Resultaat van de screening van wetgevingsvoorstellen die bij de wetgever hangende zijn

Zoals aangekondigd in haar mededeling van 16 maart 2005 over “Betere regelgeving met het oog op economische groei en meer banen in de Europese Unie”[1], heeft de Commissie besloten een stappenplan uit te voeren om ervoor te zorgen dat dankzij de kwaliteit van de wetgeving in Europa de doelstellingen van het partnerschap voor groei en werkgelegenheid kunnen worden verwezenlijkt.

Om het Europese concurrentievermogen te versterken, moet de kwaliteit van het regelgevingskader in de Europese Unie van het hoogste niveau zijn. Het communautaire acquis , d.w.z. de reeds bestaande wetgeving, moet derhalve waar nodig worden vereenvoudigd en bijgewerkt; daarvoor is een aantal maatregelen gepland, waaronder met name een nieuwe fase van het vereenvoudigingsprogramma vanaf oktober 2005.

De Commissie heeft ook besloten dat betere regelgeving al bij het uitstippelen van beleid moet worden geïntegreerd en dat de door haar ingediende nieuwe wetgevingsvoorstellen op kwaliteitsverbetering van de regelgeving en versterking van het concurrentievermogen moeten zijn gericht. Concreet betekent dit dat nieuwe wetgevingsvoorstellen thans aan een effectbeoordeling worden onderworpen, zoals aangekondigd door de Commissie in haar wetgevings- en werkprogramma voor 2005, waarvoor onlangs uitgebreide en gedetailleerde richtsnoeren zijn vastgesteld[2].

Wat de voorstellen betreft die door de Commissie in het verleden zijn ingediend en die nog in het wetgevingsproces hangende zijn, is de Commissie volgens de mededeling van maart jongstleden van plan om de bij de Raad en/of het Parlement ingediende voorstellen op hun algemene relevantie, hun invloed op het concurrentievermogen en andere effecten te screenen. De doelstellingen, methode en resultaten van deze eerste screening worden in deze mededeling toegelicht.

1. Doel van de screening van hangende voorstellen

Doel van de screening voor de Commissie was erop te kunnen toezien dat alle ingediende wetgevingsvoorstellen volledig aansluiten bij haar politieke prioriteiten en te kunnen nagaan of door de gewijzigde omstandigheden misschien de oorspronkelijke aanpak moet worden herzien.

Waar herziening noodzakelijk werd geacht, heeft de screening ook uitgewezen welke maatregelen moesten worden genomen, zoals bijvoorbeeld wijziging, vervanging of intrekking van ingediende voorstellen en betere effectbeoordeling.

De screening was specifiek bedoeld om hangende voorstellen te toetsen op de volgende drie criteria:

Ten eerste op hun samenhang met de doelstellingen van Lissabon, waaronder met name de versterking van het concurrentievermogen van de EU. De criteria die zijn gehanteerd om voorstellen hierop te beoordelen, waren die van de ‘concurrentievermogenstest’ die deel uitmaakt van de onlangs herziene richtsnoeren voor effectbeoordeling[3].

Ten tweede op het al geruime tijd ontbreken van substantiële vooruitgang in het wetgevingsproces. In dat geval is ook gezocht naar de oorzaken daarvan en naar mogelijkheden om het proces weer op gang te brengen.

Ten derde op de naleving van de voorschriften inzake betere regelgeving, vooral wat de nodige effectbeoordelingen betreft. Dit geldt vooral voor voorstellen die zijn ingediend toen effectbeoordelingen nog niet verplicht waren.

2. De screening zelf

Bij het begin van de screening in april 2005 waren er in totaal 489 voorstellen in behandeling[4]. De in de mededeling van maart aangekondigde screening was uitdrukkelijk beperkt tot de 183 voorstellen die vóór 1 januari 2004 waren ingediend.

Die voorstellen zijn dan grondig doorgelicht en daaruit is gebleken dat zowat 100 ervan volledig nieuwe wetgevingsvoorstellen waren die nog op eventuele nadelige gevolgen voor het concurrentievermogen en op algemene economische effecten werden onderzocht. De overige voorstellen werden geacht weinig of geen effect te sorteren op het concurrentievermogen, omdat ze doorgaans voortvloeien uit internationale verplichtingen of aanpassingen behelzen aan de wetenschappelijke en technische vooruitgang. Sommige van deze voorstellen dragen ook rechtstreeks bij tot ‘betere regelgeving’, omdat zij het acquis codificeren of vereenvoudigen.

