Tā arī papildina paziņojumu par „Stratēģisko pārskatu par labāku reglamentēšanu Eiropas Savienībā". ES tiesību aktu vienkāršošana var nozīmīgi veicināt normatīvās vides uzlabošanu, noteikumu atjaunināšanu un racionalizāciju un administratīvā sloga samazināšanu, lai nostiprinātu Eiropas ekonomikas stāvokli, ņemot vērā tehnoloģiju, tirgu un starptautiskā konteksta attīstību. Šā iemesla dēļ Komisija ir identificējusi vienkāršošanu kā vienu no galvenajām politiskajām prioritātēm labākas reglamentācijas darba kārtībā. Saskaņā ar šo ievirzi Komisijas darba dokumentā skata progresu, kas sasniegts 2005. gada oktobra vienkāršošanas stratēģijas izpildē, aplūko pastāvīgo darbu atbalsta kanālā un atspoguļo būtiski jaunās ierosmes, kas pastiprinās vienkāršošanas mainīgo programmu par periodu no 2006. līdz 2009. gadam. Viens no galvenajiem vienkāršošanas sasniegumiem ir pakāpeniska attiecināšana uz visām ES normatīvajām jomām. Komisijas darba dokuments atspoguļos arī norises gaitu kodifikācijas izteiksmē. Šis pirmais progresa ziņojums paralēli atspoguļo panākumu faktorus vienkāršošanas mērķu sasniegšanā, jo īpaši stingrus metodoloģijas komplektus, uzlabotu Eiropas Parlamenta un Padomes sadarbību, lai sasniegtu noslēguma posmu, pastiprināti izmantojot pašreglamentāciju un līdzreglamentāciju un vienkāršošanu valsts līmenī, lai nodrošinātu, ka jauni valstu noteikumi vai tehniskie šķēršļi nelikvidē ES vienkāršošanas ieguvumus. IEVADS Saskaņā ar politiskajām prioritātēm labākas reglamentācijas politikā, kas izklāstīta 2005. gada martā, Komisija 2005. gada oktobrī pieņēma jaunu stratēģiju normatīvās vides vienkāršošanai [1]. Stratēģijas galvenais mērķis ir uzlabot acquis kvalitāti un efektivitāti un novērst uzņēmējiem lieku slogu, tādējādi veicinot Eiropas ekonomikas konkurētspējas nostiprināšanu. Eiropas Parlaments [2] plaši atzina Komisijas programmu acquis vienkāršošanai, kamēr Eiropadome aicināja Padomi [3] izvirzīt par prioritāti vienkāršošanas priekšlikumu progresu, izmantojot tiesību sistēmu. Sadarbība ar otra akta pieņēmējiem ir būtiska vienkāršošanas priekšlikumu izplatīšanā. Kā papildinājumu “Eiropas Savienības labākas reglamentācijas stratēģiskajam pārskatam" [4] šis Komisijas darba dokuments pirmo reizi kopš stratēģijas sākšanas 2005. gada oktobrī ziņo par sasniegumiem un atspoguļo jaunus notikumus vienkāršošanas stratēģijas mērķu izpildē. Jo īpaši tas: · atspoguļo vienkāršošanas stratēģijas un kodifikācijas procesa izpildes norises gaitu, koncentrējoties uz: (1) pabeigtajām darbībām mainīgajā programmā, (2) notiekošo darbību, kam vajag turpmāku darbu, un (3) jaunām darbībām, ko noteikusi Komisija; · apskata galvenos panākumu faktorus patiesi vienkāršotas normatīvās vides sasniegšanā, jo īpaši stingru metodoloģiju komplektu, ciešu sadarbību starp ES institūcijām, pastiprinātu pašreglamentācijas un līdzreglamentācijas izmantošanu, kā arī vienkāršošanu valsts līmenī. Atjauninātā mainīgā programma attiecas uz periodu no 2006. līdz 2009. gadam un ietver vienkāršošanas ierosmes, kas iezīmētas Komisijas 2007. gada tiesību aktu un darba programmā, kā arī sniedz pārskatu par Komisijas centieniem vienkāršot pašreizējo normatīvo vidi daudzgadu perspektīvā. Tas, ka vienkāršošanas ierosmes pirmo reizi ir ietvertas Komisijas 2007. gada tiesību aktu un darba programmā, skaidri norāda uz politisko prioritāti, kas piešķirta vienkāršošanas stratēģijai. Mainās reglamentācijas kultūra. Tik tiešām Komisija pirmo reizi ir pielāgojusi savas darba metodes, prioritātes un resursus vienkāršošanas mērķiem. Viens no galvenajiem sasniegumiem ir pakāpeniska attiecināšana uz visām politikas jomām. Turpmāk pastāvīgais darbs pie administratīvā sloga samazināšanas veicinās vienkāršošanas izpildi, kas, savukārt, veicinās kopumā 25 % kopīgo samazināšanas mērķi ES un valstu tiesību aktiem, kas jāsasniedz līdz 2012. gadam, kā norādīts "Labākas reglamentācijas stratēģiskajā pārskatā". Saskaņā ar šo, no apspriedēm ar galvenajām ieinteresētajām pusēm gūtais labums un ietekmes novērtējumi palīdzēs uzlabot Komisijas jauno priekšlikumu kvalitāti un dos likumdevējiem labākas iespējas izveidot normatīvo vidi, kas pilnībā atbildīs subsidiaritātes principam, un drīzāk novedīs pie konkurētspējas, jauninājumiem un izaugsmes. Tas ļoti iespējami atvieglos turpmāko vienkāršošanas darba apjomu. Progresa ziņojumus izdos regulāri. 1. NORISES GAITA 1.1. Norises gaita – mainīgā vienkāršošanas programma 2005. gada oktobra vienkāršošanas stratēģijā ir ietverts vesels diapazons ar vienkāršošanas metodēm, kas paredz trīs gadu mainīgo programmu. Tajā sākotnēji periodam no 2005. līdz 2008. gadam ir uzskaitītas apmēram 100 ierosmes attiecībā uz 220 bāzes tiesību līdzekļiem, ko Komisija grasās vienkāršot, pamatojoties uz plašām apspriedēm ar dalībvalstīm, uzņēmumiem un pilsoņiem. Ņemot vērā acquis pastāvīgas pārskatīšanas nozīmību, Komisija tagad ir identificējusi turpmākas 43 papildu ierosmes ar potenciālu vienkāršošanas nozīmi periodam no 2006. līdz 2009. gadam. Tās ir ietvertas atjauninātajā mainīgajā programmā, kas ir norādīta I pielikumā. Programma apstiprina Komisijas apņemšanos strādāt pie administratīvā sloga samazināšanas, ko radījuši reglamentējošie noteikumi, un atjaunināt un racionalizēt noteikumus, ņemot vērā tehnoloģiju, tirgu un starptautiskā konteksta attīstību. 