Initiation of proceedings
(Case COMP/M.5335 — Lufthansa/SN Holding (Brussels Airlines))

(2009/C 37/02)
On 26 January 2009, the Commission decided to initiate proceedings in the above-mentioned case after finding that the notified concentration raises serious doubts as to its compatibility with the common market. The initiation of proceedings opens a second phase investigation with regard to the notified concentration, and is without prejudice to the final decision on the case. The decision is based on Article 6(1)(c) of Council Regulation (EC) No 139/2004.
The Commission invites interested third parties to submit their observations on the proposed concentration to the Commission.
In order to be fully taken into account in the procedure, observations should reach the Commission not later than 15 days following the date of this publication. Observations can be sent to the Commission by fax ((32-2) 296 43 01 or 296 72 44) or by post, under reference COMP/M.5335 — Lufthansa/SN Holding (Brussels Airlines), to the following address:

On 5 February 2009, the Commission decided not to oppose the above notified concentration and to declare it compatible with the common market. The publication of reference amounts for the crossing of the external borders, as referred to in Article 5(3) of Regulation (EC) No 562/2006 of the European Parliament and of the Council of 15 March 2006 establishing a Community Code on the rules governing the movement of persons across borders (Schengen Borders Code), is based on the information communicated by the Member States to the Commission in conformity with Article 34 of the Schengen Borders Code.
In addition to publication in the OJ, a monthly update is available on the website of Directorate-General for Justice, Freedom and Security.
SPAIN
Replacement of the information published in OJ C 57, 1.3.2008
The Order of the Ministry of the Presidency (PRE/1282/2007) of 10 May on the financial means aliens are required to have in order to enter Spain specifies the amount that aliens have to prove is available to them in order to be able to enter Spain.
(a) |
For the costs of their stay in Spain, the amount they have available to them must represent, in EUR, 10 % of the gross national minimum wage (EUR 62,40 for 2009) or its legal equivalent in foreign currency multiplied by the number of days they intend to stay in Spain and by the number of dependent persons travelling with them. The minimum amount at their disposal must represent 90 % of the gross national minimum wage (EUR 561,60 for 2009) or its legal equivalent in foreign currency per person, regardless of the intended duration of the stay. |
(b) |
For their return to the State of provenance or for transit via third States, aliens must be able to produce a personal, untransferable and fixed-date ticket or tickets for the planned means of transport. |
Aliens must prove that they have the above means of subsistence either by producing them if they are in cash, or by producing certified cheques, traveller's cheques, receipts or credit cards, which must be accompanied by a recent bank statement (bank letters or Internet bank statements are not acceptable) or by other evidence clearly showing the amount of credit available on the card or bank account.
SLOVAKIA
Replacement of the information published in OJ C 134, 31.5.2008
The financial resources required to cover the costs of a third-country national's residence on the territory of the Slovak Republic are fixed at EUR 56 per person per day of residence under Article 4 of the Act No 48/2002 Coll. on Stay of Aliens and on amendment of certain acts as amended.
The sum of EUR 56 is made up of the following amounts:
(a) |
EUR 30 for accommodation; |
(b) |
EUR 4 for breakfast; |
(c) |
EUR 7,5 for lunch; |
(d) |
EUR 7,5 for dinner; |
(e) |
EUR 7 spending money. |
If the costs of a third-country national's residence on the territory of the Slovak Republic are partly covered, this fact will be taken into account.
An invitation certified by a police department may take the place of the financial resources.

The Danish national procedure for the allocation of limited air traffic rights

In accordance with Article 6 of Regulation (EC) No 847/2004 of the European Parliament and of the Council of 29 April 2004 on the negotiation and implementation of air service agreements between Member States and third countries, the European Commission publishes the following national procedure for the distribution among eligible Community carriers of air traffic rights where they are limited under air service agreements with third countries.

