COMMISSION IMPLEMENTING REGULATION (EU) No 887/2014

of 14 August 2014

concerning the technical format for the transmission of European statistics on vineyards pursuant to Regulation (EU) No 1337/2011 of the European Parliament and of the Council

THE EUROPEAN COMMISSION,

Having regard to the Treaty on the Functioning of the European Union,

Having regard to Regulation (EU) No 1337/2011 of the European Parliament and of the Council of 13 December 2011 concerning European statistics on permanent crops (1), and in particular Article 8(2) thereof,

Whereas:

(1)	Regulation (EU) No 1337/2011 sets the framework for producing comparable European statistics on permanent crops.

(2)	The data structure for the transmission of statistical data on vineyards and the exchange standard should be specified.

(3)	The measures provided for in this Regulation are in accordance with the opinion of the Standing Committee on Agricultural Statistics,

HAS ADOPTED THIS REGULATION:

Article 1

Member States shall send the statistical data on vineyards referred to in Annex II to Regulation (EU) No 1337/2011 within the structure laid down in the SDMX data structure definitions. They shall either send the data to the European Commission (Eurostat) using the Single Entry Point services, or shall make the data available so that the European Commission (Eurostat) can retrieve the data using the Single Entry Point services.

Article 2

The data structure for sending statistical data on vineyards to the European Commission (Eurostat) shall be specified in the Annex.

Article 3

Data shall be provided for all single compulsory variables and all aggregates.

Article 4

Data shall be provided in hectares and in numbers of holdings.

Article 5

This Regulation shall enter into force on the twentieth day following that of its publication in the Official Journal of the European Union.

This Regulation shall be binding in its entirety and directly applicable in all Member States.

prohibiting the introduction into the Union of specimens of certain species of wild fauna and flora

THE EUROPEAN COMMISSION,

Having regard to the Treaty on the Functioning of the European Union,

Having regard to Council Regulation (EC) No 338/97 of 9 December 1996 on the protection of species of wild fauna and flora by regulating trade therein (1), and in particular Article 4(6) thereof,

Whereas:

Article 4(6) of Regulation (EC) No 338/97 provides that the Commission may establish restrictions to the introduction of specimens of certain species into the Union in accordance with the conditions laid down in points (a) to (d) thereof. Furthermore, implementing measures for such restrictions have been laid down in Article 71 of Commission Regulation (EC) No 865/2006 (2).

(2)	The list of species for which the introduction into the Union is prohibited was last established in June 2013 by Commission Implementing Regulation (EU) No 578/2013 (3).

(3)	Croatia acceded to the Union on 1 July 2013. Therefore, all references to that Member State should be deleted from the list of species whose introduction in the Union is prohibited.

On the basis of recent information, the Scientific Review Group has concluded that the conservation status of certain additional species listed in Annexes A and B to Regulation (EC) No 338/97 will be seriously jeopardised if their introduction into the Union from certain countries of origin is not prohibited. The introduction into the Union of specimens of the following new species should therefore be prohibited:

—	Loxodonta africana (hunting trophies) from Cameroon;

—	Manis tricuspis from Guinea;

—	Balearica pavonina from South Sudan;

—	Balearica regulorum from Rwanda and Tanzania;

—	Calumma tarzan from Madagascar;

—	Trioceros perreti and Trioceros serratus from Cameroon;

—	Cordylus rhodesianus from Mozambique;

—	Uroplatus sameiti from Madagascar;

—	Candoia carinata from Indonesia;

—	Python bivittatus from China;

—	Kinixys erosa from Democratic Republic of the Congo;

—	Pandinus imperator from Benin (wild specimens) and Togo (wild and ranched specimens).

The Scientific Review Group has also concluded that, on the basis of the most recent available information, the prohibition of the introduction into the Union should no longer be required for specimens of the following species:

—	Gopherus agassizii from Mexico;

—	Stigmochelys pardalis from Mozambique (ranched specimens) and Zambia (ranched specimens and specimens with code F)

—	Ornithoptera urvillianus (wild and ranched specimens) from Solomon Islands;

—	Nardostachys grandiflora from Nepal.

(6)	The countries of origin of the species which are subject to new restrictions to introduction into the Union have all been consulted.

(7)

At the 16th Conference of the Parties to the Convention on International Trade in Endangered Species of wild fauna and flora (CITES), new nomenclatural references (splitting of species and renaming of genus) for animals were adopted and should be reflected accordingly in Union legislation. Furthermore, the species Euphyllia picteti should be deleted as this species is not recognised in the standard nomenclatural reference agreed at CoP 16.

(8)	The list of species for which the introduction into the Union is prohibited should therefore be updated and Implementing Regulation (EU) No 578/2013 should, for reasons of clarity, be replaced.

(9)	The Scientific Review Group established pursuant to Article 17 of Regulation (EC) No 338/97 has been consulted.

(10)	The measures provided for in this Regulation are in accordance with the opinion of the Committee on Trade in Wild Fauna and Flora established pursuant to Article 18 of Regulation (EC) No 338/97,

HAS ADOPTED THIS REGULATION:

Article 1

The introduction into the Union of specimens of the species of wild fauna and flora set out in the Annex to this Regulation from the countries of origin indicated therein is prohibited.

Article 2

Implementing Regulation (EU) No 578/2013 is repealed.

References to the repealed Implementing Regulation shall be construed as references to this Regulation.

Article 3

This Regulation shall enter into force on the twentieth day following that of its publication in the Official Journal of the European Union.

This Regulation shall be binding in its entirety and directly applicable in all Member States.

amending Regulation (EEC) No 2454/93, as regards recognition of the common security requirements under the regulated agent and known consignor programme and the Authorised Economic Operator programme

THE EUROPEAN COMMISSION,

Having regard to the Treaty on the Functioning of the European Union,

Having regard to Council Regulation (EEC) No 2913/92 of 12 October 1992 establishing the Community Customs Code (1), and in particular Article 247 thereof,

Whereas:

(1)

Both within the field of customs and aviation security, respective legislation, in particular Regulation (EEC) No 2913/92 establishing the Community Customs Code and Regulation (EC) No 300/2008 of the European Parliament and the Council (2) on common rules in the field of civil aviation security allows that entities complying with certain conditions and requirements may be certified to ensure and contribute to a secure supply chain.

(2)

Existing customs and aviation legislation provides for certain recognition of the certificationsunder the respective programmes, in particular with regard to the security examinations done for each of them. Article 14k(2)(b) and (3) of Commission Regulation (EEC) No 2454/93 (3) provides that if the applicant for Authorised Economic Operator (AEO) status is already a regulated agent the criterion on ‘appropriate security and safety standards’ shall be deemed to be met in relation to the premises for which the economic operator obtained the status of regulated agent. Points 6.3.1.2 and 6.4.1.2 of the Annex to Commission Regulation (EU) No 185/2010 (4) provide that the appropriate authority, or independent validator acting on its behalf, should take into account whether or not the applicant for regulated agent or known consignor is a holder of an AEO certificate.

The practical implementation of both the customs legislation governing the AEO status and the aviation legislation governing the regulated agent and known consignor has shown that the existing recognition between the programmes is not sufficient to ensure the highest possible synergies between the respective security programmes. The security requirements for both the aviation security regulated agent and known consignor programme and for the customs AEO programme are equivalent to such an extent that both programmes may be aligned further.

(4)

Further alignment of both programmes in terms of equal level of recognition, including required exchange of information is necessary in order to decrease the administrative burden for the economic sector concerned and government authorities (both customs and civil aviation) while strengthening further the current level of security.

(5)

Amendment of Regulation (EEC) No 2454/93 is necessary to update the references to the aviation legislation in force, include the recognition of the known consignor status with its relevance for the AEO as well, frame the scope of recognition of the common requirements between the respective programmes and allow for the necessary exchange of information between customs and aviation authorities.

(6)	Regulation (EEC) No 2454/93 should therefore be amended accordingly.

