DÉCISION D'EXÉCUTION (UE) 2017/1845 DE LA COMMISSION
du 11 octobre 2017
modifiant l'annexe de la décision d'exécution (UE) 2017/247 concernant des mesures de protection motivées par l'apparition de foyers d'influenza aviaire hautement pathogène dans certains États membres

vu le traité sur le fonctionnement de l'Union européenne,
vu la directive 89/662/CEE du Conseil du 11 décembre 1989 relative aux contrôles vétérinaires applicables dans les échanges intracommunautaires dans la perspective de la réalisation du marché intérieur (1) et notamment son article 9, paragraphe 4,
vu la directive 90/425/CEE du Conseil du 26 juin 1990 relative aux contrôles vétérinaires et zootechniques applicables dans les échanges intracommunautaires de certains animaux vivants et produits dans la perspective de la réalisation du marché intérieur (2), et notamment son article 10, paragraphe 4,
considérant ce qui suit:

La décision d'exécution (UE) 2017/247 (3) de la Commission a été adoptée à la suite de l'apparition de foyers d'influenza aviaire hautement pathogène de sous-type H5 dans plusieurs États membres (ci-après les «États membres concernés») et de l'établissement de zones de protection et de surveillance par les autorités compétentes des États membres concernés conformément aux dispositions de l'article 16, paragraphe 1, de la directive 2005/94/CE (4) du Conseil.

La décision d'exécution (UE) 2017/247 prévoit que les zones de protection et de surveillance établies par les autorités compétentes des États membres concernés conformément à la directive 2005/94/CE comprennent au moins les zones de protection et de surveillance énumérées dans son annexe. Ladite décision établit en outre que les mesures à appliquer dans les zones de protection et les zones de surveillance, telles que prévues à l'article 29, paragraphe 1, et à l'article 31 de la directive 2005/94/CE, doivent être maintenues au moins jusqu'aux dates fixées pour ces zones dans l'annexe de la décision.

Depuis la date de son adoption, la décision d'exécution (UE) 2017/247 a été modifiée à plusieurs reprises pour tenir compte de l'évolution de la situation épidémiologique dans l'Union en ce qui concerne l'influenza aviaire. En outre, la décision d'exécution (UE) 2017/247 a été modifiée par la décision d'exécution (UE) 2017/696 (5) afin de fixer des règles concernant l'expédition de poussins d'un jour provenant des zones énumérées à l'annexe de la décision d'exécution (UE) 2017/247. Cet amendement prend en compte le fait que les poussins d'un jour font courir un risque très faible de propagation de l'influenza aviaire hautement pathogène par rapport à d'autres produits de volailles.

La décision d'exécution (UE) 2017/1841 de la Commission (6) comporte des dispositions concernant l'établissement d'autres zones réglementées dans les États membres concernés en vue de renforcer la lutte contre la maladie lorsqu'il existe un risque accru de propagation du virus et concernant l'expédition de poussins d'un jour et d'œufs à couver à partir de ces zones vers d'autres États membres sous certaines conditions de sécurité. L'annexe a été modifiée afin d'inclure les autres zones réglementées.

En outre, l'annexe de la décision (UE) 2017/247 a été modifiée à plusieurs reprises pour tenir compte des changements intervenus dans les limites des zones de protection et de surveillance établies par les États membres concernés, conformément à la directive 2005/94/CE. Cette annexe a été modifiée en dernier lieu par la décision (UE) 2017/1593 (7) de la Commission, à la suite de la notification par l'Italie de l'apparition de foyers d'influenza aviaire hautement pathogène du sous-type H5N8 chez les volailles dans des exploitations situées dans les régions de Lombardie et de Vénétie, et de la mise en place de zones de protection et de surveillance par cet État membre autour des exploitations contaminées, conformément à la directive 2005/94/CE.

Depuis la dernière modification de la décision d'exécution (UE) 2017/247 par la décision d'exécution (UE) 2017/1593, l'Italie a détecté et notifié à la Commission l'apparition de nouveaux foyers d'influenza aviaire hautement pathogène de sous-type H5N8 dans des exploitations de volailles, de nouveau dans les régions de Lombardie et de Vénétie. L'Italie a également porté à la connaissance de la Commission qu'elle avait pris les mesures nécessaires conformément à la directive 2005/94/CE, dont l'établissement de zones de protection et de surveillance autour des exploitations de volaille infectées.

La Commission a examiné les mesures prises par l'Italie conformément à la directive 2005/94/CE à la suite de l'apparition récente de foyers d'influenza aviaire hautement pathogène de sous-type H5N8 dans cet État membre et a pu s'assurer que les limites des zones de protection et de surveillance établies par l'autorité compétente italienne se trouvaient à une distance suffisante de toute exploitation au sein de laquelle un foyer d'influenza aviaire hautement pathogène de sous-type H5N8 a été confirmé.

En vue de prévenir toute perturbation inutile des échanges dans l'Union et afin d'éviter que des pays tiers imposent des entraves injustifiées aux échanges commerciaux, il est nécessaire de définir rapidement au niveau de l'Union, en collaboration avec l'Italie, les zones de protection et de surveillance établies par cet État membre conformément à la directive 2005/94/CE, à la suite de l'apparition récente de foyers d'influenza aviaire hautement pathogène de sous-type H5N8 sur son territoire. Il convient par conséquent d'actualiser les entrées pour l'Italie dans l'annexe de la décision d'exécution (UE) 2017/247 afin de tenir compte de la situation épidémiologique actuelle dans cet État membre en ce qui concerne cette maladie. En particulier, il y a lieu d'ajouter de nouvelles zones des régions de Lombardie et de Vénétie afin de répondre à cette nouvelle situation.

En conséquence, il convient de modifier l'annexe de la décision d'exécution (UE) 2017/247 afin d'actualiser la définition des zones au niveau de l'Union et d'y inclure les zones de protection et de surveillance établies par l'Italie à la suite de l'apparition récente de foyers d'influenza aviaire hautement pathogène dans les régions de Lombardie et de Vénétie, conformément à la directive 2005/94/CE, ainsi que la durée des restrictions qui y sont applicables.

Il convient dès lors de modifier en conséquence la décision d'exécution (UE) 2017/247.

Article premier
L'annexe de la décision d'exécution (UE) 2017/247 est modifiée conformément à l'annexe de la présente décision.
Article 2
Les États membres sont destinataires de la présente décision.
