ODLUKA KOMISIJE
od 5. prosinca 2006.
o izmjeni direktiva Vijeća 64/432/EEZ, 90/539/EEZ, 92/35/EEZ, 92/119/EEZ, 93/53/EEZ, 95/70/EZ, 2000/75/EZ, 2001/89/EZ i Odluke 2001/618/EZ u pogledu popisa nacionalnih referentnih laboratorija i državnih zavoda

KOMISIJA EUROPSKIH ZAJEDNICA,
uzimajući u obzir Ugovor o osnivanju Europske zajednice,
uzimajući u obzir Direktivu Vijeća 64/432/EEZ od 26. lipnja 1964. o zdravstvenim problemima životinja koji utječu na trgovinu govedima i svinjama unutar Zajednice (1), a naročito njezin članak 8., članak 9. stavak 2., članak 10. stavak 2. i članak 16. stavak 1. drugi podstavak,
uzimajući u obzir Direktivu Vijeća 90/539/EEZ od 15. listopada 1990. o uvjetima zdravlja životinja kojima se uređuje trgovina unutar Zajednice i uvoz iz trećih zemalja peradi i jaja za valenje (2), a naročito njezin članak 34.,
uzimajući u obzir Direktivu Vijeća 92/35/EEZ od 29. travnja 1992. o utvrđivanju mjera kontrole i mjera suzbijanja konjske kuge (3), a naročito njezin članak 18.,
uzimajući u obzir Direktivu Vijeća 92/119/EEZ od 17. prosinca 1992. o uvođenju općih mjera Zajednice za kontrolu određenih bolesti životinja i posebnih mjera koje se odnose na vezikularnu bolest svinja (4), a naročito njezin članak 24. stavak 2.,
uzimajući u obzir Direktivu Vijeća 93/53/EEZ od 24. lipnja 1993. o uvođenju minimalnih mjera Zajednice za suzbijanje određenih bolesti riba (5), a naročito članak 18 drugi stavak,
uzimajući u obzir Direktivu Vijeća 95/70/EZ od 22. prosinca 1995. o uvođenju minimalnih mjera Zajednice za suzbijanje određenih bolesti koje napadaju školjkaše (6), a naročito članak 9. drugi stavak,
uzimajući u obzir Direktivu Vijeća 2000/75/EZ od 20. studenoga 2000. o utvrđivanju posebnih odredaba za kontrolu i iskorjenjivanje bolesti plavog jezika (7), a naročito članak 19. drugi stavak,
uzimajući u obzir Direktivu Vijeća 2001/89/EZ od 23. listopada 2001. o mjerama Zajednice za kontrolu klasične svinjske kuge (8), a naročito njezin članak 25. stavak 2.,
uzimajući u obzir Direktivu Vijeća 2002/60/EZ od 27. lipnja 2002. o utvrđivanju posebnih odredaba za kontrolu afričke svinjske kuge i o izmjeni Direktive 92/119/EEZ koja se odnosi na tješinsku bolest i afričku svinjsku kugu (9), a naročito njezin članak 26. stavak 1.,
budući da:

što se tiče enzootske leukoze goveda, Direktiva 64/432/EEZ donosi popis državnih zavoda i nacionalnih referentnih laboratorija koji su nadležni za službena ispitivanja tuberkulina i reagenasa, popis nacionalnih referentnih laboratorija za brucelozu goveda kao i popis službenih zavoda nadležnih za umjeravanje standardnog radnog antigena laboratorija prema službenom standardnom serumu EEZ-a (serum EI) koji dostavlja Statens Veterinære Serumlaboratorium iz Kopenhagena;

Direktiva 90/539/EEZ predviđa da države članice trebaju odrediti nacionalne referentne laboratorije koji su nadležni za usklađivanje dijagnostičkih metoda i njihove uporabe u odobrenim laboratorijima. U toj je Direktivi naveden popis nacionalnih referentnih laboratorija;

Direktiva 92/35/EEZ predviđa da države članice trebaju odrediti nacionalne referentne laboratorije koji su nadležni za usklađivanje dijagnostičkih metoda i njihove uporabe u odobrenim laboratorijima. U toj je Direktivi naveden popis nacionalnih referentnih laboratorija;