(7)	The measures provided for in this Regulation are in accordance with the opinion of the Customs Code Committee,

HAS ADOPTED THIS REGULATION:

Article 1

Regulation (EEC) No 2454/93 is amended as follows:

(1)

Article 14k is amended as follows:

(a)

point (b) of paragraph 2 is replaced by the following:

‘(b)	be a regulated agent as defined in Article 3 of Regulation (EC) No 300/2008 of the European Parliament and of the Council (5) (“regulated agent”) and fulfil the requirements laid down in Commission Regulation (EU) No 185/2010 (6);

(b)

in paragraph 2, the following subparagraph is added:

‘If the airline company is a regulated agent, the conditions laid down in paragraph 1 shall be deemed to be met in relation to the sites and the operations for which the applicant obtained the status of regulated agent to the extent that the conditions for issuing the regulated agent status are identical or correspond to those laid down in paragraph 1.’;

(c)

paragraph 3 is replaced by the following:

‘3. Where the applicant is established in the customs territory of the Community and is a regulated agent or a known consignor as defined in Article 3 of Regulation (EC) No 300/2008 and fulfils the requirements laid down in Regulation (EU) No 185/2010, the conditions laid down in paragraph 1 shall be deemed to be met in relation to the sites and the operations for which the applicant obtained the status of regulated agent or known consignor to the extent that the conditions for issuing the regulated agent or known consignor status are identical or correspond to those laid down in paragraph 1.’.

In Article 14w the following paragraph 4 is added:

‘4. The issuing customs authority shall immediately make available to the appropriate national authority responsible for civil aviation security the following minimum information related to the status of authorised economic operator which it has at its disposal:

(a)

the AEO certificate — security and safety (AEOS) and AEO certificate — customs simplifications/security and safety (AEOF) including the name of the holder of the certificate and, where applicable, their amendment or revocation or the suspension of the status of authorised economic operator and the reasons therefor;

(b)	information about whether the specific site concerned has been visited by customs authorities, the date of the last visit and the purpose for the visit (authorisation process, reassessment, monitoring);

(c)	any reassessments of AEOS and AEOF certificates and the results thereof.

The national customs authorities shall, in agreement with the appropriate national authority responsible for civil aviation security, establish detailed modalities for the exchange of any information as referred to in the first subparagraph which is not covered by the electronic information and communication system referred to in Article 14x, by 1 March 2015 at the latest.

The national authorities responsible for civil aviation security handling the information concerned shall only use it for the purposes of the relevant programmes for regulated agent or known consignor and shall implement appropriate technical and organizational measures to ensure the security of this information’.

(3)

In Article 14x the following paragraph 2a is inserted:

‘2a. Where applicable, in particular when the status of authorised economic operator is considered as a basis for granting approval or authorisations or facilitations under other Union legislation access to the information referred to in points (a) and (c) of Article 14w(4) may be granted also to the appropriate national authority responsible for civil aviation security.’.

Annex 1C is amended as follows:

(a)	the title of box 15 is replaced by the following:

(b)

the title of the explanatory notes to box 15 is replaced by the following:

‘15.	Simplifications or facilitations already granted, certificates mentioned in Article 14k(4), and/or status of regulated agent or known consignor obtained as mentioned in Article 14k(2) and (3):’

(c)

the explanatory notes to box 15 are replaced by the following:

‘In case of simplifications already granted, indicate the type of simplification, the relevant customs procedure and the authorisation number.The relevant customs procedure shall be entered in the form of the letters used as column headings (A to K) to identify customs procedures in the matrix in Annex 37, Title I, point B.

In the cases of Article 14k(2) and (3), indicate the status obtained:regulated agent or known consignor and the number of the certificate.

In case the applicant is the holder of one or more certificates mentioned in Article 14k(4), indicate the type and the number of the certificate(s).’.

Article 2

This Regulation shall enter into force on the twentieth day following that of its publication in the Official Journal of the European Union.

This Regulation shall be binding in its entirety and directly applicable in all Member States.

approving the active substance metobromuron, in accordance with Regulation (EC) No 1107/2009 of the European Parliament and of the Council concerning the placing of plant protection products on the market, and amending the Annex to Commission Implementing Regulation (EU) No 540/2011

THE EUROPEAN COMMISSION,

Having regard to the Treaty on the Functioning of the European Union,

Having regard to Regulation (EC) No 1107/2009 of the European Parliament and of the Council of 21 October 2009 concerning the placing of plant protection products on the market and repealing Council Directives 79/117/EEC and 91/414/EEC (1), and in particular Article 13(2) and Article 78(2) thereof,

Whereas:

(1)

In accordance with Article 80(1)(a) of Regulation (EC) No 1107/2009, Council Directive 91/414/EEC (2) is to apply, with respect to the procedure and the conditions for approval, to active substances for which a decision has been adopted in accordance with Article 6(3) of that Directive before 14 June 2011. For metobromuron the conditions of Article 80(1)(a) of Regulation (EC) No 1107/2009 are fulfilled by Commission Implementing Decision 2011/253/EU (3).

