tekočega programa,

- sedanjih ukrepih, ki še niso zaključeni,

- novih ukrepih, ki jih je opredelila Komisija,

- so obravnavani ključni dejavniki za uspešno oblikovanje resnično poenostavljenega zakonodajnega okolja, zlasti homogeni sklop metodologij, tesno sodelovanje med institucijami EU, večja uporaba samoregulacije in koregulacije ter tudi poenostavitev na nacionalni ravni.

Posodobljeni tekoči program za obdobje 2006–2009 vključuje pobude za poenostavitev, določene v zakonodajnem in delovnem programu Komisije za leto 2007, in omogoča pregled prizadevanj Komisije za poenostavitev tekočega zakonodajnega okolja v večletni perspektivi. Dejstvo, da so pobude za poenostavitev prvič vključene v zakonodajni in delovni program Komisije za leto 2007, jasno kaže na to, da je strategija za poenostavitev politična prednostna naloga.

Spreminja se zakonodajna kultura. Komisija je za doseganje ciljev poenostavitve prvič sprejela delovne metode, prednostne naloge in sredstva. Eden od ključnih dosežkov je postopno vključevanje vseh področij politike.

V prihodnosti bo tekoče delo za zmanjševanje upravnega bremena vključeno v izvajanje poenostavitve, ki bo prispevalo k skupnemu 25-odstotnemu zmanjšanju bremena v nacionalni zakonodaji in zakonodaji EU, kar je treba doseči do leta 2012, kot je zapisano v Strateškem pregledu za boljše pravne ureditve.

V skladu s tem bodo obširna posvetovanj z zainteresiranimi stranmi in ocene učinka pripspevale k izboljšanju kakovosti novih predlogov Komisije in zakonodajalcem olajšale oblikovanje zakonodajnega okolja, ki bo popolnoma v skladu z načelom subsidiarnosti ter bo zagotovilo ugodne pogoje za konkurenčnost, inovativnost in rast. To bo verjetno zmanjšalo prihodnje delovne obremenitve glede poenostavitve.

Poročila o napredku bodo redno izhajala.

1. STANJE

1.1. Stanje – tekoči program poenostavitve

V strategiji za poenostavitev iz oktobra 2005 so zajete številne metode za poenostavitev, ki urejajo tekoči program, in je prvič navedenih 100 pobud, ki zajemajo 220 osnovnih zakonodajnih instrumentov za obdobje 2005–2008, ki jih Komisija namerava poenostaviti, na podlagi obširnih posvetovanj z državami članicami, družbami in državljani.

Zaradi pomembnosti neprekinjenega ponovnega pregleda pravnega reda Skupnosti je Komisija za obdobje 2006–2009 oblikovala še 43 dodatnih pobud, ki vsebujejo možnost poenostavitve. Te so vključene v posodobljeni tekoči program, ki je predstavljen v Prilogi 1. Program potrjuje odločenost Komisije, da zmanjša upravno breme, ki ga povzroča zakonodajni okvir, in ob upoštevanju razvoja, tehnologije, trgov in mednarodnega okvira dopolni ter posodobi predpise.

1.1.1. Napredek, ki ga je dosegla Komisija

Končanih je 12 od 14[5] pobud, ki so bile načrtovane za leto 2005. V sporočilu iz oktobra 2005 je bilo za leto 2006 načrtovanih 54 pobud, 3 pobude so bile nove, ena je bila prenesena iz leta 2005, ena pa iz leta 2008. Od teh pobud jih je do zdaj sprejetih 15[6]. Poleg tega je bilo za sprejetje pred koncem tega leta potrjenih 24 predlogov za poenostavitev, ki so predstavljeni v Prilogi 1. 15 predlogov se prestavi na leto 2007 in leto 2008. Po temeljitih pregledih in posvetovanjih z zainteresiranimi stranmi je bilo 5 pobud preklicanih.

Komisija je do zdaj za obdobje 2005–2006 sprejela 27 pobud od 71, več kot polovico programa pa bo sprejela do konca leta 2006. Stopnja napredka tekočega programa poenostavitve v letu 2006 se razlikuje glede na zapletenost zadevnega področja in v nekaterih primerih prihaja do zaostanka, čeprav so bile nekatere pobude sprejete pred načrtovanim datumom. Odložene pobude pa so skoraj vse potrjene za leto 2007.

Poudariti je treba, da je ta program uresničevanja poenostavitve najbolj drzen od vseh, kar jih je kdaj začela Komisija. Izvajanje poenostavitve se je izkazalo za zelo zahtevno, kadar morajo biti ugodnosti za družbe in državljane uravnotežene s prizadevanji in stroški, ki so potrebni za prilagoditev novemu zakonodajnemu okolju. Poenostavitev lahko na nekaterih področjih politike predstavlja posledica načrtov za reformiranje, zato je pogosto potrebno več časa, da se v celoti pokažejo makroekonomske koristi predlaganih sprememb.

Poleg tega se lahko z oceno učinka pri izbiranju najprimernejših možnosti politike poudarijo novi, pomembni dejavniki pri oblikovanju politike[7]. Izvajanje programa za poenostavitev se razvija ob upoštevanju ugotovitev teh ocen učinka.

Skoraj vse predloge za poenostavitev, ki jih je vložila Komisija, zdaj še vedno obravnavata Svet in Evropski parlament. Ti predlogi so predstavljeni v Prilogi 3.

Spodaj so predstavljeni nekateri primeri, ki kažejo na to, da je Komisija s svojim programom za poenostavitev večino področij, ki so najpomembnejša za družbe in državljane, že obravnavala.

Primeri predlogov, ki jih je sprejela Komisija, so:

- Posodobitev Carinskega zakonika in e-carina [8]: preoblikovanje carinske zakonodaje Skupnosti in izdelava vseevropskih elektronskih sistemov za izmenjavo podatkov med javnimi organi in družbami. Mednarodno trgovino bodo spodbujali usmerjeni in preprosti carinski postopki ter pravila, avtomatizirani in med seboj povezani carinski sistemi ter tesno sodelovanje vseh organov in agencij, vključenih v pretok blaga preko meja Skupnosti.

