DECISION OF THE EEA JOINT COMMITTEE

amending Annex I (Veterinary and phytosanitary matters) to the EEA Agreement

THE EEA JOINT COMMITTEE,

Having regard to the Agreement on the European Economic Area, as amended by the Protocol adjusting the Agreement on the European Economic Area, hereinafter referred to as ‘the Agreement’, and in particular Article 98 thereof,

Whereas:

(1)

Annex I to the Agreement was amended by Decision of the EEA Joint Committee No 1/2008 of 1 February 2008 (1).

(2)

Commission Regulation (EC) No 757/2007 of 29 June 2007 concerning the permanent authorisation of certain additives in feedingstuffs (2) is to be incorporated into the Agreement.

(3)

Commission Regulation (EC) No 785/2007 of 4 July 2007 concerning the authorisation of 6-phytase EC 3.1.3.26 (Phyzyme XP 5000G Phyzyme XP 5000L) as a feed additive (3) is to be incorporated into the Agreement.

(4)

Commission Regulation (EC) No 786/2007 of 4 July 2007 concerning the authorisation of endo-1,4-beta-mannanase EC 3.2.1.78 (Hemicell) as a feed additive (4) is to be incorporated into the Agreement.

(5)

Commission Regulation (EC) No 828/2007 of 13 July 2007 concerning the permanent and provisional authorisation of certain additives in feedingstuffs (5) is to be incorporated into the Agreement.

Commission Regulation (EC) No 1142/2007 of 1 October 2007 concerning the authorisation of a new use of 3-phytase (Natuphos) as a feed additive (12) is to be incorporated into the Agreement.

(13)

Commission Regulation (EC) No 1143/2007 of 1 October 2007 amending Regulation (EC) No 256/2002 as regards the authorisation of the feed additive preparation of Bacillus cereus var. toyoi, belonging to the group of microorganisms (13) is to be incorporated into the Agreement.

HAS DECIDED AS FOLLOWS:

Article 1

Chapter II of Annex I to the Agreement shall be amended as follows:

This Decision shall be published in the EEA Section of, and in the EEA Supplement to, the Official Journal of the European Union.

DECISION OF THE EEA JOINT COMMITTEE

amending Annex II (Technical regulations, standards, testing and certification) to the EEA Agreement

THE EEA JOINT COMMITTEE,

Having regard to the Agreement on the European Economic Area, as amended by the Protocol adjusting the Agreement on the European Economic Area, hereinafter referred to as ‘the Agreement’, and in particular Article 98 thereof,

Whereas:

(1)

Annex II to the Agreement was amended by Decision of the EEA Joint Committee No 132/2007 of 26 October 2007 (1).

(2)

Directive 2007/45/EC of the European Parliament and of the Council of 5 September 2007 laying down rules on nominal quantities for prepacked products, repealing Council Directives 75/106/EEC and 80/232/EEC, and amending Council Directive 76/211/EEC (2) is to be incorporated into the Agreement.

(3)

Directive 2007/45/EC repeals, with effect from 11 April 2009, Council Directives 75/106/EEC (3) and 80/232/EEC (4) which are incorporated into the Agreement and which are consequently to be repealed under the Agreement with effect from 11 April 2009,

HAS DECIDED AS FOLLOWS:

Article 1

Chapter IX of Annex II to the Agreement shall be amended as follows:

1)

The following indent shall be added in point 15 (Council Directive 76/211/EEC):

32007 L 0045: Directive 2007/45/EC of the European Parliament and of the Council (OJ L 247, 21.9.2007, p. 17).’

2)

The following point shall be inserted after point 27b (Directive 2004/22/EC of the European Parliament and of the Council):

Having regard to the Agreement on the European Economic Area, as amended by the Protocol adjusting the Agreement on the European Economic Area, hereinafter referred to as ‘the Agreement’, and in particular Article 98 thereof,

Whereas:

Annex II to the Agreement was amended by Decision of the EEA Joint Committee No 6/2008 of 1 February 2008 (1).

(2)

Commission Directive 2007/55/EC of 17 September 2007 amending certain Annexes to Council Directives 76/895/EEC, 86/362/EEC, 86/363/EEC and 90/642/EEC as regards maximum residue levels for azinphos-methyl (2), is to be incorporated into the Agreement.

(3)

Commission Directive 2007/56/EC of 17 September 2007 amending certain Annexes to Council Directives 86/362/EEC, 86/363/EEC and 90/642/EEC as regards maximum residue levels for azoxystrobin, chlorothalonil, deltamethrin, hexachlorobenzene, ioxynil, oxamyl and quinoxyfen (3), is to be incorporated into the Agreement.

