COUNCIL DECISION

of 11 May 2017

appointing 12 members of the Management Board of the European Chemicals Agency

THE COUNCIL OF THE EUROPEAN UNION,

Having regard to the Treaty on the Functioning of the European Union,

Having regard to Regulation (EC) No 1907/2006 of the European Parliament and of the Council of 18 December 2006 concerning the Registration, Evaluation, Authorisation and Restriction of Chemicals (REACH) and establishing a European Chemicals Agency (1), and in particular Article 79 thereof,

Whereas:

(1)

Article 79 of Regulation (EC) No 1907/2006 provides that the Council is to appoint one representative from each Member State as a member of the Management Board of the European Chemicals Agency (‘the Management Board’).

(2)

The members of the Management Board are to be appointed on the basis of their relevant experience and expertise in the fields of chemical safety or the regulation of chemicals, and on the basis that relevant expertise in the fields of general, financial and legal matters is available amongst the board members.

(3)

The term of office is four years and may be renewed once.

(4)

By Decision of 7 June 2007 (2) the Council appointed 27 Members of the Management Board of the European Chemicals Agency.

(5)

The present Members of the Management Board nominated by Czech Republic, Ireland, Spain, France, Italy, Luxembourg, Hungary, Netherlands, Austria, Slovenia, Finland and Sweden, were all appointed for periods that ends on 31 May 2017.

(6)

The Council has received nominations from all of the Member States concerned,

HAS ADOPTED THIS DECISION:

Article 1

The following persons shall be appointed Members of the Management Board for a second term running from 1 June 2017 to 31 May 2021 (name, nationality, date of birth):

Ms Sharon McGUINNESS, Irish, 13 July 1965,

Mr Paul RASQUE, Luxembourgish, 8 July 1981,

Ms Krisztina BIRÓ, Hungarian, 5 April 1971,

Article 2

The following persons shall be appointed Members of the Management Board for a first term running from 1 June 2017 to 31 May 2021 (name, nationality, date of birth):

The deadline for submission of applications for the call for expressions of interest for the position of member of the Management Board of the European Food Safety Authority of 24 March 2017 has been prolonged until 16 June 2017, 12.00 (noon), Brussels time.

Request for an Advisory Opinion from the EFTA Court by the Fürstliches Obergericht dated 20 December 2016 in the case of Pascal Nobile v DAS Rechtsschutz-Versicherungs AG

A request has been made to the EFTA Court by a letter dated 20 December 2016 from the Fürstliches Obergericht (Princely Court of Appeal), which was received at the Court Registry on 20 December 2016, for an Advisory Opinion in the case of Pascal Nobile v DAS Rechtsschutz-Versicherungs AG on the following questions:

1.

Does Article 201(1)(a) of Directive 2009/138/EC of the European Parliament and of the Council of 25 November 2009 on the taking-up and pursuit of the business of Insurance and Reinsurance (Solvency II) preclude a contractual agreement between a legal expenses insurance and an insured person, according to which it is a breach of duty of the insured person, releasing the insurance company from its obligations, if the insured person mandates an attorney to represent his interests, without the consent of the legal expenses insurance, at a point in time when the insured person would be entitled to make a claim according to the legal expenses insurance contract?

2.

In the event that question 1 is answered in the negative: In litigation proceedings, when does an inquiry or do proceedings referred to in Article 201(1)(a) of Directive 2009/138/EC start, leading to the free choice of a lawyer? Is the relevant point in time solely based on the formal commencement of court proceedings (the lawsuit being filed with the court), or are prior steps also included, and, if so, which ones?

3.

In the event that questions 1 and 2 are answered after 16 January 2017:

a)

Does the principle of loyalty laid down in Article 3 of the EEA Agreement preclude national courts, in all circumstances, from calling the validity of decisions of the EFTA Court into question?

b)

In the event that question 3a is answered in the negative: Which circumstances would allow national courts to question the validity of decisions of the EFTA Court, without thereby being in breach of the principle of loyalty laid down in Article 3 of the EEA Agreement?

Prior notification of a concentration

Candidate case for simplified procedure

1.

On 5 May 2017, the Commission received notification of a proposed concentration pursuant to Article 4 of Council Regulation (EC) No 139/2004 (1) by which the undertakings General Electric Company (‘GE’, USA) and Allegheny Technologies Incorporated (‘ATI’, USA) acquire within the meaning of Article 3(1)(b) and 3(4) of the Merger Regulation joint control of the NewCo (USA) by way of a purchase of shares in a newly created company constituting a joint venture.

The business activities of the undertakings concerned are:

—   for GE: global, diversified manufacturing, technology and services company.

—   for ATI: worldwide specialty materials and components producer including titanium and titanium alloys, nickel-based alloys and specialty steels, precision forgings, castings and machined components, zirconium and related alloys.

—   for NewCo/JV: development of a novel titanium alloy reduction process and subsequent commercializion of titanium alloy powders as well as titanium novel alloys.

On preliminary examination, the Commission finds that the notified transaction could fall within the scope of the Merger Regulation. However, the final decision on this point is reserved. Pursuant to the Commission Notice on a simplified procedure for treatment of certain concentrations under the Council Regulation (EC) No 139/2004 (2) it should be noted that this case is a candidate for treatment under the procedure set out in this Notice.

4.

The Commission invites interested third parties to submit their possible observations on the proposed operation to the Commission.