(2)

In accordance with Article 6(2) of Directive 91/414/EEC Francereceived on 15 December 2010 an application from Belchim Crop Protection NV/SA for the inclusion of the active substance metobromuron in Annex I to Directive 91/414/EEC. Decision 2011/253/EU confirmed that the dossier was ‘complete’ in the sense that it could be considered as satisfying, in principle, the data and information requirements of Annexes II and III to Directive 91/414/EEC.

(3)

For that active substance, the effects on human and animal health and the environment have been assessed, in accordance with the provisions of Article 6(2) and (4) of Directive 91/414/EEC, for the uses proposed by the applicant. The designated rapporteur Member State France submitted a draft assessment report on 10 January 2013. In accordance with Article 8(3) of Commission Regulation (EU) No 188/2011 (4) additional information was requested from the applicant on 13 May 2013. The evaluation of the additional information by France was submitted in the format of an updated draft assessment report in October 2013.

The draft assessment report was reviewed by the Member States and the European Food Safety Authority (hereinafter ‘the Authority’). The Authority presented to the Commission its conclusion on the pesticide risk assessment of the active substance metobromuron (5) on 15 January 2014. The draft assessment report and the conclusion of the Authority were reviewed by the Member States and the Commission within the Standing Committee on Plants, Animals, Food and Feed and finalised on 11 July 2014 in the format of the Commission review report for metobromuron.

It has appeared from the various examinations made that plant protection products containing metobromuron may be expected to satisfy, in general, the requirements laid down in Article 5(1)(a) and (b) and Article 5(3) of Directive 91/414/EEC, in particular with regard to the uses which were examined and detailed in the Commission review report. It is therefore appropriate to approve metobromuron.

(6)

In accordance with Article 13(2) of Regulation (EC) No 1107/2009 in conjunction with Article 6 thereof and in the light of current scientific and technical knowledge, it is, however, necessary to include certain conditions and restrictions. It is, in particular, appropriate to require further confirmatory information.

(7)	A reasonable period should be allowed to elapse before approval in order to permit Member States and the interested parties to prepare themselves to meet the new requirements resulting from the approval.

(8)

Without prejudice to the obligations provided for in Regulation (EC) No 1107/2009 as a consequence of approval, taking into account the specific situation created by the transition from Directive 91/414/EEC to Regulation (EC) No 1107/2009, the following should, however, apply. Member States should be allowed a period of six months after approval to review authorisations of plant protection products containing metobromuron. Member States should, as appropriate, vary, replace or withdraw authorisations. By way of derogation from that deadline, a longer period should be provided for the submission and assessment of the complete Annex III dossier, as set out in Directive 91/414/EEC, of each plant protection product for each intended use in accordance with the uniform principles.

The experience gained from inclusions in Annex I to Directive 91/414/EEC of active substances assessed in the framework of Commission Regulation (EEC) No 3600/92 (6) has shown that difficulties can arise in interpreting the duties of holders of existing authorisations in relation to access to data. In order to avoid further difficulties it therefore appears necessary to clarify the duties of the Member States, especially the duty to verify that the holder of an authorisation demonstrates access to a dossier satisfying the requirements of Annex II to that Directive. However, this clarification does not impose any new obligations on Member States or holders of authorisations compared to the Directives which have been adopted until now amending Annex I to that Directive or the Regulations approving active substances.

(10)	In accordance with Article 13(4) of Regulation (EC) No 1107/2009, the Annex to Commission Implementing Regulation (EU) No 540/2011 (7) should be amended accordingly.

