Resultados del examen de las propuestas legislativas pendientes ante el Legislador

Tal y como anunció en su Comunicación de 16 de marzo de 2005 sobre «Legislar mejor para potenciar el crecimiento y el empleo en la Unión Europea»[1] la Comisión ha decidido introducir un cambio decisivo en la manera en que pretende garantizar que la calidad de la legislación en Europa fomente los objetivos de la Asociación para el crecimiento y el empleo.

Para incrementar la competitividad europea, es preciso que el entorno normativo de la Unión Europea sea de la mayor calidad posible. Para alcanzar este objetivo, debe simplificarse y actualizarse el «acervo comunitario», que es la legislación existente, siempre que sea necesario; para ello, están previstas una serie de medidas, entre las que se encuentra la puesta en marcha de una nueva fase del programa de simplificación en octubre de 2005.

La Comisión también ha decidido que el concepto «legislar mejor» debe integrarse en el diseño de las políticas y que las nuevas propuestas legislativas presentadas por la Comisión deberían intentar promover dicho concepto y contribuir a la competitividad. La aplicación práctica de este objetivo supone, entre otras cosas, que las nuevas iniciativas legislativas se someten ahora a una evaluación de impacto como se anunció en el programa legislativo y de trabajo de la Comisión para 2005, para el que se aprobaron recientemente unas orientaciones amplias y detalladas[2].

Por lo que respecta a las propuestas presentadas por la Comisión en el pasado y aún pendientes en proceso legislativo, la Comunicación de marzo manifestaba que la Comisión se propone «examinar las propuestas pendientes ante el Consejo o el Parlamento en relación con su importancia general, su impacto en la competitividad y otros efectos». Los objetivos, proceso y resultados de dicho ejercicio de examen, que es el primero de este tipo, se presentan en la presente Comunicación.

1. Objetivos del examen de las propuestas pendientes

El ejercicio de examen tenía como objetivo que la Comisión pueda garantizar que todas las propuestas legislativas pendientes sean plenamente coherentes con las prioridades políticas de la Comisión y comprobar si la modificación de algunas circunstancias justifica la revisión del enfoque inicial.

Cuando se ha considerado necesaria una revisión, el ejercicio de examen también ha definido las medidas apropiadas que debían adoptarse, como la modificación, la sustitución o la retirada de propuestas pendientes, mejorando la evaluación de su impacto.

Más en concreto, el ejercicio de examen tenía como objetivo analizar las propuestas pendientes en tres ámbitos:

En primer lugar, se examinaron las propuestas pendientes desde el punto de vista de su coherencia con los objetivos comunitarios de Lisboa y en particular con el objetivo de fomentar la competitividad. Los criterios utilizados para evaluar las propuestas a este respecto fueron las que se especifican en el ‘test de competitividad’ que forma parte de las orientaciones de evaluación de impacto recientemente revisadas[3].

En segundo lugar, se analizaron las propuestas pendientes para comprobar si faltaban avances sustanciales en el proceso legislativo durante un periodo significativo de tiempo. En esos casos, se examinaron asimismo las razones de la lentitud de los avances y las posibilidades de desbloquear esa situación.

En tercer lugar, se examinaron las propuestas pendientes para determinar si satisfacían las exigencias actuales del concepto «legislar mejor», especialmente en relación con las oportunas evaluaciones de impacto. Este criterio afecta en concreto a las propuestas presentadas cuando las evaluaciones de impacto no constituían una exigencia formal.

2. Proceso del ejercicio de examen

Al comienzo del ejercicio de examen, en abril de 2005, la cantidad total de propuestas pendientes ascendía a 489[4]. El ejercicio definido por la Comunicación de marzo se limitó expresamente a las propuestas pendientes fechadas con anterioridad al 1 de enero de 2004, lo cual ascendía a 183 propuestas.

Las propuestas fueron sometidas a una minuciosa evaluación que dio lugar a la definición de unas 100 propuestas que constituyen verdaderas nuevas iniciativas legislativas y que se evaluaron más en profundidad por los posibles efectos adversos sobre la competitividad y los efectos económicos más amplios. El resto consta de propuestas que pueden tener un impacto limitado o nulo sobre competitividad y que hacen referencia principalmente a las propuestas derivadas de los compromisos internacionales o que constituyen adaptaciones del acervo al progreso científico y técnico. Asimismo, algunas de esas propuestas contribuyen directamente a «legislar mejor» ya que codifican o simplifican el acervo.