- Okolje [9]: posodobitev okvirne direktive o odpadkih:

- poenostavitev zakonodaje o odpadkih s pojasnjevanjem opredelitev, racionalizacijo predpisov in vključevanjem direktiv o nevarnih odpadkih in odpadnih oljih;

- izboljšanje trga za predelavo odpadkov z določanjem okoljskih standardov, ki podrobno določajo okoliščine, v katerih nekateri reciklirani odpadki niso več obravnavani kot odpadki.

- Prosti pretok delavcev [10]:

- posodobitev veljavnih predpisov o usklajevanju nacionalnih sistemov za socialno varnost;

- poenostavitev postopkov za zavarovane osebe in skrajševanje časa, ki ga potrebujejo institucije na različnih področjih socialne varnosti (bolezen, nesreče pri delu, poklicne bolezni, invalidnost, starost, brezposelnost, družinske dajatve), da se odzovejo in obdelajo čezmejne primere.

- Aditivi za živila in arome [11]:

- poenostavitev zakonodaje o aditivih za živila z oblikovanjem enotnega instrumenta za načela, postopke in dovoljenja;

- izboljšanje postopka za posodobitev seznama Skupnosti za odobrene aditive za živila.

- Mala in srednje velika podjetja v farmacevtski industriji [12] : vzpostavitev poenostavljenega zakonodajnega okvira za mikro, mala in srednje velika podjetij vključno z nižjimi prispevki, možnostmi za odlog plačila prispevkov in upravna ter zakonodajna pomoč ob predložitvi zahtevkov Evropski agenciji za zdravila.

- Plačilne storitve [13]: izdelava poenostavljenega zakonodajnega okvira za plačilne storitve za potrošnike in družbe. Predlog omogoča poenostavitev zakonodaje (nadomestitev treh direktiv in treh priporočil s skladnimi pravili), poenostavitev upravnih postopkov za javne organe (EU ali nacionalne) in za zasebne stranke. Predlog uvaja večjo preglednost ter jasnejše in nedvoumne zahteve po informacijah za uporabnike plačilnih storitev in potrošnike.

- Računovodska pravila [14]: sprememba veljavnih računovodskih pravil s podelitvijo večje svobode državam članicam, da izvzamejo družbe iz nekaterih zahtev za razkritje (z povečanjem mejnih vrednosti za takšno razkritje). To bo povzročilo upravno poenostavitev za manjše družbe.

- Strukturna statistika podjetij [15]: predlog poenostavlja izdelavo podatkov SSP z izbrisom 15 obveznih spremenljivk (v zvezi z raziskavami in razvojem, zaposlovanjem, energijo in finančnim najemom), s prestavitvijo spremenljivk iz letnega zbiranja podatkov na večletno in s črtanjem poljubnih spremenljivk. Poleg tega Eurostat razvija program za ponovno izdelavo statistike podjetij, da bi pomagal državam članicam z novimi metodami, ki bi lahko bistveno zmanjšale obremenitev poročevalskih enot npr. z intenzivnejšo uporabo upravnih podatkov in samodejnim elektronskim prenosom računov podjetij.

- Trg zračnih prevozov [16]: zaradi pregleda tako imenovanega tretjega svežnja liberalizacije zračnih prevozov in združitve 3 veljavnih uredb v novo uredbo, bo ta zakonodaja jasnejša. Zakonodaja posodablja in poenostavlja pravni okvir, zagotavlja usklajeno izvajanje v državah članicah in ugotavlja možna izkrivljanja in omejitve konkurence v nekaterih tržnih segmentih. To bo prispevalo k večji izbiri potrošnikov, cenejšim letalskim vozovnicam in večji konkurenčnosti.

1.1.2. Tekoče delo

Za leta 2006, 2007 in 2008 je zdaj potrjenih več pomembnih pobud za poenostavitev v zvezi s konkurenčnostjo, ki so predstavljene:

- Kmetijstvo: združitev 21 skupnih ureditev trga v enoten program za vzpostavitev poenostavljenega, horizontalnega pravnega okvira, ki bo zagotavljal enotna usklajena pravila na različnih področjih tržne politike, na primer intervencij, zasebnega skladiščenja, uvoznih tarifnih kvot, izvoznih nadomestil, varnostnih ukrepov, kmetijskih proizvodov, pravil o državni pomoči, komunikaciji in sporočanju podatkov.

- Okolje: pregled direktive o celovitem preprečevanju in nadzorovanju onesnaževanja (IPPC) in druge povezane zakonodaje o industrijskih emisijah za izboljšanje jasnosti in skladnosti (zlasti v zvezi s poročanjem) ter zahtev po poenostavitvi.

- Direktiva o gradbenih proizvodih za pojasnitev in zmanjšanje upravnih obremenitev, zlasti za MSP, z večjo prilagodljivostjo pri oblikovanju in uporabi tehničnih specifikacij, manj strogimi pravili za certificiranje ter odpravljanjem ovir za izvajanje, ki so do zdaj onemogočale vzpostavitev notranjega trga za gradbene proizvode.

- Statistika: razbremeniti statistično poročanje gospodarskih subjektov, zlasti MSP, ob upoštevanju tekočega dela za izboljšanje statističnega upravljanja Unije in končnega finančnega rezultata tekočih pilotnih projektov v zvezi z merjenjem in zmanjševanjem upravnega bremena.

- Označevanje hrane/krme: s posodobitvijo zakonodaje bodo postali jasnejši predpisi za označevanje, ki bodo potrošnikom omogočali, da na podlagi informacij sprejemajo varne, zdrave in trajnostne odločitve ter prispevajo h konkurenčnosti tržnega okolja, v katerem lahko izvajalci z označevanjem učinkovito prispevajo k prodaji svojih proizvodov.