(4)

Commission Directive 2007/57/EC of 17 September 2007 amending certain Annexes to Council Directives 76/895/EEC, 86/362/EEC, 86/363/EEC and 90/642/EEC as regards maximum residue levels for dithiocarbamates (4), is to be incorporated into the Agreement.

(5)

This Decision is not to apply to Liechtenstein,

THE EEA JOINT COMMITTEE,

Having regard to the Agreement on the European Economic Area, as amended by the Protocol adjusting the Agreement on the European Economic Area, hereinafter referred to as ‘the Agreement’, and in particular Article 98 thereof,

Whereas:

(1)

Annex II to the Agreement was amended by Decision of the EEA Joint Committee No 8/2008 of 1 February 2008 (1).

(2)

Regulation (EC) No 1907/2006 of the European Parliament and of the Council of 18 December 2006 concerning the Registration, Evaluation, Authorisation and Restriction of Chemicals (REACH), establishing a European Chemicals Agency, amending Directive 1999/45/EC and repealing Council Regulation (EEC) No 793/93 and Commission Regulation (EC) No 1488/94 as well as Council Directive 76/769/EEC and Commission Directives 91/155/EEC, 93/67/EEC, 93/105/EC and 2000/21/EC (2), as corrected by OJ L 136, 29.5.2007, p. 3, is to be incorporated into the Agreement.

Directive 2006/121/EC of the European Parliament and of the Council of 18 December 2006 amending Council Directive 67/548/EEC on the approximation of laws, regulations and administrative provisions relating to the classification, packaging and labelling of dangerous substances in order to adapt it to Regulation (EC) No 1907/2006 concerning the Registration, Evaluation, Authorisation and Restriction of Chemicals (REACH) and establishing a European Chemicals Agency (3), as corrected by OJ L 136, 29.5.2007, p. 281, is to be incorporated into the Agreement,

HAS DECIDED AS FOLLOWS:

Article 1

Chapter XV of Annex II to the Agreement shall be amended as specified in the Annex to this Decision.

Article 2

The texts of Regulation (EC) No 1907/2006 as corrected by OJ L 136, 29.5.2007, p. 3 and Directive 2006/121/EC as corrected by OJ L 136, 29.5.2007, p. 281 in the Icelandic and Norwegian languages, to be published in the EEA Supplement to the Official Journal of the European Union, shall be authentic.

Article 3

This Decision shall enter into force on 15 March 2008, or on the day following the last notification to the EEA Joint Committee under Article 103(1) of the Agreement, whichever is the later (*1).

Article 4

This Decision shall be published in the EEA Section of, and in the EEA Supplement to, the Official Journal of the European Union.

ANNEX

Chapter XV of Annex II to the Agreement shall be amended as follows:

1)

The following shall be inserted after point 12zb (Commission Decision 2007/565/EC):

32006 R 1907: Regulation (EC) No 1907/2006 of the European Parliament and of the Council of 18 December 2006 concerning the Registration, Evaluation, Authorisation and Restriction of Chemicals (REACH), establishing a European Chemicals Agency, amending Directive 1999/45/EC and repealing Council Regulation (EEC) No 793/93 and Commission Regulation (EC) No 1488/94 as well as Council Directive 76/769/EEC and Commission Directives 91/155/EEC, 93/67/EEC, 93/105/EC and 2000/21/EC (OJ L 396, 30.12.2006, p. 1), as corrected by OJ L 136, 29.5.2007, p. 3.

The Provisions of the Regulation shall, for the purpose of this Agreement, be read with the following adaptations:

(a)

The EFTA States shall participate in the work of the European Chemicals Agency, hereinafter referred to as “the Agency”, as set up by European Parliament and Council Regulation (EC) No 1907/2006.

(b)

Notwithstanding the provisions of Protocol 1 to the Agreement, the term “Member State(s)” contained in the Regulation shall be understood to include, in addition to its meaning in the Regulation, the EFTA States.

(c)

As regards the EFTA States, the Agency shall, as and when appropriate, assist the EFTA Surveillance Authority or the Standing Committee, as the case may be, in the performance of their respective tasks.

(d)

For products covered by Council Directive 91/414/EEC, the EFTA States will be free to limit access to their markets according to the requirements of their legislation existing at the date of entry into force of this Agreement. New EC rules will be dealt with according to the procedures laid down in Articles 97 to 104 of the Agreement.

(e)

Should any disagreement between the contracting parties arise as to the administration of these provisions, Part VII of the Agreement shall apply mutatis mutandis.

(f)

In Article 3, paragraph 10, the following shall be added at the end: “or into the territory of the EFTA States”.

(g)

Article 64 (8) shall be read with the following adaptation:

“When the Commission takes authorisation decisions, the EFTA States will simultaneously and within 30 days of the Community Decision, take corresponding decisions. The EEA Joint Committee shall be informed and shall periodically publish lists of such decisions in the EEA Supplement to the Official Journal.”