1.1.1. Komisijas gūtie panākumi Ir pabeigtas 12 no 14 [5] ierosmēm, kas paredzētas 2005. gadam. Kas attiecas uz 2006. gadu, 2005. gada oktobra paziņojumā tika plānotas ne mazāk par 54 ierosmēm, 3 ierosmes ir identificētas no jauna, viena ir pārnesta no 2005. gada, un viena ierosme ir pārnesta no 2008. gada. No tām 15 ierosmes šobrīd ir pieņemtas [6]. Turklāt 24 vienkāršošanas priekšlikumi ir apstiprināti pieņemšanai līdz šā gada beigām un ir norādīti I pielikumā. 15 priekšlikumi tiks atlikti līdz 2007./2008. gadam. Pēc rūpīgiem pārskatiem un apspriedēm ar ieinteresētajām pusēm 5 ierosmes ir atceltas. Komisija šobrīd ir pieņēmusi 27 ierosmes no 71 periodam no 2005. līdz 2006. gadam, un vairāk nekā pusi programmas pieņems līdz 2006. gada beigām. Mainīgās vienkāršošanas programmas progresa gaita 2006. gadā ir atkarīga no attiecīgās jomas sarežģītības, un dažos gadījumos ir kopumā atpalikusi no grafika, kaut arī dažas ierosmes tika pieņemtas agrāk nekā sākotnēji plānots. Tomēr gandrīz visas iekavētās ierosmes ir apstiprinātas 2007. gadam. Jāuzsver, ka šī programma ir katrā ziņā visambiciozākais vienkāršošanas projekts, ko Komisija jebkad ir sākusi. Ir izrādījies, ka vienkāršošanas izpilde ir izaicinājums, jo labums uzņēmumiem un pilsoņiem jālīdzsvaro attiecībā pret pūliņiem un izmaksām, ko vajag, lai pielāgotos jaunajai normatīvajai videi. Vienkāršošana tik tiešām var nozīmēt normatīvo reformu dažās politikas jomās. Lai pārvarētu pretestību izmaiņām, ko rada reformu plāni, bieži vajag vairāk laika, lai palīdzētu pierādīt vispārējo makroekonomisko tīro labumu no ierosinātajām izmaiņām. Turklāt ietekmes novērtējumi var uzsvērt jaunus svarīgus elementus politikas veidotājiem, kad jāizvēlas atbilstošākais politikas variants [7]. Vienkāršošanas programmas izpilde tiek attīstīta, ņemot vērā minēto ietekmes novērtējumu slēdzienus. Gandrīz visi vienkāršošanas priekšlikumi, ko Komisija iesniegusi apspriešanai, pašlaik jāpieņem Padomei un Eiropas Parlamentam. Šie priekšlikumi ir norādīti 3. pielikumā. Turpmāk ir norādīti daži sasniegumu piemēri, un tie parāda, ka Komisijas vienkāršošanas programmā jau ir apskatītas galvenās uzņēmumiem un pilsoņiem svarīgās jomas. Turpmāk ir norādīti Komisijas pieņemto priekšlikumu piemēri. · Modernizētais Muitas kodekss un e-muita [8]: Kopienas muitas tiesību aktu pārstrādāšana un Viseiropas elektronisko sistēmu radīšana datu apmaiņai starp valsts iestādēm un uzņēmumiem. Starptautisko tirdzniecību atvieglos modernizētas un vienkāršotas muitas procedūras un noteikumi, automatizētas un cieši saistītas muitas sistēmas, un cieša sadarbība starp visām iestādēm un aģentūrām, kas iesaistītas preču pārvietošanā pāri Kopienas robežām. · Vide [9]: Pamatdirektīvas par atkritumiem modernizācija: – to tiesību aktu vienkāršošana, kuri attiecas uz atkritumiem, skaidrojot definīcijas, modernizējot noteikumus un integrējot direktīvas par bīstamajiem atkritumiem un par atkritumeļļām, – pārstrādes tirgus uzlabošana, nosakot vides standartus, kas precizē apstākļus, kuros dažus pārstrādātus atkritumus vairs neuzskata par atkritumiem. · Darba ņēmēju pārvietošanās brīvība [10]: – pašreizējo noteikumu par valsts sociālo nodrošināšanas programmu saskaņošanu modernizācija, – procedūru atvieglošana apdrošinātajām personām un tā laika samazināšana, kas vajadzīgs iestādēm dažādās sociālās nodrošināšanas jomās (slimība, nelaimes gadījumi darba vietā, arodslimības, invaliditāte, vecums, bezdarbs, ģimenes pabalsti), lai atbildētu un apstrādātu pārrobežu lietas. · Pārtikas piedevas un aromatizētāji [11]: – pārtikas piedevu tiesību aktu vienkāršošana, izveidojot vienotu instrumentu principiem, procedūrām un apstiprinājumiem, – procedūras uzlabošana, lai atjauninātu Kopienas atļauto pārtikas piedevu sarakstu. · Mazie un vidējie uzņēmumi farmācijas nozarē [12]: vienkāršotu reglamentējošu noteikumu izveide mikro-MVU, tostarp samazinātas nodevas, maksājumu atlikšanas iespējas un administratīva un reglamentējoša palīdzība, iesniedzot pieteikumus Eiropas Zāļu aģentūrai. · Maksājumu pakalpojumi [13]: vienkāršota reglamentējošo noteikumu izveide attiecībā uz maksājumu pakalpojumiem patērētājiem un uzņēmumiem. Priekšlikums paredz tiesību aktu vienkāršošanu (aizstājot trīs direktīvas un trīs ieteikumus ar vienu saskaņotu noteikumu kopumu), administratīvo procedūru vienkāršošanu publiskajām iestādēm (ES vai valsts iestādēm), un administratīvo procedūru vienkāršošanu privātpersonām. Šis priekšlikums ievieš vairāk pārredzamības un skaidrākas, īsākas informācijas prasības maksājumu pakalpojumu lietotājiem un patērētājiem. · Grāmatvedības noteikumi [14]: esošo grāmatvedības noteikumu grozīšana, nodrošinot dalībvalstīm plašākas iespējas atbrīvot uzņēmumus no dažām informācijas atklāšanas prasībām (nosakot lielākus šādas informācijas atklāšanas ierobežojumus). Tā rezultātā tiks panākta administratīvā vienkāršošana mazākiem uzņēmumiem; · Strukturālā uzņēmumu statistika [15]: ar priekšlikumu vienkāršo SBS datu iegūšanu, dzēšot apmēram 15 obligātos mainīgos lielumus (par pētniecību un attīstību, nodarbinātību, enerģētiku un finanšu nomu), pārceļot citus mainīgos lielumus no gada uz vairākgadu rēķiniem, un dzēšot izvēles mainīgos lielumus. Turklāt, Eiropas Kopienu Statistikas birojs attīsta programmu uzņēmējdarbības statistikas atkārtotai izstrādei, lai palīdzētu dalībvalstīm ar jaunām metodēm, kas varētu būtiski samazināt atbildības slogu, piemēram, intensīvāk izmantojot administratīvos datus un automatizēti elektroniski pārraidot uzņēmuma rēķinus. · Gaisa pārvadājumu tirgus [16]: tā saucamā trešā aviācijas liberalizācijas pasākumu kompleksa pārskatīšanas rezultātā tiesību akti kļūs saprotamāki, jo 3 esošās regulas tiks apvienotas vienā jaunā regulā. Tiesību akti modernizē un vienkāršo tiesisko regulējumu, nodrošina saskaņotu piemērošanu dalībvalstīs un runā par iespējamiem konkurences izkropļojumiem un ierobežojumiem dažos tirgus segmentos. Tam jāveicina lielāka patērētāju izvēle, zemākas maksas un lielāka konkurence. 