3. Resultaten van de screening

Na een grondige analyse van alle hangende voorstellen zal de Commissie twee soorten maatregelen nemen:

1) voorstellen intrekken. De Commissie wil in totaal 68 voorstellen intrekken. Het zijn voorstellen die niet in overeenstemming worden geacht met de doelstellingen van Lissabon of met de beginselen van betere regelgeving of ook voorstellen die niet snel genoeg vorderen in het wetgevingsproces of die niet meer actueel zijn[5] (bv. als de doelstellingen ervan al met andere middelen worden verwezenlijkt of zullen worden verwezenlijkt). Sommige van deze voorstellen zullen na verdere analyse misschien weer in behandeling worden genomen. In bepaalde gevallen wil de Commissie op basis van de resultaten van een complete effectbeoordeling uitmaken of een wetgevingsmaatregel wel nodig is;

2) voorstellen handhaven in het wetgevingsproces, maar dan wel met een nieuwe economische analyse die aan de wetgevende autoriteit ter beoordeling moet worden voorgelegd[6]. Dit geldt voor 5 voorstellen die volgens de Commissie nog steeds belangrijk zijn, maar waarvoor de besluitvorming door de wetgevende autoriteit wellicht kan worden bespoedigd door aanvullend een effectbeoordeling in te dienen.

Als gevolg van de screening door de Commissie zullen dus in totaal circa 73 hangende voorstellen aan een van beide maatregelen worden onderworpen. Het gaat hier om voorstellen die niet volledig beantwoorden aan de doelstellingen inzake concurrentievermogen, voorstellen waarvoor een nieuwe economische analyse bij de wetgever moet worden ingediend en ook voorstellen die niet voldoende vorderen in het wetgevingsproces of die inmiddels zijn achterhaald.

Van alle hangende voorstellen die van vóór 1 januari 2004 dateren, is zowat 31%[7] ingetrokken. Alle maatregelen samen, inclusief de voorstellen waarvoor een nieuwe economische analyse moet worden verricht, betreffen 33%[8] van de hangende voorstellen.

Voor ten minste twee voorstellen heeft de screening resultaten opgeleverd die niet direct onder de bovenstaande categorieën vallen. Het eerste is een voorstel voor een richtlijn van het Europees Parlement en de Raad betreffende de minimumvoorschriften inzake gezondheid en veiligheid met betrekking tot de blootstelling van werknemers aan de risico's van fysische agentia (optische straling) (1992/0449/COD). Als gevolg van de screening heeft de Commissie geconcludeerd dat de aspecten in verband met de blootstelling aan natuurlijke optische straling moesten worden geschrapt, wat het Europees Parlement trouwens ook had voorgesteld.

Het tweede is een voorstel voor een richtlijn van het Europees Parlement en de Raad betreffende de arbeidsvoorwaarden van uitzendkrachten (2002/0072/COD); als resultaat van de screening behoudt de Commissie zich het recht voor om dit voorstel na afloop van de toekomstige besprekingen over andere voorstellen te herzien.

De bijlage bij deze mededeling geeft een overzicht van de situatie en verstrekt ook nadere gegevens over de voorstellen in kwestie.

Conclusie

De screening van de hangende wetgevingsvoorstellen is de eerste uitgebreide screening die door de Europese Commissie ooit is uitgevoerd. Dit getuigt van de inzet van de Commissie voor het partnerschap voor groei en werkgelegenheid en voor de strikte naleving van de beginselen van betere regelgeving.

Verwacht wordt dat de acties die uit de screening voortvloeien, d.w.z. de beoogde maatregelen in verband met hangende voorstellen (zie bijlage), ertoe zullen bijdragen dat door de versterking van het concurrentievermogen de doelstellingen van Lissabon worden verwezenlijkt, dat een beter regelgevingsklimaat wordt gecreëerd en dat voorstellen die weinig of geen kans maken op goedkeuring of inmiddels niet meer actueel zijn, worden ingetrokken.

In sommige gevallen zullen hangende voorstellen worden ingetrokken in het kader van een volledige beleidsherziening of om ze later in het licht van nieuwe beleidselementen en van een complete effectbeoordeling opnieuw aan de orde te stellen.

Ingevolge de verbintenissen van het Kaderakkoord over de betrekkingen tussen het Europees Parlement en de Commissie (punt 32), doet de Commissie hierbij eerst kennisgeving aan het Parlement en de Raad voordat zij haar voorstellen intrekt.

[4] De Commissie behandelt jaarlijks immers 200 à 250 voorstellen als gevolg van de internationale verplichtingen van de EU, de noodzaak om het communautaire acquis bij te werken en/of haar verplichtingen ten aanzien van de wetgever na te komen.

[5] De Commissie heeft al vaker wetgevingsvoorstellen ingetrokken, waardoor de achterstand is geslonken. Zo zijn in 1997 34 voorstellen, in 1999 58, in 2001 108 en in 2004 102 voorstellen ingetrokken.

[6] Gefluoreerde gassen, vervoer van afvalstoffen, ondertekening van een overeenkomst inzake mobiel luchtvaartmaterieel, btw reisbureaus en btw administratieve samenwerking.
