[pic] | EUROOPAN YHTEISÖJEN KOMISSIO | Bryssel 27.9.2005 KOM(2005) 462 lopullinen KOMISSION TIEDONANTO NEUVOSTOLLE JA EUROOPAN PARLAMENTILLE Vireillä olevien lakiehdotusten seulonnan tulokset KOMISSION TIEDONANTO NEUVOSTOLLE JA EUROOPAN PARLAMENTILLE Vireillä olevien lakiehdotusten seulonnan tulokset Kuten komissio ilmoitti 16. maaliskuuta 2005 antamassaan tiedonannossa ”Parempaa sääntelyä kasvun ja työllisyyden edistämiseksi Euroopan unionissa” [1], se on päättänyt muuttaa tapaa, jolla se pyrkii varmistamaan, että eurooppalaisen lainsäädännön laatu tukee ’kasvua ja työllisyyttä edistävän kumppanuuden’ tavoitteita. Euroopan kilpailukyvyn kasvattamiseksi Euroopan unionin sääntely-ympäristön on oltava mahdollisimman laadukas. Tämän päämäärän saavuttamiseksi yhteisön säännöstöä eli voimassa olevaa lainsäädäntöä on tarvittaessa yksinkertaistettava ja saatettava ajan tasalle. Tätä varten on kaavailtu joukkoa toimenpiteitä, joihin kuuluu eritoten yksinkertaistamisohjelman uuden vaiheen käynnistäminen lokakuussa 2005. Komissio on myös päättänyt, että parempi sääntely on sisällytettävä politiikan suunnitteluun ja että komission esittämillä uusilla lainsäädäntöehdotuksilla on pyrittävä parempaan sääntelyyn ja kilpailukyvyn tehostamiseen. Tämä toteutetaan käytännössä etenkin vaatimuksena, että tästä lähtien uusien lainsäädäntöaloitteiden vaikutukset on arvioitava, kuten ilmoitetaan komission vuoden 2005 lainsäädäntö- ja työohjelmassa, jota varten on hiljattain hyväksytty laajat ja yksityiskohtaiset suuntaviivat[2]. Lainsäädäntöprosessissa vireillä olevien komission aikaisemmin esittämien ehdotusten osalta maaliskuisessa tiedonannossa mainittiin komission aikeesta ”seuloa neuvostossa ja parlamentissa vireillä olevat ehdotukset niiden yleisen merkittävyyden, kilpailukykyvaikutuksen ja muiden vaikutusten kannalta”. Ensimmäisen seulonnan tavoitteet, prosessi ja tulokset esitetään tässä tiedonannossa. 1. Vireillä olevien ehdotusten seulonnan tavoitteet Seulonnalla pyrittiin mahdollistamaan se, että komissio voi varmistaa kaikkien vireillä olevien lakiehdotusten olevan täysin johdonmukaisia komission poliittisten painopisteiden kanssa ja tutkia, ovatko olosuhteissa tapahtuneet muutokset peruste tarkistaa alun perin valittua lähestymistapaa. Jos uudelleentarkastelu on katsottu tarpeelliseksi, seulonnassa on myös nimetty toteutettavat soveltuvat toimenpiteet, kuten vireillä olevien ehdotusten muuttaminen, korvaaminen tai peruuttaminen ja niiden vaikutusten arvioinnin parantaminen. Seulonnalla tähdättiin tarkemmin ottaen vireillä olevien ehdotusten testaamiseen kolmelta kannalta: Ensinnäkin tarkasteltiin, olivatko vireillä olevat ehdotukset johdonmukaisia EU:n Lissabonissa asettamien tavoitteiden kanssa ja eritoten kilpailukyvyn edistämisen päämäärän kanssa. Perusteet, joilla ehdotuksia tässä suhteessa arvioitiin, on täsmennetty ’kilpailukykytestissä’, joka on osa hiljattain tarkistettuja vaikutustenarviointia koskevia suuntaviivoja[3]. Toiseksi tarkistettiin, oliko sellaisia vireillä olevia ehdotuksia, jotka eivät olleet pitkään aikaan edenneet merkittävästi lainsäädäntöprosessissa. Jos oli, tarkasteltiin hitaan edistymisen syitä ja mahdollisuuksia vauhdittaa edistymistä. Kolmanneksi tarkasteltiin, täyttivätkö vireillä olevat ehdotukset parempaa sääntelyä koskevat nykyvaatimukset erityisesti asianmukaisten vaikutustenarviointien osalta. Tämä peruste vaikuttaa varsinkin siihen aikaan esitettyihin ehdotuksiin, jolloin vaikutustenarviointi ei vielä ollut muodollinen vaatimus. 2. Seulontaprosessi Kun seulonta aloitettiin huhtikuussa 2005, ehdotuksia oli vireillä yhteensä 489[4]. Maaliskuussa annetussa tiedonannossa seulonta rajattiin nimenomaisesti ennen 1. tammikuuta 2004 tehtyihin ehdotuksiin. Näin jäljelle jäi 183 ehdotusta. Näille ehdotuksille tehtiin huolellinen arviointi, jossa päädyttiin noin 100 ehdotukseen, jotka ovat täysin uusia lainsäädäntöaloitteita ja joiden mahdollisia kielteisiä vaikutuksia kilpailukykyyn ja laajempia taloudellisia vaikutuksia arvioitiin vielä lisää. Lopuilla ehdotuksilla on todennäköisesti vain rajallinen tai olematon vaikutus kilpailukykyyn, ja ne liittyvät lähinnä kansainvälisiin velvoitteisiin tai säännöstön mukauttamiseen tieteelliseen ja tekniseen kehitykseen. Jotkin näistä ehdotuksista myös edistävät välittömästi parempaa sääntelyä, sillä niissä esitetään säännöstön kodifiointia tai yksinkertaistamista. 