(h)

The following paragraph shall be added in Article 79:

“4.   The EFTA States shall participate fully in the Management Board and shall within it have the same rights and obligations as EC Member States, except for the right to vote. The internal rules of procedure of the Board shall give full effect to the EFTA States' participation.”

(i)

The following paragraph shall be added in Article 85:

“10.   The EFTA States shall participate fully in the Member State Committee, in the Committee for Risk Assessment and the Committee for Socio-economic Analysis, and shall have the same rights and obligations as EC Member States, except for the right to vote. The internal rules of procedure of these committees shall give full effect to the EFTA States' participation.”

(j)

The following paragraph shall be added in Article 86:

“5.   EFTA States shall participate in the Forum for Exchange of Information on Enforcement. The internal rules of procedure of this Forum shall give full effect to the EFTA States' participation.”

(k)

The following paragraph shall be added in Article 89:

“Nationals of the EFTA States shall be eligible as members, or as alternates, of the Board of Appeal.”

(l)

The following paragraph shall be added in Article 96:

“12.   The EFTA States shall, as from the entry into force of this Decision, participate in the financing of the Agency. For this purpose the procedures laid down in Article 82(1)(a) and Protocol 32 of the Agreement shall apply mutatis mutandis.

(m)

The following shall be added in Article 102:

“The EFTA States shall grant privileges and immunities to the Agency equivalent to those contained in the Protocol on privileges and immunities of the European Communities.”

(n)

The following paragraph shall be added to Article 103:

“By way of derogation from Article 12(2)(a) of the Conditions of employment of other servants of the European Communities, nationals of the EFTA States enjoying their full rights as citizens may be engaged under contract by the Executive Director of the Agency.”

(o)

The following paragraph shall be added in Article 118:

“5.   Regulation (EC) No 1049/2001 of the European Parliament and the Council of 30 May 2001 regarding public access to European Parliament, Council and Commission documents shall, for the application of Regulation (EC) No 1907/2006, apply to any documents of the Agency regarding the EFTA States as well.”

(p)

The following paragraph shall be added in Article 124:

“Liechtenstein shall not be obliged to establish a national helpdesk. Instead, Liechtenstein will publish a link to the helpdesk of the German Federal Institute for Occupational Safety and Health on the homepage of the competent Liechtenstein authority for chemicals, the Office for Environmental Protection.”’

THE EEA JOINT COMMITTEE,

Having regard to the Agreement on the European Economic Area, as amended by the Protocol adjusting the Agreement on the European Economic Area, hereinafter referred to as ‘the Agreement’, and in particular Article 98 thereof,

Whereas:

(1)

Annex XIII to the Agreement was amended by Decision of the EEA Joint Committee No 13/2008 of 1 February 2008 (1).

(2)

Directive 2006/126/EC of the European Parliament and of the Council of 20 December 2006 on driving licences (Recast) (2) is to be incorporated into the Agreement.

(3)

Directive 2006/126/EC repeals Council Directive 91/439/EEC (3), which is incorporated into the Agreement, with effect from 19 January 2013, except for Article 2(4), which is repealed with effect from 19 January 2007.

(4)

Therefore, Directive 91/439/EEC is to be repealed under the Agreement with effect from 19 January 2013,

HAS DECIDED AS FOLLOWS:

Article 1

Annex XIII to the Agreement shall be amended as follows:

1)

The following point shall be inserted after point 24e (Regulation (EC) No 561/2006 of the European Parliament and of the Council):

‘24f.

32006 L 0126: Directive 2006/126/EC of the European Parliament and of the Council of 20 December 2006 on driving licences (Recast) (OJ L 403, 30.12.2006, p. 18).

The provisions of the Directive shall, for the purposes of this Agreement, be read with the following adaptations:

(a)

The second sentence of Article 1(1) shall be replaced by the following:

“The driving licences of the EFTA States shall contain the distinguishing sign of the State issuing the licence. The respective distinguishing signs are: IS (Iceland), FL (Liechtenstein), N (Norway).”;

(b)

Liechtenstein shall, in case of accession of new Member States to the EEA, have a transitional period of 5 years before the obligations under Article 1(1) in connection with Annex I, point 3, letter (e) apply;

(c)

In point 3 of Annex I, the introductory sentence in letter (c) regarding page 1 of the licence shall be replaced by the following:

“the distinguishing sign of the EFTA State issuing the licence encircled by the ellipse referred to in Article 37 of the U.N. Convention on road traffic of 8 November 1968 (with the same background as the driving licence); the distinguishing signs shall be as follows:”;

(d)

In point 3 of Annex I, the following shall be added in letter (c) regarding page 1 of the licence:

“IS: Iceland

FL: Liechtenstein

N: Norway;”

(e)

In point 3 of Annex I, the words “European Communities model” in letter (e) regarding page 1 of the licence shall be replaced by “EEA model”;

(f)

In point 3 of Annex I, the following shall be added to letter (e) regarding page 1 of the licence:

“Ökuskírteini

Førerkort/Førarkort;”

(g)

In point 3 of Annex I, letter (f) regarding page 1 of the licence shall not apply;

(h)

In point 3 of Annex I, the words “or Icelandic or Norwegian” shall be added in letter (b) regarding page 2 of the licence after the word “Swedish”.’