- Varstvo potrošnikov : racionalizacija in poenostavitev celotnega pravnega reda Skupnosti glede varstva potrošnikov za odpravo mogočega neskladja, prekrivanj, ovir na notranjem trgu in izkrivljanja konkurence.

- Kozmetika: kozmetična direktiva je bila sprejeta pred 30 leti in je bila spremenjena več kot štiridesetkrat. Besedilo je treba preoblikovati tako, da bo bolj dosledno in jasnejše. S tem bo zmanjšan upravni strošek izvajanja direktive, obenem pa bo nespremenjena ostala sedanja ureditev v zvezi s postopno prepovedjo preskusov na živalih.

- Standardi za računovodsko in finančno poročanje: z združitvijo sedanjega sklopa uredb[17] z več kot 2 000 stranmi, v enotno, uporabnikom prijazno uredbo, zagotavljajo družbam EU sklop posodobljenih standardov za finančno poročanje.

- Ureditveni okvir za avtomobile: ko bo sprejet predlog za revizijo okvirne direktive o homologaciji motornih vozil, ki je v obravnavi, bo omogočal:

- nadomestitev direktiv ES s predpisi UN/ECE. Ta poenostavitev bo racionalizirala uredbe in odpravila odvečne zahteve. Poleg tega bo z ohranjanjem vodilnega položaja EU pri razvijanju mednarodnih standardov in omogočanjem industriji, da se hitreje prilagodi tehničnemu razvoju na mednarodni ravni, pomagala svetovni industriji, da odpravi netarifne trgovinske ovire;

- uvedbo potrebnih tehničnih predpisov za samotestiranje in virtualno testiranje v 25 direktivah ES in predpisih UN/ECE. Omogočal bo poenostavitev postopka homologacije in posodabljanje zakonodajnega okolja v skladu s tehničnim razvojem. Virtualno testiranje in samotestiranje bosta pospešila razvoj proizvodov in zmanjšala stroške industriji in potrošnikov. Poleg tega Komisija pripravlja splošno določbo v direktivi o homologaciji motornih vozil, kar bo omogočalo proizvajalcem, da delujejo kot preskusni laboratoriji, če je homologacijski organ potrdil, da so za to ustrezno usposobljeni in opremljeni.

- Dostop do cestnega prevoznega trga in do ponudnikov storitev na tem področju zaradi preoblikovanja štirih uredb in direktive so pravila, ki urejajo dostop do ponudnikov storitev in trga, vključno s cestnim prevozom blaga in potniškim prevozom, jasnejša, poenostavljena in lažje izvedljiva. Preoblikovanje mora omogočiti usklajeno uporabo in stroškovno učinkovito izvajanje predpisov tudi v nadnacionalnem okviru in tako omejiti izkrivljanje konkurence ter zaščititi pravico do ustanavljanja in izboljševanja kakovosti storitev ter varnosti v cestnem prometu.

- Konsolidacija uredb/direktiv o novem tehničnem pristopu [18] za trženje proizvodov v skladu z doslednimi opredelitvami, poenostavljenimi postopki certificiranja in poenostavljenim upravnim sodelovanjem za lažjo komercializacijo proizvodov in zaščito proizvajalcev pred neskladnimi izdelki.

1.1.3. Nove pobude za krepitev tekočega programa poenostavitve

Na podlagi tekočega programa, ki se je začel lani, je Komisija za obdobje 2006–2009 poenostavitev dopolnila s 43 novimi pobudami[19], da bi:

- spodbudila inovativnost in zmanjšala upravno breme, ki izhaja iz zakonodajnih zahtev;

- zmanjšala celotni obseg pravnega reda Skupnosti in spodbudila prehod na bolj prilagodljive zakonodajne pristope.

Predstavljene so nekatere glavne pobude:

- Poenostavitev predpisov v zvezi s spremembami zdravil po tem, ko so že bila izdana dovoljenja za promet z zdravili (tako imenovane uredbe o spremembah zdravil). Upravno vodenje teh predpisov zdaj vključuje več kot 60 % človeških virov in finančnih stroškov oddelkov družb, ki so pristojna za dovoljenja. V nekaterih primerih lahko to breme ovira inovativnost s tem, da prepreči začetek sprememb, ki so v korist pacientom in družbi. Postopki bodo poenostavljeni, tako da bodo uredbe o spremembah zdravil preprostejše, jasnejše in prožnejše ter ne bodo ogrožale javnega zdravja in zdravja živali.

- Zagotovitev medsebojnega priznavanja [20] blaga, ki ga usklajeni predpisi Skupnosti ne zajemajo. Komisija zdaj pripravlja zakonodajni predlog v zvezi z odpravo tehničnih ovir za prosti pretok blaga v EU (predlog za medsebojno priznavanje). Instrument bo po eni strani določil pravice in dolžnosti nacionalnih organov, po drugi pa družb, ki želijo v eni državi članici prodajati proizvode, ki se jih v drugi državi članici že zakonito izdeluje ali daje na trg.

- Razjasnitev opredelitve in obsega ocene varnosti novih vrst živil in racionalizacija postopka odobritve.

- Poenostavitev vodenja upravnih postopkov na področju kmetijstva z izvajanjem številnih tehničnih poenostavitev. Oblikovan je bil tekoči delovni načrt za spremembo pravnih določb, ki imajo neposredni vpliv na kmete ter druge gospodarske subjekte in nacionalne uprave. Spremembe zadevajo na primer obveznost kmetov, da dajo na voljo dokumente, obveznosti držav članic glede nadzora, pogoje za prejemanje podpore itd.

- Poenostavitev in izboljšanje skupne ribiške politike z izvajanjem pravnih in upravnih poenostavitev v skladu z akcijskim načrtom 2006–2008, ki ga je sprejela Komisija leta 2005[21]. Akcijski načrt zajema nekatere določbe uredb v zvezi z upravljanjem in nadzorom ribolovnih dejavnosti na primer spodbujanje razumljivosti zakonodajnega okvira in zmanjšanje upravnega bremena za zadevne ribiče in upravno osebje.

