NEW NATIONAL FACES OF EURO COINS INTENDED FOR CIRCULATION

Image

The euro coins intended for circulation are legal tender throughout the euro area. In order to provide professionals who handle the coins and the public with information, the Commission publishes the characteristics of the designs of all new coins (1).

Description of designs:

1 EURO CENT, 2 EURO CENT, 5 EURO CENT

The coin portrays the bust of His Holiness Pope Benedict XVI. Either side of the portrait are, to the left, the designer's initials ‘DL’ and, to the right, the mint mark ‘R’. The legend ‘CITTÀ DEL VATICANO’ followed by the year 2006 is engraved in a semi-circle above the portrait. The twelve stars of the European flag encircle the design.

10 EURO CENT, 20 EURO CENT, 50 EURO CENT

The coin portrays the bust of His Holiness Pope Benedict XVI. Either side of the portrait are, to the left, the designer's initials ‘DL’ and, to the right, the mint mark ‘R’. The legend ‘CITTÀ DEL VATICANO’ followed by the year 2006 is engraved in a semi-circle below the portrait. The twelve stars of the European flag encircle the design.

The internal part of the coin portrays the bust of His Holiness Pope Benedict XVI. The year 2006 surmounted by the mint mark ‘R’ appears to the right of the coin. The legend ‘CITTÀ DEL VATICANO’ is arranged in the form of an arc of a circle broken by the portrait. The twelve stars of the European flag are positioned around the outer circle of the coin.

On 1 August 2006, the Commission received a notification of a proposed concentration pursuant to Article 4 of Council Regulation (EC) No 139/2004 (1) by which the undertakings Cinven Limited (‘Cinven’, UK) and Warburg Pincus International LLC belonging to the Warburg Pincus group (‘Warburg Pincus’, USA) acquire within the meaning of Article 3(1)(b) of the Council Regulation joint control of the undertakings Casema Holding B.V. (‘Casema’, The Netherlands) and Multikabel B.V. (‘Multikabel’, The Netherlands) by way of purchase of shares. Prior to the proposed concentration, Multikabel is solely controlled by Warburg Pincus.

2.

The business activities of the undertakings concerned are:

for Cinven: investment company;

for Warburg Pincus: investment company;

for Casema: cable operator providing radio and television, Internet access and telephony services in the Netherlands;

for Multikabel: cable operator providing radio and television, Internet access and telephony services in the Netherlands.

3.

On preliminary examination, the Commission finds that the notified transaction could fall within the scope of Regulation (EC) No 139/2004. However, the final decision on this point is reserved.

4.

The Commission invites interested third parties to submit their possible observations on the proposed operation to the Commission.

On 31 July 2006, the Commission received a notification of a proposed concentration pursuant to Article 4 of Council Regulation (EC) No 139/2004 (1) by which the undertaking NIBC Principal Investments Equity B.V. (‘NIBC’, The Netherlands) controlled by J.C. Flowers (‘JCF’) and the undertaking NPM Capital N.V. (‘NPM’, The Netherlands) controlled by SHV Holdings N.V. (‘SHV’) acquire within the meaning of Article 3(1)(b) of the Council Regulation joint control of the whole of N.V. Deli Universal (The Netherlands), Deli Mij Holdings Limited (United Kingdom), Red River Commodities, Inc (US) and Imperial Commodities Corporation (US) (together ‘The Target’) by way of purchase of shares.

2.

The business activities of the undertakings concerned are:

for NIBC: independent private bank, corporate finance, risk management and structured investment solutions;

for SHV: trade in food and non-food consumer articles, provision of private equity, trade and production of raw materials and exploration and production of oil and gas;

for the Target: supply of timber and building materials to the construction industry, supply of constructive and decorative materials and garden centres, supply of speciality agri-products.

On preliminary examination, the Commission finds that the notified transaction could fall within the scope of Regulation (EC) No 139/2004. However, the final decision on this point is reserved. Pursuant to the Commission Notice on a simplified procedure for treatment of certain concentrations under Council Regulation (EC) No 139/2004 (2) it should be noted that this case is a candidate for treatment under the procedure set out in the Notice.

4.

The Commission invites interested third parties to submit their possible observations on the proposed operation to the Commission.

Holding S.p.A. (‘TTH’, Italy) acquire within the meaning of Article 3(1)(b) of the Council Regulation joint control of the undertaking T&M CAR S.r.l. (‘T&M CAR’, Italy) by way of purchase of shares in a newly created company constituting a joint venture.

2.

The business activities of the undertakings concerned are:

for undertaking Toyota Tsusho: logistics services for the automotive industry, and trading of metals, machinery, chemical and other products;

for undertaking TTH: management and development of retail distribution of passenger cars and parts in northern region of Lomabardy, Italy;

for T&M CAR: retail distribution of new and used passenger cars and spare parts, and the provision of automobile related services.

On preliminary examination, the Commission finds that the notified transaction could fall within the scope of Regulation (EC) No 139/2004. However, the final decision on this point is reserved. On 1 August 2006, the Commission received a notification of a proposed concentration pursuant to Article 4 of Council Regulation (EC) No 139/2004 (1) by which the undertaking Phelps Dodge Corporation (‘Phelps Dodge’, USA) acquire(s) within the meaning of Article 3(1)(b) of the Council Regulation control of the whole of Inco Limited (‘Inco’, Canada) by way of public bid announced on 26 June 2006.

2.

The business activities of the undertakings concerned are:

for Phelps Dodge: mining, processing and refining of copper and molybdenum, and the production and sale of electrical wires and cables.

for Inco: mining, processing, refining and sale of various nickel products, copper, cobalt and precious metals.

3.

On preliminary examination, the Commission finds that the notified transaction could fall within the scope of Regulation (EC) No 139/2004. However, the final decision on this point is reserved. Pursuant to the Commission Notice on a simplified procedure for treatment of certain concentrations under Council Regulation (EC) No 139/2004 (2) it should be noted that this case is a candidate for treatment under the procedure set out in the Notice.

Commission Notice concerning parties exempted, pursuant to Commission Regulation (EC) No 88/97 on the authorisation of the exemption of imports of certain bicycle parts originating in the People's Republic of China from the extension by Council Regulation (EC) No 71/97 of the anti-dumping duty imposed by Council Regulation (EEC) No 2474/93, maintained by Council Regulation (EC) No 1524/2000 and last amended by Council Regulation (EC) No 1095/2005: changes in the name and address of certain exempted parties

Commission Regulation (EC) No 88/97 (1) (the ‘exemption Regulation’) authorises the exemption from the extended anti-dumping duty on imports of certain bicycle parts originating in the People's Republic of China. This duty resulted from the extension by Council Regulation (EC) No 71/97 (2) of the anti-dumping duty imposed by Council Regulation (EEC) No 2474/93 (3), maintained by Regulation (EC) No 1524/2000 (4) and last amended by Council Regulation (EC) No 1095/2005 (5).

In this framework, and by successive Commission Decisions, a certain number of bicycle producers have been exempted from the extended anti-dumping duty: inter alia, Bike Systems (Taric additional code 8034) (6), Biria GmbH (Taric additional code 8062) (7), Cicli Lombardo di Gaspare Lombardo & C. Snc (Taric additional code A271) (8), Cicli Regina di Romagna Snc (Taric additional code 8005) (9), Ciclo Meccanica Srl (Taric additional code A170) (10), and Open Space Srl (Taric additional code A486) (11).

Bike Systems has informed the Commission that the legal name and address of the company that carries out the assembly operation and consequently requires the exemption from the extended anti-dumping duty has changed from Bike Systems, 97493 Bergrheinfeld, Germany, to Bike Systems GmbH, Freiherr vom Stein Straße 31, 99734 Nordhausen, Germany.

Biria GmbH has informed the Commission that the legal name and address of the company that carries out the assembly operation and consequently requires the exemption from the extended anti-dumping duty has changed from Biria GmbH, 68535 Edingen, Germany, to Biria Bike GmbH, Hauptstraße 37, 01904 Neukirch/Lausitz, Germany.

Cicli Lombardo di Gaspare Lombardo & C. Snc has informed the Commission that the legal name of the company that carries out the assembly operation and consequently requires the exemption from the extended anti-dumping duty has changed from Cicli Lombardo di Gaspare Lombardo & C. Snc to Cicli Lombardo S.p.A.

Cicli Regina di Romagna Snc has informed the Commission that the legal name of the company that carries out the assembly operation and consequently requires the exemption from the extended anti-dumping duty has changed from Cicli Regina di Romagna Snc to Gruppo Bici Srl.

