[pic] | KOMISIA EURÓPSKYCH SPOLOČENSTIEV | Brusel, 27.9.2005 KOM(2005) 462 v konečnom znení OZNÁMENIE KOMISIE RADE A EURÓPSKEMU PARLAMENTU Výsledok skríningu návrhov právnych predpisov v legislatívnom procese OZNÁMENIE KOMISIE RADE A EURÓPSKEMU PARLAMENTU Výsledok skríningu návrhov právnych predpisov v legislatívnom procese V súlade s vyhlásením v oznámení zo 16. marca 2005 „Lepšia právna úprava rastu a zamestnanosti v Európskej únii“[1] sa Komisia rozhodla postupne zmeniť spôsob, ktorým sa prostredníctvom kvalitnej legislatívy v Európe usiluje zabezpečiť presadzovanie cieľov partnerstva pre rast a zamestnanosť. Právne prostredie v Európskej únii musí byť na čo najvyššej možnej úrovni, aby sa zvýšila európska konkurencieschopnosť. Na dosiahnutie tohto cieľa je potrebné v prípade potreby zjednodušiť a aktualizovať „acquis communautaire“, teda súčasný súbor právnych predpisov. Na tento účel sa počíta so súborom opatrení, medzi inými predovšetkým so spustením novej etapy programu pre zjednodušenie v októbri 2005. Na základe rozhodnutia Komisie sa do tvorby politiky musí integrovať lepšia právna úprava, ktorú je potrebné presadzovať spolu s posilňovaním konkurencieschopnosti aj prostredníctvom nových legislatívnych návrhov predkladaných Komisiou. Po praktickej stránke sa to zabezpečuje predovšetkým na základe požiadavky, podľa ktorej sa nové legislatívne iniciatívy posudzujú z hľadiska ich vplyvu, ako bolo vyhlásené v legislatívnom a pracovnom programe Komisie na rok 2005, vo vzťahu ku ktorému sa nedávno prijali podrobnejšie usmernenia[2]. V súvislosti s návrhmi, ktoré Komisia predložila v minulosti a ktoré sú v legislatívnom procese, uviedla Komisia v marcovom oznámení svoj zámer „uskutočniť skríning návrhov, ktoré sú v legislatívnom procese v Rade alebo Parlamente z hľadiska ich všeobecného významu, ich vplyvu na konkurencieschopnosť a iné účinky“. Ciele, postup a výsledky takého skríningu, ktorý je prvý svojho druhu, sú obsiahnuté v tomto oznámení. 1. Ciele skríningu návrhov v legislatívnom procese Cieľom tohto skríningu je poskytnúť Komisii možnosť zabezpečiť, aby všetky návrhy v legislatívnom procese boli v plnom rozsahu v súlade s politickými prioritami Komisie a preveriť, či je v dôsledku zmenených okolností odôvodnené preskúmať pôvodne uplatňovaný počiatočný prístup. Ak sa zistilo, že preskúmanie je potrebné, v rámci skríningu sa zároveň identifikovali vhodné opatrenia, ktoré sa majú prijať, ako úprava, nahradenie alebo stiahnutie návrhov v legislatívnom procese a zlepšenie posudzovania ich vplyvov. Presnejšie povedané, skríning je zameraný na preverenie návrhov v legislatívnom procese z troch hľadísk: V prvom rade sa návrhy v legislatívnom procese preskúmavajú z hľadiska ich súladu s lisabonskými cieľmi EÚ, a to predovšetkým s cieľom zameraným na podporu konkurencieschopnosti. Pri vyhodnocovaní návrhov z tohto hľadiska sa používajú kritériá uvedené v „skúške konkurencieschopnosti“, ktorá je súčasťou nedávno revidovaných usmernení o posudzovaní vplyvov[3]. V druhom rade sa v prípade návrhov v legislatívnom procese kontroluje, či nedochádza k podstatným prieťahom v legislatívnom procese pretrvávajúcim významné časové obdobie. V takýchto prípadoch sa zároveň skúmajú dôvody pomalého napredovania a možnosti riešenia takej situácie. V treťom rade sa skúma, či sú návrhy v legislatívnom procese v súlade so súčasnými požiadavkami na lepšiu právnu úpravu, predovšetkým v súvislosti s vhodným posudzovaním vplyvov. Týmto kritériom sú dotknuté najmä tie návrhy, ktoré boli predložené v čase, keď posudzovanie vplyvov nebolo formálnou požiadavkou. 2. Postup skríningu V čase spustenia skríningu v apríli 2005 bolo v legislatívnom procese celkovo 489[4] návrhov. Skríning, ktorého rozsah bol vymedzený v marcovom oznámení, sa výslovne vzťahuje len na návrhy v legislatívnom procese, ktoré boli predložené pred 1. januárom 2004. Ide o 183 návrhov. Na základe starostlivého posúdenia týchto návrhov sa vyčlenilo okolo 100 z nich, ktoré predstavujú skutočne nové legislatívne iniciatívy, a tieto boli ďalej hodnotené z hľadiska možných nepriaznivých účinkov na konkurencieschopnosť a širších hospodárskych účinkov. Ostatné návrhy by podľa predpokladu mali mať len obmedzený alebo by nemali mať žiadny vplyv na konkurencieschopnosť. Ide hlavne o návrhy vyplývajúce z medzinárodných záväzkov alebo návrhy, prostredníctvom ktorých sa „acquis“ prispôsobovalo vedeckému a technickému pokroku. Niektoré z týchto návrhov takisto priamo prispievajú k „lepšej právnej úprave“ tým, že kodifikujú alebo zjednodušujú acquis. 