Direktiva 92/119/EEZ predviđa da države članice trebaju odrediti nacionalne laboratorije za svaku bolest koja je navedena u toj Direktivi. U toj je Direktivi naveden popis nacionalnih laboratorija za vezikularnu enterovirusnu bolest svinja;

|
Direktiva 93/53/EEZ predviđa da države članice trebaju odrediti nacionalne referentne laboratorije za svaku bolest koja je navedena u toj Direktivi. U toj je Direktivi naveden popis nacionalnih referentnih laboratorija za bolesti riba;
|
|

|
Direktiva 95/70/EZ predviđa da države članice trebaju odrediti nacionalne referentne laboratorije koji će obavljati uzorkovanje i ispitivanje. U toj je Direktivi naveden popis nacionalnih referentnih laboratorija za bolesti školjkaša;
|
|
(7)
|
Direktiva 2000/75/EZ predviđa da države članice trebaju odrediti nacionalne laboratorije koji će biti nadležni za obavljanje laboratorijskih ispitivanja. U toj je Direktivi naveden popis tih nacionalnih laboratorija;
|
|

|
Direktiva 2001/89/EZ predviđa da države članice trebaju osigurati da nacionalni laboratorij bude odgovoran za usklađivanje dijagnostičkih standarda i metoda. U toj je Direktivi naveden popis tih nacionalnih laboratorija;
|
|

Direktiva 2002/60/EZ predviđa da države članice trebaju osigurati da nacionalni laboratorij bude odgovoran za usklađivanje dijagnostičkih standarda i metoda. U toj je Direktivi naveden popis tih nacionalnih laboratorija;
|

|
Odluka Komisije 2001/618/EZ od 23. srpnja 2001. o dodatnim jamstvima u trgovini svinjama unutar Zajednice u pogledu bolesti Aujeszkoga, o kriterijima za prikupljanje informacija o ovoj bolesti i stavljanju izvan snage odluka 93/24/EEZ i 93/244/EEZ (10) donosi popis zavoda koji su u pojedinim državama članicama nadležni za ispitivanje kakvoće metode ELISA, a naročito za proizvodnju i standardiziranje nacionalnih referentnih seruma prema referentnom serumu Zajednice. Taj je popis naveden u toj Direktivi;

nadležna tijela skoro svih država članica dostavila su zahtjev za ažuriranjem podataka o nacionalnim referentnim laboratorijima koji su navedeni u većem broju direktiva i odluka. Pored toga, bilo bi primjereno da nacionalni referentni laboratoriji i državni zavodi koji se spominju u tim aktima budu popisani abecednim redom prema oznaci ISO za svaku državu članicu;

zbog jasnoće i dosljednosti zakonodavstva Zajednice, trebalo bi zamijeniti popise koji se navode u tim direktivama i odlukama;
|
|

u skladu s tim, trebalo bi izmijeniti direktive 64/432/EEZ, 90/539/EEZ, 92/35/EEZ, 92/119/EEZ, 93/53/EEZ, 95/70/EZ, 2000/75/EZ, 2001/89/EZ, 2002/60/EZ i Odluku 2001/618/EZ;

mjere koje se predviđaju ovom Odlukom u skladu su s mišljenjem Stalnog odbora za prehrambeni lanac i zdravlje životinja,
|
DONIJELA JE OVU ODLUKU:
Članak 1.
Direktive 64/432/EEZ, 90/539/EEZ, 92/35/EEZ, 92/119/EEZ, 93/53/EEZ, 95/70/EZ, 2000/75/EZ, 2001/89/EZ, 2002/60/EZ i Odluka 2001/618/EZ mijenjaju se u skladu s Prilogom ovoj Odluci.
Članak 2.
Ova se Odluka počinje primjenjivati trećeg dana od dana objave u Službenom listu Europske unije.
Članak 3.
Ova je Odluka upućena državama članicama.

U Prilogu D Direktivi 64/432/EEZ točke A.1. i A.2. u poglavlju II. zamjenjuju se sljedećim točkama:

Antigen koji se koristi u testu mora sadržavati glikoproteine virusa goveđe leukoze. Antigen mora biti standardiziran prema standardnom serumu (serumu EI) koji dostavlja Danish Institute for Food and Veterinary Research iz Kopenhagena.
|

A.2.
|
Dolje navedeni službeni zavodi moraju biti zaduženi za umjeravanje standardnog radnog antigena laboratorija prema službenom standardnom serumu EEZ-a (serumu EI) koji dostavlja Danish Institute for Food and Veterinary Research iz Kopenhagena.