3. Resultados del ejercicio de examen

Siguiendo un detallado análisis de todas las propuestas pendientes, la Comisión ha previsto dos grandes tipos de acción:

(1) Retirada de propuestas. La Comisión se propone retirar en total 68 propuestas. Se considera que esas propuestas no son coherentes con los objetivos de Lisboa o con los principios de «legislar mejor», han progresado insuficientemente en el proceso legislativo o han perdido actualidad[5] (por ejemplo: porque ya se han alcanzado o se van a alcanzar los objetivos por otros medios). Algunas de esas propuestas se pueden reconsiderar a la luz de nuevos análisis. En determinados casos, la Comisión se propone reconsiderar la necesidad de una intervención legislativa a la luz de los resultados de una evaluación de impacto global.

(2) Mantenimiento de propuestas en el proceso legislativo, pero con un análisis económico para que la autoridad legislativa pueda evaluar[6]. Esto se refiere a 5 propuestas que, a juicio de la Comisión, siguen siendo importantes, pero que podrían necesitar una presentación adicional del análisis de su impacto para facilitar el proceso decisorio a la autoridad legislativa.

De esta forma, como resultado del examen de la Comisión, unas 73 propuestas pendientes se someterán a algún tipo de intervención. Aquí se incluyen las propuestas que no cumplen plenamente los objetivos de competitividad, las que necesitan un mayor análisis económico antes de su presentación a la evaluación del Legislador así como las propuestas que no han avanzado suficientemente en el proceso legislativo o han quedado obsoletas.

Las retiradas equivalen a cerca del 31 %[7] del total de propuestas pendientes desde antes del 1 de enero de 2004. Todas las intervenciones, incluidas las propuestas que se van a someter a un mayor análisis económico, equivalen al 33 %[8] de las propuestas pendientes.

Por otra parte, por lo que respecta al menos a dos propuestas, el ejercicio de examen ha dado resultados que no se pueden incluir directamente en las categorías anteriores. En primer lugar, la propuesta de Directiva del Consejo sobre las disposiciones mínimas de seguridad y de salud relativas a la exposición de los trabajadores a los riesgos derivados de los agentes físicos (radiaciones ópticas, 1992/0449/COD), en relación con la cual el ejercicio de examen ha llevado a la Comisión a la conclusión de que deberían suprimirse los aspectos relativos a la exposición de los trabajadores a radiación óptica natural, como propone también el Parlamento Europeo.

En segundo lugar, en relación con la propuesta sobre los trabajadores cedidos por empresas de trabajo temporal (2002/0072/COD), la Comisión se reserva su posición de reconsiderar la propuesta a la luz de futuras negociaciones sobre otras propuestas.

El anexo a esta Comunicación resume la situación y facilita detalles de las propuestas en cuestión.

Conclusión

El ejercicio de examen de las propuestas pendientes es el primer examen de carácter general realizado por la Comisión. Ello muestra el compromiso de la Comisión Europea con la Asociación para el crecimiento y el empleo y su empeño en garantizar que los principios de «legislar mejor» se lleven a la práctica rigurosamente.

Las acciones resultantes del ejercicio de examen, es decir las intervenciones previstas sobre propuestas pendientes que figuran en el anexo, están destinadas a tener un efecto positivo en el cumplimiento de los objetivos de Lisboa, mediante su apoyo a la competitividad, para el desarrollo de un mejor entorno legislativo y para eliminar propuestas que no tengan posibilidades reales de adopción o hayan quedado obsoletas.

La retirada de propuestas pendientes, en determinados casos, se llevará a cabo en el marco de una revisión general de las políticas o con intención de reconsiderar las propuestas a la luz de nuevos elementos políticos y una evaluación de impacto global.

De conformidad con los compromisos del Acuerdo marco sobre las relaciones entre el Parlamento Europeo y la Comisión (apartado 32), esta última debe notificar previamente al Parlamento y al Consejo antes de retirar sus propuestas.

[4] De hecho, la Comisión trata, cada año, un volumen de unas 200/250 propuestas resultantes de las obligaciones comunitarias internacionales, la necesidad de poner al día el «acervo comunitario» y/o de responder a compromisos con el Legislador.

[5] La Comisión ha llevado a cabo ejercicios de retirada que han reducido la cantidad de propuestas pendientes. En 1997, se retiraron 34 propuestas, 58 en 1999, 108 en 2001 y 102 en 2004.
