[pic] | AZ EURÓPAI KÖZÖSSÉGEK BIZOTTSÁGA | Brüsszel, 27.9.2005 COM(2005) 462 végleges A BIZOTTSÁG KÖZLEMÉNY E A TANÁCSNAK ÉS AZ EURÓPAI PARLAMENTNEK az elbírálás alatt álló jogalkotási javaslatok átvizsgálásának eredménye A BIZOTTSÁG KÖZLEMÉNY E A TANÁCSNAK ÉS AZ EURÓPAI PARLAMENTNEK az elbírálás alatt álló jogalkotási javaslatok átvizsgálásának eredménye Mint azt a 2005. március 16-i „Jobb szabályozás a növekedés és a munkahelyteremtés területén az Európai Unióban” című közleményében[1] bejelentette, a Bizottság úgy döntött, radikálisan változtat azon a módon, amellyel azt igyekszik elérni, hogy az európai jogalkotás magasabb színvonala révén segítse a növekedést és a munkahelyteremtést célzó partnerség céljainak megvalósulását Európában. Az európai vállalkozások versenyképességének javítása érdekében az Európai Unió szabályozási környezetének a lehető legmagasabb színvonalúnak kell lennie. E cél eléréséhez az „acquis communautaire-t”, vagyis a meglévő közösségi vívmányokat szükség szerint egyszerűsíteni és korszerűsíteni kell. Intézkedések egész sorát helyezték ezért kilátásba, amelyek magukban foglalják például az egyszerűsítési program egy újabb szakaszának megkezdését 2005 októberében. A Bizottság többek között azt is eldöntötte, hogy a jobb szabályozást be kell építeni a szakpolitikák tevezésébe, valamint hogy az általa előterjesztett új jogalkotási javaslatoknak ösztönözniük kell a jobb szabályozást és hozzá kell járulniuk a versenyképesség növeléséhez. A gyakorlatban ez abban a követelményben nyilvánul meg, hogy az új jogalkotási kezdeményezéseket hatásvizsgálatnak kell alávetni, amint azt a Bizottság 2005. évi jogalkotási- és munkaprogramjában[2] – amelyhez a közelmúltban fogadtak el egy terjedelmes és részletes útmutatót – kinyilvánította. A Bizottság által régebben előterjesztett és jelenleg elbírálás alatt álló javaslatokat illetően a márciusi közleményben megfogalmazódott, hogy a Bizottságnak „szándékában áll megvizsgálni a Tanács vagy a Parlament előtt lévő javaslatokat azok általános relevanciája, a versenyre gyakorolt hatása és egyéb következményei tekintetében.” A maga nemében az első ilyen átvizsgálás céljait, folyamatát és eredményeit mutatja be ez a közlemény. 1. Az elbírálás alatt álló jogalkotási javaslatok átvizsgálásának céljai A Bizottság az átvizsgálással azt szeretné biztosítani, hogy az elbírálás alatt álló jogalkotási javaslatok tökéletes összhangban legyenek a Bizottság politikai prioritásaival, valamint egyben ellenőrizni is óhajtja, hogy a megváltozott körülmények nem indokolják-e az eredeti megközelítés újragondolását. Ahol szükségesnek tűnt az újragondolás, ott az átvizsgálási folyamat keretében meghatározták a meghozandó intézkedéseket, úgy mint módosítás, helyettesítés vagy visszavonás, illetve a hatások elemzésének javítása. Az átvizsgálás során az elbírálás alatt álló jogalkotási javaslatokat három szempontból elemezték: Először a lisszaboni célkitűzésekkel való összhang érdekében vizsgálták a javaslatokat, különös figyelmet fordítva a versenyképesség növelésére irányuló célkitűzésre. Az ilyen értékelés szempontjait a nemrég frissített hatásvizsgálati útmutatóban található „versenyképességi vizsgálat” szolgáltatta[3]. Ezt követően átnézték, hogy mely javaslatok nem léptek hosszú idő óta jelentősen előre a jogalkotási folyamatban. Az ilyen esetekben megvizsgálták, hogy mi a lassú haladás oka és, hogy mivel lehetne továbblendíteni a folyamatot. Végezetül abból a szempontból vizsgálták meg a javaslatokat, hogy megfelelnek-e a jobb szabályozás követelményeinek, vagyis sor került-e a megfelelő hatásvizsgálatokra. Ez különösen lényeges az olyan javaslatok esetében, amelyek még akkor kerültek előterjesztésre, amikor nem volt követelmény a hatásvizsgálat. 2. Az átvizsgálás folyamata 2005 áprilisában, amikor az átvizsgálás elkezdődött, összesen 489 javaslat állt elbírálás alatt[4]. A márciusi közleményben foglalt átvizsgálás kifejezetten a 2004. január 1. előtt keletkezett javaslatokra szorítkozott. Ez 183 javaslatot tesz ki. A javaslatokat gondos elemzésnek vetették alá. Végeredményben körülbelül 100 javaslatról mondható el, hogy valóban új jogalkotási kezdeményezésről van szó, és ezeket tovább vizsgálták a versenyképességre gyakorolt esetleges hátrányos következményeik, illetve tágabb gazdasági hatásaik szempontjából. A többi javaslatnak valószínűleg csak kevéssé vagy egyáltalán nincs befolyása a versenyképességre. Ezek a javaslatok leginkább nemzetközi kötelezettségekből vagy a közösségi jognak a tudományos és műszaki fejlődéshez való hozzáigazításából erednek. Néhány javaslat közvetlenül hozzájárul a jobb szabályozáshoz, mivel kodifikálja vagy egyszerűsíti a közösségi jogot. 