1.1.2. Pastāvīgs darbs Patlaban ir apstiprinātas vairākas nozīmīgas vienkāršošanas ierosmes attiecībā uz konkurenci 2006./2007./2008. gadam, kas norādītas turpmāk. · Lauksaimniecība: kopējā tirgus 21 organizācijas apvienošana vienā vienotā shēmā, lai izveidotu vienkāršotu horizontālu tiesisko regulējumu, kas sniegs vienotu saskaņotu noteikumu komplektu dažādās tirgus politikas jomās tādās kā intervence, privātā uzglabāšana, importa tarifa kvotas, eksporta kompensācijas, aizsardzības pasākumi, lauksaimniecības produkti, valsts atbalsta noteikumi, saziņa un datu paziņošana. · Vide: integrētās piesārņojuma novēršanas un kontroles direktīvas (IPPC) un citu saistīto tiesību aktu par rūpnieciskajiem izmešiem pārskatīšana, lai uzlabotu skaidrību un konsekvenci (jo īpaši ziņošanas izteiksmē) un vienkāršotu prasības. · Celtniecības materiālu direktīva ar mērķi paskaidrot un samazināt administratīvo slogu, jo īpaši MVU, izmantojot lielāku elastīgumu tehnisko specifikāciju formulējumā un lietošanā, vienkāršotus sertifikācijas noteikumus, un novēršot izpildes šķēršļus, kas līdz šim ir kavējuši pilnīga celtniecības materiālu iekšējā tirgus radīšanu. · Statistika: atvieglot uzņēmējiem, jo īpaši MVU, statistikas ziņošanu, ņemot vērā pastāvīgo darbu pie Eiropas Savienības statistikas pārvaldības uzlabošanas un galīgo rezultātu, kas iegūts no administratīvā sloga novērtēšanas un samazināšanas izmēģinājuma projektiem. · Pārtikas/barības marķēšana: modernizējot tiesību aktus, tiks precizēti noteikumi, saskaņā ar kuriem jāveic marķēšana, lai dotu patērētājiem iespēju izdarīt informētu, drošu, veselīgu un ilgtspējīgu izvēli, un veicinās konkurencei draudzīgu tirgus vidi, kurā uzņēmēji var efektīvi izmantot marķēšanu, lai pārdotu savus produktus. · Patērētāju aizsardzība: visa patērētāju aizsardzības acquis racionalizācija un vienkāršošana, lai novērstu iespējamās nekonsekvences, pārklāšanās, iekšējā tirgus šķēršļus un konkurences izkropļojumus. · Kosmētika: Kosmētikas direktīvu pieņēma pirms 30 gadiem, un tā ir grozīta vairāk nekā 40 reizes. Tā jāpārstrādā, lai ieviestu dokumentā vairāk konsekvences un skaidrības. Tas palīdzēs samazināt direktīvas izpildes un pārvaldības administratīvās izmaksas, vienlaikus saglabājot nemainītu faktisko režīmu par izmēģinājumu ar dzīvniekiem pakāpenisku aizliegšanu; · Grāmatvedības un finanšu pārskatu standarti: ES uzņēmumu apgāde ar jaunākajiem finanšu pārskatu standartiem, apvienojot pašreizējo regulas [17] kopumu, kura apjoms ir vairāk nekā 2 000 lappuses, vienotā un lietotājdraudzīgā regulā. · Automašīnu reglamentējošie noteikumi: pēc tam, kad tiks apstiprināts iesniegtais priekšlikums pārskatīt pamatdirektīvu par mehānisko transportlīdzekļu tipa apstiprinājumu, varēs: – aizstāt ES direktīvas ar ANO/EEK noteikumiem. Šī vienkāršošana racionalizēs noteikumus un likvidēs pārmērīgās prasības. Turklāt tā palīdzēs globālajai rūpniecībai likvidēt tirdzniecības beztarifu šķēršļus, saglabājot ES vadošo nostāju kā starptautisko standartu veidotājai un ļaujot rūpniecībai ātrāk pielāgoties tehniskajai attīstībai starptautiskajā līmenī; – ieviest vajadzīgos tehniskos noteikumus paštestēšanai un virtuālajai testēšanai ES 25 direktīvās un ANO/EEK noteikumos. Tas atļaus vienkāršot tipa apstiprinājuma procedūru un ļaus uzturēt normatīvo vidi saskaņā ar jaunāko tehnisko attīstību. Virtuālā un paštestēšana paātrinās ražojumu attīstību un samazinās izmaksas gan rūpniecībai, gan patērētājiem. Turklāt, Komisija pašlaik ierosina vispārīgu noteikumu direktīvā mehānisko transportlīdzekļu apstiprināšanai, dodot ražotājiem iespēju darboties kā testēšanas laboratorijām, ja tipa apstiprinājuma iestāde ir atzinusi vajadzīgo kompetenci. · Piekļuve ceļa pārvadājumu tirgum un profesijai: četru regulu un vienas direktīvas pārstrādāšana, lai paskaidrotu, vienkāršotu un padarītu izpildāmākus noteikumus, kas reglamentē piekļuvi profesijai un tirgum, ieskaitot kravu autopārvadājumu un pasažieru transporta kabotāžu. Pārstrādāšanas rezultātā jānodrošina noteikumu saskaņota piemērošana un izpilde, kas neprasa augtas izmaksas, ieskaitot starptautisku kontekstu, tādējādi ierobežojot konkurences izkropļojumus, aizsargājot tiesības veikt uzņēmējdarbību un uzlabojot pakalpojumu kvalitāti un ceļu satiksmes drošību. · Tehnisko jaunās pieejas [18] regulu un direktīvu, kas attiecas uz ražojumu laišanu tirgū, konsolidēšana attiecībā uz konsekventām definīcijām, vienkāršotām sertifikācijas procedūrām un racionalizētu administratīvo sadarbību, lai atvieglotu ražojumu tirdzniecību, vienlaikus aizsargājot ražotājus pret neatbilstošiem ražojumiem. 