Az elért eredményekről szóló első jelentés a szabályozási környezet egyszerűsítésére vonatkozó stratégiáról

Összefoglaló

Ez a bizottsági munkadokumentum a 2005. októberi, COM(2005) 535 számú, „A Közösség lisszaboni programjának végrehajtása: a szabályozási környezet egyszerűsítésére irányuló stratégiáról” című közleményt fejleszti tovább . Emellett a „Az Európai Unión belüli jobb szabályozás stratégiai felülvizsgálata ” című közlemény kiegészítésének is tekinthető.

Az EU-jogszabályok egyszerűsítése jelentős mértékben hozzájárulhat egy jobb szabályozási környezet megteremtéséhez, a szabályok naprakésszé tételéhez és korszerűsítéséhez, továbbá az európai gazdasági helyzet javítása céljából az adminisztratív terhek csökkentéséhez, figyelembe véve a technológiai, piaci és nemzetközi fejleményeket. A Bizottság ezért jelölte meg az egyszerűsítést az egyik legfontosabb prioritásént a jobb szabályozásra vonatkozó program keretében.

A bizottsági munkadokumentum a fenti háttérnek megfelelően áttekinti a 2005. októberi egyszerűsítés végrehajtása terén elért előrehaladást, foglalkozik a folyamatban lévő munkával, és bemutatja a 2006–2009 közötti időszakra vonatkozó, a jogszabályok egyszerűsítését célzó gördülő program erősítését célzó új kezdeményezéseket. Az egyszerűsítés egyik fő eredménye, hogy fokozatosan kiterjed valamennyi, az EK által szabályozott területre. A Bizottság munkadokumentuma az egységes szerkezetbe foglalás helyzetét is ismerteti.

Ezzel párhuzamosan ez az elért eredményekről szóló első jelentés az egyszerűsítési célkitűzések eléréséhez szükséges sikertényezőkkel is foglalkozik, vagyis megalapozott módszerekkel, az Európai Parlamenttel és a Tanáccsal a munka kiteljesítése érdekében folytatott intézményközi együttműködéssel, az önszabályozás és a társszabályozás fokozottabb mértékű használatával, továbbá a nemzeti szintű egyszerűsítéssel annak biztosítása érdekében, hogy az EU szintjén történő egyszerűsítésből adódó előnyöket ne szüntessék meg új, nemzeti szintű szabályok vagy technikai akadályok.

BEVEZETÉS

A Bizottság a 2005 márciusában megállapított, jobb szabályozásra irányuló szakpolitikájának politikai prioritásaival összhangban 2005 októberében új stratégiát fogadott el a szabályozási környezet egyszerűsítésére[1]. A stratégia átfogó célja az, hogy javítson a közösségi joganyag minőségén és hatékonyságán, továbbá hogy kiküszöbölje a gazdasági szereplők számára szükségtelenül felmerülő akadályokat, és ilyen módon járuljon hozzá az európai gazdaság versenyképességének növelésére vonatkozó célkitűzéshez.

Az Európai Parlament[2] általában véve üdvözölte a Bizottságnak a közösségi joganyag egyszerűsítésére irányuló programját, az Európai Tanács[3] pedig felszólította a Tanácsot, hogy adjon elsőbbséget az egyszerűsítésre irányuló javaslatok kidolgozásának a jogalkotási rendszer egészében. A társjogalkotókkal való együttműködés létfontosságú az egyszerűsítésre irányuló javaslatok megvalósítása szempontjából.

Ez a bizottsági munkadokumentum „Az Európai Unión belüli jobb szabályozás stratégiai felülvizsgálata”[4] című dokumentum kiegészítéseként első alkalommal számol be az eredményekről a stratégia 2005 októberében történt elindítása óta, és az egyszerűsítési stratégia célkitűzéseinek megvalósítása terén mutatkozó új fejleményeket ismerteti. Különösen:

- „helyzetképet” nyújt az egyszerűsítési stratégia végrehajtásáról és az egységes szerkezetbe foglalás folyamatáról, a következőkre összpontosítva:

- a jogszabályok egyszerűsítését célzó gördülő program keretében megvalósított intézkedések,

- további munkát igénylő, folyamatban lévő intézkedések, illetve

- a Bizottság által meghatározott új intézkedések.

- foglalkozik a valóban egyszerűsített szabályozási környezet eléréséhez szükséges alapvető sikertényezőkkel, vagyis megalapozott módszerekkel l, az EU-intézmények közötti szoros együttműködéssel, az önszabályozás és a társszabályozás fokozottabb mértékű használatával, továbbá a nemzeti szintű egyszerűsítéssel.

A 2006–2009 közötti időszakra vonatkozó, naprakésszé tett, a jogszabályok egyszerűsítését célzó gördülő program integrálja a Bizottság 2007. évi jogalkotási- és munkaprogramjában megállapított egyszerűsítési kezdeményezéseket, és áttekintést nyújt a Bizottságnak a jelenlegi szabályozási környezet több év alatt történő egyszerűsítésére irányuló törekvéseiről. A tény, hogy most először szerepelnek egyszerűsítésre irányuló kezdeményezések a Bizottság 2007. évi jogalkotási- és munkaprogramjában, egyértelműen az egyszerűsítési stratégiának biztosított politikai prioritás jele.

Folyamatban van a szabályozási kultúra változása. A Bizottság most először igazította ki munkamódszereit, prioritásait és forrásait az egyszerűsítésre irányuló célkitűzések alapján. Az egyik legfőbb eredmény az, hogy mindez fokozatosan kiterjed valamennyi szakpolitikai területre.

A jövőben az adminisztratív teher csökkentésével kapcsolatosan folyamatban lévő munka az egyszerűsítési folyamat része lesz, mely hozzájárul majd az EU-s és a nemzeti jogszabályok mennyiségének összességében 25%-kal történő csökkentésére vonatkozó 2012-re kitűzött célhoz, a jobb szabályozás stratégiai felülvizsgálatában megállapítottaknak megfelelően.

A fentiekkel összhangban az érintettekkel folytatott széles körű konzultáció eredményei és a hatásvizsgálatok hozzájárulnak a Bizottság új javaslatainak jobb minőségéhez, és fokozottabban lehetővé teszik a jogalkotók számára egy olyan szabályozási környezet kialakítását, amely teljes mértékben összhangban van a szubszidiaritás elvével, és ösztönzőbb a versenyképesség, az innováció és a növekedés tekintetében. Mindez valószínűleg megkönnyíti a jövőbeli egyszerűsítési munkát.

Rendszeresen készülnek majd az elért eredményről szóló jelentések.

1. HELYZETKÉP

1.1. Helyzetkép – a jogszabályok egyszerűsítését célzó gördülő program

A 2005. októberi egyszerűsítési stratégia számos egyszerűsítési módszerre kitér a hároméves gördülő program tekintetében, és a 2005–2008 közötti időszakra kiindulásként körülbelül 100 olyan kezdeményezést sorol fel, melyek a Bizottság által a tagállamokkal, a vállalatokkal és a polgárokkal folytatott széles körű konzultációk alapján egyszerűsíteni kívánt 220 alap-jogiaktusra vonatkoznak.