- Revizija zakonodajnega okvira za elektronska komunikacijska omrežja in storitve bo zmanjšala potrebe po predhodni uredbi in olajšala prilagodljivost in inovativnost v korist industrije in državljanov.

- Nadomestitev direktiv o tekstilu z eno samo uredbo za poenostavitev postopkov sprejemanja novih imen za vlakna. Poleg tega bodo v postopek standardizacije vnesene kvantitativne metode za merjenje vsebnosti vlaknin.

- Poenostavitev veljavne zakonodaje o igračah s pojasnitvijo osnovnih varnostnih zahtev in razvijanjem pogojev za boljši skupni pristop nacionalnih organov za tržni nadzor.

- Omejitev zakonodajnih aktov v zvezi z meroslovjem in gnojili na osnovno zahtevo z uporabo „novega pristopa“. Podrobne tehnične opise bodo nadomestili standardi.

- Revizija sistema Skupnosti za podeljevanje znaka za okolje z namenom:

- razviti družbam prijaznejši sistem, z vključevanjem zainteresiranih strani v postopek odločanja in potreb MSP;

- dodeljevati dela za razvoj meril zunanjim vzpostavljenim organom in tesno povezati znak za okolje z okolju prijaznimi javnimi naročili.

- Preoblikovanje Direktive o trženju razmnoževalnega materiala sadnih rastlin in sadnih rastlin, namenjenih za pridelavo sadja.

- Vključitev z delom povezanih kostno-mišičnih obolenj , v en sam zakonodajni akt, ki bi zajemal več sedanjih minimalnih varnostnih in zdravstvenih zahtev, kot so zahteve v zvezi z ročnim premeščanjem bremen ali delom s slikovnimi zasloni.

Vse službe Komisije bodo pregled svojega pravnega reda končale do leta 2009 in preverile ustreznost svojih instrumentov, izbire zakonodajnih tehnik in področja uporabe enega od postopkov za poenostavitev, določenih v strategiji za poenostavitev iz oktobra 2005. Temu bo po potrebi sledilo oblikovanje novih pobud za poenostavitev in posodobitev tekočega programa v prihodnosti.

1.2. Stanje – kodifikacija

Kodifikacija je ključni del postopka za boljšo pravno ureditev Evropske komisije. Kodifikacija je postopek, ki združuje določbe veljavnih aktov z vsemi poznejšimi spremembami v en sam zakonodajni akt in tako prispeva k zmanjšanju števila zakonodajnih aktov EU ter večji transparentnosti, razumljivosti in pravni jasnosti.

Tekoči program za kodifikacijo (v Prilogi 2) vključuje približno 500 aktov. Uspešno je bilo kodificiranih 52 aktov[22], ki so bili sprejeti in objavljeni v UL (38 aktov Komisije ter 14 aktov Evropskega parlamenta in Sveta). Poleg tega je 33 aktov v zakonodajni obravnavi, 8 aktov pa je zdaj v pisnem postopku. Evropska komisija je torej skupaj dokončala 85 aktov.

Za dosego cilja, in sicer za dokončanje programa za kodifikacijo do sredine leta 2008, so bili sprejeti ukrepi za pospešitev prevajanja preostanka izvirnikov v nove jezike EU. Zaostanek je rezultat zaostanka pri prevajanju besedil, ki se kodificirajo v teh jezikih.

Sprejeti je treba tudi ustrezne ukrepe za povečanje števila kodificiranih besedil, ki bodo na voljo v bolgarščini, romunščini, irščini in malteščini, tako da ima v primeru dokončanih zadevnih prevodov prednost kodifikacija aktov.

Poleg tega je pripravljen tudi program za sprejetje preostalih aktov, ki jih je treba kodificirati. Cilj tega je zagotoviti preglednost postopka in s tem zlasti spodbuditi nove minimalne spremembe aktov, ki so v postopku kodifikacije, ter tako utrditi zadevno zakonodajo in zmanjšati zaostanek. Ta program ostaja okviren, ker je dokončanje projekta kodifikacije odvisno od dostopnosti aktov, ki jih je treba kodificirati v vseh jezikih. To velja zlasti za bolgarščino in romunščino. Poleg tega je treba kodifikacijo prestaviti, če so predvidene nove spremembe teh aktov. Vrstni red aktov v programu se bo spreminjal glede na ta dejavnika.

Upoštevati je tudi treba, da je sprejetje kodificiranih aktov s strani zakonodajnega organa predmet pravil iz Medinstitucionalnega sporazuma o pospešeni metodi dela za uradno kodifikacijo z dne 20. decembra 1994.

2. DEJAVNIKI ZA USPEH

Zakonodajno okolje za evropske družbe in državljane je sestavljeno iz več ponavadi prepletenih plasti zakonov in predpisov, ki so oblikovani na različnih ravneh (mednarodni ravni[23], ravni Skupnosti, nacionalni, regionalni in lokalni ravni). Nihče od teh zakonodajalcev ne more sam odločilno izboljšati kakovosti te zakonodajne mreže. Za konkretno izboljšanje kakovosti celotnega zakonodajnega okvira je potrebno odločno, skladno in usklajeno prizadevanje zakonodajalcev na vseh ravneh.

2.1. Prizadevanja za poenostavitev na podlagi homogenega metodološkega ozadja

2.1.1. Posvetovanje z vsemi stranmi

Začetni program poenostavitve in posodobljeni tekoči program poenostavitve za obdobje 2006–2009 sta bila razvita na podlagi prispevkov zainteresiranih strani in držav članic. Njihove izkušnje so nepogrešljive pri uvajanju pomembnega programa za poenostavitev. Poglobljeno posvetovanje zainteresiranih strani, pregled vseh področij politike, naknadno ocenjevanje zakonodajnega akta in strokovni pregledi prispevajo k temu, da lahko oblikovalci politike lažje ugotovijo resnične težave na tem področju. Takšni postopki obenem prispevajo k temu, da se zainteresirane strani zavedajo odgovornost za predlagani ukrep.