1.1.3. Jaunas ierosmes, kas pastiprina vienkāršošanas mainīgo programmu Pamatojoties uz mainīgo programmu, kas sākta pagājušajā gadā, Komisija pastiprina savu vienkāršošanas darbību ar 43 [19] jaunām ierosmēm periodam no 2006. līdz 2009. gadam, lai · stimulētu jauninājumus un samazinātu administratīvo slogu, kas rodas no normatīvajām prasībām, · samazinātu Kopienas acquis kopapjomu un veicinātu pāreju uz elastīgākām normatīvajām pieejām. Turpmāk ir norādītas dažas jaunas nozīmīgas ierosmes. · Noteikumu, kas attiecas uz zāļu izmaiņām pēc licencēšanas (tā saukto „izmaiņu” regulu) vienkāršošana. Minēto noteikumu administratīvā pārvaldība pašlaik mobilizē vairāk nekā 60 % uzņēmumu normatīvo departamentu cilvēkresursu un finanšu izmaksu. Dažos gadījumos tāds slogs var traucēt jauninājumus, kavējot tādu izmaiņu ieviešanu, kas dod labumu pacientiem un sabiedrībai. Procedūras tiks racionalizētas, lai padarītu Izmaiņu regulas vienkāršākas, skaidrākas un elastīgākas, neapdraudot sabiedrības un dzīvnieku veselību. · Tādu preču savstarpējas atzīšanas [20] nodrošināšana, uz ko neattiecas saskaņotie Kopienas noteikumi. Komisija pašlaik strādā pie tiesību aktu projekta par tehnisko šķēršļu, kas kavē preču brīvu apriti ES, novēršanu („Savstarpējās atzīšanas priekšlikums”). Šis instruments noteiks tiesības un pienākumus, no vienas puses, valsts iestādēm un, no otras puses, uzņēmumiem, kuri vēlas kādā dalībvalstī pārdot ražojumus, kas jau likumīgi saražoti vai tirgoti kādā citā dalībvalstī. · Jaunas pārtikas drošuma novērtējuma definīcijas un darbības jomas paskaidrojums un atļauju izsniegšanas procedūras racionalizācija. · Administratīvo procedūru pārvaldības vienkāršošana lauksaimniecības jomā, ieviešot vairākus tehniskus vienkāršojumus. Ir izstrādāts mainīgais rīcības plāns, lai grozītu tiesību normas, kam ir tūlītēja ietekme uz lauksaimniekiem, citiem uzņēmējiem un valstu pārvaldes iestādēm. Grozījumi attiecas, piemēram, uz pienākumu lauksaimniekiem turēt pieejamus dokumentus, uz dalībvalstu kontrolpienākumiem, uz atbalsta saņemšanas nosacījumiem, utt. · Kopējās zivsaimniecības politikas vienkāršošana un uzlabošana, ieviešot tiesisko un administratīvo vienkāršošanu saskaņā ar „2006.-2008. gada rīcības plānu”, ko Komisija pieņēma 2005. gadā [21]. Rīcības plāns attiecas uz dažiem reglamentējošiem noteikumiem par zvejas darbības kontroli un pārvaldību, piemēram, lai veicinātu tiesiskā pamata lasāmību un samazinātu administratīvo slogu attiecīgajiem zvejniekiem un administratoriem. · Reglamentējošo noteikumu par elektroniskās saziņas tīkliem un pakalpojumiem pārskatīšana samazinās vajadzību pēc iepriekšējiem noteikumiem un atvieglos elastīgumu un jaunradi, kas dos labumu gan rūpniecībai, gan pilsoņiem. · Direktīvu par tekstilprecēm aizstāšana ar vienotu regulu, lai vienkāršotu jauno šķiedru nosaukumu pieņemšanas procedūras. Turklāt šķiedru satura mērīšanas kvantitatīvās metodes tiks iekļautas standartizācijas procesā. · Esošo tiesību aktu par rotaļlietām vienkāršošana, precizējot būtiskās drošuma prasības un attīstot nosacījumus, lai valsts tirgus uzraudzības iestādēm būtu labāka kopēja pieeja. · Tiesību aktu par metroloģiju un mēslošanas līdzekļiem ierobežošana līdz būtiskajām prasībām, izmantojot „jauno pieeju”. Ar standartiem aizstās sīki izstrādātus tehniskos aprakstus. · Kopienas ekomarķējuma piešķiršanas sistēmas pārskatīšana, lai (a) radītu uzņēmējiem draudzīgāku sistēmu, iesaistot ieinteresētās puses lēmumu pieņemšanas procesā un iekļaujot MVU vajadzības, (b) piešķiršanas kritēriju attīstīšanas atdošana, lai to kā ārpakalpojumu veic speciāla organizācija, un ekomarķējuma cieša sasaiste ar videi labvēlīgiem iepirkumiem. · Direktīvas par augļaugu pavairošanas materiālu un augļu ražošanai paredzēto augļaugu tirdzniecību pārstrādāšana. · Jautājuma par muskuļu un skeleta traucējumiem, kas saistīti ar darbu, iekļaušana vienotā instrumentā, kas apvienotu dažādas esošās obligātās veselības un drošības prasības, piemēram, kas attiecas uz kravu cilāšanu ar rokām vai uz darbu ar displeju ekrāniem. Visi Komisijas departamenti pabeigs savu acquis pārskatīšanu līdz 2009. gadam, lai pārbaudītu instrumentu atbilstību, reglamentējošās tehnikas izvēli un darbības jomu, kurā piemērot vienu no vienkāršošanas tehnikām, kas izklāstītas 2005. gada oktobra vienkāršošanas stratēģijā. Turpmāk vajadzības un atbilstības gadījumā tā rezultātā tiks noteiktas jaunas vienkāršošanas ierosmes un atjaunināta mainīgā programma. 1.2. Norises gaita – kodifikācija Kodifikācija ir būtiska daļa no Eiropas Komisijas labākas reglamentācijas procesa. Kodifikācija ir procesi, kas apvieno esošo aktu noteikumus ar visiem to turpmākajiem grozījumiem vienā tiesību aktā, tādējādi veicinot ES tiesību aktu apjoma samazināšanu un padarot tos pārredzamākus, lasāmākus un juridiski skaidrākus. Mainīgā kodifikācijas programma (2. pielikumā) ietver aptuveni 500 aktu. Sekmīgs kodifikācijas procesam ir veikts kopumā 52 aktiem [22], un tie ir pieņemti un publicēti "OV" (38 Komisijas akti un 14 Eiropas Parlamenta un Padomes akti). Turklāt 33 akti gaida pieņemšanu likumdošanas iestādē, un 8 akti atrodas rakstiskajā procedūrā. Kopumā Eiropas Komisija ir pabeigusi darbu pie 85 aktiem. Lai sasniegtu mērķi līdz 2008. gada vidum pabeigt kodifikācijas programmu, ir veikti pasākumi, lai paātrinātu oriģinālu uzkrājumu pārveidošanu jaunajās ES valodās. Uzkrājums ir