COMMISSION OPINION
of 10 March 2011
relating to the plan for the disposal of radioactive waste arising from the Lillyhall Very Low-level Radioactive Waste Disposal Facility, located in Cumbria, United Kingdom, in accordance with Article 37 of the Euratom Treaty

On 1 September 2010, the European Commission received from the British Government, in accordance with Article 37 of the Euratom Treaty, General Data relating to the plan for the disposal of radioactive waste arising from the Lillyhall Very Low-level Radioactive Waste Disposal Facility.
On the basis of these data and additional information requested by the Commission on 8 October 2010 and provided by the British authorities on 13 December 2010, and following consultation with the Group of Experts, the Commission has drawn up the following opinion:

The distance between the disposal facility and the nearest point on the territory of another Member State, in this case Ireland, is 180 km. |

During the disposal facility's operational period:

After the disposal facility's operational period: The measures envisaged for the final closure of the disposal facility as described in the General Data, provide reliance that the conclusions under point 2 above will remain valid in the long term. |
In conclusion, the Commission is of the opinion that the implementation of the plan for the disposal of radioactive waste in whatever form arising from the Lillyhall Very Low-level Radioactive Waste Disposal Facility in the United Kingdom, during its normal operational life and after its final closure, as well as in the event of an accident of the type and magnitude considered in the General Data, is not liable to result in the radioactive contamination of the water, soil or airspace of another Member State.

relating to the plan for the disposal of radioactive waste arising from the Clifton Marsh Low-level Radioactive Waste Disposal Facility, located in Lancashire, United Kingdom, in accordance with Article 37 of the Euratom Treaty

On 23 September 2010, the European Commission received from the British Government, in accordance with Article 37 of the Euratom Treaty, General Data relating to the plan for the disposal of radioactive waste arising from the Clifton Marsh Low-level Radioactive Waste Disposal Facility.
On the basis of these data and additional information requested by the Commission on 11 October 2010 and provided by the British authorities on 25 November 2010, and following consultation with the Group of Experts, the Commission has drawn up the following opinion:

Notice for the attention of the persons and entities to which restrictive measures provided for in Council Decision 2011/137/CFSP and Council Regulation (EU) No 204/2011 concerning restrictive measures in view of the situation in Libya apply

THE COUNCIL OF THE EUROPEAN UNION,
The following information is brought to the attention of the persons and entities that appear in the Annex to Council Implementing Decision 2011/156/CFSP (1) and in the Annex to Council Implementing Regulation (EU) No 233/2011 (2) concerning restrictive measures in view of the situation in Libya.
The Council of the European Union has decided that the persons and entities that appear in the above-mentioned Annexes should be included in the list of persons and entities subject to restrictive measures provided for in Council Decision 2011/137/CFSP (3) and to Council Regulation (EU) No 204/2011 (4) concerning restrictive measures in view of the situation in Libya.
The attention of the persons and entities concerned is drawn to the possibility of making an application to the competent authorities of the relevant Member State(s) as indicated in the websites in Annex IV to Regulation (EU) No 204/2011, in order to obtain an authorisation to use frozen funds for basic needs or specific payments (cf. Article 7 of the Regulation).
The persons and entities concerned may submit a request to the Council, together with supporting documentation, that the decision to include them on the abovementioned list should be reconsidered, to the following address:

On 25 February 2011 the Commission received a notification of a proposed concentration pursuant to Article 4 of Council Regulation (EC) No 139/2004 (1) by which the undertakings Suntory France SAS (France) belonging to Suntory Group (‘Suntory’, Japan) and Groupe Castel (‘Castel’, France) acquire within the meaning of Article 3(1)(b) of the Merger Regulation joint control of the undertaking SA Grands Millesimes de France (‘GMdF’, France) by way of purchase of shares, and simultaneously Castel acquires sole control of the undertakings Savour Club SA and its subsidiaries (‘Savour Club’, France) as well as SAS Appellations and its subsidiaries SAS Château Haut Caplane, SAS Tour Saint Christophe and SAS Distribution Bordeaux Grands Crus Références and their subsidiaries (‘MAAF Subsidiaries’, France) by way of purchase of shares. |
