Notification pursuant to Article 34 of the Schengen Borders Code

Article 34 of the Schengen Borders Code lays down that the Member States of the EU must notify the Commission of the list of residence permits, the list of their border crossing points, the reference amounts required for the crossing of their external borders fixed by the national authorities, the list of national services responsible for border control and the specimen of model cards issued by Foreign Ministries.
I. Article 34(1)(a): list of residence permits
Under Bulgarian law, the residence rules differ depending on whether a person is a national of an EU Member State or of a third country.
The Law on entry into, residence in and departure from the Republic of Bulgaria for EU nationals and members of their families provides for the following documents:
Long-term residence permits are issued to EU nationals by the National Police Service and testify that the bearer is entitled to long-term residence in the Republic of Bulgaria.
Permanent residence permits are issued to EU nationals by the National Police Service and testify that the bearer is entitled to permanent residence in the Republic of Bulgaria.
Long-term residence cards are issued to family members who are not EU nationals by the department responsible and testify that the bearer is entitled to long-term residence in the Republic of Bulgaria.
Permanent residence cards are issued to family members of EU citizens who are not EU nationals themselves by the department responsible and testify that the bearer is entitled to permanent residence in the Republic of Bulgaria.
Under Article 14 of the Law on Bulgarian identity documents, the following documents are issued to third-country nationals (foreign nationals) for use within the territory of the Republic of Bulgaria:

long-term residence cards for foreign nationals; |
2. |
permanent residence cards for foreign nationals; |
3. |
refugee cards; |
4. |
temporary refugee certificates and temporary certificates for refugees subject to the accelerated procedure; |
5. |
foreign travel permits for refugees; |
6. |
foreign travel permits for stateless persons; |
7. |
permits conferring the right to leave the Republic of Bulgaria temporarily; |
8. |
temporary identity cards for foreign nationals; |
9. |
permits conferring on foreign nationals the right to return to the Republic of Bulgaria; |
10. |
identity cards for foreign nationals who have been granted humanitarian status; |
11. |
temporary protection certificates for foreign nationals; |
12. |
foreign travel permits for foreign nationals who have been granted humanitarian status; |
13. |
identity cards for foreign nationals who have been accredited as officials belonging to embassies, consulates or international organisations based within the territory of the Republic of Bulgaria. |
The above are identity documents within the meaning of Bulgarian legislation and are established according to ICAO DOC 9303 recommendations.
II. Article 34(1)(b): list of border crossing points:
1. |
On the border between Bulgaria and Serbia: Bregovo, Vrashka Chuka, Kalotina, Strezimirovtsi, Oltomantsi; |
2. |
On the border between Bulgaria and Macedonia: Gyushevo, Stanke Lisichkovo, Zlatarevo; |
3. |
On the border between Bulgaria and Turkey: Malko Tarnovo, Lesovo, Kapitan Andreevo; |
4. |
On the border between Bulgaria and Greece: Kulata, Ilinden, Kapitan Petko Voyvoda; |
5. |
On the border between Bulgaria and Romania: Vidin Ferry Port, Oryahovo Ferry Port, Ruse Danube Bridge, Silistra, Kardam, Durankulak; |
6. |
River ports: Vidin, Lom, Somovit-Nikopol, Svishtov, Ruse, Tutrakan, Silistra; |
7. |
Sea ports: Balchik, Varna, Burgas, Tsarevo; |
8. |
Airports: Sofia Airport, Plovdiv Airport, Gorna Oryahovitsa Airport, Varna Airport, Burgas Airport. |
III. Article 34(1)(c): reference amounts required for the crossing of the external borders
Under Article 19(5) of the Ordinance on the terms and the procedure for the issuing of visas, adopted by Council of Ministers Decree No 97/11.05.2002, foreign nationals applying for a Bulgarian entry visa must present proof of sufficient means to cover their subsistence costs. These must amount to no less than EUR 50 per day, with a minimum of EUR 500 per stay. The same amounts apply when said foreign nationals enter the territory of the Republic of Bulgaria, unless they possess vouchers for pre-paid tourism services within the country.
IV. Article 34(1)(d): national services responsible for border control
The service responsible for border control in the Republic of Bulgaria is the Directorate-General for Border Police of the National Police Service.
V. Article 34(1)(e): specimen of model cards issued by the Foreign Ministry
Identity cards issued to staff working at embassies or consulates on the territory of the Republic of Bulgaria are as follows:

Diplomatic cards are issued only to members of the diplomatic staff of the foreign missions and to members of their families who are between the age of 14 and 21;
|
2. |
Consular cards are issued to diplomatic staff of consular representations and to members of their families who are between the age of 14 and 21;
|
3. |
Cards of members of the administrative and technical staff are issued to members of the administrative and technical staff of the embassy/consulate and to members of their families between the age of 14 and 21;
|
4. |
Cards of the service staff are issued to the relevant category of persons and to members of their families who are between the age of 14 and 21.
|
Members of the family are the persons who are part of the household of the official, as follows:

husband/wife, |
— |
unmarried children of up to 21 years of age who live permanently with their parents, |
— |
unmarried children between the age of 21 and 26 who live permanently with their parents and are university students in Bulgaria. They are issued an ID card annually upon submitting a document by the university certifying that they are registered as students for the new academic year, |
— |
disabled unmarried children above the age of 21 who live permanently with their parents and are in need of their care, which is confirmed by a medical cerificate. |

