[pic] | EUROOPA ÜHENDUSTE KOMISJON | Brüssel 27.9.2005 KOM(2005) 462 lõplik KOMISJONI TEATIS NÕUKOGULE JA EUROOPA PARLAMENDILE Seadusandjale esitatud seadusandlike ettepanekute sõelumise tulemus KOMISJONI TEATIS NÕUKOGULE JA EUROOPA PARLAMENDILE Seadusandjale esitatud seadusandlike ettepanekute sõelumise tulemus Nagu avaldati 16. märtsi 2005 teatises „Parem õiguslik reguleerimine majanduskasvu edendamiseks ja töökohtade loomiseks Euroopa Liidus“[1], on komisjon otsustanud põhjalikult muuta viisi, millega püütakse tagada seda, et Euroopa õigusaktide kvaliteet edendaks majanduskasvu ja tööhõive partnerluse eesmärke. Euroopa konkurentsivõime parandamiseks peab Euroopa Liidu õiguskeskkond olema võimalikult kvaliteetne. Selle eesmärgi saavutamiseks tuleb vajadusel lihtsustada ja ajakohastada ühenduse õigustikku (olemasolevat õigusaktide kogu), mille jaoks on ette nähtud arvukalt meetmeid, sealhulgas ka lihtsustamisprogrammi uue etapi algatamine oktoobris 2005. Komisjon on otsustanud ka, et parem õiguslik reguleerimine peab olema kaasatud poliitikavaldkondade kujundamisse ja et komisjoni esitatud seadusandlikud ettepanekud peavad edendama paremat õiguslikku reguleerimist ja soodustama konkurentsivõimet. See põhimõte väljendub eriti nõudmises, et uute õigusaktide algatuste puhul tuleb nüüd hinnata nende mõju, nagu teatati komisjoni 2005. aasta õigusloome- ja töökavas, mille kohta hiljuti võeti vastu ulatuslikud ja üksikasjalikud suunised[2]. Komisjoni varem esitatud ja menetluses olevate ettepanekute puhul nenditakse märtsi teatises, et komisjonil on kavas „sõeluda nõukogus/parlamendis menetluses olevad ettepanekud nende üldise asjakohasuse, konkurentsivõimele avalduva mõju ja muude tegurite suhtes“. Käesolevas teatises on esitatud kõnealuse sõelumise eesmärgid, kulg ja tulemused. Tegemist on esimese omalaadse sõelumisega. 1. Menetluses olevate ettepanekute sõelumise eesmärgid Sõelumise eesmärk on anda komisjonile võimalus tagada, et kõik menetluses olevad seadusandlikud ettepanekud on täielikult kooskõlas komisjoni poliitiliste prioriteetidega, ja kontrollida, kas muutunud asjaolud õigustavad algselt võetud lähenemise läbivaatamist. Kui läbivaatamine osutub vajalikuks, määrati sõelumisel kindlaks ka asjakohased meetmed, nagu menetluses olevate ettepanekute muutmine, asendamine või tagasivõtmine ning ettepanekute mõju hindamise parandamine. Täpsemalt on sõelumise eesmärk menetluses olevate ettepanekute uurimine kolmes punktis: Esiteks uuriti menetluses olevate ettepanekute vastavust EL Lissaboni eesmärkidele ja eriti konkurentsivõime edendamise eesmärgile. See tähendas, et ettepanekute hindamisel kasutati kriteeriume, mis on täpsustatud „konkurentsivõimelisuse testis“, mis moodustab ühe osa hiljuti muudetud mõjuhindamise suunistest[3]. Teiseks kontrolliti, kas leidub menetluses olevaid ettepanekuid, mis ei ole pikema aja jooksul õigusloomeprotsessis oluliselt kaugemale jõudnud. Sellisel juhul uuriti ka aeglase edasijõudmise põhjuseid ja võimalusi olukorra lahendamiseks. Kolmandaks uuriti menetluses olevate ettepanekute vastavust praegustele parema õigusliku reguleerimise nõuetele, eriti asjakohasele mõjude hindamisele. Kõnealune kriteerium mõjutab eriti neid ettepanekuid, mis on esitatud ajal, mil mõju hindamist veel ametlikult ei nõutud. 2. Sõelumise kulg Sõelumise alustamise ajal aprillis 2005 oli menetluses olevate ettepanekute koguarv 489[4]. Märtsi teatises määrati selgesõnaliselt kindlaks sõelumise ulatus, mis piirnes enne 1. jaanuarit 2004 esitatud menetluses olevate ettepanekutega. See tähendas kokku 183 ettepanekut. Neid hinnati põhjalikult ja selle tulemusena tuvastati umbes 100 ettepanekut, mis kujutavad endast tõesti uusi seadusandlikke algatusi ning mille puhul hinnati võimalikku ebasoodsat mõju konkurentsivõimele ja laiemat majanduslikku mõju. Ülejäänud ettepanekud avaldavad konkurentsivõimele tõenäoliselt vähest mõju või puudub see neil üldse. Need on põhiliselt ettepanekud, mis tulenevad rahvusvahelistest kohustustest või sisaldavad ühenduse õigustiku kohandamist teaduse ja tehnika arenguga. Mõned kõnealustest ettepanekutest aitavad ka otseselt kaasa „paremale õiguslikule reguleerimisele“, sest nendega kodifitseeritakse või lihtsustatakse ühenduse õigustikku. 