veidojies kavēšanās rezultātā, ar kādu tiek piegādāti minētajās valodās kodificējamo dokumentu tulkojumi. Turklāt ir pieņemti atbilstoši pasākumi, lai pēc iespējas palielinātu kodificēto dokumentu skaitu, kas pieejami bulgāru, rumāņu, īru un maltiešu valodā, dodot priekšroku to dokumentu kodifikācijai, kuru attiecīgie tulkojumi ir pabeigti. Turklāt ir sagatavota programma atlikušo kodificējamo dokumentu pieņemšanai. Mērķis ir nodrošināt procesa pārredzamību, lai jo īpaši veicinātu kodificējamo aktu obligātos grozījumus, tādējādi stabilizējot iesaistītos tiesību aktus un samazinot kavēšanos. Šī programma aizvien ir indikatīva, jo kodifikācijas projekta pabeigšana ir atkarīga no visās valodās kodificējamo aktu pieejamības. Tas jo īpaši attieksies uz bulgāru un rumāņu valodu. Turklāt, kodifikācija ir jāatliek, ja tiek paredzēti jauni minēto aktu grozījumi. Aktu secība programmā mainīsies, ņemot vērā minētos divus faktorus. Jāatzīmē arī tas, ka kodificēto aktu pieņemšana no likumdošanas iestādes puses ir pakļauta noteikumiem, kas izklāstīti 1994. gada 20. decembra Iestāžu nolīgumā par oficiālās kodifikācijas paātrināto darba metodi. 2. PANĀKUMU FAKTORI Normatīvā vide Eiropas uzņēmumiem un pilsoņiem sastāv no vairākām bieži savstarpēji saistītu tiesību aktu un noteikumu kārtām, kas veidoti dažādos līmeņos (starptautiskā [23], Kopienas, valsts, reģionālā un vietējā līmenī). Neviens no minētajiem reglamentējošajiem aktiem pats par sevi nespēj izšķiroši uzlabot šā tiesību aktu tīkla kvalitāti. Lai konkrēti uzlabotu vispārējos reglamentējošos noteikumus, jāveic noteikti, konsekventi un saskaņoti pasākumi visos reglamentācijas līmeņos. 2.1. Vienkāršošanas darbs, pamatojoties uz stingra metodoloģiju 2.1.1. Visu personu apspriedes Gan sākotnējā, gan atjauninātā 2006.-2009. gada vienkāršošanas mainīgā programma ir attīstīta, pamatojoties uz ieinteresēto personu un dalībvalstu ieguldījumu. Viņu pieredze ir nepieciešama, veidojot nozīmīgu vienkāršošanas programmu. Padziļinātas ieinteresēto pušu apspriedes, veselu politikas jomu pārskatīšana, tiesību akta paveiktais novērtējums un ekspertu pārskati palīdz politikas veidotājiem labāk identificēt patiesās pamatproblēmas. Tādi procesi arī atvieglo ieinteresēto pušu turpmākas īpašumtiesības uz ierosināto pasākumu. 2005. gada oktobra Vienkāršošanas paziņojumā [24] darīja zināmas vairākas īpašas ierosmes. · Kā minētss „Komisijas paziņojumā par vienkāršošanu un labāku reglamentāciju kopējai lauksaimniecības politikai”, tika izveidots rīcības plāns, ko prezentēja 2006. gada oktobra konferencē ar nosaukumu „Vienkārša kopējā lauksaimniecības politika Eiropai, izaicinājums visiem”. Rīcības plānā ir ietverti 20 īpaši tehniskās vienkāršošanas projekti (sloga samazināšana, nemainot pamatpolitiku), kas jāievieš līdz 2007. gadam. Ar šo rīcības plānu tiek sākts nepārtraukts vienkāršošanas process. Līdz ar to ieinteresētās personas un dalībvalstis tiek aicinātas iesniegt turpmākus vienkāršošanas priekšlikumus; · 2006.-2008. gada rīcības plānu kopējās zivsaimniecības politikas vienkāršošanai un uzlabošanai Komisija pieņēma 2005. gadā, un to pilnībā atbalstīja Eiropas iestādes un ieinteresētās personas, ar ko notika apspriedes; · Gaidāmais paziņojums par atbildības sloga samazināšanu, vienkāršošanu un prioritātes noteikšanu Kopienas statistikas jomā. Šajā paziņojumā ir izklāstīta stratēģiskā pieeja, lai turpinātu samazināt statistikas slogu uzņēmumiem, apvienojot divus elementus: vienkāršojot statistikas prasības izvēlētās prioritārās jomās un veicinot statistikas instrumentus un metodes, kas ļaus vieglāk ievērot statistikas pienākumu. Jo īpaši Komisija ierosinās vienotu plūsmas sistēmu Intrastat sistēmai, kas ir programma uzņēmējdarbības statistikas atkārtotai izstrādei un aktīvi darbosies pie Eiropas lauksaimniecības statistikas sistēmas vienkāršošanas. Turklāt Līguma 138. pantā ir paredzētas Eiropas sociālo partneru apspriedes par Kopienas ierosmēm sociālās politikas jomā [25]. Dažos gadījumos apspriežu procesa rezultāts ir licis Komisijas dienestiem pārskatīt sākotnējos nodomus. Piemēram, kas attiecas uz uzņēmējdarbības tiesību un autortiesību reglamentējošo noteikumu pārskatiem, kas rezultātā sagatvoja turpmākas ierosmes: · attiecībā uz uzņēmējdarbības tiesībām Komisija ir plānojusi pirms šā gada beigām uzsākt visaptverošu ierosmi, lai noteiktu administratīvās izmaksas, kas rodas no uzņēmējdarbības tiesību direktīvām, lai kopā ar dalībvalstīm un ieinteresētajām personām identificētu minēto izmaksu samazināšanas jomu. Šā uzdevuma rezultātu iekļaus paziņojumā 2007. gada otrajā pusē; · attiecībā uz autortiesībām pārskatīšanas rezultātā tika veiktas vairākas darbības, ieskaitot 2001. gada autortiesību direktīvas novērtējumu, kas cita starpā varētu noteikt izņēmumus šīs direktīvas piemērošanā. Šā uzdevuma rezultāts jāparedz līdz 2007. gada vasarai. 