3. Seulonnan tulokset Kaikkien vireillä olevien ehdotusten yksityiskohtaisen analyysin tuloksena komissio kaavailee kahdenlaisia toimia: 1) Peruutettavat ehdotukset. Komissio aikoo peruuttaa yhteensä 68 ehdotusta, joiden ei katsota olevan yhdenmukaisia Lissabonin tavoitteiden tai paremman sääntelyn periaatteiden kanssa tai jotka eivät etene riittävästi lainsäädäntöprosessissa tai jotka eivät enää ole ajankohtaisia[5] (esim. tavoitteet on jo saavutettu tai voidaan saavuttaa muulla tavoin). Joitakin näistä ehdotuksista voidaan harkita uudelleen, kun niitä on analysoitu lisää. Joissakin tapauksissa komissio aikoo harkita uudelleen lainsäädännöllisten toimenpiteiden tarvetta kattavan vaikutustenarvioinnin tulosten perusteella. 2) Ehdotukset, jotka säilytetään lainsäädäntöprosessissa, mutta joille tehdään taloudellinen analyysi, joka toimitetaan lainsäädäntövallan käyttäjän arvioitavaksi[6]. Tämä koskee viittä ehdotusta, joiden tärkeydestä komissio on vakuuttunut, mutta joiden vaikutusten arvioinnin tarkempi esittely todennäköisesti helpottaisi lainsäädäntövallan käyttäjän päätöksentekoa. Näin ollen komission seulonnan tuloksena yhteensä 73:lle vireillä olevalle ehdotukselle tehdään jonkinlaisia toimenpiteitä. Niihin kuuluvat ehdotukset, jotka eivät täysin täytä kilpailukykytavoitteita tai joiden taloudellinen lisäanalyysi on toimitettava lainsäädäntövallan käyttäjälle tai jotka eivät edisty riittävästi lainsäädäntöprosessissa tai jotka ovat vanhentuneet. Kaikista ennen 1. tammikuuta 2004 tehdyistä ehdotuksista peruutettaneen noin 31 prosenttia[7]. Toimenpiteiden kohteeksi joutuvia ehdotuksia, mukaan luettuna taloudelliseen lisäanalyysiin poimitut ehdotukset, on tällä hetkellä 33 prosenttia[8] vireillä olevista ehdotuksista. Lisäksi vähintään kahdesta ehdotuksesta on seulonnassa saatu tuloksia, jotka eivät suoraan sovi edellä mainittuihin luokkiin. Ensiksikin komissio on seulonnan tuloksena päätellyt, että ehdotuksesta neuvoston direktiiviksi terveyttä ja turvallisuutta koskevista vähimmäisvaatimuksista työntekijöiden suojelemiseksi altistumiselta fysikaalisista tekijöistä (optinen säteily) aiheutuville riskeille (1992/0449/COD) olisi poistettava työntekijöiden altistumista luonnolliselle optiselle säteilylle koskevat näkökohdat, kuten myös Euroopan parlamentti ehdottaa. Toiseksi komissio pidättää itsellään oikeuden harkita tilapäisiä työntekijöitä koskevaa ehdotusta (2002/0072/COD) uudelleen muita ehdotuksia koskevien keskustelujen valossa. Tämän tiedonannon liitteenä on yhteenveto tilanteesta ja yksityiskohtaisia tietoja asianomaisista ehdotuksista. Päätelmät Vireillä olevien ehdotusten seulonta on ensimmäinen kattava seulonta, jonka komissio on tehnyt. Se on osoitus Euroopan komission sitoutumisesta kasvua ja työllisyyttä edistävään kumppanuuteen ja sen varmistamiseen, että paremman sääntelyn periaatteita sovelletaan käytännössä tiukasti. Seulonnasta seuraavat toimet, kuten liitteessä kuvatut vireillä oleville ehdotuksille kaavaillut toimenpiteet, on suunniteltu sellaisiksi, että ne vaikuttavat myönteisesti Lissabonin tavoitteiden saavuttamiseen edistämällä kilpailukykyä, paremman lainsäädäntöympäristön kehittämiseen ja sellaisten ehdotusten poistamiseen, joilla ei ole todellisia mahdollisuuksia tulla hyväksytyiksi tai jotka jo ovat vanhentuneita. Vireillä olevien ehdotusten peruuttaminen tapahtuu joissakin tapauksissa politiikan yleisen tarkastelun yhteydessä tai siten, että aikomuksena on harkita ehdotuksia uudelleen uusien poliittisten tekijöiden ja kattavan vaikutustenarvioinnin valossa. Euroopan parlamentin ja komission välisiä suhteita koskevassa puitesopimuksessa mainittujen sitoumusten mukaisesti (kohta 32) komissio antaa täten parlamentille ja neuvostolle ennakkoilmoituksen ennen ehdotustensa peruuttamista. [4] Komissio käsittelee joka vuosi 200–250 ehdotusta, jotka perustuvat EU:n kansainvälisiin velvoitteisiin, tarpeeseen saattaa yhteisön säännöstöä ajan tasalle tai sitoumuksiin lainsäätäjään nähden. [5] Komissio on säännöllisesti peruuttanut ehdotuksia, mikä on vähentänyt vireillä olevien ehdotusten määrää: 34 ehdotusta peruutettiin vuonna 1997, 58 vuonna 1999, 108 vuonna 2001 ja 102 vuonna 2004. [6] Fluoratut kaasut, jätteiden siirto, lentoalusten matkaviestimiä koskevan yleissopimuksen allekirjoittaminen, matkatoimistojen ALV ja hallinnollisen yhteistyön ALV.