3. Sõelumise tulemused Kõikide olemasolevate ettepanekute üksikasjaliku analüüsi järel näeb komisjon ette kahte liiki üldisi meetmeid: 1) Tagasivõetavad ettepanekud. Komisjon kavatseb tagasi võtta kokku 68 ettepanekut. Kõnealuseid ettepanekuid ei peeta vastavaks Lissaboni eesmärkidele või parema õigusliku reguleerimise põhimõtetele või ei edene need õigusloomeprotsessis piisavalt või ei ole enam aktuaalsed (nt on eesmärgid juba saavutatud või neid saavutatakse muude vahenditega)[5]. Osad kõnealustest ettepanekutest võidakse uuesti üle vaadata, pidades silmas nende täiendavat analüüsi. Mõnel juhul kavatseb komisjon üle vaadata seadusandliku sekkumise vajaduse, pidades silmas üldise mõjuhindamise tulemusi. 2) Ettepanekud jäävad õigusloomeprotsessi, kuid seadusandjale tuleb esitada hindamiseks majandusanalüüs[6]. See on seotud 5 ettepanekuga, mille olulisuses on komisjon veendunud, kuid mille puhul ettepanekute mõju analüüsi täiendava esitamine tõenäoliselt kergendaks seadusandja otsustusprotsessi. Seega sekkutakse komisjonipoolse sõelumise tulemusena mingil moel 73 menetluses oleva ettepaneku käsitlemisse. See hõlmab ettepanekuid, mis ei vasta täielikult konkurentsivõime eesmärkidele, ettepanekuid, mille puhul on vaja esitada seadusandjale hindamiseks täiendav majandusanalüüs, ja ka ettepanekuid, mis ei ole õigusloomeprotsessis piisavalt kaugele jõudnud või mis on aegunud. Kõnealused tagasivõetavad ettepanekud moodustavad umbes 31%[7] kõikidest menetluses olevatest ettepanekutest enne 1. jaanuarit 2004. Kõik ettepanekud, millesse sekkutakse, sealhulgas täiendavaks majandusanalüüsiks valitud ettepanekud moodustavad 33%[8] sellistest ettepanekutest. Lisaks sellele jõuti sõelumisel vähemalt kahe ettepaneku puhul tulemuseni, mis ei lange otseselt ühegi eespool nimetatud liigi alla. Esiteks jõudis komisjon seoses nõukogu direktiivi ettepanekuga, mis käsitleb töötervishoiu ja tööohutuse miinimumnõudeid seoses töötajate kokkupuutega füüsikalistest mõjuritest (optiline kiirgus) tulenevate riskidega (1992/0449/COD), sõelumise tulemusel järeldusele, et vastavalt Euroopa Parlamendi ettepanekule tuleks välja jätta aspektid, mis käsitlevad töötajate kokkupuudet loodusliku optilise kiirgusega. Teiseks jääb komisjon seoses ettepanekuga ajutiste töötajate kohta (2002/0072/COD) oma arvamuse juurde vaadata ettepanek üle, arvestades teiste ettepanekute edaspidiseid arutlusi. Käesoleva teatise lisas on esitatud olukorra kokkuvõte ja kõnealuste ettepanekute üksikasjad. Järeldus Menetluses olevate ettepanekute sõelumine on esimene komisjoni läbiviidud üldine sõelumine. See annab tunnistust Euroopa Komisjoni kohustumustest seoses majanduskasvu ja tööhõive partnerlusega ja parema õigusliku reguleerimise põhimõtete range rakendamise tagamisega. Sõelumisest tulenevad meetmed, st kavandatud sekkumine menetluses olevatesse ettepanekutesse vastavalt lisas kirjeldatule, on loodud Lissaboni eesmärkide saavutamise soodustamiseks konkurentsivõime toetamisega, ja parema õiguskeskkonna arendamisele kaasaaitamiseks ning selliste ettepanekute kõrvaldamiseks, mille vastuvõtmine ei ole tõenäoline või mis on aegunud. Menetluses olevate ettepanekute tagasivõtmine toimub mõnel juhul üldise poliitikate läbivaatamise raamistikus või kavatsusena ettepanekud üle vaadata, pidades silmas uusi poliitikate elemente ja üldist mõjuhinnangut. Kooskõlas Euroopa Parlamendi ja komisjoni vahelisi suhteid käsitleva raamkokkuleppe kohustustega (lõige 32) annab komisjon ettepanekute tagasivõtmisest parlamendile ja nõukogule eelnevalt teada. [4] Komisjon käsitleb tõesti igal aastal kokku umbes 200-250 ettepanekut, mis tulenevad EL rahvusvahelistest kohustustest, vajadusest uuendada ühenduse õigustikku ja/või täita seadusandja kohustusi. [5] Komisjon on ettepanekuid pidevalt tagasi võtnud, mis on vähendanud menetluses olevate ettepanekute arvu. 1997. aastal võeti tagasi 34 ettepanekut, 1999. aastal 58, 2001. aastal 108 ja 2004. aastal 102. [6] Fluoritud gaasid, jäätmete vedu, õhusõidukite liikuvate töövahendite alase konventsiooni allakirjutamine, reisibüroode käibemaks ja käibemaksualane halduskoostöö.
