Inland navigation: transport of goods or passengers by inland waterway between Member States

The aim of this Regulation is to institute freedom to provide transport services between Member States.

ACT

Council Regulation (EC) no 1356/96 of 8 July 1996 on common rules applicable to the transport of goods or passengers by inland waterway between Member States with a view to establishing freedom to provide such transport services. Official Journal L 175 of 13.7.96].

SUMMARY

Scope of the Regulation. The latter is applicable to the transport of goods or passengers by inland waterway for journeys between Member States and in transit through them.

List of conditions to be fulfilled in order to be allowed to carry out the transport operations referred to in the Regulation:

  • establishment in a Member State in accordance with the laws of that Member State;
  • entitlement in that Member State to carry out international transport of goods or passengers by inland waterway;
  • the use for such transport operations of vessels which are registered in a Member State or, in the absence of registration, are covered by a certificate of membership of a fleet of a Member State.
  • fulfilment of the conditions set out in Article 2 of Council Regulation (EEC) No 3921/91 of 16 December 1991 laying down the conditions under which non-resident carriers may transport goods or passengers by inland waterway within a Member State.

Special provisions concerning the rights of operators from third countries existing under the Revised Convention for the Navigation of the Rhine (Convention of Mannheim), the Convention on Navigation on the Danube (Belgrade Convention) or the rights arising from the European Community's international obligations.