Tekintettel a közösségi joganyag folyamatos felülvizsgálatának jelentőségére, a Bizottság most további 43 olyan kezdeményezést állapított meg, melyek a 2006–2009 közötti időszakra vonatkozó egyszerűsítési lehetőségekkel foglalkoznak. Ezek az I. mellékletben ismertetett naprakésszé tett gördülő programban szerepelnek.. A program megerősíti a Bizottság arra irányuló elkötelezettségét, hogy csökkentse a szabályozási keret okozta adminisztratív terhet, és hogy naprakésszé tegye és korszerűsítse a szabályokat, figyelembe véve a technológiai, piaci és nemzetközi fejleményeket.

1.1.1. A Bizottság által elért eredmények

A 2005-re tervezett 14 kezdeményezésből[5] 12-t sikerült megvalósítani. 2006-ot illetően a 2005. októberi közlemény 54 kezdeményezést irányzott elő, 3-at újonnan határoztak meg, egynek a végrehajtása 2005-ből maradt vissza, egyet pedig 2008-ról hoztak előre. Ezek közül mostanáig 15 kezdeményezést fogadtak el[6]. Emellett 24 egyszerűsítési javaslat év végéig történő elfogadását erősítették meg, és ezek az I. mellékletben szerepelnek. 15-öt 2007/2008-ra halasztanak. Alapos felülvizsgálatok és az érintettekkel folytatott konzultációk 5 kezdeményezés visszavonását eredményezték.

A Bizottság mostanáig a 2005–2006-ra tervezett 71 kezdeményezésből 27-et fogadott el, és a program több mint felét fogadják el 2006 végéig. Az egyszerűsítési gördülő program 2006. évi alakulásának üteme az adott terület bonyolultságától függően változik, és egyes esetekben általában elmarad a tervektől, bár néhány kezdeményezés elfogadására az eredeti terv szerinti időpontnál hamarabb sor került. Azonban az elhalasztott kezdeményezések mindegyikét megerősítették 2007-re.

Hangsúlyozandó, hogy ez a program mindenképpen a Bizottság által kezdeményezett valaha volt legambiciózusabb egyszerűsítési terv. Az egyszerűsítési program nehéz feladat, amennyiben a vállalkozások és a polgárok számára jelentkező előnyöket az új szabályozási környezethez való igazodáshoz szükséges erőfeszítések és költségek tekintetében kell kiegyensúlyozni. Az egyszerűsítés szabályozási reformot is jelenthet egyes szakpolitikai területeken. A reformtervekből eredő változások által kiváltott ellenállás legyőzése érdekében gyakran több idő szükséges, hogy a javasolt változások átfogó, tiszta makroökonómiai előnyei megvilágíthatóak legyenek.

Emellett a hatásvizsgálatok új, releváns elemekre hívhatják fel a politikai döntéshozók figyelmét a legmegfelelőbb politikai döntés kiválasztásakor[7]. Az egyszerűsítési program végrehajtását ezen hatásvizsgálatok eredményeinek figyelembe vétele mellett végzik.

Szinte valamennyi, a Bizottság által benyújtott egyszerűsítési javaslat még mindig a Tanács és az Európai Parlament előtt van. E javaslatokat a 3. melléklet ismerteti.

Néhány eredményt alább ismertetünk, és ezekből kiderül, hogy a Bizottság egyszerűsítési programja már foglalkozott a vállalkozások és a polgárok számára fontos főbb területekkel.

A Bizottság által elfogadott javaslatok között szerepelnek például az alábbiak:

- Korszerűsített vámkódex és elektronikus vámkezelés [8]: a közösségi vámjogszabályok átdolgozása és a hatóságok és a vállalatok közötti adatcserét szolgáló páneurópai elektronikus rendszerek megteremtése. A nemzetközi kereskedelmet ésszerűsített és egyszerűsített vámeljárások és vámszabályok, automatizált és egymással összeköttetésben álló vámügyi rendszerek, továbbá az áruk közösségi határokon át történő mozgásában érintett valamennyi hatóság és szerv szoros együttműködése segíti elő.

- Környezet [9]: a hulladékgazdálkodási keretirányelv korszerűsítése:

- A hulladékgazdálkodási jogszabályok egyszerűsítése a fogalommeghatározások egyértelművé tétele, a veszélyes hulladékokra és a hulladékolajra vonatkozó rendelkezések ésszerűsítése és az ilyen tárgyú irányelvek integrálása;

- Az újrafeldolgozási piac fejlesztése olyan környezetvédelmi normák megállapítása révén, melyek meghatározzák azon feltételeket, melyek megléte esetén az újrafeldolgozott hulladék már nem minősül hulladéknak.

- A munkavállalók szabad mozgása [10]

- A nemzeti társadalombiztosítási rendszerek összehangolására vonatkozó hatályos rendelkezések korszerűsítése;

- A biztosítottakra vonatkozó eljárások megkönnyítése és a szociális biztonság terén (betegség, munkahelyi balesetek, foglalkozási megbetegedések, rokkantság, öregség, munkanélküliség, családi ellátások) működő intézmények számára a határon átnyúló esetekre történő reagáláshoz és azok feldolgozásához szükséges idő csökkentése.

- Élelmiszer-adalékanyagok és ízesítők [11]

- Az élelmiszer-adalékanyagokról szóló jogszabályoknak az elvekre, eljárásokra és jóváhagyásokra vonatkozó egyetlen jogi eszköz létrehozása által történő egyszerűsítése;

- Az engedélyezett élelmiszer-adalékanyagokra vonatkozó közösségi lista naprakésszé tételére irányuló eljárás hatékonyabbá tétele.

- A gyógyszeripar terén működő kis- és középvállalkozások [12]: a mikrovállalkozások tekintetében egyszerűsített szabályozási keret kialakítása, ideértve a csökkentett mértékű díjakat, a halasztott díjfizetésre vonatkozó lehetőséget és a kérelmeknek az Európai Gyógyszerértékelő Ügynökséghez történő benyújtása esetén adminisztratív és szabályozási segítségnyújtást.

- Fizetési szolgáltatások [13]: a fizetési szolgáltatásokra vonatkozó egyszerűsített szabályozási keret megteremtése a fogyasztók és a cégek tekintetében. A javaslat a jogszabályok egyszerűsítéséről rendelkezik (három irányelv és három ajánlás helyébe egy koherens szabályrendszert léptetve), a hatósági igazgatási eljárások egyszerűsítése (EK- vagy nemzeti szinten) és a magánfeleket érintő igazgatási eljárások egyszerűsítése. A javaslat több átláthatóságot biztosít, továbbá egyértelműbb, tömörebb tájékoztatási követelményekről rendelkezik a fizetési szolgáltatások felhasználói és a fogyasztók tekintetében.

- Számviteli szabályok [14]: a meglévő számviteli szabályok oly módon történő módosítása, hogy a tagállamok több lehetőséget kapjanak vállalatoknak bizonyos közzétételi előírások alól történő mentesítésére (az ilyen közzétételre vonatkozó küszöbök emelésével). Ez a kisebb cégek tekintetében adminisztratív egyszerűsítést eredményez.