3. Az átvizsgálás eredményei A meglévő javaslatok részletes vizsgálatát követően a Bizottság két fő cselekvési irányt jelölt ki: (1) Visszavonásra kerülő javaslatok: A Bizottság összesen 68 javaslatot szeretne visszavonni. Ezeket a javaslatokat úgy tekintik, hogy nincsenek összhangban a lisszaboni célkitűzésekkel vagy a jobb szabályozás elvével, esetleg nem haladnak kellőképpen előre a jogalkotási folyamatban, vagy már nem időszerűek[5] (mivel céljaikat már más eszközökkel valósítják meg). Néhány javaslatot át kell értékelni hatásaik további vizsgálata fényében. Egyes esetekben az átfogó hatásvizsgálat eredményeinek ismeretében a Bizottság újra kell gondolja a jogi beavatkozás szükségességét. (2) Olyan javaslatok, amelyeket megtartanak a jogalkotási folyamatban, de a jogalkotó hatóság vizsgálatához további gazdasági elemzéseket kell készíteni[6]. 5 olyan javaslat van, amelyeket meg kell tartani, de lehetséges hatásaikat további gazdasági elemzésnek kell alávetni. Ezek olyan javaslatok, amelyeket a Bizottság továbbra is fontosnak ítél, azonban hatásaik további elemzésének bemutatása feltehetően elősegíti a jogalkotó hatóság döntéshozatalát. Az átvizsgálás eredményeként 73 elbírálás alatt álló jogalkotási javaslat esetében kerül sor valamilyen beavatkozásra. Ezek között vannak olyan javaslatok, amelyek nem teljesen felelnek meg a versenyképességi célkitűzéseknek, más esetekben a jogalkotó elé kell terjeszteni gazdasági hatásaik értékelését, és vannak olyanok is, amelyek nem haladtak kellőképpen előre a jogalkotási folyamatban, illetve elavultak. A visszavonás a 2004. január 1. óta elbírálás alatt álló javaslatok 31 %-át érinti[7]. Az összes beavatkozás, a további gazdasági hatásvizsgálatra utalt javaslatokat is beleértve, az elbírálás alatt álló javaslatok 33 %-ára vonatkozik8. 2 javaslat esetében az átvizsgálás olyan eredményt hozott, ami a fent említett kategóriák egyikébe sem sorolható. Először is a munkavállalók fizikai tényezők (optikai sugárzás) hatására keletkező kockázatoknak való kitettségére vonatkozó egészségügyi és biztonsági minimumkövetelményekről szóló tanácsi irányelv javaslata (1992/0449/COD) esetében az átvizsgálás során a Bizottság arra a következtetésre jutott, hogy a munkavállalók természetes optikai sugárzás veszélyének való kitettségére vonatkozó részeket törölni kell, amint azt az Európai Parlament is javasolta. Másodszor, az ideiglenes alkalmazottakról szóló javaslat (2002/0072/COD) vonatkozásában pedig a Bizottság fenntartja azt az álláspontját, hogy újragondolja a javaslatot későbbi megbeszélések, például a szolgáltatásokról szóló irányelv megvitatása fényében. E közlemény melléklete áttekinti a helyzetet és részleteket is tartalmaz a javaslatokkal kapcsolatban. Következtetés Az elbírálás alatt álló javaslatok átvizsgálása a Bizottság első átfogó átvizsgálási programja. Ez tanúsítja, hogy az Európai Közösségek Bizottsága elkötelezte magát a növekedést és munkahelyteremtést célzó partnerség mellett, valamint a jobb szabályozásra irányuló elvek következetes és gyakorlati végrehajtása mellett. Az átvizsgálási programból fakadó intézkedéseket – vagyis a mellékletben felsorolt javaslatok esetében tervezett beavatkozásokat – úgy tervezték meg, hogy támogassák a lisszaboni célkitűzések elérését, ösztönözzék a versenyképességet, hozzájáruljanak a jobb szabályozási környezet kialakításához és megszüntessék az olyan javaslatokat, amelyek elfogadására nincs esély vagy már elavultak. Az elbírálás alatt álló jogalkotási javaslatok visszavonása egyes esetekben a szakpolitikák áttekintésének keretében történik, előfordul, hogy az új szakmai szempontok és az átfogó hatásvizsgálatok fényében a javaslatok átértékelődnek. Az Európai Parlament és a Bizottság közötti kapcsolatokról szóló keretmegállapodásban foglalt kötelezettségvállalásokkal ((32) bekezdés) összhangban, a Bizottság a javaslatok visszavonása előtt tájékoztatja szándékáról a Parlamentet és a Tanácsot. [4] A Bizottság évente 200–250 jogalkotási javaslattal foglalkozik, amelyek szükségessége nemzetközi kötelezettségekbÙ[5]l, a közösségi jog korszerq[pic]sítésébQ[pic]l és/vagy a jogalkotó iránti kötelezettségekbQ[pic]l fakad. [6] A Bizottság rendszeresen végzett visszavonattal foglalkozik, amelyek szükségessége nemzetközi kötelezettségekb˙l, a közösségi jog korszerűsítéséből és/vagy a jogalkotó iránti kötelezettségekből fakad. [7] A Bizottság rendszeresen végzett visszavonásokat, ezáltal csökkentve az elbírálás alatt álló jogalkotási javaslatok számát. 1997-ben 34, 1999-ben 58, 2001-ben 108 és 2004-ben 102 javaslat került visszavonásra.