2.1.2. Konkrētas nozares analīze Iepriekšējā paziņojumā Komisija noteica, ka jāvienkāršo pieeja, kas attiecas uz konkrētu nozari, lai labāk novērtētu reglamentējošo noteikumu ietekmi uz nozaru konkurētspēju. Piemēram, turpinās pastāvīgs darbs celtniecības materiālu jomā. Tas ietver to faktoru vispārēju analīzi, kas ietekmē ieinteresēto personu konkurētspēju celtniecības nozarē, kā arī īpašu darbību, lai vienkāršotu celtniecības materiālu direktīvu (Direktīva 89/106/EEK). Ieinteresēto personu apspriedes notiek nepārtraukti, un Komisija pārbauda Ieguldījumus. Mehānisko transportlīdzekļu jomā CARS 21 Augstā līmeņa grupa ir pārbaudījusi svarīgākās politikas jomas, kas ietekmē Eiropas automašīnu rūpniecības konkurētspēju, un ir izstrādājusi vairākus ieteikumus. Paralēli tam labākas reglamentēšanas principu piemērošanu pašlaik izskata saistībā ar jaunajiem forumiem, kas izveidoti paziņojuma par rūpniecības politiku [26]. Nozaru skrīninga darbības ir sākušās tādās grupās kā operatīvie spēki darbam pie IKT konkurētspējas un mehāniskās inženierijas politikas dialoga. 2.1.3. Pašreizējais darbs pie administratīvā sloga Atbildot uz 2006. gada jūnija Eiropadomes slēdzieniem un atkārtoti sāktās Lisabonas dienas kārtības konkurētspējas ietvaros 2007. gada sākumā Komisija sāks nozīmīgu rīcības plānu, lai noteiktu un samazinātu administratīvo slogu, ko rada esošie tiesību akti ES. Plāns tiks veidots uz iepriekšējās pieredzes pamata, ko veidojušas četras dalībvalstis (Apvienotā Karaliste, Nīderlande, Dānija un Čehija), kas jau ir noteikušas samazināšanas mērķi pēc plašo noteikšanas pasākumu pabeigšanas. Komisijas darba dokumentā par administratīvo izmaksu novērtēšanu un administratīvā sloga samazināšanu Eiropas Savienībā [27] ir iekļauti tā izmēģinājuma projekta rezultāti par administratīvo slogu, ko veica 2006. gadā, un šajā dokumentā izskata un pamatojas uz šādas iepriekšējas pieredzes pamata. Vidējā termiņā šim procesam jādod ES likumdevējiem un dalībvalstīm iespēja uz noteikto datu pamata identificēt prioritārās jomas, kurās jāpilveido vienkāršošana. Saistībā ar šo jāatzīmē, ka lauksaimniecības jomā tiek veikts pētījums par administratīvo slogu lauksaimniekiem. Pētījums attiecas uz 2003. gada kopējās lauksaimniecības politikas reformas un tās turpmāko grozījumu ieviešanu. Pirmie rezultāti būs pieejami 2007. gadā. 2.2. Cieša sadarbība starp ES iestādēmm Ja Komisija sagatavo augstas kvalitātes tiesību aktu projektus, tad Padomes un Parlamenta atbildība ir veikt šo vienkāršošanas darbu līdz noslēguma posmam. Komisijas pieņemtie 22 vienkāršošanas priekšlikumi tagad jāapstiprina Padomei un Eiropas Parlamentam (3. pielikums). No tiem 7 vienkāršošanas ierosmes, kas iekļautas iepriekšējās 2003. gada vienkāršošanas programmās [28], vēl jāpieņem likumdevējam. Vēl nepieņemto priekšlikumu saraksts ir norādīts 3. pielikumā un ietver uzņēmējdarbībai būtiskus dokumentus, tādus kā Sestās PVN direktīvas pārskatīšana, Muitas kodeksa modernizēšana, atkritumu tiesību aktu pārskatīšana, mehānisko transportlīdzekļu tipa apstiprinājuma vienkāršošana, strukturālās uzņēmējdarbības statistikas racionalizācija un fasējuma prasību atcelšana. Grāmatvedības direktīvas, kas satur izņēmumus MVU labā, pieņemšana [29], kā arī tas, ka Padome nesen apstiprināja kopējo nostāju par fasējumu, atspoguļo dalīto noteikšanu starp institūcijām, lai vienkāršotu reglamentējošos noteikumus. Komisijas aicinājumam rīkoties attiecībā uz 2005. gada oktobra vienkāršošanas stratēģiju, Eiropas Parlaments atbildēja 2006. gada aprīlī. Nostājas, ko Parlamenta komitejas pieņēmušas attiecībā uz daudzgadu vienkāršošanas programmu, parāda ievērojamu konverģenci ar Komisijas prioritātēm par to, kādas vajadzības jāvienkāršo. Eiropas Parlaments 2006. gada maijā pieņēma vairākus ziņojumus par dažādiem labākas reglamentēšanas aspektiem, ieskaitot vienkāršošanu [30]. Eiropas Parlaments cita starpā ierosina identificēt jauna veida instrumentu, līdz ar kodificēšanu un pārstrādi [31], specifiskiem vienkāršošanas priekšlikumu veidiem, kas varētu gūt labumu no koriģētajām darba metodēm un ātrākas pieņemšanas. Starpiestāžu nolīgums (IIA) par labāku regulējumu [32], kas ir spēkā kopš 2003. gada decembra, izveidoja platformu, lai attīstītu trīs iestāžu sadarbību. Augstā līmeņa tehniskā grupa, kas atbild par IIA izpildes uzraudzību, ir regulāri pārbaudījusi progresu tādās jomās kā likumdošanas darba saskaņošana un programmēšana, tiesību aktu kvalitāte (jo īpaši ietekmes novērtējumu), Kopienas tiesību aktu transponēšana un piemērošana, un vienkāršošana. Ir pierādījies, ka otra akta pieņēmējiem identificēt konkrētu rīcību, lai padarītu vienkāršošanu par prioritāru, un paātrinātu likumdošanas procesu, ir grūti. Vienošanās, kas 2005. gada decembrī panākta iestāžu starpā par Starpiestāzu kopējo pieeju ietekmes novērtējumam [33], pierāda, ka, ja ir politiskā griba, tad Starpiestāžu nolīgums par labāku regulējumu var dot konkrētus uzlabojumus labākas reglamentēšanas starpiestāžu izpildē. Kopējās pieejas pārskatīšanas laikā 2008. gadā iestādēm jāvienojas, ka dalībvalstu ierosmēm policijas un tiesiskās sadarbības jomā krimināllietās jāpievieno ietekmes novērtējumi. Komisija ir paziņojusi, ka tā grasās atvieglot iestāžu lēmumu pieņemšanas procesu, uzlabojot vienkāršošanas ierosmju plānošanu un redzamību, veicot šādas darbības: · integrējot vienkāršošanas priekšlikumus Komisijas gada likumdošanas un darba programmā. Patlaban tas ir panākts saistībā ar Komisijas 2007. gada likumdošanas un darba programmu; · pilnībā izmantojot paskaidrojuma rakstu, lai labāk paskaidrotu vienkāršošanas mērķus, kas ietverti tās priekšlikumos. Vienkāršošanas priekšlikumos, kas pakļauti ietekmes novērtējumam, Komisija centīsies arī novērtēt vienkāršošanas ietekmi, ieskaitot administratīvo slogu; · identificējot dažus vienkāršošanas priekšlikumu izmēģinājuma gadījumus, lai pārbaudītu iespējas izveidot uzlabotas starpinstitūciju darba metodes vienkāršošanai. 