- Strukturális vállalati statisztika (SBS) [15]: a javaslat az SBS-adatok előállítását egyszerűsíti nagyjából 15 (a K+F-re, a foglalkoztatásra, az energiára és a pénzügyi lízingre vonatkozó) kötelező változó elhagyása, egyes változóknak az éves adatgyűjtésből a többéves adatgyűjtésbe történő átvitele és a választható változók törlése révén. Emellett az Eurostat programot dolgoz ki a vállalati statisztikák újbóli kialakítása érdekében, hogy a tagállamok számára olyan új módszerek álljanak rendelkezésre, amelyek révén lényegesen csökkenthető a válaszadási teher, pl. az adminisztratív adatok intenzívebb felhasználása és a vállalati elszámolások automatikus elektronikus továbbítása útján.

- Légi közlekedési piac [16]: az úgynevezett harmadik légi közlekedési liberalizációs csomag három hatályos rendelet egyetlen új rendeletben történő kombinálása útján kell, hogy átláthatóbbá tegye a jogszabályokat. A jogszabály korszerűsíti és egyszerűsíti a jogi keretet, valamennyi tagállamban koherens alkalmazást biztosít, és kezeli az egyes piaci szegmenseken mutatkozó potenciális versenytorzulásokat és versenykorlátozásokat. Mindezek a fogyasztók számára több választási lehetőséget, alacsonyabb árakat, fokozottabb versenyt kell, hogy eredményezzenek.

1.1.2. A folyamatban lévő munka

Számos, a versenyképesség szempontjából fontos jelentősebb egyszerűsítési kezdeményezést már megerősítettek 2006/2007/2008-ra, és ezeket az alábbiakban ismertetjük:

- Mezőgazdaság : a 21 közös piacszervezési rendszer egyetlen rendszerben történő összevonása olyan ésszerűsített horizontális jogi keret megteremtése érdekében, mely egyetlen harmonizált szabályrendszerben rendelkezik a piaci politika számos területéről, ideértve az intervenciót, a magántárolást, a behozatali vámkontingenst, az export-visszatérítéseket, a védintézkedéseket, a mezőgazdasági termékeket, az állami támogatásra vonatkozó szabályokat, a közleményeket és az adatszolgáltatást.

- Környezet : a környezetszennyezés integrált megelőzéséről és csökkentéséről szóló (IPPC) irányelv és az ipari kibocsátásokról szóló további kapcsolódó jogszabályok felülvizsgálata (különösen a jelentéstétel tekintetében) a fokozottabb egyszerűség és konzisztencia, továbbá a követelmények ésszerűsítése érdekében.

- Az építési termékekről szóló irányelv, az adminisztratív teher, különösen a KKV-k tekintetében történő egyértelművé tétele és csökkentése érdekében, a következők révén: a műszaki előírások kialakítása és alkalmazása terén nagyobb fokú rugalmasság, enyhébb tanúsítási szabályok és az olyan végrehajtási akadályok kiküszöbölése, melyek mostanáig megakadályozták az építési termékek tekintetében egy teljes körű belső piac kialakítását.

- Statisztika : a gazdasági szereplők, különösen a KKV-k statisztikai adatszolgáltatási kötelezettségeinek enyhítése, az Unió jobb statisztikai irányítására vonatkozóan folyamatban lévő munkára és az adminisztratív teher mérésére és csökkentésére vonatkozó, folyamatban lévő kísérleti projektek végleges eredményére figyelemmel.

- Élelmiszerek és takarmányok címkézése : a jogszabályok korszerűsítése egyértelműbbé teszi a címkézésre vonatkozó szabályokat annak érdekében, hogy a fogyasztók tájékozottabb, biztonságosabb, egészségesebb és fenntarthatóbb döntéseket hozhassanak, továbbá egy olyan versenybarát piaci környezet megteremtése érdekében, melyben a gazdasági szereplők hatékonyan alkalmazhatják a címkézést termékeik értékesítése során.

- Fogyasztóvédelem : a teljes fogyasztóvédelmi joganyag ésszerűsítése és egyszerűsítése az esetleges inkonzisztenciák, átfedések, belső piaci akadályok és versenytorzulások kiküszöbölése érdekében.

- Kozmetika : a kozmetikai irányelvet 30 éve fogadták el, és több mint 40-szer módosították. A szöveg konzisztenciája és egyértelműsége érdekében annak átdolgozására van szükség. Ennek segítségével csökkenhetnek az irányelv végrehajtásával és irányításával összefüggő adminisztratív költségek, ugyanakkor viszont az állatkísérletek fokozatos betiltására vonatkozó jelenlegi rendszer változatlan marad.

- Számviteli és pénzügyi beszámolási standardok : az EU-s cégek számára naprakész pénzügyi beszámolási standardok rendelkezésre bocsátása a hatályos rendeletek[17] szerinti, 2 000 oldalas rendszer egyetlen felhasználóbarát rendeletben történő összevonása útján.

- Gépjármű-szabályozási keret : a jogalkotási szakaszban lévő javaslat a gépjárművek típusjóváhagyásáról szóló keretirányelv felülvizsgálatára vonatkozóan elfogadása esetén az alábbiakat teszi lehetővé:

- az EK-irányelvek ENSZ/ECE-rendeletekkel történő felváltása. Ezzel az egyszerűsítéssel ésszerűsíthetők a rendeletek, és kiküszöbölhetők a felesleges követelmények. Emellett ennek segítségével a globális ipar kiküszöbölheti a kereskedelem nem tarifális akadályait, megtartva az EU vezető szerepét a nemzetközi szabványok kifejlesztése terén, és lehetővé téve az ipar számára a nemzetközi szintű technikai fejlődéshez történő gyorsabb igazodást;

- a 25 EK-irányelvben és az ENSZ/ECE-rendeletekben a saját és a virtuális teszteléshez szükséges technikai rendelkezések bevezetése. Ezzel lehetővé válik a típus-jóváhagyási eljárás egyszerűsítése, és a szabályozási környezet a technológiai fejlődésnek megfelelő szinten tartható. A virtuális és a saját tesztelés meggyorsítja a termékfejlesztést, és mind az ipar, mind a fogyasztók tekintetében csökkenti a költségeket. Emellett a Bizottság jelenleg tesz javaslatot az irányelvben a gépjárművek jóváhagyására vonatkozó általános rendelkezésre, melynek eredményeként a gyártók tesztelő-laboratóriumként járhatnak el, amennyiben a típus-jóváhagyási hatóság elismerte az ehhez szükséges kompetencia meglétét.

- A közúti szállítási piacra és szakmába történő bejutás : négy rendelet és egy irányelv átdolgozása a szakmába és a piacra történő bejutásra irányadó szabályok egyértelművé tétele, egyszerűsítése és végrehajthatóbbá tétele érdekében, ideértve a közúti árufuvarozási kabotázst és a személyszállítást. Az átdolgozással nemzetközi síkon is lehetővé válik a szabályok harmonizált alkalmazása és költséghatékony végrehajtása, ilyen módon korlátozható a verseny torzulása, oltalmazható a letelepedés joga valamint javítható a szolgáltatások minősége és a közúti biztonság.

- A termékek értékesítéséről szóló, új megközelítésű technikai rendeletek/irányelvek[18] konzisztens fogalommeghatározások, egyszerűsített tanúsítási eljárások és ésszerűsített igazgatási együttműködés mentén történő egységes szerkezetbe foglalása a termékek kereskedelmi forgalmának megkönnyítése, ugyanakkor a gyártók nem megfelelő termékekkel szemben történő védelme érdekében.

