Oils and fats
1) OBJECTIVE
The Regulation establishes a common organisation of the market in oils and fats, including olive oil. This allows prices to be stabilised and ensures a fair level of income for farmers by laying down arrangements for trade with non-member countries.

3) CONTENTS
Products covered. The products covered are oilseeds and oleaginous fruits and flours and meals thereof, vegetable fats and oils, margarine, oil cake and residues resulting from the extraction of oil, and fats and oils of fish and marine mammals. Since 1992, however, the Regulation has related almost exclusively to olives and olive oil.
Trade arrangements with non-member countries
Imports. Licences are mandatory for imports of olives and olive oil and are granted subject to the lodging of a security.
Common Customs Tariff. The Common Customs Tariff rates of duty apply to products in the oils and fats sector.
Exports. Licences are mandatory for exports of olive oil and are granted subject to the lodging of a security. Where olive oil is exported to non-member countries and the world prices are higher than those in the Community, a levy may be collected to offset the difference in price.
Refunds. An export refund may be paid on exports of olive oil and rapeseed oil to cover the difference between the world and Community market prices.
Barriers to trade. The levying of charges equivalent to customs duties and the application of any quantitative restrictions or measures of equivalent effect are banned in trade with non-member countries.
Protective measures. Protective measures may be taken where the market is threatened with disturbance as a result of imports or exports.
Olive oil
Target price. The target price for production for the 1998/99 to 2003/04 marketing years is EUR 383.77/100 kg.
Production aid. The production aid is set at EUR 132.25/100 kg for the 1998/99 to 2003/04 marketing years. The total quantity of olive oil on which aid is payable is 1 777 261 tonnes, which is broken down into National Guaranteed Quantities (NGQs). 1.4% of the aid is to be used for measures to improve the quality of oil production and its environmental impact. 0.8% of the aid for producer organisations is withheld for special purposes. With the Commission's agreement, each Member State may allocate part of its NGQ and of its olive-oil production aid to support for table olives. Where actual production in any marketing year in a Member State is less than its NGQ, the other Member States are allowed to produce an amount in excess of their NGQ corresponding to 20% of the difference while the remaining 80% is added to the Member State's NGQ for the subsequent marketing year.
Storage. Where the market is threatened with disturbance and in particular where the price recorded on the market during a representative period is less than 95% of the intervention price for the 1997/98 marketing year, approved bodies can store the oil.
Where harvests are irregular, the Council acting on a proposal from the Commission can require the intervention agencies to set up a buffer stock.
Production of preserves using olive oil. A refund may be granted on preserves using olive oil.
Producer organisations. Olive growers are grouped in producer organisations and these may join together to form associations. A percentage of the production aid is paid to the organisations so they can perform their tasks.
Oilseeds and other vegetable oils
Oilseeds are eligible under the arable crops scheme provided for in Regulation (EC) No 1251/1999. They qualify under no other measures.
Other provisions
State aid. Save where otherwise provided in the Regulation, the Treaty rules on State aid apply to the oils and fats sector.
Marketing. Marketing standards, in particular covering labelling and quality grading, may be laid down for olive oil.
Olive oil used for humanitarian aid purposes is purchased on the Community market or comes from intervention stocks. Other oils are purchased on the Community market. Where such products are not available, they may be purchased in developing countries.
Communications. The Member States and the Commission are to send each other the information needed for implementing the Regulation.
Comitology. For the implementation of the Regulation the Commission is assisted by the Management Committee for Oils and Fats comprising representatives of the Member States and chaired by a Commission representative.