(11)	The measures provided for in this Regulation are in accordance with the opinion of the Standing Committee on Plants, Animals, Food and Feed,

HAS ADOPTED THIS REGULATION:

Article 1

Approval of active substance

The active substance metobromuron, as specified in Annex I, is approved subject to the conditions laid down in that Annex.

Article 2

Re-evaluation of plant protection products

1. Member States shall in accordance with Regulation (EC) No 1107/2009, where necessary, amend or withdraw existing authorisations for plant protection products containing metobromuron as an active substance by 30 June 2015.

By that date they shall in particular verify that the conditions in Annex I to this Regulation are met, with the exception of those identified in the column on specific provisions of that Annex, and that the holder of the authorisation has, or has access to, a dossier satisfying the requirements of Annex II to Directive 91/414/EEC in accordance with the conditions of Article 13(1) to (4) of that Directive and Article 62 of Regulation (EC) No 1107/2009.

2. By way of derogation from paragraph 1, for each authorised plant protection product containing metobromuron as either the only active substance or as one of several active substances, all of which were listed in the Annex to Implementing Regulation (EU) No 540/2011 by 31 December 2014 at the latest, Member States shall re-evaluate the product in accordance with the uniform principles, as referred to in Article 29(6) of Regulation (EC) No 1107/2009, on the basis of a dossier satisfying the requirements of Annex III to Directive 91/414/EEC and taking into account the column on specific provisions of Annex I to this Regulation. On the basis of that evaluation, they shall determine whether the product satisfies the conditions set out in Article 29(1) of Regulation (EC) No 1107/2009.

Following that determination Member States shall:

(a)	in the case of a product containing metobromuron as the only active substance, where necessary, amend or withdraw the authorisation by 30 June 2016 at the latest; or

(b)

in the case of a product containing metobromuron as one of several active substances, where necessary, amend or withdraw the authorisation by 30 June 2016 or by the date fixed for such an amendment or withdrawal in the respective act or acts which added the relevant substance or substances to Annex I to Directive 91/414/EEC or approved that substance or those substances, whichever is the latest.

Article 3

Amendments to Implementing Regulation (EU) No 540/2011

The Annex to Implementing Regulation (EU) No 540/2011 is amended in accordance with Annex II to this Regulation.

Article 4

Entry into force and date of application

This Regulation shall enter into force on the twentieth day following that of its publication in the Official Journal of the European Union.

It shall apply from 1 January 2015.

This Regulation shall be binding in its entirety and directly applicable in all Member States.

In accordance with Article 80(1)(a) of Regulation (EC) No 1107/2009, Council Directive 91/414/EEC (2) is to apply, with respect to the procedure and the conditions for approval, to active substances for which a decision has been adopted in accordance with Article 6(3) of that Directive before 14 June 2011. For aminopyralid the conditions of Article 80(1)(a) of Regulation (EC) No 1107/2009 are fulfilled by Commission Decision 2005/778/EC (3).

In accordance with Article 6(2) of Directive 91/414/EEC the United Kingdomreceived on 22 April 2004 an application from Dow AgroSciences Ltd for the inclusion of the active substance aminopyralid in Annex I to Directive 91/414/EEC. Decision 2005/778/EC confirmed that the dossier was ‘complete’ in the sense that it could be considered as satisfying, in principle, the data and information requirements of Annexes II and III to Directive 91/414/EEC.

For that active substance, the effects on human and animal health and the environment have been assessed, in accordance with the provisions of Article 6(2) and (4) of Directive 91/414/EEC, for the uses proposed by the applicant. The designated rapporteur Member State submitted a draft assessment report on 22 August 2006. In accordance with Article 11(6) of Commission Regulation (EU) No 188/2011 (4) additional information was requested from the applicant on 27 May 2011. The evaluation of the additional information by the United Kingdom was submitted in the format of an updated draft assessment report on 8 June 2012.

The draft assessment report was reviewed by the Member States and the European Food Safety Authority (hereinafter ‘the Authority’). The Authority presented to the Commission its conclusion on the pesticide risk assessment of the active substance aminopyralid (5) on 30 August 2013. The draft assessment report and the conclusion of the Authority were reviewed by the Member States and the Commission within the Standing Committee on the Food Chain and Animal Health and finalised within the Standing Committee on Plants, Animals, Food and Feed on 11 July 2014 in the format of the Commission review report for aminopyralid.

