Poultrymeat

The common organisation of the market in poultrymeat makes it possible to stabilise prices and guarantee farmers a fair standard of living by facilitating the marketing of products and laying down rules for trade with third countries.

ACT

Regulation (EEC) No 2777/75 of the Council of 29 October 1975 on the common organisation of the market in poultrymeat [See amending acts].

SUMMARY

From 1 July 2008 products covered by this Regulation will be subject to the common organisation of agricultural markets.

Scope

The products concerned are cocks, hens, ducks, geese, turkeys and guinea fowls, edible meats and offal, poultry livers, fats and other poultry-based preparations.

Marketing

To encourage action by trade and inter-trade organisations, Community measures may be taken to improve product quality and product use, to promote better organisation of production and marketing and to facilitate the recording of market price trends.

Marketing standards covering grading by category, quality and weight and labelling are adopted for poultry meats and offal. For other products the adoption of such standards is optional.

Trade with third countries

Imports and exports may be subject to the issuing of an import/export licence by the Member States.

The general rules for applying the Common Customs Tariff are applied in the poultrymeat sector.

Where imports are likely to threaten the Community market, additional duty may be levied on them.

Quotas are administered by the "first come, first served" or "simultaneous examination" methods. Other non-discriminatory methods may also be adopted.

In the event of price rises on the Community market, the Council, acting on the basis of a proposal from the Commission and after consultation with the European Parliament, may take appropriate measures.

Export refunds may be granted to facilitate exports.

The use of inward processing arrangements may be prohibited.

Protective measures may be taken if the Community market is likely to be disturbed due to imports or exports.

Charges with equivalent effect to customs duty and quantity restrictions or equivalent measures are prohibited in trade with third countries.

Other provisions

Exceptional market-support measures may be taken if outbreaks of animal diseases occur.

Except as otherwise provided for, the Treaty rules on State aid apply to the poultrymeat sector.

The Member States and the Commission communicate to each other the information necessary for implementing the Regulation.

The Commission is assisted in implementing this Regulation by the Management Committee for Poultrymeat and Eggs (FR) consisting of representatives of the Member States and chaired by a Commission representative.