1.1.3. Az egyszerűsítésre irányuló gördülő program megerősítését célzó kezdeményezések

A múlt évben elindított gördülő program alapján a Bizottság a 2006–2009 közötti időszakra 43[19] új kezdeményezéssel erősíti meg egyszerűsítési intézkedéseit a következők érdekében:

- az innováció ösztönzése és a szabályozási követelményekből eredő adminisztratív terhek csökkentése;

- a közösségi joganyag mennyiségének csökkentése és rugalmasabb szabályozási megközelítés felé történő átmenet ösztönzése.

Néhány fontosabb kezdeményezést az alábbiakban ismertetünk:

- a gyógyszerek engedélyezés utáni módosítására vonatkozó szabályok (az úgynevezett módosítási rendeletek) egyszerűsítése . Az ilyen szabályoknak a vállalatok szabályozási részlegein történő adminisztratív végrehajtása jelenleg az emberi erőforrások és pénzügyi költségek 60%-át veszi igénybe. Egyes esetekben e teher megakadályozhatja a betegek és a társadalom javát szolgáló változások bevezetését, és ezáltal az innovációt. Az eljárásokat olyan módon ésszerűsítik, hogy a módosítási rendeletek egyszerűbbekké, egyértelműbbekké és rugalmasabbakká váljanak, a közegészségügy és az állategészségügy területén bármilyen hátrányos következmény nélkül.

- A harmonizált közösségi szabályok által nem szabályozott áruk kölcsönös elismerésének biztosítása[20]. A Bizottság jelenleg dolgozik az áruk EU-n belüli szabad mozgását gátló technikai akadályok kiküszöbölésére vonatkozó jogalkotási javaslaton („a kölcsönös elismerésről szóló javaslat”). Ez a jogi eszköz meghatározza egyrészről a nemzeti hatóságok, másrészről pedig egy tagállamban törvényesen gyártott vagy forgalmazott termékeket másik tagállamban értékesíteni kívánó vállalatok jogait és kötelezettségeit.

- Az újszerű/új élelmiszerek biztonsági értékelésének meghatározásának és alkalmazási körének egyértelművé tétele és az engedélyezési eljárás ésszerűsítése.

- Az adminisztratív eljárások végrehajtásának egyszerűsítése a mezőgazdaság területén, számos technikai egyszerűsítés végrehajtása útján. Gördülő cselekvési tervet hoztak létre a gazdálkodókra, más gazdasági szereplőkre és a nemzeti igazgatásra közvetlen hatással bíró jogi rendelkezések módosítása érdekében. A módosítások tárgya például a gazdálkodók kötelezettsége a dokumentumok rendelkezésre tartására vonatkozóan, a tagállamok ellenőrzési kötelezettsége, a támogathatóság feltételei stb.

- A közös halászati politika egyszerűsítése és fejlesztése a Bizottság által 2005-ben elfogadott, a jogi és igazgatási egyszerűsítés a „2006–2008 közötti időszakra vonatkozó cselekvési terv”-vel[21] összhangban történő végrehajtása útján. A cselekvési terv a halászati tevékenységek irányításáról és ellenőrzéséről szóló egyes szabályozási rendelkezésekre irányul például a jogi keret jobb értelmezhetősége és a halászok és az érintett adminisztrációs munkatársak adminisztratív terhének csökkentése érdekében.

- Az elektronikus kommunikációs hálózatok és szolgáltatások szabályozási keretének felülvizsgálata csökkenti majd az előzetes szabályozás szükségességét, illetve elősegíti a rugalmasságot és az innovációt úgy az iparág, mint a polgárok érdekében.

- A textilirányelvek egyetlen rendelettel történő felváltása az új szálak elnevezésének elfogadására irányuló eljárások egyszerűsítése érdekében. Emellett a száltartalom mérésére vonatkozó kvantitatív módszereket is bevonják a szabványosítási eljárásba.

- A játékokra vonatkozó hatályos jogszabályok egyszerűsítése az alapvető biztonsági előírások egyértelművé tétele és a nemzeti piacfelügyeleti hatóságok által alkalmazott megfelelőbb közös megközelítés feltételeinek kialakítása érdekében.

- A mérésügyi és a műtrágyákra vonatkozó jogszabályok alkalmazásának az „új megközelítés” keretében a lényegi előírásokra történő korlátozása. A részletes technikai leírások helyébe szabványok lépnek.

- A közösségi ökocímke-odaítélési rendszer felülvizsgálata a következők érdekében:

- Vállalkozásbarátabb rendszer megteremtése az érdekelteknek a döntéshozatali folyamatba történő bevonása és a KKV-k igényeinek figyelembe vétele útján;

- Az odaítélési feltételek kialakításának kijelölt szerv felé történő kiszervezése, illetve az ökocímke és a zöld közbeszerzés szoros kapcsolatának kialakítása.

- A gyümölcstermő növények szaporítóanyagai, illetve a gyümölcstermesztésre szánt gyümölcstermő növények forgalmazásáról szóló irányelv átdolgozása.

- A foglalkozási eredetű, izom- és csontrendszeri rendellenességekről egyetlen jogi aktusban történő rendelkezés, mely aktus integrálja a különféle hatályos egészségügyi és biztonsági minimum-előírásokat, például a kézzel történő rakodás vagy a képernyő előtt végzett munka tekintetében.

2009-re valamennyi bizottsági szervezeti egység elvégzi a hatáskörébe tartozó joganyag felülvizsgálatát a jogi aktusok relevanciája, a szabályozási technika megválasztása és a 2005. októberi egyszerűsítési stratégiában megállapított valamelyik egyszerűsítési technika alkalmazási köre tekintetében. Ez adott esetben új egyszerűsítési kezdeményezések megállapítását és a gördülő program jövőbeli naprakésszé tételét eredményezheti.

1.2. Helyzetkép – egységes szerkezetbe foglalás

Az egységes szerkezetbe foglalás az Európai Bizottság jobb szabályozásra irányuló programjának alapvető része. Az egységes szerkezetbe foglalás során a hatályos jogszabályok rendelkezéseit és azok módosításait egyetlen jogi aktusba foglalják, ezáltal csökkentve az EU jogszabályainak mennyiségét és biztosítva azok átláthatóbb, értelmezhetőbb és jogilag egyértelmű mivoltát.

Az egységes szerkezetbe foglalásra vonatkozó gördülő program (2. melléklet) körülbelül 500 jogi aktust ölel fel. Összesen 52 jogi aktus tekintetében hajtották végre sikeresen az egységes szerkezetbe foglalásra vonatkozó eljárást[22] és történt meg ezek elfogadása és a HL-ben történő közzététele (38 bizottsági és 14 európai parlamenti és tanácsi jogi aktus). Emellett 33 aktus van jelenleg a jogalkotási szakaszban a jogalkotó szervnél, 8 pedig az írásbeli szakaszban. Összesen 85 aktust véglegesített az Európai Bizottság.