It has appeared from the various examinations made that plant protection products containing aminopyralid may be expected to satisfy, in general, the requirements laid down in Article 5(1)(a) and (b) and Article 5(3) of Directive 91/414/EEC, in particular with regard to the uses which were examined and detailed in the Commission review report. It is therefore appropriate to approve aminopyralid.

(6)	A reasonable period should be allowed to elapse before approval in order to permit Member States and the interested parties to prepare themselves to meet the new requirements resulting from the approval.

(7)

Without prejudice to the obligations provided for in Regulation (EC) No 1107/2009 as a consequence of approval, taking into account the specific situation created by the transition from Directive 91/414/EEC to Regulation (EC) No 1107/2009, the following should, however, apply. Member States should be allowed a period of six months after approval to review authorisations of plant protection products containing aminopyralid. Member States should, as appropriate, vary, replace or withdraw authorisations. By way of derogation from that deadline, a longer period should be provided for the submission and assessment of the complete Annex III dossier, as set out in Directive 91/414/EEC, of each plant protection product for each intended use in accordance with the uniform principles.

(9)	In accordance with Article 13(4) of Regulation (EC) No 1107/2009, the Annex to Commission Implementing Regulation (EU) No 540/2011 (7) should be amended accordingly.

(10)	The measures provided for in this Regulation are in accordance with the opinion of the Standing Committee on Plants, Animals, Food and Feed,

HAS ADOPTED THIS REGULATION:

Article 1

Approval of active substance

The active substance aminopyralid, as specified in Annex I, is approved subject to the conditions laid down in that Annex.

Article 2

Re-evaluation of plant protection products

1. Member States shall in accordance with Regulation (EC) No 1107/2009, where necessary, amend or withdraw existing authorisations for plant protection products containing aminopyralid as an active substance by 30 June 2015.

2. By way of derogation from paragraph 1, for each authorised plant protection product containing aminopyralid as either the only active substance or as one of several active substances, all of which were listed in the Annex to Implementing Regulation (EU) No 540/2011 by 31 December 2014 at the latest, Member States shall re-evaluate the product in accordance with the uniform principles, as referred to in Article 29(6) of Regulation (EC) No 1107/2009, on the basis of a dossier satisfying the requirements of Annex III to Directive 91/414/EEC and taking into account the column on specific provisions of Annex I to this Regulation. On the basis of that evaluation, they shall determine whether the product satisfies the conditions set out in Article 29(1) of Regulation (EC) No 1107/2009.

Following that determination Member States shall:

(a)	in the case of a product containing aminopyralid as the only active substance, where necessary, amend or withdraw the authorisation by 30 June 2016 at the latest; or

(b)

in the case of a product containing aminopyralid as one of several active substances, where necessary, amend or withdraw the authorisation by 30 June 2016 or by the date fixed for such an amendment or withdrawal in the respective act or acts which added the relevant substance or substances to Annex I to Directive 91/414/EEC or approved that substance or those substances, whichever is the latest.

Article 3

Amendments to Implementing Regulation (EU) No 540/2011

The Annex to Implementing Regulation (EU) No 540/2011 is amended in accordance with Annex II to this Regulation.

Article 4

Entry into force and date of application

This Regulation shall enter into force on the twentieth day following that of its publication in the Official Journal of the European Union.

It shall apply from 1 January 2015.

This Regulation shall be binding in its entirety and directly applicable in all Member States.

Having regard to Commission Implementing Regulation (EU) No 543/2011 of 7 June 2011 laying down detailed rules for the application of Council Regulation (EC) No 1234/2007 in respect of the fruit and vegetables and processed fruit and vegetables sectors (2), and in particular Article 136(1) thereof,

Whereas:

Implementing Regulation (EU) No 543/2011 lays down, pursuant to the outcome of the Uruguay Round multilateral trade negotiations, the criteria whereby the Commission fixes the standard values for imports from third countries, in respect of the products and periods stipulated in Annex XVI, Part A thereto.

