granting derogations to certain Member States with respect to the transmission of statistics pursuant to Regulation (EC) No 1338/2008 of the European Parliament and of the Council, as regards statistics on healthcare expenditure and financing

THE EUROPEAN COMMISSION,
Having regard to the Treaty on the Functioning of the European Union,
Having regard to Regulation (EC) No 1338/2008 of the European Parliament and of the Council of 16 December 2008 on Community statistics on public health and health and safety at work (1), and in particular Article 9(2) thereof,
Whereas:

Regulation (EC) No 1338/2008 establishes a common framework for the systematic production of European statistics on public health and health and safety at work. |
|
(2) |
Regulation (EC) No 1338/2008 requires Member States to provide statistics on healthcare expenditure and financing as defined in Annex II to that Regulation. |
|
(3) |
According to Article 9(2) of Regulation (EC) No 1338/2008, derogations and transition periods may be adopted, where necessary, for Member States, provided they are based upon objective grounds. |
|
(4) |
The Kingdom of Spain, the Kingdom of the Netherlands, Romania and the United Kingdom of Great Britain and Northern Ireland have requested derogations due to the need for major adaptations in their national statistical systems in order to comply with Regulation (EC) No 1338/2008. |

(5) |
The derogations requested by these Member States should therefore be granted. |
|
(6) |
The measures provided for in this Decision are in accordance with the opinion of the European Statistical System Committee, |
HAS ADOPTED THIS DECISION:
Article 1
Derogations set out in the Annex shall be granted to the Kingdom of Spain, the Kingdom of the Netherlands, Romania and the United Kingdom of Great Britain and Northern Ireland.
Article 2
This Decision is addressed to the Kingdom of Spain, the Kingdom of the Netherlands, Romania and the United Kingdom of Great Britain and Northern Ireland.

DEROGATIONS FROM REGULATION (EC) NO 1338/2008 CONCERNING STATISTICS ON HEALTHCARE EXPENDITURE AND FINANCING
The Kingdom of Spain, the Kingdom of the Netherlands, Romania and the United Kingdom of Great Britain and Northern Ireland shall not deliver the variables specified in the following table:
