Teisės aktų leidėjams pateiktų teisės aktų pasiūlymų atrankos rezultatai

Kaip pranešama 2005 m. kovo 16 d. komunikate dėl „Reglamentavimo gerinimas augimui ir užimtumui Europos Sąjungoje skatinti“[1], Komisija nusprendė iš esmės kitaip siekti užtikrinti, kad teisės aktų kokybė Europoje padėtų siekti augimo ir užimtumo partnerystės tikslų.

Siekiant padidinti Europos konkurencingumą, Europos Sąjungos teisinė aplinka turi atitikti pačius aukščiausius standartus. Siekiant šio tikslo, acquis communautaire, turi būti supaprastintas ir, jei reikia, atnaujintas; šiam tikslui numatomas priemonių rinkinys, įskaitant, visų pirma, 2005 m. spalio mėn. pradedamą naują paprastinimo programos etapą.

Komisija taip pat nusprendė, kad reglamentavimo gerinimas turi būti įterpiamas į politikos formavimo procesą ir kad naujais Komisijos teikiamais teisės aktų pasiūlymais turi būti siekiama gerinti reglamentavimą ir konkurencingumą. Tai įgyvendinama laikantis reikalavimo įvertinti naujų teisės aktų leidimo iniciatyvų poveikį, kaip skelbiama 2005 m. Komisijos teisėkūros ir darbo programoje, dėl kurios buvo neseniai priimtos daug apimančios ir išsamios gairės[2].

Kovo mėnesio komunikate buvo nustatytas Komisijos ketinimas „atlikti pirminę svarstymo Taryboje arba Parlamente svarstomų pasiūlymų atranką, įvertinant jų visuotinį aktualumą, poveikį konkurencijai ir kitas pasekmes“ dėl anksčiau pateiktų ir vis dar priėmimo procese esančių Komisijos pasiūlymų. Šiame komunikate pateikiami šios atrankos, kuri yra pirma tokio pobūdžio atranka, tikslai, tvarka ir rezultatai.

1. Svarstomų pasiūlymų atrankos tikslai

Atrankos tikslas yra suteikti galimybę Komisijai užtikrinti, kad visi svarstomi teisės aktų pasiūlymai yra visiškai suderinami su Komisijos politiniais prioritetais, ir patikrinti, ar pasikeitusios aplinkybės pateisintų pirminės pozicijos persvarstymą.

Jei persvarstymas buvo būtinas, atranka taip pat nustatomos atitinkamos priemonės, kurių reikia imtis, pavyzdžiui, svarstomų pasiūlymų pakeitimas, pakeitimas kitais arba panaikinimas ir jų poveikio įvertinimo tikslinimas.

Tiksliau atranka yra siekiama patikrinti svarstomus pasiūlymus trimis aspektais:

Pirma, buvo patikrinta, ar svarstomi pasiūlymai yra suderinami su ES Lisabonos tikslais ir, visų pirma, su konkurencingumo didinimo tikslu. Svarstomiems pasiūlymams įvertinti šiuo aspektu yra naudojami kriterijai, nurodomi „konkurencingumo bandyme“, kuris yra neseniai peržiūrėtų poveikio įvertinimo gairių dalis[3].

Antra, buvo patikrinta ar svarstomuose pasiūlymuose pakankamai ilgą laikotarpį yra numatoma esminė teisėkūros proceso pažanga. Jei ne, taip pat buvo nagrinėjamos lėtos pažangos priežastys ir galimybės išspręsti šią problemą.

Trečia, buvo tikrinama, ar svarstomi pasiūlymai atitinka dabartinius geresnio reglamentavimo reikalavimus, visų pirma, atitinkamai įvertinti poveikį. Šis kriterijus, visų pirma, turi įtakos tiems pasiūlymams, kurie buvo pateikti, kai dar nebuvo oficialiai taikomas reikalavimas įvertinti poveikį.

2. Atrankos tvarka

2005 m. balandžio mėn. pradėjus vykdyti atranką, bendras svarstomų pasiūlymų skaičius buvo 489[4]. Kovo komunikate apibrėžtos atrankos taikymo sritis aiškiai apsiribojo svarstomais pasiūlymais, pateiktais iki 2004 m. sausio 1 d. Tokių pasiūlymų buvo 183.

Jie buvo kruopščiai įvertinti, ir buvo atrinkti 100 pasiūlymų, kurie iš tikrųjų buvo naujos teisėkūros iniciatyvos, bei buvo toliau tikrinama, ar jie neturės galimo neigiamo poveikio konkurencingumui, ir įvertinamas jų platesnis ekonominis poveikis. Likusieji pasiūlymai greičiausiai turėtų ribotą poveikį konkurencingumui arba niekaip jo neveiktų. Tai daugiausiai pasiūlymai, susiję su tarptautiniais įsipareigojimais, arba pritaikantys acquis prie mokslinės arba techninės pažangos. Keletas šių pasiūlymų taip pat tiesiogiai prisideda prie „geresnio reglamentavimo“, nes jie kodifikuoja arba supaprastina acquis .