Ciclo Meccanica Srl has informed the Commission that the legal name of the company that carries out the assembly operation and consequently requires the exemption from the extended anti-dumping duty has changed from Ciclo Meccanica Srl to GI Bike Srl.

Open Space Srl has informed the Commission that the legal address of the company has changed from Via Guido Rossa 18/A, 35020 Roncaglia de Ponte San Nicolo, Padova, Italy, to Viale Europa 6/B, Int. D, 35020 Roncaglia de Ponte San Nicolo, Padova, Italy.

The Commission, after having examined the information supplied, has established that the changes in the companies' names and legal addresses do not affect the assembly operations with regard to the stipulations of the exemption Regulation and therefore the Commission does not consider that these changes should affect the exemption from the extended anti-dumping duty.

Hence references to Bike Systems in Commission Decision 98/115/EC, to Biria GmbH in Commission Decision 97/447/EC, to Cicli Lombardo di Gaspare Lombardo & C. Snc in Commission Decision 2002/606/EC, to Cicli Regina di Romagna Snc in Commission Decision 98/684/EC, to Ciclo Meccanica Srl in Commission Decision 2006/22/EC and to Open Space Srl in Commission Decision 2004/776/EC should be read as reported in the following Annex.

The Commission draws attention to the judgement delivered on 30 April 1996 in the ‘CIA Security’ case (C-194/94 — ECR I, p. 2201), in which the Court of Justice ruled that Articles 8 and 9 of Directive 98/34/EC (formerly 83/189/EEC) are to be interpreted as meaning that individuals may rely on them before national courts which must decline to apply a national technical regulation which has not been notified in accordance with the Directive.

This judgement confirms the Commission's communication of 1 October 1986 (OJ C 245, 1.10.1986, p. 4).

Accordingly, breach of the obligation to notify renders the technical regulations concerned inapplicable, and consequently unenforceable against individuals.

UK-Edinburgh: Operation of scheduled air services

Invitation to tender issued by the United Kingdom under Article 4(1)(d) Council Regulation (EEC) No 2408/92 in respect of the operation of scheduled air services between Glasgow-Campbeltown, Glasgow-Tiree and Glasgow-Barra (Glasgow Airport means Glasgow International Airport) (Scotland) (2006/C 186 and S 150 of 9.6.2006)

1.   Introduction: In pursuance of Article 4(1)(a) of Regulation (EEC) No 2408/92 of 23 July 1992 on access for Community air carriers to intra-Community air routes, the United Kingdom has imposed public service obligations (PSOs) in respect of scheduled air services operated between Glasgow-Campbeltown, Glasgow-Tiree and Glasgow-Barra. The standards required by these public service obligations were published in the Official Journal of the European Communities No C 387/06 and No C 387/07 of 21.12.1996, as modified in the Official Journal of the European Communities/Union No C 355/03 and No C 355/04 of 8.12.1999, No C 310/07 and No C 310/08 of 13.12.2002, No C 278/05 and No C 278/06 of 19.11.2003, No C 321/06 and No C 321/05 of 16.12.2005 and No C 186 and S 150 of 9.6.2006.

If, by 1 January 2006, no air carrier has commenced or is about to commence scheduled air services between Glasgow-Campbeltown, Glasgow-Tiree and Glasgow-Barra in accordance with the PSOs imposed and without requesting compensation, the United Kingdom has decided, in accordance with the procedure laid down in Article 4(1)(d) of the above-mentioned Regulation, to continue to limit access to these routes to a single air carrier and to offer the right to operate such services from 1 January 2007 by public tender.

2.   Object of Invitation to Tender: Operation from 1 January 2007 of scheduled air services between Glasgow-Campbeltown, Glasgow-Tiree and Glasgow-Barra in accordance with the public service obligations imposed on these routes and published in the Official Journal of the European Communities No C 387/06 and No C 387/07 of 21.12.1996, as modified in the Official Journal of the European Communities/Union No C 355/03 and No C 355/04 of 8.12.1999, No C 310/07 and No C 310/08 of 13.12.2002, No C 278/05 and No C 278/06 of 19.11.2003 and No C 321/06 and No C 321/05 of 16.12.2005 and No C 186 and S 150 of 9.6.2006.

3.   Participation: Participation is open to all air carriers holding a valid operating licence issued by a Member State in accordance with Council Regulation (EEC) No 2407/92 of 23 July 1992 on licensing of air carriers. The services will operate under the Civil Aviation Authority (CAA) regulatory regime.