Az egységes szerkezetbe foglalás program 2008 közepéig történő véglegesítésére vonatkozó célkitűzés elérése érdekében az eredeti szövegek új EU-nyelvekre történő fordításában mutatkozó hátralék feldolgozásának meggyorsítását célzó intézkedések meghozatalára került sor. A hátralék oka az adott nyelveken egységes szerkezetbe foglalt szövegek fordításának elkészítésében mutatkozó késedelem.

Megfelelő intézkedéseket hoztak továbbá a bolgár, román, ír és máltai nyelven rendelkezésre álló, egységes szerkezetbe foglalt szövegek számának maximalizálása érdekében, elsőbbséget adva az olyan jogi aktusok egységes szerkezetbe foglalásának, ahol a vonatkozó fordítás már elkészült.

Emellett az egységes szerkezetbe foglalásra váró jogi aktusok elfogadására irányuló program is elkészült. A cél a folyamat átláthatóságának biztosítása, különösen az egységes szerkezetbe foglalással érintett jogi aktusok újabb módosításainak a minimumra történő korlátozására való ösztönzés útján, ilyen módon megszilárdítva az adott jogszabályokat és csökkentve a késedelmet. Ez a program egyelőre indikatív, mivel az egységes szerkezetbe foglalásra vonatkozó projekt véglegesítése az egységes szerkezetbe foglalandó jogi aktusok valamennyi nyelven történő rendelkezésre állásától függ. Ez különösen vonatkozik a bolgár és a román nyelvre. Emellett az egységes szerkezetbe foglalást az érintett jogi aktusok újabb módosítására vonatkozó tervek esetén el kell halasztani. A programban szereplő jogi aktusok sorrendje az említett két tényező alapján változhat.

Megjegyzendő továbbá, hogy az egységes szerkezetbe foglalt jogszabályoknak a jogalkotási szerv által történő elfogadására a jogszabályszövegek hivatalos egységes szerkezetbe foglalásának gyorsított munkamódszeréről szóló, 1994. december 20-i intézményközi megállapodásban megállapított szabályok irányadók.

2. SIKERTÉNYEZŐK

Az európai vállalkozásokra és polgárokra vonatkozó szabályozási környezetet számos, különféle (nemzetközi[23], közösségi, nemzeti, regionális és helyi) szinten létrehozott és gyakran egymásba fonódó jogszabály és szabály alkotja. E szabályozók egyike sem javíthat e jogalkotási háló minőségén egymaga. Az átfogó szabályozási keret konkrét minőségi javulásához minden szabályozási szinten elkötelezett, konzisztens és összehangolt törekvésekre van szükség.

2.1. A szilárd módszertani alapokon nyugvó egyszerűsítési munka

2.1.1. Konzultáció valamennyi féllel

Mind a kezdeti, mind a naprakésszé tett, 2006–2009-re vonatkozó egyszerűsítési gördülő program az érdekeltek és a tagállamok észrevételei alapján került kialakításra. Ezek tapasztalatai elengedhetetlenek egy tartalmas egyszerűsítési program elkészítéséhez. Az érdekeltekkel folytatott részletes konzultációk, egész szakpolitikai területek felülvizsgálata, a jogi aktusok utólagos értékelése és a szakértői vizsgálatok révén a politikai döntéshozók hatékonyabban azonosíthatják a tényleges problémákat. Az ilyen eljárások révén ezt követően az érdekeltek könnyebben teszik magukévá a javasolt intézkedést.

Az egyszerűsítésről szóló, 2005. októberi közlemény[24] számos egyedi kezdeményezésről értesített:

- „A Bizottság közleménye a közös agrárpolitika egyszerűsítéséről és jobb szabályozásáról” című dokumentumban megállapítottak szerint cselekvési tervet hoztak létre és ismertettek a 2006 októberében tartott, „Egységes KAP Európának: kihívás mindenki számára” című konferencián. A cselekvési terv 20, 2007-ig végrehajtandó konkrét projektet ismertet, melyek a technikai egyszerűsítést célozzák (a terhek csökkentése az adott politika módosítása nélkül). A cselekvési terv folyamatos egyszerűsítési folyamattal kezdődik. Az érdekelt feleket és a tagállamokat felkérik tehát további egyszerűsítési javaslatok benyújtására.

- A Bizottság 2005-ben fogadta el, az európai intézmények és a konzultációra felkért érdekelt felek teljes körű támogatása mellett, „a közös halászati politika egyszerűsítésére és javítására szolgáló, 2006–2008-ra vonatkozó cselekvési tervet”.

- A közösségi statisztika terén az adatszolgáltatási terhek csökkentéséről, az egyszerűsítésről és a prioritások megállapításáról szóló jövőbeli közlemény. E közlemény stratégiai megközelítést állapít meg a vállalatokra háruló statisztikai terhek további csökkentése érdekében két elem kombinálása útján: a kiválasztott, prioritást élvező területeken a statisztikai követelmények egyszerűsítése, továbbá a statisztikai kötelezettségek könnyebb teljesítését célzó statisztikai eszközök és módszerek terjesztése. A Bizottság különösen javaslatot tesz a vállalati statisztikák újbóli kidolgozását célzó Intrastat program egységes feldolgozási rendszerére, és aktívan törekszik a mezőgazdasági statisztikák európai rendszerének egyszerűsítésére.

A Szerződés 138. cikke emellett rendelkezik az európai szociális partnerekkel a szociálpolitikai területen tett közösségi kezdeményezésekről való konzultációról[25].

A konzultációs folyamat eredményeként egyes esetekben a bizottsági szolgálatoknak felül kellett vizsgálniuk eredeti szándékaikat. Például a társasági jogra és a szerzői jogra vonatkozó szabályozási keret felülvizsgálata során, melynek eredményeként további kezdeményezések születtek:

- A társasági jog tekintetében a Bizottság ez év vége előtt átfogó kezdeményezést tervez útjára indítani a társasági jog körébe tartozó irányelvekből eredő adminisztratív költségek felmérése céljából, hogy a tagállamokkal és az érdekeltekkel közösen megállapíthassa e költségek csökkentésének lehetséges mértékét. E program eredményét 2007 második felében egy közleményben ismertetik.

- A szerzői jog tekintetében a felülvizsgálat eredményeként számos intézkedés született, ideértve a 2001. évi szerzői jogi irányelv vizsgálatát is, mely többek között mentességeket állapíthat meg az irányelv alkalmazása alól. E program eredménye 2007 nyarára várható.

2.1.2. Ágazatspecifikus elemzés

A Bizottság korábbi közleményében megállapította, hogy az egyszerűsítés ágazatspecifikus megközelítésére van szükség a szabályozási környezet által az ágazati versenyképességre gyakorolt hatás jobb felmérése érdekében.

Folyamatban van például a munka az építési termékek terén. Ennek részeként az építési ágazatban érdekelt felek versenyképességét befolyásoló tényezők átfogó elemzésére is sor kerül, továbbá az építési termékekről szóló (89/106/EGK) irányelv egyszerűsítésére irányuló egyedi intézkedést is hoznak. Az érdekeltekkel folytatott konzultáció folyamatban van, eredményeit a Bizottság vizsgálja.

A gépjárművek területén a CARS 21 magas szintű csoport megvizsgálta azon főbb politikai területeket, melyek az európai gépjárműipar versenyképességére hatással vannak, és számos ajánlást tett.

