implementing Regulation (EC) No 765/2006 concerning restrictive measures in respect of Belarus
THE COUNCIL OF THE EUROPEAN UNION,
Having regard to the Treaty on the Functioning of the European Union,
Having regard to Council Regulation (EC) No 765/2006 of 18 May 2006 concerning restrictive measures in respect of Belarus (1), and in particular Article 8a(3) thereof,
Whereas:

On 18 May 2006, the Council adopted Regulation (EC) No 765/2006. |
(2) |
The Council considers that one person and two entities should be removed from the list of persons and entities subject to restrictive measures as set out in Annex I to Regulation (EC) No 765/2006. |
(3) |
Annex I to Regulation (EC) No 765/2006 should be amended accordingly, |
HAS ADOPTED THIS REGULATION:
Article 1
Annex I to Regulation (EC) No 765/2006 is hereby amended in accordance with the Annex to this Regulation.
Article 2
This Regulation shall enter into force on the day of its publication in the Official Journal of the European Union.

COMMISSION IMPLEMENTING REGULATION (EU) No 495/2013
of 29 May 2013
amending Implementing Regulation (EU) No 996/2012 imposing special conditions governing the import of feed and food originating in or consigned from Japan following the accident at the Fukushima nuclear power station
(Text with EEA relevance)
THE EUROPEAN COMMISSION,
Having regard to the Treaty on the Functioning of the European Union,
Having regard to Regulation (EC) No 178/2002 of the European Parliament and of the Council of 28 January 2002 laying down the general principles and requirements of food law, establishing the European Food Safety Authority and laying down procedures in matters of food safety (1), and in particular Article 53(1)(b)(ii) thereof,
Whereas:

Article 53 of Regulation (EC) No 178/2002 provides for the possibility to adopt appropriate Union emergency measures for food and feed imported from a third country in order to protect public health, animal health or the environment, where the risk cannot be contained satisfactorily by means of measures taken by the Member States individually. |

Following the accident at the Fukushima nuclear power station on 11 March 2011, the Commission was informed that radionuclide levels in certain food products originating in Japan exceeded the action levels in food applicable in Japan. Such contamination may constitute a threat to public and animal health in the Union and therefore Commission Implementing Regulation (EU) No 297/2011 of 25 March 2011 imposing special conditions governing the import of feed and food originating in or consigned from Japan following the accident at the Fukushima nuclear power station (2) was adopted. That Regulation was later replaced by Commission Implementing Regulation (EU) No 961/2011 (3), Commission Implementing Regulation (EU) No 284/2012 (4) and Commission Implementing Regulation (EU) No 996/2012 (5). |

Article 17 of Implementing Regulation (EU) No 996/2012 provides for a review of the provisions when the results of sampling and analysis on the presence of radioactivity of feed and food of the third growing season after the accident will be available, i.e. by 31 March 2014. However, in accordance with that Article, the provisions concerning the products for which the harvest is mainly in the second part of the second growing season and therefore all the data of the second growing season are not yet available, should be reviewed by 31 March 2013. |

The measures have been reviewed taking into account the occurrence data on radioactivity in feed and food provided by the Japanese authorities for the period between September 2012 and January 2013. |

As regards the prefectures of Gunma, Ibaraki, Tochigi, Miyagi, Saitama, Tokyo, Iwate, Chiba and Kanagawa, Implementing Regulation (EU) No 996/2012 requires to sample and analyse, before export to the Union, mushrooms, tea, fishery products, certain edible wild plants, certain vegetables, certain fruits, rice and soybeans and the processed and derived products thereof. Following the detailed assessment of the data provided, pears, taro, yacon, pome fruit, pawpaw and scallops should be removed from the list of products for which sampling and analysis are required before export while buckwheat, lotus root and threeleaf arrowroot should be included in that list. Given that the import of fresh bovine meat from Japan has been recently allowed by Commission Implementing Regulation (EU) No 196/2013 of 7 March 2013 amending Annex II to Regulation (EU) No 206/2010 as regards the new entry for Japan in the list of third countries or parts thereof from which imports into the European Union of certain fresh meat are authorised (6), it is necessary to add fresh bovine meat to the list of products for which sampling and analysis are required before export. |

Following findings of non-compliance, it is appropriate to add the requirement for sampling and analysis before export for mushrooms from the prefectures Nagano, Niigata and Aomori. |

Therefore Implementing Regulation (EU) No 996/2012 should be amended accordingly. |

The measures provided for in this Regulation are in accordance with the opinion of the Standing Committee on the Food Chain and Animal Health, |
HAS ADOPTED THIS REGULATION:
Article 1
Implementing Regulation (EU) No 996/2012 is amended as follows:

Article 2
Entry into force
This Regulation shall enter into force on the third day following that of its publication in the Official Journal of the European Union.
This Regulation shall be binding in its entirety and directly applicable in all Member States.