4.   Tender Procedure: This invitation to tender is subject to the provisions of Article 4(1) (d), (e), (f), (g), (h), and (i) of Regulation (EEC) No 2408/92.

5.   Tender Dossier/Qualifications etc: The complete tender documentation, including form of tender, specifications, conditions of contract/schedule to the conditions of contract, as well as the text of the original public service obligations published in the Official Journal of the European Communities No C 387/06 and No C 387/07 of 21.12.1996, as modified in the Official Journal of the European Communities/Union No C 355/03 and No C 355/04 of 8.12.1999, No C 310/07 and No C 310/08 of 13.12.2002, No C 278/05 and No C 278/06 of 19.11.2003, no C 321/06 and No C 321/05 of 16.12.2005 and No C 186and S 150 of 9.6.2006, may be obtained free of charge from the Awarding Authority as follows:

Airlines will be required to include in their tender documents, evidence of their financial standing (an annual report and audited accounts for the past 3 years must be provided and must include turnover and pre-tax profit for the past 3 years), previous experience and technical capability to provide the services described. The Awarding Authority reserves the right to solicit further information about any applicant's financial and technical resources and abilities.

The right to operate the Glasgow-Campbeltown, Glasgow-Tiree and Glasgow-Barra services is being offered on the basis that they may be grouped together into one contract, or tenders may be made to operate any one of the services or any combination of 2 of the services. Accordingly, the Awarding Authority reserves the right to exercise discretion in accepting bids which are to provide one service only or 2 services only (in whatever combination) and tenderers should provide separate costings for each bid permutation. However, tenderers should note that the Awarding Authority may also accept single bids for the provision of all 3 services, and should provide costings for such a bid. Bids, whether separate or combined, will be evaluated according to which bid(s) is/are the most economically advantageous and will secure the operation of each of the 3 services for the duration of their respective specified tender periods. Tenders should be priced in Sterling and all supporting documents must be in English. The contract(s) shall be considered as contract(s) made under Scottish Law and subject to the exclusive jurisdiction of the Scottish courts.

6.   Financial Compensation: Tenders submitted should indicate the amount required by way of grant for operating the services from the scheduled starting date to 31 March 2009 (with an analysis to each year). For the avoidance of doubt, tenders submitted which involve the provision of services between Glasgow-Campbeltown and/or Glasgow-Tiree and/or Glasgow-Barra should provide the amount required by way of grant for operating the services. The grant should be calculated in accordance with the specifications. The maximum limit finally granted may be revised only in the event of an unforeseen change in the operating conditions.

The contract(s) will be awarded by the Scottish Ministers. All payments under the contract will be in sterling.

7.   Period of validity, amendment and termination of the contract(s): Contract(s) commencing 1 January 2007 will terminate on 31 March 2009. Any amendment or termination of the contract(s) will be in accordance with the conditions of contract(s). Variations in the services will be permitted only with the agreement of the Awarding Authority.

8.   Penalties in the event of the carrier failing to comply with the contract(s): In the event of the carrier failing to operate a flight for any reason then, subject as aftermentioned, the Scottish Ministers may reduce the grant on a pro rata basis for each occasion on which a flight is not operated provided that the Scottish Ministers shall not make any such reduction in the grant where the failure to operate the flight is as a consequence of any of the following, and the appropriate occurrence has not arisen as a consequence of the acts or omissions of the carrier:

weather/tidal conditions;

closure of the airports;

security reasons;

strikes;

reasons of safety

An explanation from the carrier(s) for such non-operation is also required in accordance with the conditions of contract(s).

9.   Deadline for submission of bids: 1 month after the date of publication of this notice.

10.   Application procedure: Tenders must be sent to the address at 5 above. Persons admitted to open tenders are designated staff from the Scottish Executive's Enterprise, Transport and Lifelong Learning Department and Procurement and Commercial Services Division at the Scottish Executive.

11.   Validity of invitations to tender: In accordance with Article 4(1)(d) of Regulation (EEC) No 2408/92, the validity of this invitation to tender is subject to the condition that no Community air carrier presents, by 1 December 2006, a programme for operating the routes in question from 1 January 2007 or before that date, in accordance with the PSOs imposed, as amended, without receiving any subsidy.