The publication of the list of residence permits referred to in Article 2(15) of Regulation (EC) No 562/2006 of the European Parliament and of the Council of 15 March 2006 establishing a Community Code on the rules governing the movement of persons across borders (Schengen Borders Code) is based on the information communicated by the Member States to the commission in conformity with Article 34 of the Schengen Borders Code.
In addition to the publication in the Official Journal, a monthly update is available on the website of Directorate General Justice, Freedom and Security.
FRANCE:

List of persons participating in a school trip within the European Union NB 1:It should be noted that acknowledgements of first-time applications for residence permits do not give entitlement to entry without a visa. In contrast, acknowledgements of requests to renew residence permits, or to amend permits are considered valid, when these are accompanied by the old permit. NB 2:The ‘attestation de fonctions’ (certificate of appointment) issued by the protocol department of the Ministry of Foreign Affairs does not constitute a replacement for a residence permit. Holders must also be in possession of one of the standard residence permits. |
MALTA
Residence permits to third country nationals are issued in the uniform format in accordance with Council Regulation (EC) 1030/2002 of 13 June 2002 laying down a uniform format for residence permits for third-country nationals. In the blank space provided on each document for ‘Type of Permit’ the following categories are being utilised:

In the interim period when the application for the residence permit is being processed, the applicant is furnished with an acknowledgement of his/her application. The said document would serve the purpose of a temporary residence document for national use only.
The immigration police issue an ‘Immigration Certificate’ on humanitarian grounds to third-country nationals who have no other means of identification. This document is used nationally for identification purposes and is not valid for travel.
Third country nationals who are family members of EEA nationals exercising a Treaty right in Malta are issued with a residence document in the form of a stamp endorsed in the passport of the person concerned.
The spouse/widow/widower/child under 21 years of age of a citizen of Malta is considered to be an exempt person and, therefore, may reside and work in Malta. The immigration position of such persons is reflected in the holder's passports by means of one of the following stamps:

holder possesses freedom of movement in term of section 44(4)(a) of the Constitution of Malta, |
— |
holder is an exempt person in terms of section 4(1)(g)(h) of Chapter 217 of the Laws of Malta. |

Residence permits issued before 25 March 2000 are distinguished by the presence of stamps (not stickers) in the bearers' travel documents. For foreign nationals subject to a visa requirement, these stamps are accompanied by a Norwegian visa sticker for the period of validity of the residence permit. Residence permits issued after Schengen is brought into force on 25 March 2001 will have a sticker. If a foreign national's travel document has an old stamp in it, this will remain valid until such time as the Norwegian authorities have to replace the stamps with the new sticker to be affixed to the residence permit.
The abovementioned permits are not valid as travel documents. In cases where the foreign national needs a travel document, one of the two following documents may be used as a supplement to the work-, residence- or settlement permit:

A refugee's travel document (‘Reisebevis’ — green), |
— |
An immigrant's passport (‘Utlendingspass’ — blue). |
The holder of one of these travel documents is guaranteed to be permitted to re-enter Norway while the document remains valid.

EEA card issued to EEA nationals and members of their families who are third-country nationals. These cards are always laminated. |

The publication of model cards issued by the Ministries of Foreign Affairs of Member States to accredited members of diplomatic missions and consular representations and members of their families, as referred to in Article 19(2) of Regulation (EC) No 562/2006 of the European Parliament and of the Council of 15 March 2006 establishing a Community Code on the rules governing the movement of persons across borders (Schengen Borders Code) is based on the information communicated by the Member States to the commission in conformity with Article 34 of the Schengen Borders Code.
In addition to the publication in the Official Journal, a monthly update is available on the website of Directorate General Justice, Freedom and Security.

FRANCE:
Replacement of the information published in Official Journal of the European Union C 247 of 13 Ocotber 2006.
The reference amount for adequate means of subsistence for the planned duration of an alien's stay or for his transit via France to a destination in a third State is equal to the amount of the guaranteed minimum wage in France (SMIC) calculated daily on the basis of the rate fixed on 1 January of the current year.
This amount is regularly reassessed on the basis of the French cost of living index:
— |
automatically whenever the retail price index rises more than 2 %, |
— |
by a government decision — after consultation with the national commission for collective bargaining — to grant a rise higher than the rise in the retail price index. |
As of 1 July 2005, the daily amount of the SMIC (minimum wage) is EUR 56,20.
Persons holding proof of accommodation (attestation d'accueil) must possess a minimum amount of money, equivalent to half the SMIC, in order to stay in France. This amount is therefore EUR 28,10 per day.