amending Annex I to Council Regulation (EC) No 732/2008 applying a scheme of generalised tariff preferences
THE EUROPEAN COMMISSION,
Having regard to the Treaty on the Functioning of the European Union and in particular Article 207 thereof,
Having regard to Council Regulation (EC) No 732/2008 of 22 July 2008 applying a scheme of generalised tariff preferences from 1 January 2009 and amending Regulations (EC) No 552/97, (EC) No 1933/2006 and Commission Regulations (EC) No 1100/2006 and (EC) No 964/2007 (1) (GSP Regulation), and in particular Article 25 thereof,
Whereas:

Recital 12 of Regulation (EC) No 732/2008 provides that the special arrangement for the least-developed countries should continue to grant duty-free access to the Community market for products originating in the least-developed countries, as recognised and classified by the UN. |
(2) |
In accordance with point (b) of Article 25 of the GSP Regulation the Commission shall adopt amendments made necessary by change in the international status or classification of countries or territories. |
(3) |
The Republic of South Sudan (hereinafter South Soudan) has become an independent State. On 14 July 2011 the General Assembly of United Nations adopted Resolution A/RES/65/308 admitting South Sudan to membership in the United Nations. |
(4) |
On 18 December 2012 the General Assembly of United Nations adopted Resolution A/RES/67/136 adding South Sudan to the list of Least Developed Countries. |
(5) |
The Netherlands Antilles have been dissolved. Bonaire, Sint Eustatius and Saba, Curaçao and Sint Maarten (Dutch part) are now overseas countries and territories of the Kingdom of Netherlands. |

Commission Regulation (EU) No 1106/2012 of 27 November 2012 implementing Regulation (EC) No 471/2009 of the European Parliament and of the Council on Community statistics relating to external trade with non-member countries, as regards the update of the nomenclature of countries and territories (2) deleted Netherlands Antilles from and included Bonaire, Sint Eustatius and Saba, Curaçao, Sint Maarten (Dutch part) and South Sudan in the version of nomenclature of countries and territories for the external trade statistics of the Union and statistics of trade between Member States which is valid as from 1 January 2013. |

Accordingly Annex I to the GSP Regulation should be amended as follows. Netherlands Antilles should be deleted from Column B of Annex I to the GSP Regulation. South Sudan, Bonaire, Sint Eustatius and Saba, Curaçao and Sint Maarten (Dutch part) should be included in Column B of Annex I to the GSP Regulation. South Sudan should be also included in Column D of Annex I to the GSP Regulation, as country included in the special arrangement for the least developed countries. |

The measures provided for in this Regulation are in accordance with the opinion of the Generalised Preferences Committee, |
HAS ADOPTED THIS REGULATION:
Article 1
Annex I to Regulation (EC) No 732/2008 is replaced by the text set out in the Annex to this Regulation.
Article 2
This Regulation shall enter into force on the day following that of its publication in the Official Journal of the European Union.
It shall apply from 1 January 2013.
This Regulation shall be binding in its entirety and directly applicable in all Member States.

amending and correcting Regulation (EU) No 231/2012 laying down specifications for food additives listed in Annexes II and III to Regulation (EC) No 1333/2008 of the European Parliament and of the Council

Having regard to the Treaty on the Functioning of the European Union,
Having regard to Regulation (EC) No 1333/2008 of the European Parliament and of the Council of 16 December 2008 on food additives (1), and in particular Article 14 thereof,
Having regard to Regulation (EC) No 1331/2008 of the European Parliament and of the Council of 16 December 2008 establishing a common authorisation procedure for food additives, food enzymes and food flavourings (2), and in particular Article 7(5) thereof,
Whereas:

Commission Regulation (EU) No 231/2012 (3) lays down specifications for food additives listed in Annexes II and III to Regulation (EC) No 1333/2008. |
(2) |
Those specifications may be updated in accordance with the common procedure referred to in Article 3(1) of Regulation (EC) No 1331/2008, either on the initiative of the Commission or following an application. |
(3) |
When updating those specifications it is necessary to take into account the specifications and analytical techniques for food additives as set out in the Codex Alimentarius as drafted by the Joint FAO/WHO Expert Committee on Food Additives. |

Regulation (EU) No 231/2012 contains errors in the specifications for sodium bisulphite (E 222), sodium lactate (E 325) and ammonium phosphatides (E 442). Those errors should be corrected. |

Commission Regulation (EU) No 380/2012 of 3 May 2012 amending Annex II to Regulation (EC) No 1333/2008 of the European Parliament and of the Council as regards the conditions of use and the use levels for aluminium-containing food additives (4) deletes the food additives calcium aluminium silicate (E 556) and aluminium silicate (kaolin) (E 559) from the list of Annex II to Regulation (EC) No 1333/2008 as of 1 February 2014. Consequently, the specifications for those food additives should also be deleted. |

Regulation (EU) No 231/2012 contains two errors regarding Einecs numbers (5) assigned to disodium guanylate (E 627) and dipotassium guanylate (E 628). Those errors should be corrected. |

Regulation (EU) No 231/2012 should therefore be amended and corrected accordingly. |

The measures provided for in this Regulation are in accordance with the opinion of the Standing Committee on the Food Chain and Animal Health and neither the European Parliament nor the Council has opposed them, |

Article 1
The Annex to Regulation (EU) No 231/2012 is amended and corrected in accordance with the Annex to this Regulation.
Article 2
This Regulation shall enter into force on the twentieth day following that of its publication in the Official Journal of the European Union.
This Regulation shall be binding in its entirety and directly applicable in all Member States.

THE EUROPEAN COMMISSION,
Having regard to the Treaty on the Functioning of the European Union,
Having regard to Council Regulation (EC) No 1234/2007 of 22 October 2007 establishing a common organisation of agricultural markets and on specific provisions for certain agricultural products (Single CMO Regulation) (1),
Having regard to Commission Implementing Regulation (EU) No 543/2011 of 7 June 2011 laying down detailed rules for the application of Council Regulation (EC) No 1234/2007 in respect of the fruit and vegetables and processed fruit and vegetables sectors (2), and in particular Article 136(1) thereof,
Whereas:

Implementing Regulation (EU) No 543/2011 lays down, pursuant to the outcome of the Uruguay Round multilateral trade negotiations, the criteria whereby the Commission fixes the standard values for imports from third countries, in respect of the products and periods stipulated in Annex XVI, Part A thereto. |
(2) |
The standard import value is calculated each working day, in accordance with Article 136(1) of Implementing Regulation (EU) No 543/2011, taking into account variable daily data. Therefore this Regulation should enter into force on the day of its publication in the Official Journal of the European Union, |
HAS ADOPTED THIS REGULATION:
Article 1
The standard import values referred to in Article 136 of Implementing Regulation (EU) No 543/2011 are fixed in the Annex to this Regulation.
Article 2
This Regulation shall enter into force on the day of its publication in the Official Journal of the European Union.
This Regulation shall be binding in its entirety and directly applicable in all Member States.

THE COUNCIL OF THE EUROPEAN UNION,
Having regard to the Treaty on European Union, and in particular Article 31(2) thereof,
Having regard to Council Decision 2012/642/CFSP of 15 October 2012 concerning restrictive measures against Belarus (1), and in particular Article 6(1) thereof,
Whereas:

On 15 October 2012, the Council adopted Decision 2012/642/CFSP. |
(2) |
The Council considers that one person and two entities should be removed from the list of persons and entities subject to restrictive measures as set out in the Annex to Decision 2012/642/CFSP. |
(3) |
The Annex to Decision 2012/642/CFSP should be amended accordingly, |
HAS ADOPTED THIS DECISION:
Article 1
The Annex to Decision 2012/642/CFSP is hereby amended in accordance with the Annex to this Decision.
Article 2
This Decision shall enter into force on the day of its publication in the Official Journal of the European Union.

THE EUROPEAN COMMISSION,
Having regard to the Treaty on the Functioning of the European Union,
Having regard to Regulation (EC) No 853/2004 of the European Parliament and of the Council of 29 April 2004 laying down specific hygiene rules for food of animal origin (1), and in particular the first paragraph of Article 9 thereof,
Whereas:

Commission Decision 2009/852/EC (2) allows that the requirements laid down in Regulation (EC) No 853/2004, Annex III, Section IX, Chapter I, Subchapters II and III, not apply to milk processing establishments in Romania listed in Annex II and Annex III to that Decision until 31 December 2013. |
(2) |
According to Decision 2009/852/EC, certain milk-processing establishments listed in Annex II to that Decision may process non-compliant milk with separate production lines. |
(3) |
Romania sent the Commission a revised and updated list of those milk processing establishments on 15 February 2013. |
(4) |
In that revised and updated list, establishment number L35 SC DANONE PDPA ROMANIA SRL has been removed from Annex II and authorised to processing only compliant milk to be placed on the EU market. |
(5) |
Establishment number MM 1795 SC CALITATEA SRL has been authorised to process compliant and non-compliant raw milk without separation and, consequently, it should be removed from Annex II and transferred to Annex III to the same Decision. |
(6) |
17 establishments currently listed in Annex III to Decision 2009/852/EC have been deleted as they are authorised to place dairy products on the intra-Union market, since they are using only compliant milk. Those establishments were listed in the table in Annex III to Decision 2009/852/EC at No 1(AB 641 SC BIOMILK SRL); 6 (L78 SC ROMFULDA PROD SRL) 9 (BN 2399 SC CARMO-LACT PROD SRL) 13(L140 S.C.