Ezzel párhuzamosan jelenleg vizsgálják a jobb szabályozásra vonatkozó elvek alkalmazását az iparpolitikai közlemény[26] nyomon követése során létrehozott új fórum keretében. Ágazati szűrési tevékenységek kezdődtek olyan csoportokban, mint az IKT-versenyképességgel, illetve a gépgyártás területén a szakpolitikai párbeszéddel foglalkozó munkacsoportban.

2.1.3. Az adminisztratív teherrel kapcsolatosan jelenleg folytatott munka

Az Európai Tanács 2006. júniusi következtetéseire adott válaszul és az újból elindított lisszaboni program versenyképességi keretében a Bizottság 2007 elején átfogó cselekvési tervet kezd a hatályos EU-s jogszabályokból eredő adminisztratív teher mérése és csökkentése érdekében. A terv négy olyan tagállam (UK, NL, DK és CZ) korábbi tapasztalatain alapul, melyek jelentős, alapvető értékelések elvégzését követően már megállapítottak csökkentési célkitűzéseket. A Bizottság „Adminisztratív költségek mérése és adminisztratív terhek csökkentése az Európai Unióban”[27] című munkadokumentuma ismerteti a 2006-ban az adminisztratív terhekre vonatkozóan elvégzett azon kísérleti projekt eredményeit, mely ilyen korábbi tapasztalatokat vizsgál és ilyenekre épít. Ez a folyamat középtávon lehetővé kell, hogy tegye az EU jogalkotója és a tagállamok számára számszerű adatok alapján a további egyszerűsítésre teret kínáló, elsőbbséget élvező területek meghatározását.

Ezzel kapcsolatosan megjegyzendő, hogy a mezőgazdaság terén vizsgálat van folyamatban a gazdálkodók adminisztratív terheinek csökkentése tekintetében. A vizsgálat a 2003. évi KAP-reform és módosításai végrehajtásával foglalkozik. Az első eredmények 2007-ben állnak majd rendelkezésre.

2.2. Az EU-intézmények közötti szoros együttműködés

A Bizottság által készített, színvonalas jogalkotási javaslatok tekintetében a Tanács és a Parlament feladata az egyszerűsítési munka kiteljesítése.

22, a Bizottság által elfogadott egyszerűsítési javaslat van a Tanács és az Európai Parlament előtt (3. melléklet). Ezek közül 7, a 2003. évi, korábbi egyszerűsítési programhoz kötődő egyszerűsítési kezdeményezés[28] még mindig a jogalkotó előtt van. A függőben lévő javaslatok listája a 3. mellékletben szerepel, és ezek között találhatók olyan, a vállalatok számára rendkívül fontos szövegek is, mint a 6. HÉA-irányelv felülvizsgálata, a Vámkódex korszerűsítése, a hulladékgazdálkodási jogszabályok felülvizsgálata, a gépjárművek típusjóváhagyásának egyszerűsítése, a strukturális vállalati statisztika ésszerűsítése és az előre csomagolt árukra vonatkozó követelmények hatályon kívül helyezése. A számviteli irányelv[29] elfogadása a KKV-k javára mentességekről rendelkezik, és az előre csomagolt árukról szóló közös állásfoglalásnak a Tanács által nemrég történt jóváhagyása is igazolja az intézményeknek a szabályozási keret egyszerűsítésére irányuló közös elkötelezettségét.

Az Európai Parlamentnek a Bizottság által a 2005. októberi egyszerűsítési stratégiára való reagálásra irányuló felkérését követően az Európai Parlament 2006 áprilisában válaszolt. A parlamenti bizottságok által a többéves egyszerűsítési programokra vonatkozóan elfoglalt álláspontok nagyrészt összhangban vannak a Bizottság prioritásaival az egyszerűsítés tárgyát illetően.

Az Európai Parlament 2006 májusában több jelentést fogadott el a jobb szabályozás egyes aspektusai tekintetében, ideértve az egyszerűsítést is[30]. Az Európai Parlament többek között újfajta jogi aktus meghatározását javasolja, az egységes szerkezetbe foglalás és az átdolgozás mellett[31], bizonyos egyszerűsítési javaslatok tekintetében, melyeknek javára szolgálhatnának a kiigazított munkamódszerek és a gyorsabb elfogadás.

A 2003 decembere óta hatályos, jobb jogalkotásról szóló intézményközi megállapodás[32] hozta létre a három intézmény fokozottabb együttműködésének platformját. Az intézményközi megállapodás végrehajtásának nyomon követéséért felelős magas szintű technikai csoport rendszeresen megvizsgálta az aktuális helyzetet például a jogalkotási munka összehangolása és programozása, a jogszabályok minősége (különösen a hatásvizsgálat), a közösségi jogszabályok átültetése és alkalmazása valamint az egyszerűsítés terén. Nehéz feladatnak bizonyult a társjogalkotók számára, hogy meghatározzák a jogalkotási folyamat egyszerűsítésének és meggyorsításának adandó prioritás érdekében szükséges konkrét intézkedéseket.

Az intézmények által 2005 decemberében kötött, hatásvizsgálatra vonatkozó közös intézményközi megközelítésről szóló megállapodás[33] a tanúsága annak, hogy a politikai akarat megléte esetén a jobb jogalkotásról szóló intézményközi megállapodás ténylegesen jobb eredményeket hozhat a jobb szabályozás intézményközi végrehajtásának terén. A közös megközelítés 2008. évi felülvizsgálata során az intézményeknek egyet kell érteniük abban, hogy a tagállamok által a büntetőügyekben folytatott rendőrségi és igazságügyi együttműködés terén tett kezdeményezések mellé hatásvizsgálatnak kell társulnia.

A Bizottság bejelentette, hogy szándékában áll az intézményközi döntéshozatali folyamatnak az egyszerűsítési kezdeményezések megfelelőbb programozása és fokozottabb láthatósága révén az alábbiak útján történő megkönnyítése:

- Az egyszerűsítési javaslatoknak a Bizottsági éves jogalkotási és munkaprogramjába történő integrálása. Ezt már elérték a 2007. évi jogalkotási és munkaprogram tekintetében;

- Az indokolás teljes körű kihasználása a javaslatokban kitűzött egyszerűsítési célkitűzéseket alátámasztó megfelelőbb magyarázatok céljából. A hatásvizsgálathoz kötött egyszerűsítési javaslatokban a Bizottság törekszik továbbá az egyszerűsítési hatások értékelésére, ideértve az adminisztratív terheket is;

- Az egyszerűsítési javaslatok tekintetében mintául szolgáló esetek megállapítása az egyszerűsítésre irányuló jobb intézményközi munkamódszerek meghatározásának lehetőségeinek vizsgálata céljából.

2.3. A társszabályozás és az önszabályozás nagyobb mértékű alkalmazása

A társszabályozás és az önszabályozás jó példa az olyan eszközökre, melyek bizonyos körülmények között a jogalkotó kismértékű beavatkozása mellett alkalmazhatók egyes politikai célkitűzések elérésére.