2.3. Pastiprināta līdzreglamentācijas un pašreglamentācijas izmantošana Līdzreglamentācija un pašreglamentācija ir to instrumentu piemēri, ko zināmos apstākļos var izmantot, lai sasniegtu politikas mērķus ar ierobežotu likumdevēja iejaukšanos. Piemēram, Eiropas standartizācijas iestādes un Komisija pašlaik sadarbojas, lai ierosinātu jaunas standarta ierosmes pakalpojumu sektorā, kas koncentrētos tieši uz iekšējo tirgu. Standarti atļauj lietotājiem brīvi salīdzināt ražojumus un cenas, tādējādi stiprinot konkurenci un pastiprinot ES iekšējo tirdzniecību ar pakalpojumiem. Pēc plašām apspriedēm standartizācijas rīcības plāns, kura mērķis ir veicināt rūpniecisko konkurētspēju, kā arī lēmuma apstiprinājums par Kopienas finansēšanu aktivizēs standartizācijas darbības. Pašregulācijas jomā sociālajiem partneriem Eiropas līmenī ir specifiska nozīme, jo viņiem ir iespēja noslēgt nolīgumus [34], kas padarīti saistoši ar tiesību aktu projektu vai ko izpilda uz autonoma pamata. Pašreglamentēšana ir konsekventa ar Kopienas politiku veicināt korporatīvo sociālo atbildību (CSR). Brīvprātīgās ierosmes, ko veic saskaņā ar Eiropas aliansi par CSR, var dot iecerēto rezultātu – jaunus nolīgumus par pašreglamentēšanu. Tādām ierosmēm, ko ES uzņēmumi veic ciešā sadarbībā ar attiecīgajām ieinteresētajām personām, arī jāveicina daudz plašāka CSR prakses izmantošana Eiropā un pasaulē. Lai labāk informētu privātās personas, kas vēlas izveidot vai uzlabot pašreglamentācijas sistēmas, kā arī reglamentējošās institūcijas, kas atbild par līdzreglamentācijas izveidi, Eiropas Ekonomikas un sociālo lietu komiteja (EESC) un Eiropas Komisija ir izveidojušas datu bāzi ar gandrīz 100 ES sistēmām. Šī datu bāze, kas jālaiž klajā 2006. gada novembrī, starp citām lietām sīki izstrādā problēmu veidus, kas noveda pie ES pašreglamentācijas vai līdzreglamentācijas sistēmu, to mērķu un organizacionālā ietvara attīstības. Tādējādi būs daudz vieglāk identificēt labo un slikto praksi. 2.4. Vienkāršošana valsts līmenī 2.4.1. Vienkāršotie ES tiesību akti jāatspoguļo arī valsts līmenī ES vienkāršošanas uzdevums būs pilnībā jāatbalsta dalībvalstīm, lai nodrošinātu, ka vieglākas Kopienas normatīvās vides priekšrocības netiek atceltas ar jauniem valstu noteikumiem vai tehniskajiem šķēršļiem. Tas jau tā ir pieaugošam skaitam dalībvalstu, lai gan vēl ir telpa uzlabojumiem. To atspoguļo statistikas prasību uzturēšana valsts līmenī, kur Kopienas tiesību akti ir racionalizēti. Līdz ar to dažos nesenos atcelšanas priekšlikumos Komisija ir ieviesusi savstarpējas atzīšanas noteikumu, lai nodrošinātu, ka pēc Kopienas tiesību akta atcelšanas nerodas jauni šķēršļi tirdzniecībai. Piemēram, priekšlikuma par fasējumu mērķis ir novērst tirdzniecības šķēršļus valsts prasību uzturēšanas dēļ. Līdzīgi, lai stātos spēkā lēmums atcelt ES tiesību aktus par neapstrādātiem kokmateriāliem, jābūt vienotai pārbaudei visā ES. Attiecīgi jāgroza valsts tiesību akti, kas attiecas uz direktīvu, un dalībvalstīm jānodrošina, lai tehniskās izmaiņas tiktu ieviestas ātri un skaidri. Pārāk bieži administratīvās kontroles un procedūras tiek uzliktas Eiropas uzņēmumiem, kuri vēlas darboties kādā citā dalībvalstī. Attiecīgā gadījumā Līguma noteikumi veicina operāciju vienkāršošanu iekšējā tirgū. Komisija palīdz samazināt tādus slogus, ieviešot 28. pantu EK Līgumā par preču brīvu apriti, jo īpaši, uzraugot valsts tiesību aktu projektus. 2007. gadā Komisija skatīs aizsardzības tirgus integrāciju, lai atvieglotu pārmērīgo administratīvo slogu, kas kavē ES rūpniecības konkurētspēju šajā laukā. Tik tiešām, gada izmaksas, kas saistītas ar Kopienas iekšējā importa un eksporta licencēm militārajām precēm, tiek lēstas uz 238.90 miljoniem euro rūpniecībām un administrācijām. Praksē minētie licenču pieprasījumi gandrīz nekad netiek atteikti [35]. 2.4.2. Izvairīšanās no "uzlabošanas" Valsts izpildes noteikumu, ar ko transponē Kopienas direktīvas, pārbaude sniedz daudz piemēru tam, kādas ir tehniskās prasības, marķēšanas prasības, termiņi, autorizācijas procedūras un citas administratīvās prasības, ko valstu reglamentējošās iestādes papildus pievieno Kopienas tiesību aktiem (“uzlabošana”). Normatīvo vidi ES uzņēmumiem var uzlabot tikai tad, ja ES līmenī pieņemtās ierosmes papildina atbilstoša rīcība valsts līmenī. To apstiprina arī citi avoti, piemēram, nesenais pētījums [36], ko veica priekš MVU nacionālās federācijas. Minētais pētījums norāda, ka direktīvu sākotnējās jomas paplašināšana, transponējot pasākumus, var nopietni kavēt mazo uzņēmumu ražīgumu, tādējādi atņemot naudu no galvenajiem bagātības un darbu radītājiem. Turklāt, uzlabošana var radīt valsts uzņēmumiem neizdevīgus konkurences apstākļu attiecībā pret citām valstīm. Tas pamatoja Komisijas nodomu, kas paziņots 2005. gada oktobra paziņojumā, labāk izmantot vienkāršošanas potenciālu, attiecīgos gadījumos izmantojot drīzāk regulas, nevis direktīvas. Direktīvas 91/414/EEK aizstāšana ar regulu par augu aizsardzības ražojumu izvietošanu tirgū ir konkrēts piemērs šai izmaiņai reglamentējošajā praksē. 