DECISION OF THE EEA JOINT COMMITTEE

amending Annex XVII (Intellectual property) to the EEA Agreement [2016/517]

THE EEA JOINT COMMITTEE,

Having regard to the Agreement on the European Economic Area (‘the EEA Agreement’), and in particular Article 98 thereof,

Whereas:

(1)	Directive 2012/28/EU of the European Parliament and of the Council of 25 October 2012 on certain permitted uses of orphan works (1) is to be incorporated into the EEA Agreement.

(2)	For practical reasons, the acts listed under the heading ‘ACTS OF WHICH THE CONTRACTING PARTIES SHALL TAKE NOTE’ in Annex XVII to the EEA Agreement shall be renumbered.

(3)	Annex XVII to the EEA Agreement should therefore be amended accordingly,

HAS ADOPTED THIS DECISION:

Article 1

Annex XVII to the EEA Agreement shall be amended as follows:

1.	Under the heading ‘ACTS OF WHICH THE CONTRACTING PARTIES SHALL TAKE NOTE’, points 10 (Council Resolution 92/C-138/01) and 11 (Commission Communication of 27 October 1992) are renumbered points 1 and 2.

The following is inserted after point 9h (Directive 2008/95/EC of the European Parliament and of the Council):

‘10.

32012 L 0028: Directive 2012/28/EU of the European Parliament and of the Council of 25 October 2012 on certain permitted uses of orphan works (OJ L 299, 27.10.2012, p. 5).

The provisions of the Directive shall, for the purposes of this Agreement, be read with the following adaptation:

(a)	The EFTA States shall participate in the single publicly accessible online database established by the Office for Harmonization in the Internal Market referred to in Article 3(6). The EFTA States shall bear the costs of translation in the Icelandic and Norwegian languages, where necessary.

(b)	For the EFTA States, the date of application referred to in Article 8 shall be the day of entry into force of Decision of the EEA Joint Committee No 29/2015 of 6 February 2015.’

Article 2

The text of Directive 2012/28/EU in the Icelandic and Norwegian languages, to be published in the EEA Supplement to the Official Journal of the European Union, shall be authentic.

Article 3

This Decision shall enter into force on 26 February 2015, provided that all the notifications under Article 103(1) of the EEA Agreement have been made (*).

Article 4

This Decision shall be published in the EEA Section of, and in the EEA Supplement to, the Official Journal of the European Union.