V sporočilu o poenostavitvi iz oktobra 2005[24] je bilo objavljenih veliko posebnih pobud:

- Kot je napovedano v Sporočilu Komisije o poenostavitvi in boljši pravni ureditvi za skupno kmetijsko politiko, je bil akcijski načrt izdelan in predstavljen na konferenci z naslovom: Preprosta SKP za Evropo, izziv za vse, ki se je odvijala oktobra 2006. Akcijski načrt predstavlja 20 konkretnih projektov za tehnično poenostavitev (zmanjšanje bremena brez spreminjanja osnovne politike), ki se bodo izvajali do leta 2007. Akcijski načrt je začetek trajnega postopka poenostavitve. Zainteresirane strani in države članice so zato povabljene, da predstavijo nadaljnje predloge za poenostavitev.

- Komisija je leta 2005 sprejela akcijski načrt 2006–2008 za poenostavitev in izboljšanje skupne ribiške politike, evropske institucije pa so ga popolnoma podprle in se posvetovale z zainteresiranimi stranmi.

- Naslednje sporočilo o zmanjšanju obremenitve poročanja, poenostavitvi in določanju prednostnih nalog na področju statistike Skupnosti. To sporočilo določa strateški pristop za vnaprejšnje zmanjševanje statistične obremenitve družb zaradi poročanja s kombinacijo dveh elementov: poenostavitev zahtev po statističnih podatkih na izbranih prednostnih področjih in spodbujanje uporabe statističnih orodij in metod, ki bodo olajšale izpolnjevanje statističnih obveznosti. Komisija bo predlagala predvsem enosmerni sistem za Intrastat, program za preoblikovanje statistike podjetij, in dejavno izvajala poenostavitev evropskega sistema kmetijske statistike.

Poleg tega člen 138 Pogodbe določa posvetovanje evropskih socialnih partnerjev v zvezi s pobudami na področju socialne politike[25].

V nekaterih primerih je na podlagi posvetovalnega postopka Komisijo ponovno proučila svoje prvotne namene, kakor na primer v zvezi s pregledi prava družb in normativno ureditvijo avtorskih pravic, ki so vplivali na nastanek naslednjih pobud:

- V zvezi z družbenim pravom je Komisija pred koncem tega leta načrtovala izdajo celovite pobude, s katero bi ocenili upravne stroške, ki izhajajo iz direktiv o pravu družb, v kateri bi države članice skupaj z zainteresiranimi stranmi ugotovile možnosti za zmanjšanje teh stroškov. Rezultati te pobude bodo predstavljeni v sporočilu v drugi polovici leta 2007.

- Po pregledu avtorskih pravic je sledilo več dejavnosti, vključno z oceno direktive o avtorskih pravicah iz leta 2001, pri katerih bi lahko med drugim bile ugotovljene izjeme pri izvajanju te direktive. Rezultati te ocene bi vili lahko predvidoma znani do poletja 2007.

2.1.2. Področna analiza

V prejšnjem sporočilu je Komisija za boljšo oceno učinka zakonodajnega okvira na področno konkurenčnost opredelila potrebo po področnem pristopu k poenostavitvi.

Na področju gradbenih proizvodov se prizadevanja na primer nadaljujejo. Vključena sta splošna analiza teh dejavnikov, ki vplivajo na konkurenčnost zainteresiranih strani v sektorju gradbeništva in tudi posebni ukrep za poenostavitev direktive o gradbenih proizvodih (Direktiva 89/106/EGS). Posvetovanje zainteresiranih strani se nadaljuje, prispevke pa pregleduje Komisija.

Na področju motornih vozil je skupina na visoki ravni „CARS 21“ pregledala glavna področja politike, ki vplivajo na konkurenčnost evropske avtomobilske industrije, in predložila več priporočil

Obenem se v kontekstu novih forumov, ki so se izoblikovali po sporočilu o industrijski politiki[26], zdaj pregleduje izvajanje načel za boljšo pravno ureditev. Področne dejavnosti pregledovanja so se začele v skupinah, kot sta delovna skupina za konkurenčnost IKT in politični dialog na področju strojništva.

2.1.3. Tekoča prizadevanja v zvezi z upravno obremenitvijo

Kot odgovor na sklepe Evropskega sveta iz junija 2006 in v okviru konkurenčnosti ponovno sproženega programa lizbonske strategije bo Komisija pripravila glavni akcijski načrt ter tako ocenila in zmanjšala upravno obremenitev, ki jo nalaga veljavna zakonodaja v EU. Načrt bo temeljil na predhodnih izkušnjah štirih držav članice (Velike Britanije, Nizozemske, Danske in Češke), ki so po izvedbi obširnih osnovnih merjenj že določile cilje za zmanjšanje. Delovni dokument Komisije o merjenju upravnih stroškov in zmanjševanju upravnih bremen v Evropski uniji[27] predstavlja rezultate pilotnega projekta o upravni obremenitvi, ki je bil izveden letos in temelji na takšnih predhodnih izkušnjah. Srednjeročno lahko ta postopek zakonodajalcem EU in državam članicam omogoči, da na podlagi količinskih podatkov opredelijo prednostna področja, na katerih je možna dodatna poenostavitev.

Tukaj je treba omeniti, da se na področju kmetijstva izvaja študija o upravni obremenitvi za kmete. Študija zadeva izvajanje reforme SKP 2003 in njene poznejše spremembe. Prvi rezultati bodo na voljo leta 2007.

2.2. Tesno sodelovanje med institucijami EU

Komisija mora predložiti zelo kakovostne zakonodajne predloge, Svet in Parlament pa sta odgovorna za to, da prizadevanja za poenostavitev uresničita.