Guidelines for the limited distribution of air traffic rights

These guidelines are issued on the basis of Regulation (EC) No 847/2004 of the European Parliament and of the Council of 29 April 2004 on the negotiation and implementation of air service agreements between Member States and third countries. They should be applied in cases where more than one air carrier wishes to use Danish traffic rights which under a bilateral air service agreement which Denmark has concluded with a third country are limited, in cases in which the scope of these rights does not suffice to satisfy all the wishes of all interested parties to provide traffic services under the agreement. The guidelines should also apply if under the agreement in force only one air carrier can be designated even though several have expressed an interest in being designated. |

If the limited traffic rights belong to the three Scandinavian countries of the Community, the case should be dealt with in accordance with these guidelines if the relevant air route starts or ends in Denmark. In such cases, there should be consultation with the appropriate authorities of Norway and Sweden. |

In these guidelines, ‘air carrier’ means an air carrier which is established in Denmark and has been issued an operating licence in accordance with Council Regulation (EEC) No 2407/92. |
4. |
Information on traffic rights under the bilateral air service agreements which Denmark has concluded, on the distribution of such rights in accordance with these guidelines and on air service negotiations will be provided by the Ministry of Transport and published on its website (www.trm.dk). |
5. |
Applications for the distribution of traffic rights under these guidelines should be dealt with by the Ministry of Transport, and decisions on the granting of such rights should be published. |
6. |
An air carrier that wishes to use limited traffic rights should submit a written application to the Ministry of Transport. The application should be drawn up in Danish or English and contain the following information:
The Ministry may require applicants to submit additional information for their application. The Ministry will inform the appropriate authorities of Norway and Sweden of any applications received. |

Applications are processed in a non-discriminatory and transparent procedure. In the procedure, special values may be assigned to air services that:

In particular, the following points should be taken into account in processing applications:
Other aspects may also be taken into account if they are provided by the applicant before a decision is taken. |
9. |
In processing applications, account should be taken of the need for continuity in air transport services. |
10. |
The decision on the distribution of traffic rights in accordance with these guidelines should specify the considerations on which it is based. |
11. |
Allocated traffic rights may not be transferred without special permission. |
12. |
An air carrier which has been authorised to use traffic rights in accordance with these guidelines should commence the air transport services within the next schedule period. If it fails to do so, the authorisation is invalidated. |

Authorisation is also invalidated if:

The Ministry of Transport may partly or fully withdraw authorisation if:

If authorisation granted pursuant to these guidelines is invalidated or withdrawn, the Ministry may reconsider the question of authorisation. |

These guidelines do not affect any traffic rights in force at any time that are effectively used in a way that is in conformity with Community law and national competition law. |

Support for the networking and mobility of students and trainers in Europe

1. Objectives and description
This notice of a call for proposals is based on Decision No 1718/2006/EC of the European Parliament and of the Council of 15 November 2006 concerning the implementation of a programme of support for the European audiovisual sector (MEDIA 2007).
One of the objectives of the programme is to encourage exchanges and cooperation, in supporting the networking of European training players, in particular Higher educations institutions, training organisations and partners of the audiovisual sector and to encourage the mobility of students and trainers in Europe.
2. Eligible applicants
This notice is aimed at pan-European consortia of Higher education institutions, training organisations and partners from the audiovisual sector whose activities contribute to the attainment of the above objectives of the MEDIA programme as described in the Council Decision.
Applicants must be established in one of the following countries:

3. Eligible actions
The following actions and their activities, taking place in the MEDIA countries, are eligible:
Actions aiming at developing the capacity of future audiovisual professionals to understand and integrate a European dimension to their work by improving expertise in the following fields:

training in economic, financial and commercial management, |
— |
training in new audiovisual technologies, |
— |
training in script project development. |
The duration of the action (= duration of eligibility of costs) is of 12 months (up to 18 months maximum when dully justified).
The action must occur between 1 September 2009 and 30 June 2011.
4. Award criteria
Points will be allocated to eligible applications out of a total of 100 on the basis of the following weighing:

5. Budget
The total budget available is EUR 1 900 000.
The financial contribution awarded is a subsidy. The financial support from the Commission cannot exceed 50 % or 75 % of the total eligible costs.
The Agency reserves the right not to allocate all the funds available.