2)

The following indent shall be added in point 24a (Council Directive 91/439/EEC):

‘—

Whereas:

Annex XVIII to the Agreement was amended by Decision of the EEA Joint Committee No 132/2007 of 26 October 2007 (1).

(2)

Directive 2006/54/EC of the European Parliament and of the Council of 5 July 2006 on the implementation of the principle of equal opportunities and equal treatment of men and women in matters of employment and occupation (recast) (2) is to be incorporated into the Agreement.

(3)

Directive 2006/54/EC repeals, with effect from 15 August 2009, Council Directives 75/117/EEC (3), 76/207/EEC (4), 86/378/EEC (5) and 97/80/EC (6), which are incorporated into the Agreement and which are consequently to be repealed under the Agreement with effect from 15 August 2009,

HAS DECIDED AS FOLLOWS:

Annex XVIII to the Agreement shall be amended as follows:

“With a view to ensuring full equality in practice between men and women in working life, the principle of equal treatment shall not prevent any Member State from maintaining or adopting measures providing for specific advantages in order to make it easier for the underrepresented sex to pursue a vocational activity or to prevent or compensate for disadvantages in professional careers”.

Commission Decision 2005/381/EC of 4 May 2005 establishing a questionnaire for reporting on the application of Directive 2003/87/EC of the European Parliament and of the Council establishing a scheme for greenhouse gas emission allowance trading within the Community and amending Council Directive 96/61/EC (2) is to be incorporated into the Agreement.

(3)

Commission Decision 2006/803/EC of 23 November 2006 amending Decision 2005/381/EC establishing a questionnaire for reporting on the application of Directive 2003/87/EC of the European Parliament and of the Council establishing a scheme for greenhouse gas emission allowance trading within the Community and amending Council Directive 96/61/EC (3) is to be incorporated into the Agreement,

HAS DECIDED AS FOLLOWS:

Article 1

Annex XX to the Agreement shall be amended as follows:

The first report, covering the calendar year 2008, shall be due on 30 June 2009.” ’

Regulation (EC) No 862/2007 repeals Council Regulation (EEC) No 311/76 (3), which is incorporated into the Agreement and which is consequently to be repealed under the Agreement,

Commission Regulation (EC) No 1334/2007 of 14 November 2007 amending Regulation (EC) No 1749/96 on initial implementing measures for Council Regulation (EC) No 2494/95 concerning harmonised indices of consumer prices (3) is to be incorporated into the Agreement,

amending Protocol 31 to the EEA Agreement, on cooperation in specific fields outside the four freedoms

THE EEA JOINT COMMMITTEE,

Having regard to the Agreement on the European Economic Area, as amended by the Protocol adjusting the Agreement on the European Economic Area, hereinafter referred to as ‘the Agreement’, and in particular Articles 86 and 98 thereof,

Whereas:

(1)

Protocol 31 to the Agreement was amended by Decision of the EEA Joint Committee No 96/2007 of 27 July 2007 (1).

(2)

It is appropriate to extend the cooperation of the Contracting Parties to the Agreement to include Council Decision 2007/779/EC, Euratom of 8 November 2007 establishing a Community Civil Protection Mechanism (recast) (2).

(3)

Decision 2007/779/EC, Euratom repeals Council Decision 2001/792/EC, Euratom (3), which is included in the Agreement and which is consequently to be repealed under the Agreement.

(4)

Protocol 31 to the Agreement should therefore be amended in order to allow for this extended cooperation to take place from 1 January 2008,

HAS DECIDED AS FOLLOWS:

Article 1

The text of sub-paragraph (b) of Article 10(8) of Protocol 31 to the Agreement shall be replaced by the following:

‘Community acts which shall take effect from 1 January 2008:

32007 D 0779: Council Decision 2007/779/EC, Euratom of 8 November 2007 establishing a Community Civil Protection Mechanism (recast) (OJ L 314, 1.12.2007, p. 9).’

Article 2

This Decision shall enter into force on the day following the last notification to the EEA Joint Committee under Article 103(1) of the Agreement (*1).

It shall apply from 1 January 2008.

This Decision shall be published in the EEA Section of, and in the EEA Supplement to, the Official Journal of the European Union.