22 predlogov za poenostavitev, ki jih je sprejela Komisija, zdaj obravnavata Svet in Evropski parlament (Priloga 3). Od teh pobud za poenostavitev jih zakonodajalec sedem, ki so ostali iz predhodnih programov za poenostavitev iz leta 2003[28], še vedno obravnava. Seznam nerešenih predlogov je predstavljen v Prilogi 3 in vključuje poslovno zelo pomembna besedila kot so šesta direktiva o DDV, posodobitev Carinskega zakonika, revizija zakonodaje o ravnanju z odpadki, poenostavitev homologacije motornih vozil, usmeritev strukturne statistike podjetij in razveljavitev zahtev za predpakiranje. Sprejetje računovodske direktive[29], ki vsebuje izjeme za MSP, in nedavna odobritev skupnega stališča o predpakiranju s strani Sveta kažeta na skupno zavezanost instituciji k poenostavitvi zakonodajnega okvira.

Komisija je Evropski parlament pozvala, naj se odzove na njeno strategijo za poenostavitev iz oktobra 2005, Evropski parlament pa je odgovor predložil aprila 2006. Stališča, ki so jih zavzeli parlamentarni odbori v zvezi z večletnim programom za poenostavitev, kažejo bistveno usklajenost s prednostnimi nalogami Komisije glede tega, kaj je treba poenostaviti.

Maja 2006 je Evropski parlament sprejel veliko poročil, ki zajemajo različne vidike boljše pravne ureditve, vključno s poenostavitvijo[30]. Evropski parlament razen kodifikacije in preoblikovanja[31] med drugim predlaga določitev nove vrste instrumenta za določene vrste predlogov za poenostavitev, ki bi jim delovne metode in hitrejše sprejemanje lahko koristili.

Medinstitucionalni sporazum o boljši pripravi zakonodaje[32], ki velja od decembra 2003, je vzpostavil platformo za razvoj sodelovanja med temi tremi institucijami. Strokovna skupina na visoki ravni, ki je odgovorna za spremljanje izvajanja Medinstitucionalnega sporazuma, redno preverja napredek, kot so usklajevanje in načrtovanje programov zakonodajnega dela, kakovost zakonodaje (zlasti presojo vpliva), prenos in izvajanje zakonodaje Skupnosti ter poenostavitve. Določitev konkretnih ukrepov za opredelitev prednosti za poenostavitev in pospešitev zakonodajnega postopka s strani sozakonodajalcev se je izkazala za zapleteno.

Sporazum o medinstitucionalnem skupnem pristopu k presoji vplivov[33], ki so ga institucije sklenile decembra 2005, dokazuje, da se lahko v okviru Medinstitucionalnega sporazuma o boljši pripravi zakonodaje ob politični volji dosežejo konkretne izboljšave medinstitucionalnega izvajanja boljše pravne ureditve. Institucije se morajo dogovoriti, da bodo ob pregledu skupnega pristopa za leto 2008 pobudam držav članic na področju policije in pravosodnega sodelovanja v kazenskih zadevah dodale ocene učinkov.

Komisija je objavila, da namerava z izboljšanjem načrtovanja programov in s preglednostjo pobud za poenostavitev poenostaviti medinstitucionalni postopek odločanja z:

- vključevanjem predlogov za poenostavitev v letni zakonodajni in delovni program Komisije. To je že doseženo v okviru Zakonodajnega in delovnega programa za leto 2007;

- bolje izkoriščenim obrazložitvenim memorandumom za boljšo razlago ciljev za poenostavitev, za kar si prizadevajo predlogi. V predlogih za poenostavitev, ki so predmet presoje vplivov, si bo Komisija prizadevala oceniti tudi učinke poenostavitev, vključno z upravnim bremenom;

- določitvami nekaterih pilotnih primerov za predloge za poenostavitev in preverjanjem možnosti za ustanovitev izboljšanih medinstitucionalnih delovnih metod za poenostavitev.

2.3. Večja uporaba koregulacije in samoregulacije

Koregulacija in samoregulacija sta primera orodij, ki se lahko uporabljajo v nekaterih okoliščinah in se z omejenim posredovanjem zakonodajalca dosežejo politični cilji.

Evropski organi za standardizacijo in Komisija na primer zdaj sodelujejo pri pripravi predlogov novih pobud glede standardov v sektorju storitev s posebnim poudarkom na notranjem trgu. Standardi omogočajo uporabnikom, da neovirano primerjajo proizvode in cene, kar pozitivno vpliva na konkurenčnost in trgovino s storitvami v EU. Po obširnih posvetovanjih bosta opredelitev akcijskega načrta za standardizacijo, katerega cilj je spodbujanje industrijske konkurenčnosti, in odobritev sklepa za financiranje Skupnosti okrepila dejavnosti standardizacije.

Na področju samoregulacije imajo socialni partnerji na evropski ravni posebno vlogo, ker imajo možnost sklepanja sporazumov[34], ki postanejo obvezujoči z zakonodajnim predlogom ali pa se izvajajo avtonomno. Samoregulacija je v skladu s politiko Komisije za spodbujanje družbene odgovornosti podjetij. Rezultat prostovoljnih pobud pod okriljem Evropske zveze za spodbujanje družbene odgovornosti podjetij bi verjetno lahko bili novi sporazumi o samoregulaciji. Takšne pobude, ki jih sprejemajo družbe EU v tesnem sodelovanju z ustreznimi zainteresiranimi stranmi, morajo prav tako prispevati k veliko širšemu prevzemanju praks za spodbujanje družbene odgovornosti v Evropi in na svetovni ravni. Za boljše obveščanje zasebnih strank, ki želijo vzpostaviti ali izboljšati sistem samoregulacije, in tudi zakonodajalcev, ki so odgovorni za načrtovanje samoregulacije, sta Evropski socialno-ekonomski odbor (EESO) in Evropska komisija oblikovala podatkovno bazo s skoraj 100 sistemi EU. V bazi, ki naj bi bila na voljo novembra 2006, so med drugim podrobni podatki v zvezi z vrstami težav, ki so povzročile razvoj sistemov samoregulacije in koregulacije, njihovih ciljev in organizacijskega okvira. Tako bo določanje dobrih in neustreznih praks precej lažje.