2.4.3. Valsts reformas programmas Normatīvās prasības un izpildes pasākumi galvenokārt tiek radīti valsts līmenī. Valsts reformu programmas (NRP) ir daļa no jaunās izaugsmes un darba stratēģijas (Lisabonas stratēģijas) jaunās pārvaldes struktūras, un tā izklāsta ekonomiskās reformas politikas valsts līmenī uz Kopienas pamatnostādņu pamata. Līdz ar to tās ir būtiskas, lai radītu ES labāku uzņēmējdarbības vidi. Visas dalībvalstis ir atbildējušas uz pamatnostādnēm par labāku reglamentāciju un ir iekļāvušas labākas reglamentācijas veicināšanas pasākumus savās valsts reformu programmās. Šajā posmā deviņas dalībvalstis minēto valsts reformu programmu kontekstā ir sākušas vienkāršošanas programmas ar dažādām ambīciju pakāpēm. Tomēr ir būtiski, lai ES vienkāršošanas programmu papildinātu progress vienkāršošanā visās dalībvalstīs un visos reglamentācijas līmeņos. Piezīmē Ekonomikas politikas komitejai “Labākas reglamentācijas veicināšana” [37], ko sagatavojusi Eiropas Komisija, un 2006. gada Konkurētspējas ziņojumā ir izklāstīti galvenie slēdzieni par labākas reglamentācijas ieviešanu dalībvalstu līmenī, un tie sīkāk apraksta progresu, kas līdz šim sasniegts šajā jomā. Valsu ierosmju piemēri ir šādi. · Administratīvo izmaksu samazināšana. 17 dalībvalstis apzinās vajadzību analizēt administratīvās izmaksas, kas uzliktas uzņēmumiem, un ir sākušas mērījumu darbības. Dažas ir noteikušas kvantitatīvos mērķus administratīvo izmaksu samazināšanai (piemēram, 20 vai 25 % līdz 2010. gadam). Ierosmes šā darba atbalstam ir, piemēram, e-valdība, vienas institūcijas apstiprinājums [38] vai centrālie reģistrācijas biroji, fiskālo tiesību aktu samazināšana, administratīvo procedūru, kas saistītas ar nodarbinātību un pašnodarbinātību vai pārvaldību ierosmēm, vienkāršošana. · e-valdība un IKT risinājumi, lai samazinātu birokrātismu valsts pārvaldē: tādu portālu izveide, kas ietver tiesību aktus un veidlapas (pieprasījumus, ziņošanas instrumentus, utt.), palielināta platjoslas pieejamība. · Tiesību aktu pārskatīšana: lai nodrošinātu, ka to mērķi joprojām ir spēkā – darba tiesību vienkāršošana, labas reglamentējošās prakses izplatīšana ar valdību starpniecību, tiesību aktu izmaksu un labumu analīze, uzņēmējdarbības reglamentēšanas foruma izveide, kurā ieinteresētās personas pārbauda uzņēmējdarbībai uzliktos slogus, labas reglamentācijas vispārīgie principi, kā vajadzība, proporcionalitāte, subsidiaritāte, pārredzamība, pārskatatbildība, pieejamība un vienkāršība. · Nodokļu uzlikšanas, administrēšanas un ziņošanas vienkāršošana: īpaši vienas institūcijas apstiprinājums uzņēmumiem, MVU un pilsoņiem, korporatīvā un kapitāla ienākumu nodokļa reforma. · PVN saistību vienkāršošana, piemēram, likvidējot nodokļu šķēršļus pārrobežu darbībās, ieviešot noteikumus, lai pieļautu nodokļu atvieglojumus ieguldījumiem pensiju shēmās ES dalībvalstīs, palīdzot gan migrantiem, gan pārrobežu pakalpojumu sniedzējiem. · Iekšējā tirgus tiesību aktu izpildes uzlabošana, lai maksimāli palielinātu labumu no tā. · MVU: labāka pieeja finansēm, ziņošanas prasību samazinājums, vienas institūcijas apstiprinājuma izveide uz tīmekļa pamata uzņēmumu dibināšanai. · Kopējie sākuma datumi (CCD) [39]. Paraugprakses apmaiņa starp dalībvalstīm un speciālistu veiktas salīdzinošās pārskatīšanas ir būtiski svarīgas, lai uzlabotu normatīvo vidi. Komisija atvieglo šo darbu ar Augstā līmeņa grupas par labāku reglamentāciju, kā arī Lisabonas procesa starpniecību. Dalībvalstis un reģioni jāmudina strādāt kopā pie labās prakses attīstības, piemēram, ar BEST ierosmes starpniecību [40]. 3. NOBEIGUMS Šī vienkāršošanas stratēģija, kas ir labākas reglamentācijas ierosmes pamatā, dod pirmos rezultātus. Eiropas Komisija ir apņēmusies virzīties uz priekšu, lai izpildītu apņemšanos veicināt stipru normatīvo vidi, izmantojot bagātinātu un mērķtiecīgu mainīgo programmu. Lai sasniegtu mūsu kopīgo mērķi, Padomei un Parlamentam jāpastiprina sava līdzdalība, lai panāktu vienkāršošanas darba noslēguma posmu. Dalībvalstīm arī jādara sava darba daļa. Pilnīgā saskaņā ar labākas reglamentēšanas principiem Komisija nolēma sākt paplašinātu ietekmes novērtējumu, lai turpmāk izskatītu iespējas tostarp esošās regulas atcelšanu vai daļēju liberalizāciju, un atkal apspriesties ar ieinteresētajām personām; b) nesenie starptautiskie notikumi enerģētikas jomā un turpmākas debates par enerģētikas drošumu lika Komisijai atlikt, varbūt līdz 2008. gadam, tās plānoto pārskatīšanu attiecūbā uz tiesību aktiem par naftas krājumiem. Komisijas turpmākā politika šajā jomā lielā mērā būs atkarīga no apspriežu rezultāta par Zaļo grāmatu par enerģētikas politiku, ko Komisija iesniegusi apspriešanai 2006. gada martā. [40] Uzņēmējdarbības vides vienkāršošanas darba spēks (BEST) tika izveidots 1997. gadā: iesaistot pārstāvjus no dalībvalstu uzņēmējdarbības kopienas un valsts iestādēm, BEST rezumējums bija sagatavot neatkarīgu ziņojumu par veidiem, kā uzlabot tiesību aktus un novērst liekus kavējumus Eiropas uzņēmumu, jo īpaši mazo un vidējo uzņēmumu (MVU), attīstībā. BEST ekspertu grupa ir identificējusi paraugprakses ierosmes (piemēram, veicinot vienas institūcijas apstiprinājumus, uz risku pamatotu reglamentāciju), kas sāktas dažādās valstīs ar mērķi, ko citi var mācīties no savas pieredzes. Uz risku pamatotas reglamentācijas mērķis ir koncentrēt reglamentācijas centienus (un uzņēmumiem radušās izmaksas) uz tām darbībām, kas rada lielāku risku veselībai un videi.