Például az európai szabványosítási testületek és a Bizottság jelenleg együttműködést folytat a szolgáltatási ágazatban olyan új szabványosítási kezdeményezésekre tett javaslatok érdekében, melyek különösen a belső piacra összpontosítanak. A szabványok lehetővé teszik a felhasználók számára a termékek és árak szabad összevetését, ilyen módon erősítve a versenyt és bővítve a szolgáltatások EU-n belüli kereskedelmét. Az ipar versenyképességének előmozdítására irányuló szabványosítási cselekvési terv széles körű konzultációkat követő meghatározása, továbbá a közösségi finanszírozásra vonatkozó határozat jóváhagyása fellendíti majd a szabványosítási tevékenységeket.

Az önszabályozás terén az európai szintű szociális partnerek sajátos szerepet játszhatnak a tekintetben, hogy megállapodásokat köthetnek[34], melyek kötelező erejét jogalkotási javaslat biztosíthatja vagy melyeket autonóm alapon hajthatnak végre. Az önszabályozás összhangban áll a Bizottságnak a vállalati szociális felelősség (CSR) előmozdítására irányuló politikájával. Az Európai CSR Szövetség égisze alatt végrehajtott önkéntes kezdeményezések nyilvánvalóan új önszabályozási megállapodásokat eredményezhetnek. Az EU vállalatai által az érdekelt felekkel szoros együttműködésben tett ilyen kezdeményezések hozzájárulhatnak továbbá a CSR gyakorlatainak európai és globális szinten szélesebb körben történő átvételéhez. Az önszabályozási rendszereket létrehozni kívánó magánfelek, továbbá az önszabályozás kialakításáért felelős szabályozók megfelelőbb tájékoztatása érdekében az Európai Gazdasági és Szociális Bizottság (EGSZB) és az Európai Bizottság majdnem 100 EU-rendszert tartalmazó adatbázist hozott létre. A 2006 novemberében működésbe helyezendő adatbázis többek között azon problémákat részletezi, melyek az EU ön- vagy társszabályozási rendszereinek kialakításához vezettek, továbbá ezek célkitűzéseit és szervezeti felépítését. A bevált és a helytelen gyakorlat meghatározása ilyen módon jóval könnyebbé válik.

2.4. A nemzeti szintű egyszerűsítés

2.4.1. Az EU-jogszabályok egyszerűsítésének nemzeti szinten is tükröződnie kell

Az EU egyszerűsítési programját a tagállamoknak teljes mértékben támogatniuk kell annak biztosítása érdekében, hogy az enyhébb közösségi szabályozási környezet előnyeit nem semmisítik meg újabb nemzeti szabályok vagy technikai akadályok. Ez már egyre több tagállamban valósul meg, bár még van mit javítani. Az egyik ilyen példa a statisztikai követelmények nemzeti szinten történő fenntartása olyan esetekben, amikor a közösségi jogot már ésszerűsítették.

Ebből következően a Bizottság néhány hatályon kívül helyezésre irányuló javaslatában kölcsönös elismerésre vonatkozó rendelkezéseket vezetett be annak biztosítására, hogy a közösségi jogszabályok hatályon kívül helyezését nem követik a kereskedelemre háruló újabb akadályok. Például az előre csomagolt árukra vonatkozó javaslat célja a nemzeti követelmények fenntartása miatti kereskedelmi akadályok kiküszöbölése.

Ehhez hasonlóan a gömbfa osztályozására vonatkozó EU-jogszabály hatályon kívül helyezésére vonatkozó határozat eredményessége érdekében ezt EU-szerte egységes intézkedéseknek kell követniük. Az ezen irányelvre alapuló nemzeti jogszabályokat megfelelően módosítani kell, és a tagállamoknak biztosítaniuk kell, hogy a technikai változtatásokat gyorsan és egyértelműen végrehajtsák.

A másik tagállamban tevékenységet folytatni kívánó európai vállalatok túl gyakran szembesülnek igazgatási ellenőrzésekkel és eljárásokkal. A Szerződésben foglalt szabályok adott esetben hozzájárulnak a belső piac egyszerűbb működéséhez. A Bizottság a Szerződésnek az áruk szabad mozgásáról szóló 28. cikke végrehajtása útján segít az ilyen terhek csökkentésében, különösen a nemzeti jogszabálytervezetek ellenőrzésével.

A Bizottság 2007-ben foglalkozik majd a védelmi piac integrálásával az EU iparának e területre vonatkozó versenyképességét akadályozó túlzott adminisztratív terhek enyhítése céljából. A katonai áruk közösségen belüli export–import-engedélyeihez kötődő éves költség a becslések szerint 238,90 millió euró az iparágak és az igazgatás tekintetében. A gyakorlatban az ilyen engedélyek iránti kérelmeket nemigen utasítják el[35].

2.4.2. A gold plating (túldíszítés) elkerülése

A közösségi irányelveket átültető nemzeti végrehajtási rendelkezések vizsgálata bőséges példákkal szolgál a nemzeti szabályozók által a közösségi jogszabályok rendelkezésein túlmenően előírt technikai követelményekre, címkézési kötelezettségekre, határidőkre, engedélyezési eljárásokra és egyéb igazgatási követelményekre („túldíszítés” [gold plating]). Az EU vállalataira vonatkozó szabályozási környezet csak akkor javítható, ha az EU-szinten hozott kezdeményezésekhez nemzeti szinten hozott megfelelő intézkedések társulnak.

Ezt más források is megerősítik, például a KKV-k egy nemzeti szövetsége részére nemrég végzett vizsgálat[36]. E vizsgálat szerint az irányelvek az intézkedések átültetésére vonatkozó eredeti alkalmazási körének kiterjesztése komolyan akadályozhatja a kisvállalkozások termelékenységét, ilyen módon pénzt vonva el a vagyon és a munkahelyek megteremtésében az egyik legfontosabb szereplőtől. Emellett a túldíszítés eredményeként a nemzeti vállalatok versenyhátrányba kerülhetnek más országokkal szemben.

Ez megerősíti a Bizottságnak a 2005. októberi közleményben ismertetett szándékát, mely az egyszerűsítési potenciálnak adott esetben inkább rendeletek, mint irányelvek alkalmazása révén történő megfelelőbb kihasználására vonatkozik. A 91/414/EGK irányelvnek a növényvédő szerek forgalomba hozataláról szóló rendelettel történő felváltása konkrét példa lehet e váltásra a szabályozási gyakorlatban.

2.4.3. Nemzeti reformprogramok

A szabályozási követelmények és végrehajtási intézkedések általában a nemzeti szintről származnak.

A nemzeti reformprogramok (NRP) a növekedési és foglalkoztatási stratégia (lisszaboni stratégia) új irányítási struktúrájának részei, és megállapítják a közösségi iránymutatások alapján a nemzeti szintű gazdasági reformpolitikákat. Ilyen módon tehát ezek alapvető fontosságúak az EU-ban a megfelelőbb vállalkozási környezet kialakítása tekintetében. Valamennyi tagállam reagált a jobb szabályozásra vonatkozó iránymutatásokra, és intézkedéseket hozott nemzeti reformprogramja keretében a jobb szabályozás előmozdítása céljából.