2.4. Poenostavitev na nacionalni ravni

2.4.1. Tudi zakonodajo na nacionalni ravni je treba poenostaviti v skladu s poenostavljeno zakonodajo EU

Države članice bodo morale v celoti podpreti izvajanje poenostavitve EU in tako zagotoviti, da se prednosti poenostavljenega zakonodajnega okolja Skupnosti ne izničijo z novimi nacionalni predpisi ali tehničnimi ovirami. Čeprav vse več držav članic podpira poenostavitev, pa so še vedno možnosti za izboljšave. To ponazarja ohranjanje statističnih zahtev na nacionalni ravni, čeprav so bili predpisi na ravni Skupnosti ustrezno poenostavljeni.

Zato je Komisija v nekaterih nedavnih predlogih za razveljavitev predpisov uvedla določbo za medsebojno priznavanje, da bi s tem zagotovila, da ti novi predlogi za trgovino ne predstavljajo novih ovir. Cilj predloga za predpakiranje je na primer preprečevanje ovir v trgovini zaradi izpolnjevanja nacionalnih zahtev.

Podobno velja za ukrep za razveljavitev zakonodaje EU v zvezi s klasifikacijo neobdelanega lesa, ki bi bil učinkovit, če bi ga priznavali po vsej EU. Nacionalne zakone, ki se nanašajo na zadevno direktivo, je treba temu primerno spremeniti, države članice pa morajo zagotoviti, da se tehnične spremembe izvajajo hitro in jasno.

Prepogosto za evropske družbe, ki želijo svojo dejavnost opravljati v drugi državi članici, veljajo upravni postopki in se izvaja upravni nadzor. Po potrebi k poenostavitvi opravljanja dejavnosti na notranjem trgu prispevajo pravila Pogodbe. Komisija pripomore k zmanjšanju takšnih obremenitev z uveljavljanjem člena 28 Pogodbe ES o prostem pretoku blaga, zlasti s spremljanjem nacionalnega osnutka zakonodaje.

V letu 2007 bo Komisija obravnavala povezovanje obrambnega trga z namenom zmanjšanja pretirane upravne obremenitve, ki ovira konkurenčnost industrije EU na tem področju. Dejansko so letni stroški za industrije in uprave, povezani z dovoljenji za uvoz/izvoz vojaškega blaga znotraj Skupnosti, ocenjeni na 238,9 milijona EUR. Dejansko so zahtevki za ta dovoljenja skoraj vedno odobreni[35].

2.4.2. Izogibanje nepotrebnim zahtevam in postopkom (gold-plating)

Preverjanje izvajanja nacionalnih predpisov, v katere so prenesene direktive Skupnosti, prinaša številne primere glede tehničnih zahtev, obveznosti označevanja, rokov, postopkov odobritve in drugih upravnih zahtev, ki jih poleg že sprejetih predpisov na ravni Skupnosti dodatno sprejmejo nacionalni zakonodajalci Skupnosti (nepotrebne zahteve in postopki). Zakonodajno okolje za družbe EU se lahko izboljša zgolj tako, da se pobude, ki so sprejete na ravni EU, dopolnijo z ustreznimi ukrepi na nacionalni ravni.

To potrjujejo tudi drugi viri, na primer nedavna študija[36], katere naročnik je bila nacionalna zveza MSP. Ta študija kaže na to, da lahko povečevanje prvotnega področja uporabe direktiv pri prenosu ukrepov resno ovira produktivnost ter finančno slabi mala podjetja, ki so ključnega pomena za zagotavljanje blaginje in ustvarjanje delovnih mest. Poleg tega so lahko nacionalna družbe zaradi nepotrebnih zahtev ali postopkov družbe v primerjavi z družbami v drugih državah v podrejenem konkurenčnem položaju.

To krepi namen Komisije, ki je bil objavljen v sporočilu oktobra 2005, da je možnost za boljšo poenostavitev bolje izkoriščena ob uporabi uredb in ne direktiv, kadar je to primerno. Nadomestitev Direktive 91/414/EGS o dajanju fitofarmacevtskih sredstev v promet z uredbo je konkreten primer premika zakonodajne prakse.

2.4.3. Programi nacionalnih reform

Zakonodajne zahteve in izvajanje ukrepov se začenjajo zlasti na nacionalni ravni.

Programi nacionalnih reform so del nove upravne strukture strategije za rast in delovna mesta (lizbonska strategija) in določajo politiko gospodarskih reform na nacionalni ravni na podlagi smernic Skupnosti. Zato so ti v EU ključnega pomena pri ustvarjanju ugodnejših pogojev za družbe. Vse države članice so se odzvale na smernice o boljši pravni ureditvi in so v programe nacionalnih reform vključile ukrepe za spodbujanje boljše pravne ureditve.

Do sedaj je v okviru teh programov nacionalnih reform devet držav članic objavilo programe za poenostavitev, ki so različno zastavljeni. Vsekakor je ključno, da se program za poenostavitev EU dopolnjuje z napredkom poenostavitve v vseh državah članicah na vseh zakonodajnih ravneh. Obvestilo Odboru za ekonomsko politiko „Spodbujanje boljše pravne ureditve“[37], ki ga je pripravila Evropska komisija, in poročilo o konkurenčnosti za leto 2006, vsebujejo glavne sklepne ugotovitve v zvezi z izvajanjem boljše pravne ureditve na nacionalni ravni in zelo podroben opis napredka, doseženega na tem področju.

