Amendments to the Explanatory Note to Article 17 of the pan-Euro-Mediterranean protocols on rules of origin

The Note to Article 17 — ‘Certification of origin for the purpose of pan-Euro-Mediterranean cumulation’, the paragraph ‘Mandatory use of the movement certificate EUR-MED’, shall be completed with the following example:

Example of cumulation applied in one of the countries referred to Articles 3(1) and 4(1) when an originating product is exported to one of the Mediterranean countries.

Swiss white chocolate in bulk (HS 1704) is imported into the Community where the chocolate bars are formed and packed for sale. The Community originating status of chocolate (HS 1704) is obtained on the basis of cumulation with Switzerland therefore when the chocolate is exported to Tunisia, the Community customs administration must issue a movement certificate EUR-MED containing a statement ‘Cumulation applied with Switzerland’.

Call for applications in connection with the renewal of members of the ‘European Energy and Transport Forum’

(2007/C 231/09)

By Decision of 11 July 2001 (1), the Commission has set up a Consultative Committee, the European Energy and Transport Forum, to advise the Commission on matters of energy and transport policy. As the mandate of the current Forum members has lapsed, the Commission is therefore calling interested persons to submit applications in connection with of the renewal of the Forum.

In accordance with the above Decision, the Forum comprises 34 full members, including 6 trade union representatives not covered by this call for applications. One alternate member shall be appointed for every full member. The Commission shall select individual members for a two-year renewable mandate.

Forum members are required to give the Commission an independent opinion, free from outside influence, and to respect the conditions of confidentiality mentioned in the Commission Decision establishing the Forum. They must be nationals of a European Union country or, if appropriate a European Economic Area country. The distribution of members is as follows:

nine (9) members representing operators (energy producers and land, sea and air freight carriers, manufacturing industry),

five (5) members representing networks and infrastructures (gas, electricity, rail, road, ports, airports, air traffic control),

seven (7) members representing users and consumers (transport users, energy consumers, demand management),

six (6) members representing unions,

five (5) members representing environmental organisations and organisations responsible for safety particularly in the field of transport,

two (2) members from the academic world or from think tanks.

The Commission shall select members on the basis of the applications received under this Call and taking into account the following selection criteria:

proven competence and experience in areas relevant to energy and transport policies, representativeness, including at European and/or international level. In this context, applicants must either currently hold, or previously have held, the following positions:

either as executive managers in business, preferably with experience of developing trans-national projects in the areas of activity relating to operators, networks and infrastructures,

or as managers within associations, organisations or businesses with national responsibility for fields relating to users, consumers, environmental protection and safety,

or in universities or think tanks for managerial duties,concerning studies, for example, or institutes/specialised research centres; academics must also demonstrate their competence in European affairs (for example: special duties, publications, etc.);

ability to contribute to strategic discussions, consider matters relating to energy and transport as well as the interaction between the two policy areas,

balance in terms of specialists from the various areas of activity, gender (2) and geographical origin.

Each application must be completed in one of the official languages of the European Union, clearly indicating the nationality of the applicant and including the necessary documentation. All applicants must document their professional experience and expertise in full (by means of a curriculum vitae and/or letter in support of their application, for example).

Applications, duly signed, must be sent no later than two months after the date of publication of this notice. Following this date, the Commission will proceed to appoint the full and alternate members of the Forum. Applications must be sent:

There will be no remuneration for the performance of members' duties.

Prior notification of a concentration

On 24 September 2007, the Commission received a notification of a proposed concentration, consisting of two interrelated transactions, pursuant to Article 4 of Council Regulation (EC) No 139/2004 (1) by which the undertakings CPI Capital Partners Europe L.P. and CPI Capital Partners Europe (NFR) L.P. (together ‘CPI Europe Fund’, UK), belonging to Citibank International plc, and Corpus Immobiliengruppe GmbH & Co. KG (‘Corpus’, Germany) acquire within the meaning of Article 3(1)(b) of the Council Regulation joint control of 149 properties and four real estate companies (ZBI Invest 1 AG, ZBI Wohnen GmbH, DIB Vermögensverwaltungs AG und GbR Erfurt) (together ‘Real Estate Portfolio’). Next, the undertaking CitCor Commercial Properties GmbH & Co. KG, jointly controlled by CPI Europe Fund und Corpus acquires four business properties.

The business activities of the undertakings concerned are:

for CPI Europe Fund: real estate fund,

for Corpus: investment management, asset management including maintenance, selling, and development of residential,

for Real Estate Portfolio: 149 existing residential properties and for real estate companies.

On preliminary examination, the Commission finds that the notified transaction could fall within the scope of Regulation (EC) No 139/2004. However, the final decision on this point is reserved. Pursuant to the Commission Notice on a simplified procedure for treatment of certain concentrations under Council Regulation (EC) No 139/2004 (2) it should be noted that this case is a candidate for treatment under the procedure set out in the Notice.

The Commission invites interested third parties to submit their possible observations on the proposed operation to the Commission.

Observations must reach the Commission not later than 10 days following the date of this publication. On 25 September 2007, the Commission received a notification of a proposed concentration pursuant to Article 4 of Council Regulation (EC) No 139/2004 (1) by which the undertaking Carlyle Europe Partners III L.P., belonging to and managed by The Carlyle Group (‘Carlyle’, USA) acquires within the meaning of Article 3(1)(b) of the Council Regulation control of the whole of the undertaking Applus Servicios Technológicos, S.L. (‘Applus’, Spain) by way of purchase of shares.

On 26 September 2007, the Commission received a notification of a proposed concentration pursuant to Article 4 of Council Regulation (EC) No 139/2004 (1), by which the undertakings One Equity Partners II (‘OEP’, USA) — indirectly controlled by J.P Morgan Chase & Co (USA) — and MSP-Stiftung (‘MSP’, Germany) acquire within the meaning of Article 3(1)(b) of the Council Regulation joint control over the undertakings De-Vau-Ge Gesundkostwerk Gesellschaft mit beschrankter Haftung (‘DVG’, Germany), Milk-Snack Produktions GmbH (‘Milk-Snack’, Germany), Delicia B.V. (The Netherlands), Dailycer S.A.S. (France), Dailycer Ltd (UK) and Dailycer B.V. (The Netherlands) (together the ‘Dailycer Group’), by way of purchase of shares.

The business activities of the undertakings concerned are:

for MSP: foundation under German law, holding certain assets for the benefit of members of the Seventh-Day Adventists Church,

for DVG: manufacturing, distribution and marketing of various food products, including cereal products, bars, soya drinks etc.,

for Dailycer Group: manufacturing and distribution of cereal products.

On 25 September 2007, the Commission received a notification of a proposed concentration pursuant to Article 4 of Council Regulation (EC) No 139/2004 (1) by which the undertaking MOL Hungarian Oil and Gas Plc. (‘MOL’, Hungary) acquires within the meaning of Article 3(1)(b) of the Council Regulation control of the whole of the undertaking Italiana Energia e Servizi S.p.A. (‘IES’, Italy) by way of purchase of shares.

The business activities of the undertakings concerned are:

for MOL: exploration and production of crude oil, natural gas and gas products; refining and marketing of crude oil products at both retail and wholesale level; transmission of natural gas, and production and sales of petrochemical products,

for IES: refining of crude oil and subsequent sales of each derivative oil products; automotive retail sales of fuels; sale of bitumen, and provision of catering services along common roads.