4.1. Name: ‘Faba de Lourenzá’
4.2. Description: The product covered by the PGI ‘Faba de Lourenzá’ is the ‘Faba Galaica’, a local variety of bean (‘faba’) of the species ‘Phaseolus vulgaris, L’, belonging to the Fabaceae or Leguminosae family, dried, separated from the pod, unblemished, whole, clean and intended for human consumption.
Genetically, the Faba Galaica is an Andean variety of the species ‘Phaseolus vulgaris’. For international trade purposes, it is classed under ‘Favada’.
It has the following characteristics:
colour: plain white all over,
size: very big (80-120 gr/100 seeds),
measurements: length 19-26 mm, width 9-11 mm, thickness 7-8 mm,
shape: kidney-shaped, long, of medium thickness,
moisture: 14-17 %.
The ‘Faba Galaica’ has qualities that distinguish it from other beans and make it highly sought after by consumers. It has outstanding culinary qualities, with a low percentage of skin (8-10 %) and high water absorption capacity (over 100 %). When cooked, the beans remain whole — they do not split or disintegrate. The texture is smooth and creamy and the skin is so fine that it can barely be distinguished from the rest of the bean.
4.3. Geographical area: The beans are grown, prepared for sale and packed in the same area. This covers the coastal territory of the province of Lugo, a natural district known as A Mariña Luguesa, divided into three administrative districts: A Mariña Occidental, A Mariña Central and A Mariña Oriental, which include the municipalities of: Alfoz, Barreiros, Burela, Cervo, Foz, Lourenzá, Mondoñedo, Ourol, A Pontenova, Ribadeo, Trabada, O Valadouro, O Vicedo, Viveiro and Xove.
The area contains a series of valleys enclosed by mountains which run from north to south. The soil is rich, deep, well-drained and medium-textured and the climate is greatly influenced by the topography and the proximity to the sea.
4.4. Proof of origin: Traceability is guaranteed by identifying the product at each stage of the production and marketing process.
In order to check compliance with the provisions of the specification, the inspection body will keep a register of fields, and a register of warehouses and packaging plants, kept constantly up-to-date.
Only beans which are grown in accordance with the provisions of the specification and other rules, in the fields and by producers listed in the register, and which meet the requirements laid down, may be covered by the ‘Faba de Lourenzá’ PGI.
Likewise, only dried beans which are handled and/or packaged in plants listed in the register may qualify for the ‘Faba de Lourenzá’ PGI.
Any natural or legal persons holding assets listed in these registers, the fields, warehouses, facilities and the products, will undergo inspections and checks carried out by the inspection body, in order to verify that products bearing the PGI ‘Faba de Lourenzá’ meet the requirements of the specification and other relevant rules.
Those listed on the register must also declare the quantity of PGI ‘Faba de Lourenzá’ actually produced and marketed, by entering this information in registers set up for the purpose. The inspection body will check whether the quantities marketed by the packers tally with the quantities produced by the farmers who supply them, and whether the quantities declared by the farmers tally with the yields of the registered plots.
All the beans produced will be marketed in packaging bearing the PGI numbered identification label.
4.5. Method of production: Only beans, dried and separated from the pod, of the ‘Faba Galaica’ local variety of the species ‘Phaseolus vulgaris, L’, grown from certified seeds, approved seeds produced by the same grower or seeds from other fields listed in the inspection body's register can be covered by the ‘Faba de Lourenzá’ PGI.
The land is prepared for sowing by being worked two or three times in cross pattern with ploughs, harrows and rotovators. Fertiliser is applied at this stage so that the land will be in the best possible condition. The use of manure from local farms is still an important factor in the production process. The seeds are sown from May to June at a depth of 2 to 5 cm.
To grow ‘Faba Galaica’ the land needs to be prepared with the appropriate support structure to allow the plant to develop properly. That support will depend on the cultivation method chosen:
monoculture: stakes made of wood or other materials, linked with taut wire or rope, with twine or netting stretched across the spaces,
maize and beans grown together: the maize provides the support.
Pests and diseases are combated by:
disinfecting the support structures and the soil before the seeds are planted, in plots with a history of red spider problems,
removing weeds and crop remains,
carefully watching the crop in the first stages of its development,
planting in a pattern to ensure proper ventilation,
using healthy seeds with good germination potential,
keeping the soil properly limed and fertilised, avoiding excess nitrogen,
when watering, not allowing water to pool and avoiding the soil becoming compacted,