Primeri nacionalnih pobud so:

- Zmanjšanje upravnih stroškov: 17 držav članic se zaveda potrebe po analiziranju upravnih stroškov, ki so naloženi družbam in so uvedle ustrezne meritve. Nekatere države so opredelile določene količinske cilje za zmanjšanje upravnih stroškov (npr. 20 ali 25 % do leta 2010). Pobude za zmanjševanje stroškov so med drugim na primer e-uprave, sistemi „vse na enem mestu“ (one stop-shops )[38] ali osrednji uradi za registracijo, poenostavitev davčne zakonodaje, poenostavitev upravnih postopkov, ki so povezani z zaposlovanjem in samozaposlovanjem ali medvladnimi pobudami;

- E-uprave in rešitve IKT za zmanjšanje birokracije v javni upravi: vzpostavitev portalov, kjer bodo dostopni zakonodaja in obrazci (prošnje, orodja za poročanje itn.), večja širokopasovna dostopnost;

- Pregled zakonodaje: za zagotovitev, da so cilji še vedno veljavni – poenostavitev delovnega prava, razširjanje dobrih zakonodajnih praks na vseh upravnih ravneh, analiza stroškov in koristi zakonodaje, vzpostavitev foruma za poslovne predpise, na katerem lahko zainteresirane strani proučijo upravne stroške, ki so naložene družbam, prednostna načela dobre pravne ureditve, vključno z načeli nujnosti, sorazmernosti, subsidiarnosti, transparentnosti, odgovornosti, dostopnosti in preprostosti;

- Poenostavitev davčnih obveznosti, uprave ali poročanja: zlasti sistema „vse na enem mestu“ za družbe, MSP in državljane, reforme davkov na dobiček in premoženje podjetij;

- Poenostavitev obveznosti DDV, na primer z odstranitvijo davčnih ovir pri opravljanju čezmejnih poslovnih dejavnostih z uvedbo predpisov, ki dovoljujejo davčno olajšavo za prispevke v pokojninske sisteme v državah članicah EU, v korist priseljencem in čezmejnim ponudnikom storitev;

- Doslednejše izvajanje zakonodaje za notranji trg, da se čim bolj izkoristijo prednosti;

- MSP: boljši dostop do finančnih sredstev, zmanjšanje zahtev za poročanje, oblikovanje spletno zasnovane agencije za ustanavljanje podjetij;

- Enotni datumi začetka veljavnosti[39].

Izmenjava najboljših praks med državami članicami in medsebojni pregledi so ključni za izboljšanje zakonodajnega okolja. Komisija ta prizadevanja podpira, in sicer s skupino na visoki ravni za boljšo pravno ureditev in z lizbonskim procesom.

Države članice in regije je treba spodbuditi k sodelovanju pri razvoju dobrih praks, na primer s pobudo BEST[40].

3. SKLEPNA UGOTOVITEV

Strategija za poenostavitev, ki je jedro pobude za boljšo pravno ureditev, že kaže prve rezultate.

Evropska komisija je odločena, da naredi korak naprej in izpolni svoje obveznosti ter z dopolnjenim in drzno zastavljenim tekočim programom prispeva k učinkovitemu zakonodajnemu okolju.

Za dosego skupnega cilja si morata Svet in Parlament še bolj prizadevati za dokončno uresničitev poenostavitve.

Države članice morajo prav tako opraviti svoj del naloge, in sicer z izmenjavo najboljših praks in izvedbo programov za poenostavitev.

Poenostavitev vključuje veliko različnih instrumentov vključno z razveljavitvijo, kodifikacijo, preoblikovanjem ali spremembo zakonodajnega pristopa. Opredelitev kodifikacije je v tem dokumentu predstavljena pod točko 1.2. Stanje – kodifikacija. Preoblikovanje je postopek, pri katerem nov pravno zavezujoč akt, ki razveljavi akte, ki jih nadomesti, po eni strani združi spremembe vsebine zakonodaje in po drugi strani kodifikacijo tistega dela, ki ni spremenjen.

[7] Primeri zaostanka pri izvajanju strategije za poenostavitev so: (a) Prvotno načrtovana razveljavitev zakonodaje o računalniških sistemih rezervacij v letalskem sektorju se zdaj pregleduje: Odloži se kakršno koli ukrepanje, saj so glede na odzive obeh zainteresiranih strani in Evropskega parlamenta potrebne dodatne analize. Da bi bolje ocenila vse možnosti, vključno z razveljavitvijo ali delno liberalizacijo veljavne uredbe, in da bi se posvetovala z zainteresiranimi stranmi, je Komisija popolnoma v skladu z načeli za boljšo ureditev sklenila izdati razširjeno oceno učinka. (b) Zaradi nedavnih dogodkov na področju energije in posledične razprave o varnosti oskrbe z energijo je Komisija načrtovani pregled zakonodaje zalog nafte predvidoma preložila na leto 2008. Prihodnja politika Komisije na tem področju bo zlasti odvisna od rezultata posvetovanja o zeleni knjigi o energetski politiki, ki jo je predložila Komisija marca 2006.

[40] Delovna skupina za poenostavitev poslovnega okolja (BEST) je bila ustanovljena leta 1997: ob vključevanju predstavnikov iz poslovne skupnosti in javnih organov v državah članicah je bila naloga delovne skupine BEST pripraviti neodvisno poročilo o načinih za izboljšanje zakonodaje in odpravi nepotrebnih ovir za razvoj evropskih podjetij, zlasti malih in srednje velikih podjetij (MSP). Skupina strokovnjakov BEST je poudarila pobude za najboljšo prakse (spodbujanje sistemov „vse na enem mestu“, predpisi, usmerjeni v obravnavo tveganja), ki se uporabljajo v nekaterih državah, da bi se druge države lahko imele s pridom uporabile njihove izkušnje. Cilj predpisov, usmerjenih v obravnavo tveganja, je usmeriti prizadevanja predpisov (in stroškov, ki jih imajo družbe) v tiste dejavnosti, ki so največje tveganje za zdravje ali okolje.