E szakaszban kilenc tagállam indított eltérő fokú célokat kitűző egyszerűsítési programokat e NRP-k keretében. Fontos azonban, hogy az EU egyszerűsítési programját valamennyi tagállamban és valamennyi szabályozási szinten egyszerűsítési folyamat kell, hogy kiegészítse. Az Európai Bizottság által a Gazdaságpolitikai Bizottság részére készített, „A jobb szabályozás előmozdítása” című feljegyzés[37] és a 2006. évi versenyképességi jelentés megállapítja a jobb szabályozás tagállami szinten történő végrehajtásának főbb következtetéseit, és részletesebben leírja az e területen az eddigiekben elért eredményeket.

A nemzeti kezdeményezések között szerepelnek például az alábbiak:

- Az adminisztratív költségek csökkentése: 17 tagállam van tudatában annak, hogy elemezni kell a vállalkozásokra rótt adminisztratív terheket, és kezdett értékelési tevékenységekbe. Néhány tagállam mennyiségi célkitűzéseket állapított meg az adminisztratív költségek csökkentése érdekében (pl. 20 vagy 25% 2010-re). Az e program támogatására vonatkozó kezdeményezések között szerepelnek például az elektronikus kormányzás, az egyablakos ügyintézés[38] vagy a központi regisztrációs hivatalok, az adóügyi jogszabályok számának csökkentése, a foglalkoztatáshoz és önfoglalkoztatáshoz kötődő igazgatási eljárások egyszerűsítése vagy a kormányközi kezdeményezések;

- A közigazgatás bürokratikus jellegének csökkentése érdekében e-kormányzás és IKT-megoldások: jogszabályokat és űrlapokat (kérelmek, adatszolgáltatás stb.) elérhetővé tévő portálok létrehozása, a szélessávú hozzáférés kiterjesztése;

- A jogszabályok felülvizsgálata: annak biztosítása, hogy ezek célkitűzései továbbra is relevánsak – a munkaügyi jogszabályok egyszerűsítése, a bevált szabályozási gyakorlat egész kormányzaton belüli terjesztése, a jogszabályok költség–haszon-elemzése, vállalkozási szabályozási fórum létrehozása, ahol az érdekeltek megvizsgálják a vállalkozásokra nehezedő terheket, a jó szabályozás átfogó elvei, ideértve a szükségszerűség, az arányosság, a szubszidiaritás, az átláthatóság, az elszámoltathatóság, a hozzáférhetőség és az egyszerűség elvét;

- Az adózási kötelezettségek, adminisztráció vagy bevallások egyszerűsítése: különösen egyablakos ügyintézéssel vállalatok, KKV-k és az állampolgárok számára, illetve a társasági és a tőkejövedelmi adók reformjával;

- A HÉA-kötelezettségek egyszerűsítése, például a határon átnyúló tevékenységek adóügyi akadályainak kiküszöbölése, az EU-tagállamok nyugdíjrendszereibe befizetett járulékok tekintetében adókedvezményre vonatkozó szabályok bevezetésével mind a migránsok, mind a határon átnyúló szolgáltatók érdekében;

- A belső piaci jogszabályok megfelelőbb módon történő végrehajtása az abból adódó előnyök maximális kiaknázása érdekében;

- KKV-k: jobb finanszírozási hozzáférés, a beszámolási kötelezettségek csökkentése, internetes alapú, egyablakos hivatal létrehozása az induló vállalkozások számára;

- Közös kezdődátumok (CCD-k)[39].

A bevált gyakorlatok tagállamok közötti cseréje és a szakmán belüli felülvizsgálat létfontosságú a jobb szabályozási környezet megteremtése szempontjából. A Bizottság e munkát a jobb szabályozással foglalkozó magas szintű csoport, illetve a lisszaboni folyamat révén segíti elő.

A tagállamokat és a régiókat a bevált gyakorlatok kialakítása terén közös munkára kell ösztönözni, például a BEST kezdeményezés[40] keretében.

3. KÖVETKEZTETÉS

Az itt ismertetett és a jobb szabályozás tekintetében központi szerepet játszó egyszerűsítési stratégia már meghozta első eredményeit.

Az Európai Bizottság feltett szándéka, hogy további lépéseket tegyen azon kötelezettségvállalásai teljesítése érdekében, melyek egy kibővített és ambiciózus gördülő program megvalósításával egy erős szabályozási környezet kialakítására vonatkoznak.

Hogy elérhessük közös célunkat, a Tanácsnak és a Parlamentnek nagyobb szerepet kell vállalnia az egyszerűsítésre irányuló munka kiteljesítésében.

A tagállamoknak szintén megvan a maguk feladata e munkában. Végre kell hajtaniuk a bevált gyakorlatok cseréjét és az egyszerűsítési programokat.

Az Európai Parlament ezen állásfoglalással együtt foglalkozott továbbá egy, az elnökök értekezlete által tett észrevétellel is, mely a bizottságoknak az egyszerűsítési gördülő programra vonatkozó álláspontját foglalja össze az egyszerűsítés intézményközi vonatkozásaira is kitérve.

[34] A 2006. áprilisában aláírt „ A munkavállalók egészségének a kristályos szilícium-dioxid és az ezt tartalmazó termékek megfelelő kezelése és használata útján történő védelméről szóló megállapodás ” sikeres példája az önszabályozásnak. Ez egy autonóm megállapodás, mely felsorolja a munkaerő kristályos szilícium-dioxid pornak való kitettsége minimalizására szolgáló bevált gyakorlatokat. Célja, hogy a különféle nemzeti foglalkozási határértékeknek való megfelelést elősegítse. Az egyes iparágakat képviselő szociális partnerek által kötött megállapodás az első több szektorra kiterjedő, az európai szociális párbeszéd keretében kötött autonóm megállapodás.

[38] Egyablakos ügyintézés: az igazgatási eljárások egységes eljárás keretében történő összevonása. Fokozza a hatékonyságot, előnyös a KKV-knek, átvihető, eredményessége pedig számszerűsíthető.

[39] A CCD-k célja az, hogy az üzleti tervek felkészülhessenek az új szabályozásra, illetve hogy fokozódjon a tudatosság az új vagy megváltozott követelmények bevezetését illetően. Például az új szabályozás kezdésének két dátumra történő korlátozása nyomán remények szerint az a tény, hogy a vállalatok az új vagy módosított kötelezettségeknek jobban tudatában vannak, fokozottabb megfelelést eredményez.

[40] A vállalkozói környezet egyszerűsítésével foglalkozó munkacsoportot (BEST) 1997-ben hozták létre: a vállalkozói közösség és a tagállami hatóságok képviselőinek részvételével; a BEST feladata független jelentés elkészítése volt a jobb jogalkotás és az európai vállalatok, különösen a kis- és középvállalkozások (KKV-k) fejlődésének szükségtelen gátjai kiküszöbölése lehetőségeit illetően. A BEST szakértői csoportja meghatározta a bevált gyakorlatra vonatkozóan az egyes országokban tett kezdeményezéseket (pl. az egyablakos ügyintézés és a kockázat alapú szabályozás ösztönzésével) annak érdekében, hogy mások tanulhassanak a tapasztalatokból. A kockázat alapú értékelés célja a rendelet törekvéseinek (és a vállalkozások tekintetében felmerült költségeknek) az egészség vagy a környezet tekintetében a legnagyobb kockázatokat jelentő tevékenységekre való összpontosítása.
