Two- or three-wheeled motor vehicles: stands for two-wheeled vehicles

1) OBJECTIVE

To harmonize the national laws and to set up a component type-approval procedure in respect of stands for two-wheeled motor vehicles.

2) ACT

Council Directive 93/31/EEC of 14 June 1993 on stands for two-wheeled motor vehicles [Official Journal L 188 of 29.07.1993].

Amended by:

Commission Directive 2000/72/EC of 22 November 2000 [Official Journal L 300 of 29.11.2000].

3) SUMMARY

Directive 93/31/EEC

This Directive forms part of the approval procedure for two or three-wheeled motor vehicles, initially put in place by Directive 92/61/EEC which was repealed and replaced by Directive 2002/24/EC.

The vehicles covered by the Directive are as follows:

  • mopeds: two- or three-wheeled vehicles powered by an engine having a capacity not exceeding 50 cm3 and having a maximum design speed of not more than 45 km/h;
  • motorcycles: two-wheeled vehicles with or without sidecar powered by an engine having a cylinder capacity of more than 50 cm3 and/or having a maximum design speed of more than 45 km/h.

The general requirements concerning the design and fitting of stands are as follows:

  • all two-wheeled vehicles shall be provided with at least one stand;
  • the stand is to be either a prop stand or a centre stand, or both;
  • the stand is to be equipped with a steadying system which holds it in its closed or retracted position;
  • in addition the vehicles concerned may be equipped with a warning light which, when the ignition is switched on, lights up and remains lit until the stand is in the closed or retracted position.

There are individual specifications depending upon the type of stand.

Stand test conditions and explanatory diagrams.

The procedure for adapting the requirements to technical progress has been introduced.

The procedure for the granting of component type-approval is as follows:

  • the application for component type-approval is lodged with the competent authority within a Member State by the manufacturer or assembler;
  • the competent authority component type-approves the stand if this meets the requirements of this Directive and is in line with the information supplied by its manufacturer;
  • to that end that same authority fills out the component type-approval certificate annexed to this Directive.

The requirements concerning the stand form part of a body of 47 characteristics required by Council framework Directive 92/61/EEC, which must be supplied at one and the same time in order that two-wheeled vehicles can be type approved and placed on the Community market.

Directive 2000/72/EC

If the requirements concerning stands are fulfilled, Member States may not, with effect from 1 January 2002:

  • refuse to grant EC type-approval for a type of two-wheeled motor vehicle;
  • prohibit the registration, sale or entry into service of two-wheeled motor vehicles.

With effect from 1 July 2002, Member States shall refuse to grant EC type-approval for any new type of two-wheeled motor vehicle on grounds relating to stands if the requirements of Directive 93/31/EEC, as amended by this Directive, are not fulfilled.

Proposal for a Directive of the European Parliament and of the Council on stands for two-wheel motor vehicles [COM (2003) 147 final - Not published in the Official Journal].

On 1 April 1987, the Commission decided to instruct its staff that all legislative acts should be codified after no more than ten amendments to ensure that the Community rules were clear and readily understandable. The purpose of this proposal is therefore to codify Directive 93/31/EEC.