3. Výsledky skríningu V nadväznosti na podrobnú analýzu doteraz neprijatých návrhov plánuje Komisia dva rozsiahle druhy činností: 1) Stiahnutie návrhov. Komisia má v úmysle stiahnuť celkovo 68 návrhov. Dospelo sa k záveru, že tieto návrhy nie sú v súlade s lisabonskými cieľmi či zásadami lepšej právnej úpravy, v ich legislatívnom procese sa dostatočne nenapreduje alebo tieto návrhy už naďalej nie sú aktuálne[5] (napr. výsledky sa už dosiahli alebo sa dosiahnu inými prostriedkami). V prípade niektorých návrhov sa môže tento postup prehodnotiť vzhľadom na ďalšiu analýzu ich vplyvov. V niektorých prípadoch má Komisia v úmysle opätovne zvážiť potrebu legislatívnych zásahov v závislosti od výsledkov komplexného posudzovania vplyvov. 2) Ponechanie návrhov v legislatívnom procese s tým, že legislatívnemu orgánu sa na účely ich posúdenia predloží hospodárska analýza[6]. Týka sa to 5 návrhov, o ktorých je Komisia presvedčená, že sú aj naďalej dôležité, ale dodatočné predloženie analýzy o ich vplyve by malo uľahčiť rozhodovanie legislatívneho orgánu. V dôsledku skríningu uskutočňovaného Komisiou sa tak vykonajú určité zásahy do celkove 73 návrhov v legislatívnom procese. Týka sa to návrhov, ktoré nie sú v úplnom súlade s cieľmi zabezpečovania konkurencieschopnosti, návrhov, na účely posúdenia ktorých zákonodarca potrebuje podrobnejšiu hospodársku analýzu, ako aj tých návrhov, ktorých legislatívny proces nenapreduje dostatočne, alebo ktoré už nie sú aktuálne. Konkrétne sa stiahnutie týka 31 %[7] všetkých návrhov v legislatívnom procese, ktoré boli predložené pred 1. januárom 2004. Všetky zásahy vrátane vyčlenenia návrhov na podrobnejšiu hospodársku analýzu sa v skutočnosti dotýkajú 33 %[8] takých návrhov v legislatívnom procese. Okrem toho sa na základe výsledkov skríningu vymedzili dva návrhy, ktoré nespadajú bezvýhradne do žiadnej z uvedených kategórií. Po prvé, v súvislosti s návrhom smernice Rady o minimálnych zdravotných a bezpečnostných požiadavkách týkajúcich sa vystavenia pracovníkov rizikám vyplývajúcim z fyzikálnych faktorov (optické žiarenie) č. 1992/0449/COD dospela Komisia na základe skríningu k záveru, že časti týkajúce sa vystavenia pracovníkov prírodnému optickému žiareniu by sa mali vypustiť, čo je zároveň v súlade s návrhom Európskeho parlamentu. Po druhé, pokiaľ ide o návrh týkajúci sa dočasných pracovníkov (2002/0072/COD), Komisia si vyhradzuje právo prehodnotiť tento návrh v súvislosti s budúcimi rokovaniami o iných návrhoch. Príloha k tomuto oznámeniu obsahuje zhrnutie situácie a podrobnosti o dotknutých návrhoch. Záver Tento skríning návrhov v legislatívnom procese je vôbec prvým komplexným skríningom podniknutým zo strany Komisie. Jeho prostredníctvom sa potvrdzuje záväzok Európskej Komisie vo vzťahu k partnerstvu pre rast a zamestnanosť a jej záväzok zabezpečiť, aby zásady lepšej právnej úpravy boli v praxi dôkladne implementované. Cieľom činností vyplývajúcich zo skríningu, t. j. plánovaných zásahov do návrhov v legislatívnom procese podľa prílohy, je dosiahnuť pozitívne výsledky v rámci dosahovania lisabonských cieľov prostredníctvom podpory konkurencieschopnosti, ako aj v rámci rozvoja lepšieho právneho prostredia a v súvislosti s odstraňovaním návrhov, pri ktorých nie je reálna šanca na ich prijatie alebo ktoré už nie sú aktuálne. Stiahnutie návrhov z legislatívneho procesu sa v niektorých prípadoch uskutoční v rámci celkovej revízie politík alebo k tomu dôjde v úmysle prehodnotiť návrhy vzhľadom na nové prvky politík a komplexné posudzovanie vplyvov. V súlade s povinnosťami podľa Rámcovej dohody o vzťahoch medzi Európskym parlamentom a Komisiou (odsek 32) predkladá Komisia pred stiahnutím svojich návrhov Parlamentu a Rade predbežné oznámenie. [6] Komisia sa ročne zaoberá okolo 200 až 250 návrhmi vyplývajúcimi z medzinárodných záväzkov EÚ, z potreby aktualizovať „acquis communautaire“ a(alebo) dodržiavať záväzky voči zákonodarcovi. [7] Komisia pravidelne sťahuje návrhy, čím sa znižuje počet návrhov v legislatívnom procese. V roku 1997 bolo stiahnutých 34 návrhov, 58 návrhov bolo stiahnutých v roku 1999, 108 návrhov v roku 2001 a 102 návrhov v roku 2004. [8] Fluorované plyny, preprava odpadu, podpis dohovoru o leteckých mobilných zariadeniach, DPH cestovných kancelárií a administratívna spolupráca v oblasti DPH, efektívnosť a služby v oblasti konečného využívania energie.