(2)

The standard import value is calculated each working day, in accordance with Article 136(1) of Implementing Regulation (EU) No 543/2011, taking into account variable daily data. Therefore this Regulation should enter into force on the day of its publication in the Official Journal of the European Union,

HAS ADOPTED THIS REGULATION:

Article 1

The standard import values referred to in Article 136 of Implementing Regulation (EU) No 543/2011 are fixed in the Annex to this Regulation.

Article 2

This Regulation shall enter into force on the day of its publication in the Official Journal of the European Union.

COMMISSION IMPLEMENTING DECISION

of 14 August 2014

on the compliance of European standards EN 16433:2014 and EN 16434:2014 and of certain clauses of European standard EN 13120:2009+A1:2014 for internal blinds with the general safety requirement of Directive 2001/95/EC of the European Parliament and of the Council and publication of the references of those standards in the Official Journal of the European Union

THE EUROPEAN COMMISSION,

Having regard to the Treaty on the Functioning of the European Union,

Having regard to Directive 2001/95/EC of the European Parliament and of the Council of 3 December 2001 on general product safety (1), and in particular the first subparagraph of Article 4(2) thereof,

Whereas:

(1)	Article 3(1) of Directive 2001/95/EC requires producers to place only safe products on the market.

(2)

Under the second subparagraph of Article 3(2) of Directive 2001/95/EC, a product is to be presumed safe, as far as the risks and risk categories covered by the relevant national standards are concerned, when it conforms to voluntary national standards transposing European standards, the references of which have been published by the Commission in the Official Journal of the European Union, in accordance with Article 4(2) of that Directive.

(3)	Pursuant to Article 4(1) of Directive 2001/95/EC, European standards are established by European standardisation organisations under mandates drawn up by the Commission.

(4)	Pursuant to Article 4(2) of Directive 2001/95/EC, the Commission is to publish the references of such standards.

(5)

On 27 July 2011, the Commission adopted Decision 2011/477/EU (2). This Decision specifies that, in order to reduce the risk of strangulation and internal asphyxiation, internal window blinds (and corded window coverings) must be of an inherently safe design and that accessible cord(s), chain(s), ball-chain(s), if any, shall not form a hazardous loop. Furthermore, if the design of the product does not eliminate the risk that a hazardous loop is formed, the product must be provided with appropriate safety devices, to minimise the risk of strangulation. If present, the safety device(s) must be resistant to operation by young children. In addition, they must not release small parts that could result in internal asphyxiation of the child, must not pose risks of physical injuries to children, due, for example, to sharp edges, entrapment of fingers or protruding parts, must sustain durability and fatigue tests (wear and tear) and must be resistant to ageing due to weather conditions.

(6)	On 4 September 2012, the Commission issued mandate M/505 to the European standardisation organisations to draw up European standards to address certain risks posed to children by internal blinds, corded window coverings and safety devices.

(7)	On 19 February 2014, the European Committee for Standardisation published for the first time the European standards EN 16433:2014 and EN 16434:2014 and the revised European standard EN 13120:2009+A1:2014 for internal blinds in response to the Commission's mandate.

(8)	European standards EN 16433 and EN 16434 and certain clauses of European standard EN 13120+A1 fulfil the mandate M/505 and comply with the general safety requirement of Directive 2001/95/EC. Their references should accordingly be published in the Official Journal of the European Union.

(9)	The measures provided for in this Decision are in accordance with the opinion of the Committee set up under Directive 2001/95/EC,

HAS ADOPTED THIS DECISION:

Article 1

The following European standards meet the general safety requirement of Directive 2001/95/EC for the risks they cover:

(a)	EN 16433:2014 ‘Internal blinds — Protection from strangulation hazards — Test methods’;

(b)	EN 16434:2014 ‘Internal blinds — Protection from strangulation hazards — Requirements and test methods for safety devices’; and

(c)	clauses 8.2 and 15 of European standard EN 13120:2009+A1:2014 ‘Internal blinds — Performance requirements including safety’.

Article 2

The references of standards EN 16433:2014 and EN 16434:2014 and of clauses 8.2 and 15 of European standard EN 13120:2009+A1:2014 shall be published in series C of the Official Journal of the European Union.

Article 3

This Decision shall enter into force on the twentieth day following that of its publication in the Official Journal of the European Union.