3. Atrankos rezultatai

Atsižvelgdama į išsamią svarstomų pasiūlymų analizę, Komisija nustato dvi plačias veiklos sritis:

(1) Pasiūlymai, kuriuos reikia panaikinti. Komisija ketina panaikinti iš viso 68 pasiūlymus. Šie pasiūlymai nesiderina su Lisabonos tikslais ar geresnio reglamentavimo principais arba jų daroma pažanga teisėkūros procese yra nepakankama, arba jie nebėra aktualūs[5] (pvz.: jų tikslų jau siekiama arba bus siekiama kitomis priemonėmis). Keletas šių pasiūlymų gali būti persvarstyti atsižvelgiant į tolesnę analizę. Kai kuriais atvejais Komisija ketina apsvarstyti, ar reikia imtis veiksmų dėl teisės aktų pasiūlymų, atsižvelgdama į išsamią poveikio analizę.

(2) Pasiūlymai, kurie turi būti paliekami teisėkūros procese, bet teisėkūros institucijoms įvertinti turi būti pateikta jų ekonominė analizė[6]. Tai taikoma 5 Komisijos manymu vis dar svarbiems pasiūlymams, tačiau papildomai pateikta tolesnė jų poveikio analizė leistų teisėkūros institucijai lengviau priimti sprendimus.

Dėl Komisijos vykdomos atrankos 73 svarstomi pasiūlymai bus vienaip ar kitaip pakeisti. Tai pasiūlymai, kurie nevisiškai atitinka konkurencingumo tikslus, pasiūlymai, dėl kurių teisės aktų leidėjams įvertinti turi būti pateikta tolesnė ekonominė analizė, taip pat pasiūlymai, kuriais nedaroma pakankama pažanga teisėkūros procese arba kurie yra pasenę.

Vien panaikinami pasiūlymai sudaro apie 31 %[7] visų svarstomų pasiūlymų, pateiktų iki 2004 m. sausio 1 d. Iš viso imamasi veiksmų dėl 33 %[8] šių svarstomų pasiūlymų, įskaitant pasiūlymus, kuriems būtina tolesnė ekonominė analizė.

Be to, mažiausiai 2 pasiūlymų atrankos rezultatai tiesiogiai nepriklauso pirmiau išvardytoms kategorijoms. Pirma, dėl Tarybos direktyvos pasiūlymo dėl būtiniausių sveikatos ir saugos reikalavimų, susijusių su fizinių veiksnių (optinės spinduliuotės diapazono) keliama rizika darbuotojams (1992/0449/COD) Komisija, atsižvelgdama į atranką, nusprendė, kad su optinės spinduliuotės diapazono keliama rizika susiję aspektai turėtų būti ištrinti, kaip siūlė ir Parlamentas.

Antra, dėl pasiūlymo dėl laikinųjų darbuotojų (2002/0072/COD) Komisija ir toliau išlaiko galimybę persvarstyti šį pasiūlymą atsižvelgiant į būsimas diskusijas dėl kitų pasiūlymų.

Šio komunikato priede apibendrinama esama padėtis ir pateikiami atitinkamų pasiūlymų duomenys.

Išvada

Svarstomų pasiūlymų atranka yra pirma tokio pobūdžio Komisijos vykdoma atranka. Tai rodo, kad Europos Komisija vykdo augimo ir užimtumo partnerystės įsipareigojimą ir užtikrina, kad geresnio reglamentavimo principai būtų veiksmingai įgyvendinami praktikoje.

Veiksmai, kurių imamasi dėl atrankos, t.y. planuojami priede nurodomi svarstomų pasiūlymų pakeitimai yra skirti veiksmingai siekti Lisabonos tikslų remiant konkurencingumą, palankesnės teisinės aplinkos kūrimui skatinti ir pasiūlymams, kurių priėmimas neturi perspektyvų arba kurie yra pasenę, panaikinti.

Kai kuriais atvejais sprendimai bus panaikinami dėl visos atitinkamos politikos performavimo arba siekiant persvarstyti pasiūlymus atsižvelgiant į naujus politikos aspektus ir išsamią poveikio analizę.

Pagal Pamatinio susitarimo dėl santykių tarp Europos Parlamento ir Komisijos įsipareigojimus (32 dalis) Komisija iš anksto praneša Parlamentui ir Tarybai apie ketinimą panaikinti savo pasiūlymus.