shallow sowing,
establishing crop rotation, to avoid the spread of diseases which are difficult to control,
not sowing too early.
When applying any kind of treatment to the fields, the following rules will generally be observed:
the minimum possible number of treatments should be applied, in the doses recommended by the manufacturer,
a product will not be applied more than twice in succession unless otherwise indicated,
the safety period required between applying the treatments and harvesting must be observed.
Watering will be frequent and evenly distributed, but light in order to prevent the formation of puddles. In any event, as far as possible, it will be done in such a way as to avoid plant health risks.
The crop will be harvested between the end of August and the end of November. This is done when the pods are dry and it can be done manually, by picking the pods from the plants in the field, or by pulling up the plants and picking the pods off them away from the field. The beans will then be shelled, either manually or mechanically.
The beans will be stored in cool, dry places which meet the required hygiene and health standards.
Before being packed the beans are cleaned, sifted, and sorted. They are then treated for weevils by being put in refrigerated chambers for at least 48 hours at a temperature of minus 20 °C or less. No chemicals are used to preserve the product.
The beans put on the market will be classed as ‘extra’ or ‘first’ class in accordance with the quality standard for dried vegetables approved by the Order of 16 November 1983 (Boletín Oficial del Estado No 275, 17 November 1983). The packaging must be new, clean and made of material which allows the product to be properly ventilated, preserved and transported. The beans are normally packed in 0,5 kg and 1 kg packages.
4.6. Link: Beans are a very important crop in this area and they are widely referred to, for example in works such as ‘Descripción económica del Reyno de Galicia’ (Lucas Labrada, 1804), ‘Historia fin de siglo. Descripción geográfica e historia de la provincia de Lugo’ (Antonio Correa Fernández, 1900) and ‘Geografía del Reino de Galicia’ (Carreras and Candi, 1936). Material in the archives at Vilanova de Lourenzá relating to the weekly market and monthly fair shows that this was an important crop in the district. At the beginning of the 1960s there was a sharp increase in bean production in the district of La Mariña Luguesa, especially in the municipality of Vilanova de Lourenzá. This was when the beans started to be known more widely on the market as ‘Fabas de Lourenzá’, and they are referred to as such in various gastronomic guides. The importance and popularity of this crop in the area led to the first ‘Festa da Faba de Lourenzá’ in 1991. This now takes place every year in the first week of October and has been listed as a tourist attraction by the Xunta de Galicia.
The valleys where the ‘Faba de Lourenzá’ is grown are an optimal natural environment for growing beans in general, and particularly for the ‘Faba Galaica’ variety. In addition to having deep, rich, well-trained, medium-textured soil (sandy or silty loam soil), the climate is especially suitable, with mild, wet summers (in Lourenzá, average temperatures of 13,6 °C in May and 17,0 °C in September) with small variations in temperature between day and night and from one day to another. These conditions have a fundamental impact on the quality of the product. The beans are shiny with a thin skin and soft flesh and have a pleasant texture and taste. They are highly valued by consumers and fetch higher prices on the markets than other dried beans.
In addition, this is a local variety of bean which has been grown from time immemorial by farmers in the district of A Mariña Luguesa, who have developed it by choosing the best seeds from each harvest. The local farmers have been selecting and tending the best plants in the time-honoured way for generations, while adapting their production techniques to local conditions. This has resulted in a product which is very strongly linked to the local environment and has excellent organoleptic qualities.
The close association between the Faba Galaica and the defined production area has been noted in a study by the Consejo Superior de Investigaciones Científicas (CSIC), which concludes that the commercial quality of these beans (especially their water absorption capacity and the low percentage of skin) is much higher when they are grown in the defined production area than when grown in other neighbouring bean-growing areas.

4.8. Labelling: Dried beans marketed with the ‘Faba de Lourenzá’ Protected Geographical Indication must bear, after certification, the trade mark label of each producer/packer and a PGI label, approved and issued by the inspection body, bearing a sequential alphanumeric code and the official logo of the ‘Faba de Lourenzá’ Protected Geographical Indication.
The words ‘Faba de Lourenzá Protected Geographical Indication’ must appear on both the trade mark label and the PGI label.
