DECISIÓN DE EJECUCIÓN (UE) 2017/351 DE LA COMISIÓN

de 24 de febrero de 2017

por la que se modifica el anexo de la Decisión de Ejecución 2014/709/UE, sobre medidas de control zoosanitarias relativas a la peste porcina africana en determinados Estados miembros

[notificada con el número C(2017) 1261]

LA COMISIÓN EUROPEA,

Visto el Tratado de Funcionamiento de la Unión Europea,

Vista la Directiva 89/662/CEE del Consejo, de 11 de diciembre de 1989, relativa a los controles veterinarios aplicables en los intercambios intracomunitarios con vistas a la realización del mercado interior (1), y en particular su artículo 9, apartado 4,

Vista la Directiva 90/425/CEE del Consejo, de 26 de junio de 1990, relativa a los controles veterinarios y zootécnicos aplicables en los intercambios intracomunitarios de determinados animales vivos y productos con vistas a la realización del mercado interior (2), y en particular su artículo 10, apartado 4,

Vista la Directiva 2002/99/CE del Consejo, de 16 de diciembre de 2002, por la que se establecen las normas zoosanitarias aplicables a la producción, transformación, distribución e introducción de los productos de origen animal destinados al consumo humano (3), y en particular su artículo 4, apartado 3,

Considerando lo siguiente:

La Decisión de Ejecución 2014/709/UE de la Comisión (4) establece medidas de control zoosanitarias relativas a la peste porcina africana en determinados Estados miembros. En las partes I, II, III y IV del anexo de dicha Decisión de Ejecución se delimitan y enumeran ciertas zonas de tales Estados miembros, diferenciadas según el nivel de riesgo a partir de la situación epidemiológica. La lista incluye, entre otras, determinadas zonas de Letonia, y Lituania.

En febrero de 2017 se produjeron dos brotes de peste porcina africana en cerdos domésticos en el novads de Salaspils, en Letonia, y en el rajono savivaldybė de Biržai, en Lituania, en zonas que figuran actualmente en la parte II del anexo de la Decisión de Ejecución 2014/709/UE. La aparición de estos brotes representa un incremento del nivel de riesgo que debe tenerse en cuenta. Por consiguiente, las zonas pertinentes de Letonia y Lituania que figuran en las partes I y II deben incorporarse ahora a la parte III de dicho anexo.

En enero de 2017 se dieron algunos casos de peste porcina africana en jabalíes en el novads de Talsu y Tukuma, en Letonia, en dos zonas que actualmente figuran en la parte II del anexo de la Decisión de Ejecución 2014/709/UE, pero en las inmediaciones de las zonas indicadas en la parte I de dicha Decisión de Ejecución. La aparición de estos casos representa un incremento del nivel de riesgo que debe tenerse en cuenta. Por consiguiente, las zonas pertinentes de Letonia deben incorporarse ahora a la parte II, en lugar de la parte I, de dicho anexo, y deben incluirse nuevas zonas en la parte I del anexo.

Al evaluar el riesgo zoosanitario que presenta esta situación en lo que respecta a la peste porcina africana en Letonia y Lituania, debe tenerse en cuenta la evolución de la actual situación epidemiológica respecto a esta enfermedad en las poblaciones de cerdos domésticos y de jabalíes afectadas en la Unión. Con el fin de hacer más específicas las medidas de control zoosanitarias previstas en la Decisión de Ejecución 2014/709/UE y de impedir la propagación de la peste porcina africana, a la vez que se evita toda perturbación innecesaria del comercio dentro de la Unión y la introducción de barreras injustificadas al comercio por parte de terceros países, procede modificar la lista de la Unión de las zonas sujetas a las medidas de control zoosanitarias establecidas en el anexo de dicha Decisión de Ejecución con el fin de tener en cuenta los cambios en la actual situación epidemiológica de Letonia y Lituania en relación con esta enfermedad.

(5)	Procede, por tanto, modificar el anexo de la Decisión de Ejecución 2014/709/UE en consecuencia.

(6)	Las medidas previstas en la presente Decisión se ajustan al dictamen del Comité Permanente de Vegetales, Animales, Alimentos y Piensos.

HA ADOPTADO LA PRESENTE DECISIÓN:

Artículo 1

El anexo de la Decisión de Ejecución 2014/709/UE se sustituye por el texto del anexo de la presente Decisión.

Artículo 2

Los destinatarios de la presente Decisión serán los Estados miembros.
